Democratizing Cleveland: The Rise And Fall Of Community Organizing In Cleveland, Ohio 1975-1985, Randy Cunningham

Cleveland Memory

Democratizing Cleveland is the result of almost fifteen years of research on a topic that has been missing from local works on Cleveland history: the community organizing movement that put neighborhood concerns and neighborhood voices front and center in the setting of public policies in the late 1970s and early 1980s.Original publication date 2007.

Gideon Skepticism, Alexandra Natapoff Mar 2013

Gideon Skepticism, Alexandra Natapoff

Washington and Lee Law Review

The criminal defense lawyer occupies a special doctrinal place in criminal procedure. It is the primary structural guarantor of fairness, the single most important source of validation for individual convictions. Conversely, if a person did have a competent lawyer, it generates a set of presumptions that his trial was in fact fair, the evidence sufficient, and his plea knowing and voluntary. This is a highly problematic legal fiction. The presence of counsel advances but cannot guarantee fair trials and voluntary pleas. More fundamentally, a lawyer in an individual case will often be powerless to address a wide variety of systemic …

Between Brain And State: Herbert C. Hoover, George W. Wickersham, And The Commission That Grounded Social Scientific Investigations Of American Crime And Justice, 1929–1931 And Beyond, James D. Calder

Marquette Law Review

The National Commission on Law Observance and Enforcement, more popularly known as the Wickersham Commission, was embedded in President Herbert C. Hoover’s broader policy initiative to improve the federal criminal justice system. Hoover also believed that the results would provide state and local governments with models for upgrading all other justice systems. President Hoover instructed the chairman, former U.S. Attorney General George W. Wickersham, to assemble a group of leading scholars and the best research findings, mainly from the nascent social sciences, to investigate the causes and costs of crime, Prohibition enforcement, policing, courts and antiquated criminal procedures, and prisons, …

Applying International Fair Trial Standards To The Military Commissions Of Guantanamo, David J. R. Frakt Mar 2013

Applying International Fair Trial Standards To The Military Commissions Of Guantanamo, David J. R. Frakt

Southern Illinois University Law Journal

The Military Commissions Act was significantly revised in 2009.  Despite the undeniable improvements, questions remain as to whether the revised commissions comply with international law.  Some critics assert that military commissions are not “regularly constituted courts” and therefore are not in compliance with the Geneva Convention, or that the military commissions do not meet international fair trial standards.  On the other hand, the current Chief Prosecutor argues that the military commissions meet or exceed applicable fair trial standards under international humanitarian law.  This Article addresses the question of whether military commissions under the MCA of 2009 meet applicable international rules …

Reconceptualizing The Burden Of Proof, Edward K. Cheng Mar 2013

Reconceptualizing The Burden Of Proof, Edward K. Cheng

Vanderbilt Law School Faculty Publications

The preponderance standard is conventionally described as an absolute probability threshold of 0.5. This Essay argues that this absolute characterization of the burden of proof is wrong. Rather than focusing on an absolute threshold, the Essay reconceptualizes the preponderance standard as a probability ratio and shows how doing so eliminates many of the classical problems associated with probabilistic theories of evidence. Using probability ratios eliminates the so-called Conjunction Paradox, and developing the ratio tests under a Bayesian perspective further explains the Blue Bus problem and other puzzles surrounding statistical evidence. By harmonizing probabilistic theories of proof with recent critiques advocating …

Nonmarket Values In Family Businesses, Benjamin Means Mar 2013

Nonmarket Values In Family Businesses, Benjamin Means

William & Mary Law Review

Despite the economic importance of family businesses, legal scholarship has often overlooked their distinctive character. Instead, scholars focus on the chosen form of business organization— partnership, corporation, LLC—and assume that the participants are economically rational actors who seek to maximize their individual preferences. This Article contends that family businesses are extensions of family relationships and that nonmarket values affect their goals and governance choices.

Just as family law scholars have shown that contract principles can be applied to regulate intimate relationships, corporate law scholars should recognize that the intimacy of family life often substitutes for arm’s length bargaining in family …

The First And The Last: A Confluence Of Factors Leading To The Integration Of Carver School Of Missions And Social Work, 1955, Tanya Smith Brice, T. Laine Scales

The Journal of Sociology & Social Welfare

The Carver School of Missions and Social Work, affiliated with the Southern Baptist Theological Seminary in Louisville, Kentucky, was an all-female social work program that eventually became the first seminary-affiliated social work program accredited by the Council on Social Work Education. This article examines Carver's efforts towards racial integration during the late 1950s, which was a time of heightened racial tensions across the United States. This article is informed by a series of oral histories of the two African American women who integrated Carver in 1955.

Alcohol Outlets, Social Disorganization, Land Use, And Violence In A Large College Town: Direct And Moderating Effects, Aleksandra J. Snowden, William Alex Pridemore

Social and Cultural Sciences Faculty Research and Publications

This study examined the direct and moderating effects of alcohol outlet density, social disorganization, and land use on violence in a large college town whose economy is driven by the presence of a flagship state university. Empirical literature points to a consistent association between alcohol outlet density and assault density, and recent research has found social disorganization and land use to moderate the association in urban areas. However, little research has been done to determine whether similar associations hold outside large urban cities. Using geocoded data on assaults and alcohol outlets in Bloomington, Indiana, we estimated ordinary least squares and …

The 2012 Amendments To Singapore's Evidence Act: More Questions Than Answers As Regards Expert Opionion Evidence?, Siyuan Chen

Research Collection Yong Pung How School Of Law

Singapore amended the expert opinion evidence provisions in its Evidence Act (EA) in 2012. The criteria for admissibility have been broadened, but the courts are now also expressly given the discretion to exclude relevant expert opinion evidence if it is ‘in the interests of justice’. This article explains why the 2012 amendments have raised more questions than answered them. First, Parliament did not appear to have properly appreciated the distinction—as conceptualised by the EA—between legal and logical relevance and relevance and admissibility. Second, it did not appear to have appreciated the distinction between general and specific relevance. Third, the introduction …

A citation analysis of two preeminent terrorism journals (Terrorism and Political Violence and Studies in Conflict and Terrorism) was used to identify 37 additional social science journals of significant importance to terrorism research. Citation data extracted from the Web of Science database was used to investigate the impact of the two journals on the social science journal literature. The impact of the two journals was also analyzed in terms of SSCI subject categories. This study could provide useful information for collection development librarians interested in the social sciences.

Recognizing The Feminization Of Displacement: A Proposal For A Gender-Focused Approach To Local Integration In Ecuador, Johanna L. Gusman Mar 2013

Recognizing The Feminization Of Displacement: A Proposal For A Gender-Focused Approach To Local Integration In Ecuador, Johanna L. Gusman

Washington International Law Journal

The feminization of displacement refers to the phenomenon in which women represent an increasingly disproportionate percentage of displaced populations worldwide. The objective of this comment is to raise awareness of this growing problem and recommend that policymakers craft legal responses to better address this reality, using Ecuador as an example. Specifically, this comment outlines how a gender-focused approach to local integration in Ecuador can rectify a refugee policy that never once mentions gender and is silent on the most pressing issues facing refugee women and girls in the area: sexual and gender-based violence. Through the proposal put forth in this …
