Non-Market Values In Family Businesses, Benjamin Means
Non-Market Values In Family Businesses, Benjamin Means
Faculty Publications
Despite the economic importance of family businesses, legal scholarship has often overlooked their distinctive character. Instead, scholars focus on the chosen form of business organization — partnership, corporation, LLC — and assume that the participants are economically rational actors who seek to maximize their individual preferences. This Article contends that family businesses are an extension of family relationships and that non-market values affect their goals and governance choices.
Just as family law scholars have shown that contract principles can be applied to regulate intimate relationships, corporate law scholars should recognize that the intimacy of family life often substitutes for arms-length …

Disentangling The Effects Of Violent Victimization, Violent Behavior, And Gun Carrying For Minority Inner-City Youth Living In Extreme Poverty, Richard Spano, John Bolland
Criminal Justice Faculty Publications
Two waves of longitudinal data were used to examine the sequencing between violent victimization, violent behavior, and gun carrying in a high-poverty sample of African American youth. Multivariate logistic regression results indicated that violent victimization T1 and violent behavior T1 increased the likelihood of initiation of gun carrying T2 when examined separately (by 132% and 91%, respectively). However, only violent victimization T1 was a significant predictor of initiation of gun carrying T2 after controlling for violent behavior T1. More nuanced analyses uncovered no significant difference in the likelihood of initiating gun carrying when comparing offensive versus defensive gun carriers. The …

Vols 21-30 (2004-2014)
The Spring 2013 issue of the Alaska Justice Forum is devoted primarily to issues related to school discipline and the juvenile justice system, and features three articles on "zero tolerance" policies by Dean Williams, who was the Superintendent of the McLaughlin Youth Center; Carol Comeau, who was the Superintendent of the Anchorage School District; and William Hitchcock, who was the Master of the Anchorage Children’s Court. Background is provided through an examination of recent data on juvenile delinquency and school suspensions and expulsions for Alaska. A fifth article describes StepUp, a diversion program for expelled or long-term suspended students which …

A Rejoinder To Professor Schauer's Commentary, Yale Kamisar
A Rejoinder To Professor Schauer's Commentary, Yale Kamisar
Washington Law Review
It is quite a treat to have Professor Frederick Schauer comment on my Miranda article. Professor Schauer is a renowned authority on freedom of speech and the author of many thoughtful, probing articles in other areas as well, especially jurisprudence. I am pleased that in large measure, Schauer, too, laments the erosion of Miranda in the last four-and- a-half decades and that he, too, was unhappy with the pre-Miranda due process/“totality of circumstances”/“voluntariness” test. I also like what Schauer had to say about “prophylactic rules,” a term that has sometimes been used to disparage the Miranda rules. As Schauer …

Comprehensive Self-Study Submitted By President Jeremy Travis To The Middle States Commission On Higher Education, March 2013., John Jay College Of Criminal Justice
Reports and Publications from John Jay College
Our Self-Study tells a story of institutional transformation. It is not a story driven by accidental circumstances, historical necessity, external forces, or the will of an individual—though each has played a role—but by collective and deliberate analysis of the College’s position in 2005, followed by thoughtful consideration of the future. Institutional change is often, if not always, difficult, but we have learned to pay constant attention to the ever-changing environment and the fixed destination. We have taken advantage of the opportunity offered by the Self-Study to reflect on the past and look toward the future.

A Study Of Relationships Between Socioeconomic Indicators And Rates Of Human Trafficking Victimization In Europe And Central Asia, Ivan Grishchenko
Social Sciences
This study uses IBM SPSS(Statistical Package for the Social Sciences) statistical software to determine if there is a statistically significant relationship between the numbers of officially identified human trafficking victims and social and economic indicators that can significantly affect the victimization rate. These indicators are GDP per capita, Human Development index, levels of government corruption, internet usage, GINI index, numbers of agricultural laborers, and tourism rates. The regions chosen for this study are Europe and Central Asia. The data is obtained from the official reports or statistics published by the United Nations, the World Bank, and the Central Intelligence Agency.

Domestic Violence, Sexual Assault, And Sex Trafficking In The Media: A Content Analysis, Katie Ann Martin
Domestic Violence, Sexual Assault, And Sex Trafficking In The Media: A Content Analysis, Katie Ann Martin
Master's Theses and Doctoral Dissertations
The following analysis focuses on the issues of sexual assault, domestic violence, and sex trafficking in media portrayals. A content analysis was done on six film releases, two for each of the topics. Prevalence of myths, stereotypes, victim portrayal, perpetrator portrayal, and final outcomes/consequences were reviewed within each of the films, along with overall themes present. The content analysis results found that some myths are present and vary by category. The most common theme in the movies was the ineptitude of the criminal justice system to successfully intervene and aid victims. Another commonly occurring theme was that victims must escape …

Overcharging, Kyle Graham
Overcharging, Kyle Graham
Faculty Publications
The prosecutors in several recent high-profile criminal cases have been accused of “overcharging” their quarry. These complaints have implied — and sometimes expressly asserted — that by “overcharging,” the prosecutors engaged in socially undesirable, illegitimate, and even corrupt behavior. United States Supreme Court Justice Antonin Scalia also weighed in on the “overcharging” phenomenon not long ago, describing this practice as a predictable though regrettable aspect of modern plea bargaining.
Unfortunately, many of these commentators either have failed to explain precisely what they meant by “overcharging,” or have used the same word to describe different types of charging practices. The various …

It is a truism that new technologies are remaking the tactical and legal landscape of armed conflict. While such statements are undoubtedly true, it is important to separate genuine trends from scholarly exaggeration. The following essay, an introduction to the Drone Wars symposium of the Journal, catalogues today’s most pressing disputes regarding international humanitarian law (IHL) and their consequences for criminal responsibility. These include: (i) the triggering and classification of armed conflicts with non-state actors; (ii) the relative scope of IHL and international human rights law in asymmetrical conflicts; (iii) the targeting of suspected terrorists under concept- or status-based classifications …

The Role Of Vicarious And Anticipated Strain On The Overlap Of Violent Perpetration And Victimization: A Test Of General Strain Theory, Egbert Zavala, Ryan E. Spohn
Criminology and Criminal Justice Faculty Publications
Numerous studies have documented a relationship between criminal offending and violent victimization. That is, people who commit criminal behavior are also more likely to be victimized. As such, criminological theories traditionally used to explain criminal behavior have now been applied to explain victimization. The current study examines whether Agnew’s general strain theory can explain the offender-victim overlap using a nationally representative sample of males. Results show that vicarious strain is positive and significant in predicting both victimization and perpetration. Anticipated strain was found only to be significant and positive in predicting victimization, but not perpetration. The study’s limitations and future …

The Perceptions Of Behavioral Health Psychology Held By Medical Personnel In Oregon, Carleton H. Lloyd
The Perceptions Of Behavioral Health Psychology Held By Medical Personnel In Oregon, Carleton H. Lloyd
Doctor of Psychology (PsyD)
The purpose of the current research was to obtain medical personnel perceptions about the role of behavioral health psychology within their medical care practices in Oregon. Four hypotheses were explored. Hypothesis 1 asserted that medical personnel from urban, suburban, and rural locations would hold significantly different views; Hypothesis 2 suggested that the sample would more likely refer the more acute patients; Hypothesis 3 posited that medical personnel would make more referrals if they knew a mental health provider; Hypothesis 4 stated that there would be significant differences between the perceptions and practices of female and male members of this sample. …

"Striking For The Guardians And Protectors Of The Mind": The Convention On The Rights Of Persons With Mental Disabilities And The Future Of Guardianship Law, Michael L. Perlin
Dickinson Law Review (1908-2003)
In many nations, entry of a guardianship order becomes the "civil death" of the person affected because persons subjected to such measure are not only fully stripped of their legal capacity in all matters related to their finance and property but are also deprived of many other fundamental rights, including the right to vote, the right to consent or refuse medical treatment (including forced psychiatric treatment), freedom of association, and the right to marry and have a family. The United Nations' ratification of the Convention on the Rights of Persons with Disabilities (CRPD) radically changes the scope of international human …
