Juvenile Life Without The Possibility Of Parole: Constitutional But Complicated, Christopher A. Mallett Jan 2013

Juvenile Life Without The Possibility Of Parole: Constitutional But Complicated, Christopher A. Mallett

Social Work Faculty Publications

The Supreme Court's recent decision in Miller v. Alabama found that juvenile life without the possibility of parole sentences for homicide crimes was unconstitutional if mandated by state law. Thus, allowing this sentence only after an individualized decision determines the sanction proportional given the circumstances of the offense and mitigating factors. This decision, for a number of reasons, does not go far enough in protecting those youthful offenders afflicted with maltreatment victimizations, mental health problems, and/or learning disabilities - all potential links for some adolescents to serious offending and potentially homicide. While the Supreme Court has not protected these youthful …

Information Sharing Among Public Safety Agencies, Vinyl Baker Jan 2013

Information Sharing Among Public Safety Agencies, Vinyl Baker

2010-2016 Archived Posters

During the September 11, 2001, terrorist attacks and the 2005 Hurricane Katrina disaster failures in communications and information sharing occurred among public safety agencies. These communication problems led to the loss of lives, the destruction of property, and the delay of timely medical assistance. Results indicated that while standard operating procedures have changed since the September 11, 2001 terrorist attacks and the 2005 Hurricane Katrina disaster, there is still a need for greater emphasis in regards to training, interoperability, and shared resources among public safety agencies

Community And Individual Well-Being In Nonmetropolitan Nebraska: 2013 Nebraska Rural Poll Results, Rebecca J. Vogt, Cheryl A. Burkhart-Kriesel, Randolph L. Cantrell, Bradley Lubben

Nebraska Rural Poll

By many different measures, rural Nebraskans are positive about their community. Many rural Nebraskans rate their community as friendly, trusting and supportive. Most rural Nebraskans also say it would be difficult to leave their community. In addition, most rural Nebraskans disagree that their community is powerless to control its future.

Differences of opinion exist by the size of their community. Residents of smaller communities are more likely than residents of larger communities to rate their community favorably on its social dimensions. However, residents of larger communities are more likely than residents of smaller communities to say their community has changed …

Water And Climate: Perceptions Of Nonmetropolitan Nebraskans: 2013 Nebraska Rural Poll Results, Rebecca J. Vogt, Cheryl A. Burkhart-Kriesel, Randolph L. Cantrell, Bradley Lubben

Nebraska Rural Poll

Many rural Nebraskans have experienced loss of wildlife and wildlife habitat, voluntary decrease in water usage, decreased farm production and wildfires to some extent as a result of last year’s drought. The majority of persons with occupations in agriculture have experienced decreased farm production and loss of business income as a result of last year’s drought.

Most rural Nebraskans rate indoor use in existing homes and agricultural uses (irrigation and livestock) as high priority uses of water. Uses of water that were not ranked very high include swimming pools for individual homes, watering golf courses and transferring water to other …

Whose Streets: California Public Utilities Code Section 7901 In The Wireless Age, Michael W. Shonafelt Jan 2013

Whose Streets: California Public Utilities Code Section 7901 In The Wireless Age, Michael W. Shonafelt

UC Law SF Communications and Entertainment Journal

In 1850, cutting-edge communications infrastructure took the form of telegraph poles and wires. The first Transcontinental Railroad would not be completed until the Golden Spike joined the rail lines at Promontory Point on May 10, 1869. The railroad right of way afforded an important avenue, allowing the new nation to be linked from coast to coast by the miracle of the telegraph's new technology. Today, 162 years later, the new technology is wireless broadband. An important avenue for its expansion and goal of universal coverage are the roads and highways of the state of California.

To meet exponential demand, wireless …

The Impact Of The Criminalization Of Hiv Non-Disclosure On The Health And Human Rights Of “Black” Communities, Ciann L. Wilson

Psychology Faculty Publications

The criminalization of HIV non-disclosure has become a hot topic for discussion and debate amongst human rights advocates, HIV/AIDS service providers, and people infected and affected by HIV/AIDS. This paper explores the inherent problems with HIV non-disclosure laws. These laws are ambiguous and pose a serious threat to public health policy and programming by obstructing the fundamental human rights of people infected and affected by HIV/AIDS. Using a human rights framework, this paper explores the impact of non-disclosure laws on the health and rights of African, Caribbean, and Black-Canadian communities and proposes ways to address the shortcomings of HIV non-disclosure …

Taxes were in the spotlight in Nebraska last year when the governor proposed the elimination of the state income tax. Although this proposal did not pass in the Legislature, a review of the state’s tax system was authorized. While this study may focus more on the revenue side of the tax equation, the expenditures or spending side of the equation are important to examine as well. How do rural Nebraskans feel about the current level of spending for various items? How would rural Nebraskans fund five major public expenditures? This paper provides a detailed analysis of these questions. This report …

You Can't Get There From Here: Elderly Prisoners, Prison Downsizing, And The Insufficiency Of Cost Cutting Advocacy, Elizabeth Rapaport Jan 2013

You Can't Get There From Here: Elderly Prisoners, Prison Downsizing, And The Insufficiency Of Cost Cutting Advocacy, Elizabeth Rapaport

Faculty Scholarship

The prison population in the United States has peaked and begun to recede, reversing more than 30 years of growth. Mass incarceration is yielding to the imperative to reduce state budgets in recessionary times. As states turn away from the extravagant use of prison for nonviolent offenders, the percentage of the prison population serving long and life sentences for violent felonies will increase. By 2009 one in eleven prisoners were lifers. These are the prisoners growing old and dying in prison. High cost elderly prisoners who have aged out of crime should be good candidates for cost saving measures such …

The Impact Of Living In A Mixed-Status Family On K-12 Students, Allison Mass Jan 2013

The Impact Of Living In A Mixed-Status Family On K-12 Students, Allison Mass

Honors Capstones

The Impact of Living in a Mixed-Status Family on K-12 Students is important because itexamines a serious issue confronting today’s schools— the experiences and needs of students living in mixed-status families, which are often not considered by educators. The significant number of students in today’s schools who are either undocumented themselves or directly impacted by a parent who is undocumented calls on teachers and administrators, regardless of their personal beliefs on immigration, to learn about the needs of these students, the challenges they face, and what can be done to help them. This is a review of the current literature …

Animal Farm Reality: The First Amendment Struggle To Reveal The Frightening Truth Behind Industrial Farm Animal Production, Melanie M. Ghaw

Buffalo Environmental Law Journal

When I began writing this article, a deadly outbreak of listeria was ravaging the nation.' It began with the recall of cantaloupes and led to three additional recalls of produce in the following weeks.2Although the produce originatedfr om a single farm in Colorado, the harmful effects of the outbreak spanned 18 states, reaching as far as Alaska. Currently 29 people have died and 72 others were infected.3

Produce contaminated with animal waste caused this deadly traged.' Listeria outbreaks are becoming more common, coinciding 1with the increase of Industrial Farm Animal Production (IFAP), and many believe IFAP facilities are to blame …

United States Geological Survey: Water Reports and Publications

The United States Geological Survey (USGS), in cooperation with the North Dakota Department of Transportation and the North Dakota State Water Commission, completed hydrographic surveys at six Missouri River bridges and one Yellowstone River bridge during the 2011 flood of the Missouri River system. Bridges surveyed are located near the cities of Cartwright, Buford, Williston, Washburn, and Bismarck, N. Dak. The river in the vicinity of the bridges and the channel through the city of Bismarck, N. Dak., were surveyed. The hydrographic surveys were conducted using a high-resolution multibeam echosounder (MBES), the RESON SeaBatTM 7125, during June 6–9 and June …

Community Exposure To Tsunami Hazards In California, Nathan J. Wood, Jamie Ratliff, Jeff Peters Jan 2013

Community Exposure To Tsunami Hazards In California, Nathan J. Wood, Jamie Ratliff, Jeff Peters

United States Geological Survey: Publications

Evidence of past events and modeling of potential events suggest that tsunamis are significant threats to low-lying communities on the California coast. To reduce potential impacts of future tsunamis, officials need to understand how communities are vulnerable to tsunamis and where targeted outreach, preparedness, and mitigation efforts may be warranted. Although a maximum tsunami-inundation zone based on multiple sources has been developed for the California coast, the populations and businesses in this zone have not been documented in a comprehensive way. To support tsunami preparedness and risk-reduction planning in California, this study documents the variations among coastal communities in the …

Effect Of Projectile Impact And Penetration On The Phase Composition And Microstructure Of High Performance Concretes, Fei Ren, Catherine H. Mattus, John Jy-An Wang, Beverly P. Dipaolo

United States Army: Publications

As a result of increased concerns regarding public safety in recent years, the impact and penetration resistance of infrastructure has become an emerging research focus in the cement and concrete industry. Ultra-high performance concretes (UHPCs) with fiber reinforcement usually possess compressive strengths greater than 200 MPa and are promising candidates for penetration-resistant building materials. In the current project, two UHPC materials, ERDC-M (a modified composition developed at U.S. Army Engineer Research and Development Center) and Ductal®, were subjected to projectile penetration testing. The microstructural evolution due to projectile impact and penetration was examined via scanning electron microscopy and …

Regression To The Mean: How Miranda Has Become A Tragicomical Farce, Alfredo Garcia Jan 2013

Regression To The Mean: How Miranda Has Become A Tragicomical Farce, Alfredo Garcia

St. Thomas Law Review

In my original article, I examined Miranda's historical and social background, discussed its precursors, traced the evolution of the case, and documented the dismantling of the Miranda doctrine. I also argued that the doctrine's "seductive appeal" lulled defense counsel into a false sense of security, thereby deflecting reliance on the "voluntariness" standard as a failsafe to Miranda. Further, I maintained that a waiver of Miranda in some instances served to sanitize an otherwise involuntary confession. Finally, I proposed to "do away" with Miranda, to return to the voluntariness standard with one caveat: that the government be precluded from relying on …

Effectiveness Of Vehicle Weight Enforcement In A Developing Country Using Weigh-In-Motion Sorting System Considering Vehicle By-Pass And Enforcement Capability, M.R. Karim, N.I. Ibrahim, A.A. Saifizul, H. Yamanaka

Research Publications (2011 to 2015)

Vehicle overloading has been identified as one of the major contributors to road pavement damage in Malaysia. In this study, the weigh-in-motion (WIM) system has been used to function as a vehicle weight sorting tool to complement the exsiting static weigh bridge enforcement station. Data collected from the developed system is used to explore the effectiveness of using WIM system in terms of generating more accurate data for enforcement purposes and at the same time improving safety and reducing the number of vehicle weight violations on the roads. This study specifically focus on the effect of vehicle by-pass and static …

Community Development For The 21st Century: Asset-Building And The Resurgence Of Pittsburgh, Jason D. Tigano Jan 2013

Community Development For The 21st Century: Asset-Building And The Resurgence Of Pittsburgh, Jason D. Tigano

Electronic Theses and Dissertations

Revitalizing a distressed community is a difficult challenge. Oftentimes it can take decades to achieve. Pittsburgh's East Liberty and Lawrenceville neighborhoods had fallen on hard times in the late part of the 20th century. However, in recent years, both were able to identify and leverage the assets of the community as a part of their revitalization strategy. Led by the efforts of local community organizations, these communities developed innovative redevelopment strategies that ultimately produced meaningful revitalization in both neighborhoods. The following is a study to understand if and how asset-building theories of community development influenced the strategies used to revitalize …

The Procedural Due Process Rights Of The Stigmatized Prisoner, Lindsey Webb Jan 2013

The Procedural Due Process Rights Of The Stigmatized Prisoner, Lindsey Webb

Sturm College of Law: Faculty Scholarship

This Article addresses the role of stigma in procedural due process claims brought by prisoners. In particular, the Article focuses on inmates whom prisons have classified as sexual offenders although they have never been convicted of a sex offense. Prisons label these inmates—identified here as the “branded class”—as sexual offenders based on information outside of the inmates’ conviction histories, including charges that ended in dismissal or acquittal. As a result of the sex offender classification, prisons impose upon the branded class a wide range of sex offender-specific conditions, including mandatory treatment and sex offender registration.

In addressing procedural due process …
