What About Collections? Mitigation Best Practices For University Collections To Ensure Resilience, Pat Young

DRU Workshop 2013 Presentations – Disaster Resistant University Workshop: Linking Mitigation and Resilience

When considering disaster mitigation practices and disaster resilience within the university context, naturally and logically the first consideration is for the protection and safety of university community members – students, faculty and staff. While this focus is of primary importance and value, a secondary area of concern is often overlooked – the collections of documents, records, objects and artifacts that are of vital importance to the ongoing function of the university itself.

This session will consider important steps that can be taken to address disaster mitigation, preparedness, response and recovery within university collections by examining the case study of the …

The Protective And Developmental Varieties Of Liberal Democracy: A Difference In Kind Or Degree?, Devin K. Joshi Mar 2013

The Protective And Developmental Varieties Of Liberal Democracy: A Difference In Kind Or Degree?, Devin K. Joshi

Research Collection School of Social Sciences

Liberal democratic governments may differ in both their kind and degree of democracy. However, the literature too often conflates this distinction, hindering our ability to understand what kinds of governing structures are more democratic. To clarify this issue, the article examines two prominent contemporary models of democracy: developmental liberal democracy (DLD) and protective liberal democracy (PLD). While the former takes a 'thicker' approach to governance than the latter, conventional wisdom holds that these systems differ only in kind rather than degree. The article tests this assumption through an empirical comparison of electoral, legislative, and information-regulating institutions in two representative cases: …

Presidential Pardon In Singapore: A Comment On Yong Vui Kong V Ag, Shubhankar Dam

Research Collection Yong Pung How School Of Law

This paper critically analyses the decision of the Singapore Court of Appeal in Yong Vui Kong v Attorney-General in relation to presidential pardon. Two questions were central to the case. First, is the President bound by the decision of the Cabinet in pardon-related matters? Secondly, are decisions regarding pardon—whether made by the Cabinet or President—subject to judicial review? In relation to the first question, the Court based its reasoning on Singapore's political system being a Westminster-inspired model and, therefore, that the President generally undertakes the same functions as the British monarch. However, this paper identifies the unique features of Singapore's …

Tax Planning For Marijuana Dealers, Benjamin Leff Feb 2013

Tax Planning For Marijuana Dealers, Benjamin Leff

Scholarly Articles in Law Reviews & Journals

In recent years, many states have legalized marijuana while the federal government continues to consider all marijuana sales and use illegal. But marijuana industry insiders consider not federal criminal law but federal tax law to be the biggest impediment to the development of a legitimate marijuana industry. State-sanctioned marijuana sellers are required to pay federal income taxes pursuant to § 280E, a formerly largely symbolic provision that Congress enacted to punish drug dealers, but which now could potentially drive legitimate marijuana sellers underground.

This paper proposes a tax strategy that enables state-sanctioned marijuana sellers to avoid the impact of § …

Incitement To Riot In The Age Of Flash Mobs, Margot Kaminski Feb 2013

Incitement To Riot In The Age Of Flash Mobs, Margot Kaminski

University of Cincinnati Law Review

As people increasingly use social media to organize both protests and robberies, government will try to regulate these calls to action. With an eye to this intensifying dynamic, this Article reviews First Amendment jurisprudence on incitement and applies it to existing statutes on incitement to riot at a common law, state, and federal level. The article suggests that First Amendment jurisprudence has a particularly tortuous relationship with regulating speech directed to crowds. It examines current crowd psychology to suggest which crowd behavior, if any, should as a matter of policy be subject to regulation. It concludes that many existing incitement-to-riot …
