Studies In Pathogenesis Of A Novel Isolate Of Cronobacter Sakazakii Using An In Vitro Blood Brain Barrier Model, Elliott Weston Welker

Microbiological Sciences

Genus Cronobacter is a member of the family Enterobacteriaceae consisting of several opportunistic species. The primary focus of this study was to utilize an in vitro co-culture model of the blood brain barrier to investigate a bovine fecal strain of C. sakazakii to investigate pathogenicity. The strain was found to have the same effect on the barrier’s integrity as the positive Escherichia coli control. Additionally, C. sakazakii strain BAA-894 was found to have the same effect as the negative E. coli control. This study also focused on the development of a site-specific mutagenesis procedure for C. sakazakii. A procedure using …

Nonlinear Fatigue Damage Accumulation In Aircraft Engine Alloys Multiaxial Loading, Sandip Kumar Suman Jan 2013

Nonlinear Fatigue Damage Accumulation In Aircraft Engine Alloys Multiaxial Loading, Sandip Kumar Suman

Mechanical Engineering and Applied Mechanics

Fatigue is considered to be one of the most frequent phenomena in the failure of many machine parts. Most of the prior studies on fatigue have been limited to uniaxial loading cases with a primary focus on constant amplitude cycles. A detailed exploration of multiaxial fatigue under constant and variable amplitude loading scenarios for a wide variety of aircraft engine alloys has been performed in this study, and a new methodology for the accurate prediction of fatigue damage is developed. A critical-plane based constant amplitude fatigue damage model has been developed in this study which is simple in comparison to …

The main music covered will be by the composers Samuel Barber (United States), Juan Morel Campos (Puerto Rico), Heitor Villa-Lobos (Brazil), and Louis Moreau Gottschalk (United States). Each composer is represented by one or two pieces. Each piece is analyzed in terms of …

Rhomboid Proteases And Surface Adhesins During Cryptosporidium Development, Ebot Sahidu Tabe Jan 2013

Rhomboid Proteases And Surface Adhesins During Cryptosporidium Development, Ebot Sahidu Tabe

Microbiological Sciences

Cryptosporidium parvum, a primary cause of cryptosporidiosis in humans and livestock worldwide, has a complex life cycle that includes an environmental oocyst stage, and stages of merogony, gametogony, and sporogony that are completed in a single host. Development within the host takes place in a protected intracellular but extracytoplasmic niche at the apical surface of epithelial cells. The life cycle can be described as having alternating extracellular invasive and intracellular replicative stages. With no effective chemotherapeutics, understanding the mechanism of host cell invasion by this pathogen is paramount. The first aim dissertation was to identify functions of sporozoite surface proteins …

Alternative Analyses Of Three Multiple Percussion Works, Brett Eric Woodmansee Jan 2013

Alternative Analyses Of Three Multiple Percussion Works, Brett Eric Woodmansee

Music

The goal of this research document is to provide a flexible analysis that is directly applicable to multiple percussion performance and will inform a performer about the nature of decisions in specific circumstances without discouraging new explorations or interpretations. These analyses attempt to organize music components into four groups: dynamics, timbre, note density, and articulations and ornaments. Each of these groups can change in levels of importance within a hierarchy for each phrase, which provides information for performance practice. This information can theoretically reveal the most important components of a phrase, including the most significant mistakes of composers and performers. …

Jocelyn Hagen And Timothy Takach: An Introduction To Their Choral Music And A Study Of Their Positions Within A Lineage Of Minnesota-Based Composers, Michael Patrick Culloton Jan 2013

Jocelyn Hagen And Timothy Takach: An Introduction To Their Choral Music And A Study Of Their Positions Within A Lineage Of Minnesota-Based Composers, Michael Patrick Culloton

Music

This study serves as an introduction to the choral music of Jocelyn Hagen and Timothy Takach. It also examines their positions within a lineage that includes three generations of successful Minnesota-based composers. It begins with Dominick Argento as the key figure in the first generation. The second group includes Stephen Paulus, Libby Larsen, Carol Barnett, and Craig Carnahan. Hagen, Takach, and Abbie Betinis have emerged as leaders of the third generation, and are discussed in that context. Major similarities that link each generation include a high level of compositional craft and advocacy work on behalf of other composers and the …

The Yellowstone River Waterfowl Hunting Closure In Eastern Montana: Evaluation Of Private Landowner Attitudes, Steven John Atwood Jan 2013

The Yellowstone River Waterfowl Hunting Closure In Eastern Montana: Evaluation Of Private Landowner Attitudes, Steven John Atwood

Natural Resources Management

Wildlife managers now hypothesize the limiting factor regarding waterfowl hunting opportunity and goose harvest in the lower Yellowstone River Valley is hunter access rather than waterfowl abundance. This study used a questionnaire to ascertain landowner attitudes towards the Yellowstone River waterfowl hunting closure (YRC) and determine the level of receptiveness towards changes to the waterfowl management policy. Landowners within the closure area indicated they valued and would disagree with a policy change. Landowners located outside of the closure area did not demonstrate an affinity towards the YRC and would be unlikely to disagree with a policy change. Engaging Inside landowners …

Ring-Necked Pheasant: Evaluation Of Winter Survival, Habitat Use, And Current Research Methods Of Nest Searching, Jeffery Wilson Stackhouse Jan 2013

Ring-Necked Pheasant: Evaluation Of Winter Survival, Habitat Use, And Current Research Methods Of Nest Searching, Jeffery Wilson Stackhouse

Natural Resources Management

Radio telemetry was used to monitor a population of male and female ring-necked pheasant (Phasianus colchicus; hereafter pheasant) in southwestern North Dakota to examine pheasant habitat selection. Study objectives were to: 1) determine preferred pheasant winter cover habitat; 2) develop management recommendations to increase pheasant abundance; 3) identify habitat use, survival, and dispersion differences between male and female pheasants; and 4) compare nest-searching techniques to determine most efficient research technique for finding pheasant nests. We captured 191 pheasants, assessed weekly survival using known-fate models in Program MARK and determined home ranges and habitat selection and preference using ArcGIS. We assessed …

Lung Mucosal Response To Repeated Inhalational Insults With Immunomodulatory Agents In A Murine Model Of Fungal Asthma: Airway Epithelium Takes The Center Stage, Sumali Pandey Jan 2013

Lung Mucosal Response To Repeated Inhalational Insults With Immunomodulatory Agents In A Murine Model Of Fungal Asthma: Airway Epithelium Takes The Center Stage, Sumali Pandey

Microbiological Sciences

Asthma is a debilitating disease of the lungs affecting 235 million people worldwide. Fungus-associated asthma leads to a particularly severe type of disease, and exposure to environmental fungi and their products is unavoidable due to the ubiquitous nature of fungal species. Besides being allergenic, fungi are opportunistic pathogens, and anti-fungal and/or allergic pathways may be modified through repeated inhalation of immunomodulatory agents, affecting the outcome of fungus-induced asthma. Our aim in this project was to investigate the extent to which repeated inhalation of immunomodulatory agents influence the lung mucosal responses in a naïve murine host or in one that had …

Analysis Of Significant Factors In Division I Men's College Basketball And Development Of A Predictive Model, Samuel Paul Unruh Jan 2013

Analysis Of Significant Factors In Division I Men's College Basketball And Development Of A Predictive Model, Samuel Paul Unruh

Statistics

While a number of statistics are collected during an NCAA Division I men’s college basketball game, it is potentially of interest to universities, coaches, players, and fans which of these variables are most significant in determining wins and losses. To this end, statistics were collected from two seasons of games and analyzed using logistic and least squares regression methods. The differences between the two competing teams in four common statistics were found to be significant to determining victory: assists, free throw attempts, defensive rebounds, and turnovers. The logistic and least squares models were then used with data from the 2011- …

Predicting Recessions In The U.S. With Yield Curve Spread, Di Huang Jan 2013

Predicting Recessions In The U.S. With Yield Curve Spread, Di Huang

Statistics

This paper proposes a hidden Markov model for the signal of U.S. recessions. The model uses the spread of interest rate between 10-year Treasury bond and 3-month Treasury bill, together with other financial indicators which are the real M2 growth, the change in the Standard and Poor's 500 index of stock prices, and difference between the 6-month commercial paper and 6-month Treasury bill rates as predictors. The hidden Markov model considers temporal dependence between the recession signals and provides an estimate of the long-term probability of recessions. The empirical results indicate the hidden Markov model well predict the signal of …

Representing Intersubject Variability With A Statistical Shape And Alignment Model Of The Knee, Chandreshwar Rao Jan 2013

Representing Intersubject Variability With A Statistical Shape And Alignment Model Of The Knee, Chandreshwar Rao

Electronic Theses and Dissertations

Prior statistical shape models have not considered multiple structures in the knee joint to characterize anatomic variation which are required to investigate joint mechanics further for the successful knee replacement. Accordingly, the study's objective was to develop statistical shape and alignment model (SSAM) to capture intersubject variability and demonstrate the ability to generate realistic instances for use in finite element analysis (FEA). SSAM described the variability in the training set of 20 subjects with a series of modes of variation obtained by performing principal component analysis (PCA). PCA produced modes of variation with the first 3 modes representing 70% and …

Restrictive And Expansive Views Of Equality: A Grounded Theory Study That Explores The Influence Of Racial Consciousness On The Behaviors Of White Faculty In The Classroom, Chayla M. Haynes Jan 2013

Restrictive And Expansive Views Of Equality: A Grounded Theory Study That Explores The Influence Of Racial Consciousness On The Behaviors Of White Faculty In The Classroom, Chayla M. Haynes

Electronic Theses and Dissertations

Attempts to address the ever increasing achievement gap among students have failed to explain how and why educational traditions and teaching practices perpetuate the devaluing of some and the overvaluing of others. This predicament, which plagues our educational system, has been of increased concern, given the growing racial diversity among college students and the saturation of White faculty in the academy. White faculty make up the majority, 79%, of all faculty in the academy. White faculty, whether consciously or unconsciously, are less likely to interrogate how race and racism both privilege them within the academy and influence their faculty behaviors. …

Everything In Di Dark Muss Come To Light: A Postcolonial Investigation Of The Practice Of Extra Lessons At The Secondary Level In Jamaica's Education System, Saran Stewart Jan 2013

Everything In Di Dark Muss Come To Light: A Postcolonial Investigation Of The Practice Of Extra Lessons At The Secondary Level In Jamaica's Education System, Saran Stewart

Electronic Theses and Dissertations

Despite the vast research examining the evolution of Caribbean education systems, little is chronologically tied to the postcolonial theoretical perspectives of specific island-state systems, such as the Jamaican education system and its relationship with the underground shadow education system. This dissertation study sought to address the gaps in the literature by critically positioning postcolonial theories in education to examine the macro- and micro-level impacts of extra lessons on secondary education in Jamaica. The following postcolonial theoretical (PCT) tenets in education were contextualized from a review of the literature: (a) PCT in education uses colonial discourse analysis to critically deconstruct and …

Remedies Reveals The Seamless Web, Candace Kovacic-Fleischer Jan 2013

Remedies Reveals The Seamless Web, Candace Kovacic-Fleischer

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: Remedies is a course that consolidates many of the concepts learned in the first year of law school and some from the second. A typical Remedies course will reintroduce principles from constitutional law, compare and contrast torts and contracts, and apply criminal concepts in civil contexts. Teaching Remedies can be both challenging and rewarding. Challenging because it crosses a wide variety of subject areas. Rewarding because it weaves a variety of subject areas into the "seamless web" of the law, eliciting from students an occasional "aha." Early classes in law school tend to separate courses into discrete subject areas, …

Law And Ethics For Autonomous Weapon Systems: Why A Ban Won't Work And How The Laws Of War Can, Kenneth Anderson, Matthew C. Waxman Jan 2013

Law And Ethics For Autonomous Weapon Systems: Why A Ban Won't Work And How The Laws Of War Can, Kenneth Anderson, Matthew C. Waxman

Faculty Scholarship

Public debate is heating up over the future development of autonomous weapon systems. Some concerned critics portray that future, often invoking science-fiction imagery, as a plain choice between a world in which those systems are banned outright and a world of legal void and ethical collapse on the battlefield. Yet an outright ban on autonomous weapon systems, even if it could be made effective, trades whatever risks autonomous weapon systems might pose in war for the real, if less visible, risk of failing to develop forms of automation that might make the use of force more precise and less harmful …

Critical Legal Histories In Eu Law, Fernanda Nicola Jan 2013

Critical Legal Histories In Eu Law, Fernanda Nicola

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: A workshop aiming to narrate the history of EU Law took place in November 2012 at a critical time for the very existence of the Union and its role as a global actor. On the one hand, the current financial crisis is weakening some of the foundations and values that, in the last sixty years, EU lawyers, judges, and scholars have relied on. On the other hand, the U.S. government is pursuing a Transatlantic Free Trade and Investment Agreement with the EU, aimed at creating a Western bloc to resist the rising Chinese power. The fascination of current EU …

Fee Effects, Kathryn Judge Jan 2013

Fee Effects, Kathryn Judge

Faculty Scholarship

Intermediaries are a pervasive feature of modern economies. This article draws attention to an under-theorized cost arising from the use of specialized intermediaries – a systematic shift in the mix of transactions consummated. The interests of intermediaries are imperfectly aligned with the parties to a transaction. Intermediaries seek to maximize their fees, a transaction cost from the perspective of the parties. Numerous factors, including the requirement that a transaction create value in excess of the associated fees to proceed and an intermediary’s interest in maintaining a good reputation, constrain an intermediary’s tendency to use its influence in a self-serving manner. …

Perspectives On Crimes Of Sexual Violence In International Law, Susana Sacouto Jan 2013

Perspectives On Crimes Of Sexual Violence In International Law, Susana Sacouto

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: Sexual and gender-based violence (SGBV) during conflict and periods of repression has been a problem in every region of the globe.' Historically, these crimes were rarely prosecuted, particularly when government leaders were responsible for tolerating, encouraging, or orchestrating these crimes. However, the last two decades have seen an incredible transformation in the treatment of SGBV under international law. Great strides have been made in the investigation and prosecution of sexual and gender-based crimes, particular by the ad hoc International Criminal Tribunals for the Former Yugoslavia and Rwanda, and the Special Court for Sierra Leone This essay examines the way …

The Republic Of Choosing: A Behaviorist Goes To Washington, William H. Simon Jan 2013

The Republic Of Choosing: A Behaviorist Goes To Washington, William H. Simon

Faculty Scholarship

Cass Sunstein’s book Simpler recounts the author’s efforts during his tenure in the first Obama administration to apply the policy tools he helped derive from behavioral economics. In this review, I suggest that, while Sunstein reports some notable achievements, he exaggerates the utility of the behaviorist toolkit. Behaviorist-inspired interventions are marginal to most of the largest policy problems, and they played little role in the Obama administration’s most important initiatives. The book also reflects a misguided political strategy.

Idiosyncratic Risk During Economic Downturns: Implications For The Use Of Event Studies In Securities Litigation, Edward G. Fox, Merritt B. Fox, Ronald J. Gilson Jan 2013

Idiosyncratic Risk During Economic Downturns: Implications For The Use Of Event Studies In Securities Litigation, Edward G. Fox, Merritt B. Fox, Ronald J. Gilson

Faculty Scholarship

We reported in a recent paper that during the 2008-09 financial crisis, for the average firm, idiosyncratic risk, as measured by variance, increased by five-fold. This finding is important for securities litigation because idiosyncratic risk plays a central role in event study methodology. Event studies are commonly used in securities litigation to determine materiality and loss causation. Many bits of news affect an issuer’s share price at the time of a corporate disclosure that is the subject of litigation. Because of this, even if an issuer’s market–adjusted price changes at the time of the disclosure, one cannot determine with certainty …

Courts Rulings Accept Climate Science, Michael Gerrard Jan 2013

Courts Rulings Accept Climate Science, Michael Gerrard

Faculty Scholarship

Viewers of certain television networks, readers of certain newspapers, and anyone visiting Capitol Hill would come away with the impression that there are serious questions about whether climate change is occurring and, if it is, whether it is mostly caused by human activity. One place where there are few such questions is the courts. In fact it appears that (with one lone exception in a dissent) not a single U.S. judge has expressed any skepticism, in a written opinion or dissent, about the science underlying the concern over climate change. To the contrary, the courts have uniformly upheld this science, …

Becker And Foucault On Crime And Punishment – A Conversation With Gary Becker, François Ewald, And Bernard Harcourt: The Second Session, Gary S. Becker, Francois Ewald, Bernard E. Harcourt Jan 2013

Becker And Foucault On Crime And Punishment – A Conversation With Gary Becker, François Ewald, And Bernard Harcourt: The Second Session, Gary S. Becker, Francois Ewald, Bernard E. Harcourt

Faculty Scholarship

In his 1979 lectures at the Collège de France, The Birth of Biopolitics, Michel Foucault discussed and analyzed Gary Becker’s economic theory of crime and punishment, originally published in The Journal of Political Economy in 1968 under the title “Crime and Punishment: An Economic Approach.” In this historic, second encounter at the University of Chicago, Gary Becker responds to Foucault’s lectures and possible critical readings of his writings on crime and punishment, in conversation with Professors François Ewald (who was, at the time in 1979, Foucault’s assistant at the Collège and one of Foucault’s closest interlocutors) and Bernard Harcourt (a …

Freedom Of Contracts, Hanoch Dagan, Michael Heller Jan 2013

Freedom Of Contracts, Hanoch Dagan, Michael Heller

Faculty Scholarship

“Freedom of contracts” has two components: (1) the familiar freedom to bargain for terms within a contract and (2) the long-neglected freedom to choose from among contract types. Theories built on the first freedom have reached an impasse; attention to the second points toward a long-elusive goal, a liberal and general theory of contract law. This theory is liberal because it develops an appealing conception of contractual autonomy grounded in the actual diversity of contract types. It is general because it explains how contract values – utility, community, and autonomy – properly relate to each other across contract types. Finally, …

The U.S. Department Of Agriculture As A Public Health Agency, Lindsay Wiley Jan 2013

The U.S. Department Of Agriculture As A Public Health Agency, Lindsay Wiley

Scholarly Articles in Law Reviews & Journals

Introduction: The "war on obesity" is now well into its second decade.' What began as an effort to encourage medical doctors to screen and treat patients whose weight put them at risk for health problems has transformed into a much broader public health campaign to address the root causes of obesity. A growing number of state, territorial and local health departments are currently exploring new ways to promote healthy eating and physical activity. At the federal level, the U.S. Centers for Disease Control and Prevention (CDC) has made "nutrition, physical activity and obesity" a top priority.

Who’S Your Nanny, Lindsay Wiley Jan 2013

Who’S Your Nanny, Lindsay Wiley

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: In June 2012, New York City Mayor Michael Bloomberg announced his plans for a ban on the sale of sugary beverages in containers larger than 16 ounces. Shortly thereafter, the Center for Consumer Freedom took out a full-page ad in the New York Times featuring Bloomberg photo-shopped into a matronly dress with the tag line "New Yorkers need a Mayor, not a Nanny."1 On television, the CATO Institute's Michael Cannon declared, "This is the most ridiculous sort of nanny state-ism; [ilt's none of the mayor's business how much soda people are drinking." And in news- papers around the country, …

On Normativity And Responsibility: Responses, Joseph Raz

Faculty Scholarship

Contains responses to comments by Chang, Hestein and Heuer on "From Normativity to Responsibility". The paper responds to various criticisms especially about methodology, the bearing of a secure area of competence on responsibility, the univocality of 'reasons', the relations of value and practical reasons, the scope of rational powers, the function of reasons to be rational, and most extensively about following reasons and the distinction between standard and non-standard reasons (where Heuer has pointed out some deficiencies in the discussion of the matter in the book).

Comments On Alrc Discussion Paper 79, Copyright And The Digital Economy, June M. Besek, Jane C. Ginsburg, Philippa Loengard

Faculty Scholarship

We provide these comments in connection with the Australian Law Reform Commission’s ongoing study of copyright and the digital economy, and in particular its request for comments on the recommendations put forth in its Discussion Paper 79 (June 2013). We focus on US law, and how the US experience bears on the possibility of an open-ended uncompensated "fair use" type exception in Australia, and other related issues.

The fair use doctrine in the US provides great flexibility, but that flexibility in many instances comes at the cost of certainty and predictability. We are not suggesting that reasonable judgments cannot be …
