More Is More: Strengthening Free Exercise, Speech, And Association, John D. Inazu

Prominent scholars have suggested that one important means of strengthening the First Amendment is by limiting its protections to “core” interests. Philip Hamburger has asserted the argument most forcefully. His generalized worry is that expanding the coverage of First Amendment rights can shift absolute protection of a defined core to contingent “balancing” for all claims asserted under those rights. In Hamburger’s words, “more is less.” We can think of cautions like these as arguments for rights confinement. On this view, legal doctrine will be most resilient to cultural pressures when it is construed narrowly. But the interplay between doctrine and …

In the Dred Scott case, Justice Taney remarked that black people “had no rights which the white man was bound to respect.” In The Far-Reaching Shadow Cast by Ferguson, Professor Norwood questions whether, in today’s society, Justice Taney’s sentiment still holds true. Citing examples of recent police shootings and beatings of unarmed African-Americans and personal and family experiences, Professor Norwood argues that our country is broken and needs fixing. Professor Norwood concludes that we are not the ‘post-racial’ society we claim to be and that the Michael Brown shooting, among others, provides a watershed moment to confront our country’s underlying …

Sex discrimination law has not kept pace with the lived experience of discrimination. In the early years of Title VII of the Civil Rights Act of 1964, courts settled on an idea of what sex discrimination looks like—formal practices that exclude employees based on their group membership. The problem is that sex discrimination has become highly individualized. Modern sex discrimination does not target all men or all women, nor does it target subgroups of men or women. The victims of modern sex discrimination are particular men and women who face discrimination because they do not or cannot conform to the …

Mad Money: Rethinking Private Placements, Abraham Cable

Currently, regulations try to limit unregistered sales of stock (private placements) to the “smart money,” either by informing investors through disclosure or excluding unsophisticated investors from the market. In theory, these smart-money approaches promote the dual goals of capital formation and investor protection. But in practice, regulators have struggled to craft effective disclosure or screening mechanisms. In light of these failures, this Article advocates for a new approach—investment caps that allow every investor a limited amount of “mad money” to invest in risky private placements. A small number of items published in Italy and Luxembourg were also added. This Collection serves as the research arm for the Department of Germanic Languages and Literature's Max Kade Center for Contemporary German Literature. Dissemination Of The Transmissible Quinolone-Resistance Gene Qnrs1 By Incx Plasmids In Nigeria, Eric T. Sumrall '13, Elizabeth B. Gallo '12, Aaron Aboderin Oladipo, Adebayo Lamikanra, Iruka N. Okeke

The plasmid-encoded quinolone resistance gene qnrS1 was recently found to be commonly associated with ciprofloxacin resistance in Nigeria. We mapped the qnrS1 gene from an Escherichia coli isolate obtained in Nigeria to a 43.5 Kb IncX2 plasmid. The plasmid, pEBG1, was sufficient to confer ciprofloxacin non-susceptibility, as well as tetracycline and trimethoprim resistance, on E. coli K-12. Deletion analysis confirmed that qnrS1 accounted for all the ciprofloxacin non-suceptibility conferred by pEBG1 and tetracycline and trimethoprim resistance could be attributed to tetAR and dfrA14 genes respectively. Phosphorus (P), an essential element for plants and animals, can be a limiting nutrient in organically-managed soils. To better understand P dynamics in organically-managed grasslands, P forms and availability in certified organic grasslands at the WVU Organic Research Farm were determined. The experimental design was a randomized complete block established in 2000 and has been maintained continuously with certified organic methods. We compared three Usage systems (Pasture, Buffer, and Hay) each at two levels of Fertility (High and Low). Phosphorus forms were determined by sequential fractionation with H2O, NaHCO3, NaOH and HCl. Geographic Information Systems (GIS) have the ability to map, model, and analyze real world data and phenomena, and yet visibility and lighting conditions are rarely considered or researched in Geographic Information Science (GISci). Lighting technologies have been created and implemented to overcome the darkness of night and other issues of visibility, and in no place is that more evident than urban areas. Malignant mesothelioma is an extremely aggressive form of cancer that affects mesothelial cells. These cells act to form a slippery and protective layer of cells that line the serous cavities and internal organs of the body. Malignant mesothelioma most often develops in the pleural space, but also arises in the peritoneum, pericardium, tunica vaginalis testis, and ovarian epithelium (Vinícius and Isoldi, 2013). Evidence has shown a strong relationship between asbestos exposure and malignant mesothelioma, and this is the most widely known disease vector of malignant mesothelioma. This research is a case study on the lived experience of international graduate students in the Graduate School of Asia Pacific Studies (GSAPS) at Waseda University in Tokyo, Japan. Using cultural globalization and internationalization as a lens, this research positions international graduate students as local actors in an abroad community and addresses, 1) how and why students decided on an English Medium degree in Japan, and 2) the lived academic and social experiences of this particular group of students while in Japan. Achalasia is an esophageal motility disorder characterized by incomplete relaxation of the lower esophageal sphincter (LES) and aperistalsis of the esophageal body. Treatment of achalasia is aimed at decreasing the resting pressure in the LES. Peroral endoscopic myotomy (POEM), derived from natural orifice transluminal endoscopic surgery (NOTES) and advances in endoscopic submucosal dissection (ESD), presents a novel, minimally invasive, and curative endoscopic treatment for achalasia. POEM involves an esophageal mucosal incision followed by creation of a submucosal tunnel crossing the esophagogastric junction and myotomy before closure of the mucosal incision. Many people may have become increasingly concerned about the risks associated with vaccines. At the same time, there is a lack of qualitative research on the impact of various vaccinations schedules on individuals' physio-psychological health. In addition, "mandatory" versus "nonmandatory, but recommended" vaccines are still under debate in some Western countries. The purpose of this ethnographic study was to provide an in-depth understanding of the beliefs, experiences, and perceptions of adolescents, parents, and health care providers regarding different vaccination schedules. Informed parent advocates are essential to planning the educational outcomes of their children with special needs in the K through 12 public school system. However, inappropriate instructional techniques used in advocacy training may reduce trainees' learning outcomes by adding complexity and increasing cognitive load. This study examined whether using worked examples to break down complex problems into component parts to build long term schema could lower cognitive load and thus improve learning outcomes for parent advocacy trainees. There is an increasing prevalence of Type 2 diabetes mellitus among Filipino Americans. However, how well Filipino Americans with diabetes self-manage their disease and what factors influence their diabetes self-management behaviors remain unknown. Based on a holistic approach, this quantitative study was designed to investigate the diabetes self-management behaviors of this population and the factors influencing their self-management behaviors. The combined roles of diabetes knowledge, diabetes self-efficacy, spirituality, and social support were examined in predicting diabetes self-care behaviors. The purpose of this study is to understand how users of Camp Santanoni perceive and interpret the visual harmony between historic rustic architectural design and the natural environment and if these meanings are congruent with the design recommendations from Downing, Olmsted, and Wicks. The main goal is to understand the congruent relationships between how a designer wished to achieve visual harmony between buildings and landscapes, and how people actually perceive this interaction. The meaningful relationships between users (the people) of Camp Santanoni’s buildings and the surrounding landscape (the place) were documented.

This thesis project departs from Guy Debord’s Society of the Spectacle by claiming that architecture temporarily supports a passive acceptance of the environment. Architecture has the ability to confront its own crisis of spectacle by offering a different illusion. The Circumpolar Active Layer Monitoring (CALM) project has been observing permafrost (perennially frozen ground) and its overlaying active layer (which freezes and thaws annually) in northern Alaska’s Kuparuk River watershed and throughout the polar regions since the mid 1990’s to detect long-term responses to climatic change. The soil-surface temperature data is collected by thermistors that were positioned immediately below the surface of the ground at nine locations within a transect of 1-ha plots arranged from north to south across the region.
