Alapatt Redux: Support For Functional Language In Software Patent Claims, Andrew Chin
Alapatt Redux: Support For Functional Language In Software Patent Claims, Andrew Chin
SMU Law Review
The Federal Circuit has suggested in some recent cases that any algorithm can serve as adequate structural support for a means-plus-function element in a software patent claim under § 112(f). A recent proposal by Mark Lemley fully endorses this proposition and seeks its broader application. The concept of an algorithm, however, is too slippery to serve as the basis for such a rule. In this Article, I argue that this overreliance on the algorithm concept originated in a revisionist gloss on the Federal Circuit's 1994 Alappat decision. Informed by a closer reading of what Alappat actually has to say about …

Further Reflections On Extinguishing The Fountainhead Of Knowledge: A Call To Transition To The "Innovation Policy" Narrative In Patent Law, Simone Rose
SMU Law Review
Economists are unable to provide a clear answer to how effective the patent system is in encouraging innovation. At best, they point to certain sectors, such as pharmaceutical and biotechnology, which benefit from a robust patent scheme. Conversely, sectors such as software and, ironically at the same time, biotechnology may be harmed by an overly broad patent scheme. The question emerges: Why do the various stakeholders in all industrial sectors, Congress, the Patent and Trademark Office ("PTO"), and the courts (in particular, the Federal Circuit) continue to center the development of patent law around the "innovation presumption" despite the lack …

A Semiotic Interpretation Of Sense-Making In Information Seeking, Zao Liu
A Semiotic Interpretation Of Sense-Making In Information Seeking, Zao Liu
Library Philosophy and Practice (e-journal)
Sense-making in information seeking process is one of the major information seeking models. Questions have been raised about information seekers’ ambiguous needs and focus-shifting tendency relative to sense-making. This paper tackles this problem by reviewing two related approaches and suggesting an alternative interpretation from the semiotic point of view. The author argues that information seeking is often interactive, dynamic, and infinite just as the relationships between sign, object and interpretant posited in Peirce’s semiotics. The implication of this paper is to alert information seekers about this potential endless information seeking process and come to terms with their search results which …

Knowledge-Sharing Behavior In Dairy Sector Of Pakistan, Syed Rahmatullah Shah, Khalid Mahmood Dr.
Library Philosophy and Practice (e-journal)
This study is about knowledge sharing behavior in dairy sector. Two-hundred middle managers (with professional qualifications) from five industrial units in Pakistan were selected for study. Fifty-seven managers participated in the study (29 percent of the sample). Research model and hypotheses were based on behavioral theories, i.e., TRA, TPB, and TAM. Data were collected through a questionnaire using Likert scale. Spearman’s and Pearson’s correlation coefficients and structural equation model among different variables tested hypotheses of the research modal. The study proved that attitude, intention, and behavior had accepted mutual positive direct effects for knowledge sharing in dairy sector. Conversely, subjective …

Phillip Johnson, Executive Director Oregon Shores Conservation Coalition
The Oregon Shores Conservation Coalition’s "Coastal Climate Change Adaptation Project" is under development as an experiment in grassroots organizing for adaptive planning for expected climate change impacts. Oregon Shores is a regional conservation group with a 40-year history of working to protect marine, shoreline, estuarine and other coastal habitats. The organization’s board and staff came to recognize that the likely effects of climate change—rising sea levels, more intensive storm surges, increased erosion, lower-river flooding, among others—would affect every aspect of the group’s work. Consequently, a new program, the Climate Action …

Cataloging And Classification Skills Of Library And Information Science Practitioners In Their Workplaces: A Case Analysis, David A. Cabonero, Russell B. Dolendo
Library Philosophy and Practice (e-journal)
Information resources are useless when access is not provided. This fundamental function is within the concept of cataloging. Thus, cataloging is an essential process that provides access to all acquired information resources of the library for it allows people to find information needed for their personal and professional growth and development. It also provides access points to information resources in a way that users will be able to find the need information or resources.
With this, the study determined the cataloging and classification skills of library and information science graduates which is centered on assessing the cataloging and classification skills …

Fundraising In Academic Libraries: A Case Study Of Selected Academic Libraries In Southwest Nigeria, Ronke Anke Olurayi
Library Philosophy and Practice (e-journal)
ABSTRACT
This study examines fundraising in academic libraries as a global problem. This has become imperative since what these libraries receive from the government through their parent institutions is not sufficient to maintain and sustain library services and operations. Academic libraries in Nigeria have resorted to other ways of raising funds for their libraries due to world economic recession and inflation which has hampered them from effectively and efficiently meeting their set objectives. This study therefore investigated fundraising in selected academic libraries in the southwest of Nigeria in order to ascertain their sources of funds, how adequately it is received, …

Our Place In The World: A New Relationship For Environmental Ethics And Law, Jedediah Purdy
Our Place In The World: A New Relationship For Environmental Ethics And Law, Jedediah Purdy
Duke Law Journal
Forty years ago, at the birth of environmental law, both legal and philosophical luminaries assumed that the new field would be closely connected with environmental ethics. Instead, the two grew dramatically apart. This Article diagnoses that divorce and proposes a rapprochement. Environmental law has always grown through changes in public values; for this and other reasons, it cannot do so without ethics. Law and ethics are most relevant to each other when there are large open questions in environmental politics: lawmakers act only when some ethical clarity arises; but law can itself assist in that ethical development. This process is …

Ground-based aerosol measurements made in June 2010 within Sacramento urban area (site T0) and at a 40-km downwind location (site T1) in the forested Sierra Nevada foothills area are used to investigate the evolution of multispectral optical properties as the urban aerosols aged and interacted with biogenic emissions. Along with black carbon and non-refractory aerosol mass and composition observations, spectral absorption (ᵝabs), scattering (ᵝsca), and extinction (ᵝext) coefficients for wavelengths ranging from 355 to 1064nm were measured at both sites using photoacoustic (PA) instruments with integrating nephelometers and using cavity ring-down (CRD) instruments. The …
