Lee, Stephanie T. Pituc, Kyoung-Rae Jung, Irene J.K. Park, Jose A. Soto, Su Yeong Kim, Seth J. Schwartz

Department of Psychology: Faculty Publications

Many ethnic minorities in the United States consider themselves to be just as American as their European American counterparts. However, there is a persistent cultural stereotype of ethnic minorities as foreigners (i.e., the perpetual foreigner stereotype) that may be expressed during interpersonal interactions (i.e., foreigner objectification). The goal of the present study was to validate the Foreigner Objectification Scale, a brief self-report measure of perceived foreigner objectification, and to examine the psychological correlates of perceived foreigner objectification. Results indicated that the Foreigner Objectification Scale is structurally (i.e., factor structure) and metrically (i.e., factor loadings) invariant across foreign-born and U.S.-born Asian …

Effects Of Deer Density And Land Use On Mass Of White-Tailed Deer, Trevor J. Hefley, Scott E. Hygnstrom, Jason M. Gilsdorf, Gregory M. Clements, Myndi J. Clements, Andrew J. Tyre, David M. Baasch, Kurt C. Vercauteren Jan 2013

Effects Of Deer Density And Land Use On Mass Of White-Tailed Deer, Trevor J. Hefley, Scott E. Hygnstrom, Jason M. Gilsdorf, Gregory M. Clements, Myndi J. Clements, Andrew J. Tyre, David M. Baasch, Kurt C. Vercauteren

United States Department of Agriculture Wildlife Services: Staff Publications

Local and regional land use changes, such as the expansion of cropland for cellulosic biofuels, and the population density of white-tailed deer can affect the health and body mass of white-tailed deer Odocoileus virginianus. We collected hunterharvest data for 1,731 white-tailed deer from DeSoto National Wildlife Refuge in eastern Nebraska and western Iowa from 2003 to 2010. We used linear mixed-effects models and information theoretic methods to estimate effects of density of white-tailed deer and proportion of total landcover area converted from cropland to cool- or warm-season grassland on body mass of white-tailed deer. Density of white-tailed deer at …

The Malthusian–Darwinian Dynamic And The Trajectory Of Civilization, Jeffrey C. Nekola, Craig D. Allen, James H. Brown, Joseph R. Burger, Ana D. Davidson, Trevor S. Fristoe, Marcus J. Hamilton, Sean T. Hammond, Astrid Kodric-Brown, Norman Mercado-Silva, Jordan G. Okie Jan 2013

United States Geological Survey: Staff Publications

Two interacting forces influence all populations: the Malthusian dynamic of exponential growth until resource limits are reached, and the Darwinian dynamic of innovation and adaptation to circumvent these limits through biological and/or cultural evolution. The specific manifestations of these forces in modern human society provide an important context for determining how humans can establish a sustainable relationship with the finite Earth.

The New Borders Of The Constitutional, Gavin W. Anderson Jan 2013

The New Borders Of The Constitutional, Gavin W. Anderson

Osgoode Hall Law Journal

The key critical constitutional debates of the future are likely—and need—to be very different from those that animated the Charter’s first thirty years. Since 1982, the borders between law and politics, rights and utility, and the public and the private have staked out the main territory contested by critical scholarship. However, these borders now demarcate a restricted landscape, drawing critics onto the ground of normative debate preferred by liberal theory, and leading them to propose, at best, a form of moderate pragmatism. A more promising approach lies in reconnecting constitutional debate to the socio-historical strand of critical theory, as represented …

Ogwehoweneha: A Hodinohsonih Research Methodology, Darren Thomas Jan 2013

Ogwehoweneha: A Hodinohsonih Research Methodology, Darren Thomas

Theses and Dissertations (Comprehensive)

Critical pathways for the liberation of Indigenous populations will come from “re-membering” our Indigenous ways of knowing, “decolonizing” the Indigenous mind and “re-building” our Nations. Indigenizing the academy allows our original ways of knowing to create space, for Indigenous scholarship to reclaim Indigenous knowledge and reality. By visiting with Hodinǫhśǫ:nih knowledge holders, this MA thesis translates the nature of Hodinǫhśǫ:nih reality, ways of knowing, values, and methods of acquiring knowledge into an Indigenous research methodology. By the ongoing introduction of Indigenous knowledge into a theoretical positioning within the academy, creates opportunity for continued Indigenous knowledge-generation through Indigenous methodologies. Indigenous research …

What Is Constitutional Obligation?, Abner S. Greene Jan 2013

What Is Constitutional Obligation?, Abner S. Greene

Faculty Scholarship

Mike Seidman’s book, On Constitutional Disobedience, offers an impressive challenge to constitutional fidelity. With much of it, my book Against Obligation is on all fours – we both share the view that our Constitution’s meaning should not be bound by past sources. Seidman seems to go further, though, and reject the bindingness of the Constitution as a text. What does it mean to ask whether the Constitution itself obligates? Most of the Constitution doesn’t set rules for citizens; rather, it establishes powers, and what we might consider conditional obligations, for officials. All government officials in the United States swear an …

Civil Recourse Defended: A Reply To Posner, Calabresi, Rustad, Chamallas, And Robinette, Benjamin C. Zipursky, John C.P. Goldberg Jan 2013

Civil Recourse Defended: A Reply To Posner, Calabresi, Rustad, Chamallas, And Robinette, Benjamin C. Zipursky, John C.P. Goldberg

Faculty Scholarship

As part of a symposium issue of the Indiana Law Journal devoted to our Civil Recourse Theory of Tort Law, we respond to criticisms by Judge Calabresi, Judge Posner, and Professors Chamallas, Robinette, and Rustad. Calabresi and Posner criticize Civil Recourse Theory as a bit of glib moralism that fails to generate useful answers to the difficult questions that courts face when applying Tort Law. We show with several examples, both old and new, that the glibness is all on their side. From duty to causation to punitive damages, from products liability to fraud to privacy, our scholarship has had …

"Emotional Landscapes" And The Value Of Sex: Exploring The Lived Experiences Of Sex Workers' Clients, Zoey K. Jones Jan 2013

"Emotional Landscapes" And The Value Of Sex: Exploring The Lived Experiences Of Sex Workers' Clients, Zoey K. Jones

Theses and Dissertations (Comprehensive)

Clients of sex workers face criminalization and stigmatization in Canada and across the globe; they are commonly depicted by their stereotypes in entertainment and news media and have become a more visible population with the advent of the internet and online erotic review boards. However, these people are infrequently represented by their own voices and stories in academic research and, as such, the reality of being a client is not encompassed by the existing literature. An accurate and comprehensive understanding of the sex industry is particularly important in the twenty-first century, as the laws surrounding sex work in Canada – …

The Significance Of Pentateuchal Tithing As A Legal Instruction For The 21st Century Reader, Miracle Ajah Jan 2013

The Significance Of Pentateuchal Tithing As A Legal Instruction For The 21st Century Reader, Miracle Ajah

The Asbury Journal

So much debate has arisen as to whether or not the obligation to tithe was bound to the Old Testament and Judaism, or applied to the contemporary Christian Church. This paper seeks to answer the questions about how we can understand and apply the Old Testament datum to the contemporary church in Africa; how we can define our relationship to God’s covenant revealed in the Old Testament in the light of our New Testament experience; and the significance of Pentateuchal tithing as a legal instruction for the 21st Century reader. Discussions were done under the following headings: The Pentateuchal tithing …

Local Residents’ Responses To Tourism As A Framework To Understand Hosts’ Responses To Short-Term Missions, Jeremy Griffin Jan 2013

Local Residents’ Responses To Tourism As A Framework To Understand Hosts’ Responses To Short-Term Missions, Jeremy Griffin

The Asbury Journal

The research on the perspectives of the hosts in short-term missions is beginning to gain a stronger presence in the literature on short-term missions. To analyze the hosts’ point of view in short-term missions, this article uses four theoretical frameworks from the anthropology of tourism that measure hosts’ attitudes, behaviors, and perceptions of tourism, its development and impacts. The result is that the hosts may show advocacy, concession, contention, or resignation towards short-term missions.

A Narrative Approach To Delivering Bad News In Organizations: Effective Or Not?, Michael S. Carriger

WCBT Faculty Publications

Purpose: This paper presents empirical evidence for the use of narrative to deliver bad news within an organization, specifically bad news about layoffs. The attempt is to extend previous empirical work, using narrative by senior leadership to convey corporate strategy, to a different leadership challenge and further explicate a model for understanding the effectiveness of narrative as a leadership communication tool. Design/Methodology/Approach: The paper presents further original research on the effectiveness of narrative as a leadership tool. And theoretical implications for leaders seeking effective communication tools are explored. Findings: Data presented to substantiate that narrative use, as opposed to a …

Will "Smarter" Marketing End Social Discrimination? A Critical Review, Frances Grodzinsky, Andra Gumbus, Stephen J. Lilley Jan 2013

Will "Smarter" Marketing End Social Discrimination? A Critical Review, Frances Grodzinsky, Andra Gumbus, Stephen J. Lilley

School of Computer Science & Engineering Faculty Publications

Purpose - There are two claims made by the web marketing/advertising industry. 1) By collecting, managing, and mining data, companies serve consumer’s best interests and 2) by adopting sophisticated analytics web marketers avoid discriminations that disserve individuals. Although we share an interest in ending social discrimination, we are more circumspect about pronounced individualism and technological fixes. Despite its appeal, or perhaps because of it, we should not accept the claim at face value. In this paper we argue that social discrimination may not disappear under smarter marketing; more overt forms may wane only to be replaced by more subtle forms. …

Sex-Parate But Equal? The Legality Of Single-Sex Public Schools And Their Discriminatory Effect On Transgender Students, Bryana Turner Jan 2013

Sex-Parate But Equal? The Legality Of Single-Sex Public Schools And Their Discriminatory Effect On Transgender Students, Bryana Turner

Cardozo Journal of Equal Rights & Social Justice

The note argues that single-sex public schools are both legally problematic and harmful, particularly to transgender students. It contends that such schools violate Title IX of the Education Amendments of 1972 and are unconstitutional under the precedent set by Brown v. Board of Education. The analysis highlights the discriminatory effects of single-sex education, which perpetuates gender stereotypes and fails to accommodate transgender students, who are disproportionately affected by such policies.

Employee Benefits Law: The Hidden Gap Enabling Sexual Orientation Discrimination In Employment, Jason E. Shapiro Jan 2013

Employee Benefits Law: The Hidden Gap Enabling Sexual Orientation Discrimination In Employment, Jason E. Shapiro

Cardozo Journal of Equal Rights & Social Justice

The note argues that state anti-discrimination laws are ineffective in protecting individuals from sexual orientation discrimination in employment, particularly in cases involving ERISA-governed employee benefits. It highlights how federal ERISA preemption undermines state laws, creating a legal gap that allows employers to discriminate without consequences. The note advocates for federal legislation to address this issue, as amending ERISA or relying on state laws alone cannot fully protect LGB individuals from discrimination in employment.

An Exploration Of The Past, Present And Future Of Nursing In Early Parenting Services In Australia, Elaine Bennett Jan 2013

An Exploration Of The Past, Present And Future Of Nursing In Early Parenting Services In Australia, Elaine Bennett

Theses

Nursing has a long history of providing services to families and children over the past century and more within Early Parenting Services (EPS) in Australia. Much has been written on issues regarding the general nursing workforce and requirements for the future, but little is known about the role of nursing within the EPS area around Australia in the context of an interdisciplinary team.

The aim of this study was to describe how nursing has responded to the changing needs of EPS in Australia and to investigate nurses’ and allied professionals’ perceptions of the nursing role within an interdisciplinary team. This …

New Evangelization, Conversion And Catholic Education, Mark Tynan Jan 2013

New Evangelization, Conversion And Catholic Education, Mark Tynan

Theses

Magisterial teaching since the Second Vatican Council has identified the need for a re-evangelization of Western cultures. Catholic teaching since Vatican II has continued to identify this need and exhort Christians to what Pope John Paul II termed a New Evangelization. This teaching had five significant thrusts. Firstly, it identified the need for the New Evangelization. Secondly, it discussed the essential role of the laity in this endeavor. Thirdly, it positioned conversion as the primary initial goal of this enterprise and defined what it conversion would look like experientially. Fourthly, the Holy Spirit was promoted as the initiator and primary …

Family-Focused Physical Activity, Diet, And Obesity Interventions In African-American Girls: A Systematic Review, Daheia J. Barr-Anderson, Alexis W. Adams-Wynn, Katherine I. Disantis, Shiriki Kumanyika Jan 2013

Family-Focused Physical Activity, Diet, And Obesity Interventions In African-American Girls: A Systematic Review, Daheia J. Barr-Anderson, Alexis W. Adams-Wynn, Katherine I. Disantis, Shiriki Kumanyika

Faculty Publications

Obesity interventions that involve family members may be effective with racial/ethnic minority youth. This review assessed the nature and effectiveness of family involvement in obesity interventions among African-American girls aged 5-18 years, a population group with high rates of obesity. Twenty-six databases were searched between January 2011 and March 2012, yielding 27 obesity pilot or full-length prevention or treatment studies with some degree of family involvement and data specific to African-American girls. Interventions varied in type and level of family involvement, cultural adaptation, delivery format, and behavior change intervention strategies; most targeted parent-child dyads. Some similarities in approach based on …

Deconstructing Disintermediation: A Skeptical Copyright Perspective, Guy Pessach Jan 2013

Deconstructing Disintermediation: A Skeptical Copyright Perspective, Guy Pessach

Cardozo Arts & Entertainment Law Journal

This essay attempts to uncover the impacts of disintermediation in copyright law. I argue that contrary to the common view, within the political economy of networked communication platforms and the Internet, disintermediation in copyright law does not necessarily lead to its expected outcomes. Disintermediation may undermine cultural diversity, decentralization and authors' welfare no less than the traditional corporate media proprietary model. My analysis focuses on the manner in which disintermediation in copyright law tends to stimulate concentrated markets, which channel audience attention to a handful of mega networked intermediaries. The market and media power, which is then held by these …

The Semiotics Of Alpha Brands: Encoding/Decoding/Recoding/Transcoding Of Louis Vuitton And Implications For Trademark Laws, David Tan Jan 2013

The Semiotics Of Alpha Brands: Encoding/Decoding/Recoding/Transcoding Of Louis Vuitton And Implications For Trademark Laws, David Tan

Cardozo Arts & Entertainment Law Journal

Alpha brands are the most influential global brands that possess significant configurations of meanings and can offer peculiarly powerful affirmations of belonging and recognition in the lives of their consumers. The trademark, as the visual source-designating emblem of a brand, is also a semiotic sign that resonates with the structure of myths and archetypes within a cultural environment of desire. Focusing on the world-renowned Louis Vuitton trademark, this Article explores how an understanding of semiotics can be useful to a legal analysis of trademarks. Two decisions involving the iconic Louis Vuitton brand one from the United States and one from …

Race And Racism In Internet Studies: A Review And Critique, Jessie Daniels Jan 2013

Race And Racism In Internet Studies: A Review And Critique, Jessie Daniels

Publications and Research

Race and racism persist online in ways that are both new and unique to the Internet, alongside vestiges of centuries-old forms that reverberate significantly both offline and on. As we mark 15 years into the field of Internet studies, it becomes necessary to assess what the extant research tells us about race and racism. This paper provides an analysis of the literature on race and racism in Internet studies in the broad areas of (1) race and the structure of the Internet, (2) race and racism matters in what we do online, and (3) race, social control and Internet law. …

Meme World Syndrome: A Critical Discourse Analysis Of The First World Problems And Third World Success Internet Memes, Robert Chandler Jan 2013

Meme World Syndrome: A Critical Discourse Analysis Of The First World Problems And Third World Success Internet Memes, Robert Chandler

Electronic Theses and Dissertations

This thesis applies the theory and method of Critical Discourse Analysis (CDA) to examine the ideological components of the First World Problems (FWP) and Third World Success (TWS) Internet memes. Drawing on analytical concepts from CDA and related perspectives, such as multimodal discourse analysis and social semiotics, the paper analyzes the visual and textual elements of a sample of the FWP and TWS memes. The paper argues that the text and images featured in the memes are ideologically salient and discursively construct oppositional binaries between “us” and “them” in terms of wealth disparity.

Distinct Trends In 30-Day Observed And Risk-Standardized Mortality Rates Of Acute Myocardial Infarction Patients, 2005-2010, Caroline Yoo

Public Health Theses

In the effort of comparing health care quality across hospitals and profiling hospitals, the Centers for Medicare and Medicaid Services (CMS) utilize risk-standardized outcome in which the hospital-level outcome is standarized adjusting for patient-covariates using hierarchical model for patients outcome clustered within hospital. Even though standardized measure is useful for comparing hospitals, we believe the analysis of observed hospital-level outcome without standarization can reveal additional information at the hospital-level. The implication of using both types of mortality rates was studied in the context of analyzing 30-day mortality trend of Acute Myocardial Infarction (AMI) patients. Therefore the objective of this study …
