Bilingualism In Education In The Multilingual Apple: The Future Of The Past, Ofelia García
Journal of Multilingual Education Research
This article traces the ways in which New York City schools have responded to the multilingualism of its children in the last forty years. I review here the past to construct the future—the future of the past. I argue that in the predominantly Puerto Rican community of the 1960s and 1970s a simple approach toward languages and bilingualism in education was an appropriate response to meet the needs of language minority children. Thus, subtractive and additive bilingual education programs might have been sufficient. There is little known about South African women’s help-seeking behavior after sexual offence victimization. South Africa is estimated to have the highest rate of rape and sexual assault globally. However, only one in six women seek health services post victimization. The importance of medical and mental health care following victimization has been clearly established. Therefore understanding more about South African women’s help-seeking after victimization is profoundly important. The purpose of this study was to explore the lived experience of help-seeking behaviors of South African women after sexual offence victimization. Unequal Inequalities? Poverty, Sexual Orientation, And The Dynamics Of Constitutional Law, Jane S. Schacter

As we think about the future role the judicial branch will play in our governance, we might consider one important function of the courts: addressing claims of constitutional inequality. In this Article, I explore this question by juxtaposing two claims of inequality that have been pressed by advocates—one concerning sexual orientation, the other concerning poverty. These two contexts are undoubtedly different in ways both numerous and significant. The lesbian, gay, bisexual, and transgender (LGBT) rights movement is today, while the constitutional movement for the rights of the poor was yesterday.1 The LGBT movement has won major Supreme Court victories in …

Outsiders Looking In: Advancing The Immigrant Worker Movement Through Strategic Mainstreaming, Jennifer J. Lee
Utah Law Review
The immigrant worker movement faces the age-old problem of social movements: whether change should be pursued from the inside or outside. Shaped by dominant cultural norms, the current legal framework generally disadvantages immigrant workers. They suffer from workplace exploitation, anti-immigrant hostility, and exclusion. By examining the interplay between law and culture, this Article offers a unique perspective on how immigrant workers have the power to change law through cultural narratives.
Change pursued from the inside by immigrant workers, community advocates, and public interest attorneys has more immediately provided positive results for immigrant workers. They have done so by mainstreaming immigrant …

Can I Smile With Spirit? Towards A Process Model Associating Workplace Spirituality And Emotional Labor, Ashwini Gangadharan

Workplace spirituality (WS) is a framework of organizational values embedded in the culture of the organization that promotes employees to experience a sense of meaningfulness at work, sense of connection with coworkers, congruence of organizational values with theirs' and experience transcendence through their work. This dissertation presents workplace spirituality as an organizational intervention to manage the problem of emotional labor and its dysfunctional consequences among the service employees.
The main thesis of the dissertation is that workplace spirituality will enable service employees to appraise emotional labor as a positive stressor (challenge stressor) rather than a negative stressor (hindrance stressor). The …

The New Habeas Corpus In Death Penalty Cases, Larry Yackle

This article offers the first systematic examination of Chapter 154, United States Code, which establishes new statutory arrangements for cases in which state prisoners under sentence of death file federal habeas corpus petitions challenging their convictions or sentences. Chapter 154 was enacted as part of the Antiterrorism and Effective Death Penalty Act of 1996. Yet its provisions were made applicable only in capital cases arising from states that established qualifying schemes for providing indigent death row prisoners with counsel in state postconviction proceedings. No state’s system for supplying lawyers in state court won approval and, in consequence, Chapter 154’s rules …

Identity And Language Perceptions Among Second-Generation Spanish Speakers In Miami, Elizabeth G. Lanier
Open Access Theses
This study explored how second-generation Spanish speakers in South Florida imagine Miami in sociolinguistic terms, how linguistic identity is constructed within and outside of Miami, and how perceived language ideologies, labels, and stereotypes affect identity construction. The analysis was based upon semi-structured, open-ended interviews with thirteen young adults (ages 20-28) born in Miami, whose parents immigrated to the U.S. from a Latin American country. The theoretical framework relied upon Anderson’s (1991) notion of imagined communities. Participants often contextualized their identity not only as English-speaking U.S. citizens, but also as members of their heritage country, and within the imagined Hispanic community …

The amusement park industry represents leisure facilities that “operate mechanical rides, water rides, games, shows, themed exhibits, refreshment stands and other attractions” (Industry Overview, 2014). It encompasses 482 businesses in the United States (Industry at a Glance, 2014) and generated revenue of $15.4 billion dollars in 2013 (Industry at a Glance, 2014). The industry is currently growing, but faced a decline in attendance and revenue during the economic recession (2007-2008) (Industry at a Glance, 2014). Debt And College Students' Life Transitions: The Effect Of Educational Debt On Career Choice In America, Yeseul Choi

This study reviewed the literature to investigate the impact of student loans on career choices, in order to provide implications for policy makers and researchers with respect to student loan policy. For this purpose, empirical studies in peer reviewed journals since 1985 were analyzed. This review explored the results of empirical studies regarding the relationship between debt and career choice in three areas: 1) general career choice, 2) specialty choice in particular fields such as law and medical school, and 3) the decision to pursue an advanced degree. The results suggest that educational debt generally has no clear negative effect …

Energized by the fiftieth anniversary of Gideon v. Wainwright, and in light of the nearly one million low-income Americans who are denied legal aid services each year, renewed calls to expand the right to counsel to civil litigants have emerged. Lucas explains that there are “numerous ways in which Gideon’s promise has fallen short” in the criminal realm and, as a result, there is little consensus about how to proceed in the civil context. In January 2014, the ABA Task Force on the Future of Legal Education released its report calling, among other things, for limited licensing and the expansion of independent paraprofessional training by law schools. In Washington State, all three law schools are collaborating with community college paralegal programs to design and deliver specialized training for “Limited License Legal Technicians” (LLLTs), who will be licensed to deliver limited family law services beginning in 2015. At least three other states, including California and New York — which together contain nearly twenty-six percent of U.S. lawyers and seventy-six law schools — are actively seeking …
