Prosecutorial Discretion And The Legal Limits In Singapore, Gary Kok Yew Chan
Prosecutorial Discretion And The Legal Limits In Singapore, Gary Kok Yew Chan
Research Collection Yong Pung How School Of Law
Article 35(8) of the Constitution of the Republic of Singapore states that the Attorney-General, as the Public Prosecutor, “shall have the power, exercisable at his discretion, to institute, conduct or discontinue any proceedings for any offence”. This prosecutorial discretion, though extremely wide, is not an unfettered one and must not be exercised in bad faith or in breach of constitutional rights. With respect to the equality provision in the Constitution, the Prosecution has to give unbiased consideration to all potential accused persons and avoid any irrelevant considerations. The article considers whether the presumption of the constitutionality of prosecutorial decisions and …

The Right To Counsel For Indians Accused Of Crime: A Tribal And Congressional Imperative, Barbara L. Creel
The Right To Counsel For Indians Accused Of Crime: A Tribal And Congressional Imperative, Barbara L. Creel
Faculty Scholarship
Native American Indians charged in tribal court criminal proceedings are not entitled to court appointed defense counsel. Under well-settled principles of tribal sovereignty, Indian tribes are not bound by Fifth Amendment due process guarantees or Sixth Amendment right to counsel. Instead, they are bound by the procedural protections established by Congress in the Indian Civil Rights Act of 1968. Under the Indian Civil Rights Act (ICRA), Indian defendants have the right to counsel at their own expense. This Article excavates the historical background of the lack of counsel in the tribal court arena and exposes the myriad problems that it …

Growing Inequality And Racial Economic Gaps, Thomas W. Mitchell
Growing Inequality And Racial Economic Gaps, Thomas W. Mitchell
Faculty Scholarship
Over the past several decades, economic inequality has grown dramatically in the United States while inter-generational economic mobility has declined, which has challenged the very notion of the "American Dream." In fact, the United States is more economically unequal than most other industrialized countries. Further, there are dramatic and growing racial economic gaps in this country. Despite the Occupy Wall Street Movement, and the various spinoffs it has catalyzed, there has not been any sustained, widespread social movement to address economic inequality in the United States over the course of the past several decades. Furthermore, it is unlikely that a …

Rural Natives’ Perceptions Of Strengths And Challenges In Their Communities, Jessica D. Ulrich-Schad
Rural Natives’ Perceptions Of Strengths And Challenges In Their Communities, Jessica D. Ulrich-Schad
Carsey Publications
This brief uses two sources of data to explore how Native Americans view the current socioeconomic and environmental state of their communities and their future within them—the Community and Environment in Rural America (CERA) surveys and focus groups with Native leaders in one rural state. The data help to illustrate how the Native experience is both similar to, and unique from, that of other rural Americans. While the findings reported by author Jessica Ulrich-Schad illustrate that there are significant challenges facing Native people, they also show that strengths and opportunities continue to exist in Indian Country and that Natives remain …

The Impact Of Perpetrator Gender On Child Protective Services Sexual Abuse Cases: A National Picture, David Axlyn Mcleod
The Impact Of Perpetrator Gender On Child Protective Services Sexual Abuse Cases: A National Picture, David Axlyn Mcleod
Theses and Dissertations
Child sexual assault is a problem of epidemic proportions in the United States with some research suggesting up to one fifth of our nations children being victimized before reaching adulthood. Research has suggested females could be responsible for up to 20% of child sexual abuse cases, and at the same time only represent only 1% of sexual offenders incarcerated the US. This creates a situation where a large group of relatively under-researched offenders are evading detection. Numerous calls for further research have been made, but relatively few studies have had the ability to shed significant light on this phenomenon on …
