Seminole Tribe Of Florida V. State Of Florida, Wesley J. Furlong Nov 2014

Seminole Tribe Of Florida V. State Of Florida, Wesley J. Furlong

Public Land & Resources Law Review

Seminole Tribe of Florida v. State of Florida stands as a declaration that tribal sovereignty preempts state taxation of tribal lands. Although the court framed its decision in the “‘deeply rooted’ historical ‘policy of leaving Indians free from state jurisdiction and control,” it held that Florida’s Rental and Utility Taxes imposed upon the Tribe were impermissible, based not on the rights and sovereignty of tribes, but on well-established principals of judicial deference to agency rule making.

Ellis V. Bradbury, Tristan T. Riddell Nov 2014

Ellis V. Bradbury, Tristan T. Riddell

Public Land & Resources Law Review

The United States District Court for the Northern District of California reiterated the need for a party seeking suspension or cancellation of an EPA registered pesticide to fully exhaust their administrative remedies under FIFRA. Here, plaintiffs filed a number of claims, including claims requesting either cancellation or suspension of pesticides containing clothianidin and thiamethoxam. However, as described by the court, plaintiffs failed to adequately exhaust existing administrative remedies outlined within § 136d of FIFRA. Additionally the court found that claims asserting § 7 violations of the ESA could be filed prior to exhaustion of administrative remedies under FIFRA.

Integrating Community Service Into Scholarship: Youth Engagement By Active Participation Case Study Of Ruwwad, Eunjee Anna Koh

Independent Study Project (ISP) Collection

This research project applies Asset-Based Community Development theory to Ruwwad, a community-based organization in Al-Natheef. As a marginalized community, the approach to community development must be investigated to ensure that it does not worsen the community dependency. Through the Myoub Khorma Youth Education and Empowerment Fund, Ruwwad provides scholarships for youth from the neighborhood and surrounding areas. The impact of the scholarship on youth was investigated through conducting student interviews and collected material culture published by the organization. Ruwwad exemplifies an example of asset-based community development in the Middle East and youth have shown that they feel empowered through an …

Warm Water Benthic Foraminifera Document The Pennsylvanian-Permian Warming And Cooling Events – The Record From The Western Pangea Tropical Shelves, Vladimir Davydov Nov 2014

Warm Water Benthic Foraminifera Document The Pennsylvanian-Permian Warming And Cooling Events – The Record From The Western Pangea Tropical Shelves, Vladimir Davydov

Geosciences Faculty Publications and Presentations

Shallow warm water benthic foraminifera (SWWBF), including all larger fusulinids (symbiont-bearing benthic foraminifera), are among the best indicators of paleoclimate and paleogeography in the Carboniferous and Permian. The distribution of benthic foraminifera in space and time constrain important tectonic, paleogeographic and climatic events at a global scale. The North American shelves during Pennsylvanian and Permian time - though geographically within the tropical belt - are characterized by temperate environments with significantly lower foraminifera diversification and rare occurrences of warm water Tethyan forms, that are in general appear in the region as a migration entities. Such environments allow documentation of warming …

Background Bats are a major reservoir of emerging infectious viruses. Many of these viruses are highly pathogenic to humans however bats remain asymptomatic. The mechanism by which bats control viral replication is unknown. Here we utilize an integrated approach of proteomics informed by transcriptomics to compare the response of immortalized bat and human cells following infection with the highly pathogenic bat-borne Hendra virus (HeV). Results The host response between the cell lines was significantly different at both the mRNA and protein levels. Human cells demonstrated minimal response eight hours post infection, followed by a global suppression of mRNA and protein …

Credit Risk Adjusted Bank’S Liquidity As A Support Measure For The Process Of Financial Stability Management, Paweł Niedziółka Nov 2014

Credit Risk Adjusted Bank’S Liquidity As A Support Measure For The Process Of Financial Stability Management, Paweł Niedziółka

European Management Studies

The article focuses on the evaluation of selected methods of quantifying liquidity risk which is affected by a broad spectrum of risk factors, including in particular the credit risk. The following forms of impact of credit risk on liquidity risk were taken into consideration: (1) problems related to the influence of the deterioration of the quality of bank’s loan portfolio, resulting in an increase in liquidity gap and a need to convert liquid assets into cash or obtain additional external financing, (2) an increase in credit risk of the bank (passive credit risk) resulting in disturbances in the process of …

The Role Of Biotin And Oxamate In The Carboxyltransferase Reaction Of Pyruvate Carboxylase, Adam D. Lietzan, Yi Lin, Martin St. Maurice Nov 2014

The Role Of Biotin And Oxamate In The Carboxyltransferase Reaction Of Pyruvate Carboxylase, Adam D. Lietzan, Yi Lin, Martin St. Maurice

Biological Sciences Faculty Research and Publications

Pyruvate carboxylase (PC) is a biotin-dependent enzyme that catalyzes the MgATP-dependent carboxylation of pyruvate to oxaloacetate, an important anaplerotic reaction in central metabolism. During catalysis, carboxybiotin is translocated to the carboxyltransferase domain where the carboxyl group is transferred to the acceptor substrate, pyruvate. Many studies on the carboxyltransferase domain of PC have demonstrated an enhanced oxaloacetate decarboxylation activity in the presence of oxamate and it has been shown that oxamate accepts a carboxyl group from carboxybiotin during oxaloacetate decarboxylation. The X-ray crystal structure of the carboxyltransferase domain from Rhizobium etli PC reveals that oxamate is positioned in the active site …

Tartan Noir And The Scottish Literary Canon, Matt Mcguire Nov 2014

Tartan Noir And The Scottish Literary Canon, Matt Mcguire

Studies in Scottish Literature

Takes up Willy Maley's recent critique of Scottish university literature teaching (in SSL 38) and argues that Scottish creative writing, especially the crime novels that James Ellroy labelled Tartan Noir, has stimulated new critical readings of such earlier Scottish writers as James Hogg and Robert Louis Stevenson.

The Popular Voice In Sir David Lyndsay's Satire Of The Thrie Estaitis, Greg Walker Nov 2014

The Popular Voice In Sir David Lyndsay's Satire Of The Thrie Estaitis, Greg Walker

Studies in Scottish Literature

Analyzes the representation of the Scottish people in the 16th century Scottish drama A Satire of the Thrie Estaitis by Sir David Lyndsay [or Lindsay] (1490-1555), through the figure of the Pauper or Poor Man in the first version (the 1540 interlude performed at Linlithgow), and the character of John of the Commonwealth in the two fuller versions (at Cupar in 1552 and Edinburgh in 1554). Distinguishes Lyndsay's Pauper from equivalent figures in plays by John Bale and Nicholas Udall, and argues (by contrast with Tyrone Guthrie's famous 1948 Edinburgh festival production) that John of the Commonwealth is less a …

How Scottish Is The Scottish Psalter? William Mure Of Rowallan, Zachary Boyd, And The Metrical Psalter Of 1650, Peter Auger Nov 2014

How Scottish Is The Scottish Psalter? William Mure Of Rowallan, Zachary Boyd, And The Metrical Psalter Of 1650, Peter Auger

Studies in Scottish Literature

Reassesses the origin and sources for the Scottish metrical psalter of 1650, in particular the contributions and influence of Sir William Mure of Rowallan and Zachary Boyd, questioning the statistical analysis of specific phrases by William Rorison on which most previous discussions have relied, and focusing instead on circumstances of the revision, the complex interrelation of multiple available versions, and the significance of Mure's version as a model of what Scottish psalmody could be, rather than as a source for particular verses or lines.

The Effects Of Terrorism On The Travel And Tourism Industry, David Mc. A Baker Nov 2014

The Effects Of Terrorism On The Travel And Tourism Industry, David Mc. A Baker

International Journal of Religious Tourism and Pilgrimage

The impact of terrorism on the travel and tourism industry can be enormous. It can lead to unemployment, homelessness, deflation, and many other social and economic ills. The contribution of tourism for many countries is so great that any downturn in the industry is a cause of major concern for many governments. The repercussions are left in many other industries associated with tourism like airlines, hotels, restaurants and shops that cater to the tourists and allied services. Terrorism is an enigmatic and compelling phenomenon, and its relationship with tourism is complex and multifaceted. This paper aims to clarify this relationship …

Understanding Perceptions And Attitudes To Risk In The Tourism Industry, Anthony Clayton, Lourdes Cisneros Mustelier, Maximiliano E. Korstanje Nov 2014

Understanding Perceptions And Attitudes To Risk In The Tourism Industry, Anthony Clayton, Lourdes Cisneros Mustelier, Maximiliano E. Korstanje

International Journal of Religious Tourism and Pilgrimage

An increasingly complex and rapidly-evolving array of risks presents one of the greatest challenges for decision-makers in all sectors, including the transport and tourism industry. The prospects of an international destination can be profoundly damaged in minutes as a result of a major outbreak of infectious disease, a natural disaster or a terrorist incident. It is therefore vital to understand the changing nature of risk and the ways that risks are perceived and understood, especially as people tend to respond to the perception of risks rather than actual risks, which means that their responses are not always rational and can …

Security Guards And Counter-Terrorism: Tourism And Gaps In Terrorism Prevention, Luke Howie Nov 2014

Security Guards And Counter-Terrorism: Tourism And Gaps In Terrorism Prevention, Luke Howie

International Journal of Religious Tourism and Pilgrimage

Organisation operating in the tourism industry are high priority targets for terrorists. In the aftermath of the 9/11 attacks tourism destinations, hotels and modes of public transportation have regularly been targeted by terrorists seeking to convey their violent message. As such, leaders and managers in the tourism industry carefully plan their security and counter-terrorism responses, often involving the hiring of security guards. It is here that I believe a significant gap in counter-terrorism preparedness exists. I argue that protecting tourism destinations is only possible if consideration is given the effectiveness of security guards and understanding that their well-being will impact …

International Journal of Exercise Science

International Journal of Exercise Science 7(4) : 339-345, 2014. Inclined treadmill walking is a commonly performed activity to increase cardiovascular health. Handrail support on a treadmill provides an individual the opportunity to change their posture with respect to the walking surface. Differences in metabolic cost during inclined walking due to postural changes with handrail use are unknown. To test the hypothesis that metabolic cost will differ depending on how handrail support is used, respiratory gas analysis was performed during inclined walking in 13 healthy subjects. Energy expenditure was quantified while each subject walked in four conditions: 5% incline unsupported, 10% …

"You Can't Be Creative Anymore": Students Reflect On The Lingering Effects Of The Five-Paragraph Essay, Jennifer P. Gray

Teaching/Writing: The Journal of Writing Teacher Education

The five-paragraph essay continues to make headlines in composition and pedagogy journals and on teacher listservs. This long-cherished genre has been touted for teaching the basics to writers in college, and teachers often claim that it is the best foundation for solid essay writing. In contrast, there are numerous five-paragraph essay critics who claim that the essay is a “school-created thing” that has no real-world value and persists due to an enshrinement in textbooks as preparation for objective standardized testing. Regardless of the debate, one thing remains: there is little research on the essay from the students’ perspective. This essay …
