Little Black Boxes: Legal Anthropology And The Politics Of Autonomy In Tort Law, Riaz Tejani Jun 2013

Little Black Boxes: Legal Anthropology And The Politics Of Autonomy In Tort Law, Riaz Tejani

The University of New Hampshire Law Review

[Excerpt] "Law’s interdisciplinary turn toward social sciences suggests a growing realization that jurists may not be independently equipped to explain the world in and upon which they act. But if law embraces empirical social science for its usable output, it struggles to make sense of the more interpretive disciplines such as anthropology. This has proven to be a major setback for both law and anthropology and confounds the historically productive rapport between the two fields stretching back more than a century. While it may be tempting to conclude that today’s legal academic misunderstands the interpretive turn in anthropology, that conclusion …

Development Of Visual Philosophy Under Impact Of Philosophy Of Technology, Li Zhao, Shuyu Zhang Jun 2013

Development Of Visual Philosophy Under Impact Of Philosophy Of Technology, Li Zhao, Shuyu Zhang

Journal of Educational Technology Development and Exchange (JETDE)

Throughout history the development of technology has been affecting people’s lives. Any kind of technological innovation may give a qualitative leap in human society. The impact of technology has penetrated into the study of various disciplines. Philosophy is no exception. In 1877, Karp formally proposed the concept of“philosophy of technology.” Technology has been studied from the practical aspect of a tool to the level of philosophy. Although the concept of visual philosophy has not yet been formally proposed, the thinking of philosophical vision has already existed. This paper is to analyze the impact of philosophy of technology on the …

Thinking Through Consciousness, Erica Hanson Jun 2013

Thinking Through Consciousness, Erica Hanson

University Honors Theses

Consciousness is difficult to pin down. Most human beings go about their days with full and more or less uninterrupted consciousness, without contemplating their own (or other peoples’) conscious states. To be in the world, and accomplish great acts takes little metaawareness of consciousness, but in the study of consciousness our inability to think outside of our conscious states creates controversies at the conceptual and methodological levels. As Victor Lamme states (2006), even when we set aside the more difficult (or more poorly defined) questions about conscious experience to focus on finding the neural correlates of consciousness (NCC), we face …

Use Of Gender Aschematicity In The Reassessment Of Gender Concepts, Ashley A. Ward Jun 2013

Use Of Gender Aschematicity In The Reassessment Of Gender Concepts, Ashley A. Ward

University Honors Theses

The purpose of this thesis is to reevaluate the binary constructs of sex and gender; and the biological and social influence these constructs have on males, females, and non-normative individuals. Throughout this examination, biological, specifically chromosomal and anatomical, differences between sexes will help foster a definition of sex. Psychological theories will then be examined, calculating the psychological and social factors surrounding gender. A reevaluation of gender constructs will shed light on previously held misconceptions about gender and help lay groundwork for non-normative gender acceptance in the future. Furthermore, the thesis will delve into gender aschematicity and potential benefits of gender …

Language Learning, Ecological Validity, And Innovation Under Conditions Of Superdiversity, Steven L. Thorne Jun 2013

Language Learning, Ecological Validity, And Innovation Under Conditions Of Superdiversity, Steven L. Thorne

World Languages and Literatures Faculty Publications and Presentations

This article describes three pedagogical proposals oriented toward moving language learning to the center of higher education, and further, to emphasizing the importance of both continued first (L1) and additional/foreign (L2) language learning as central to academic and professional success. The first project, titled Language-Integrated Knowledge Education (or LIKE), aims at making explicit the linguistic resources necessary for full participation in written and spoken academic contexts, in both students' first as well as (potentially) multiple foreign languages. The second project describes the benefits and rationale for broadening the use of online intercultural exchange within foreign language education as well as …

Geographical Spread Of Asians In California, Lydia Tang Jun 2013

Geographical Spread Of Asians In California, Lydia Tang

Social Sciences

The goal of my senior project is to perform a spatial analysis of Asian American settlement patterns within California. With my findings, I want to predict future Asian immigrant settlement patterns, places within California that they will likely cluster around, the rate of immigration, and how their increasing or decreasing presence in California affects California’s urban and economic climate. What I hope to achieve from this study is an understanding for why certain areas attract more Asians than others. By finding the answers to the following questions, I will be able to forecast the future spread of Asian Americans in …

Beyond Small Change: Reforming Nevada's Approach To Education Reform, Sonya D. Horsford Jun 2013

Beyond Small Change: Reforming Nevada's Approach To Education Reform, Sonya D. Horsford

Lincy Institute Reports and Briefs

When it comes to education, Nevada’s reputation as a low‐performing state in no way reflects a shortage of reforms. The politics of high‐stakes accountability characteristic of federal education policy since the 1980s has resulted in much reform, but “small change” in terms of funding and improved outcomes in the Silver State. This brief examines the history of Nevada education reform and why Nevada must reform its approach to improving schools by turning its attention from unfunded mandates to adequate and equitable investments in education. It concludes with a discussion of how Nevada policymakers and educational leaders can move beyond small …

Experiences Of Male Saudi Arabian International Students In The United States, Molly Elizabeth Heyn Jun 2013

Experiences Of Male Saudi Arabian International Students In The United States, Molly Elizabeth Heyn

Dissertations

Despite the increasing presence of Saudi Arabian international college students in American higher education, the literature regarding the experience of Saudi students in the United States is limited. This qualitative study explored and described the lived experiences of 9 male Saudi Arabian international college students studying in the United States. All the participants had studied in the United States for at least 2 years and were regularly admitted international students at Western Michigan University in Kalamazoo, Michigan. Moustakas’s (1994) phenomenological data analysis approach guided the data collection and analysis. The participants shared their lived experiences and the meaning of those …

On The Demand To Incorporate Shari'a Law Into Uk Law, Mayada Serageldin Jun 2013

On The Demand To Incorporate Shari'a Law Into Uk Law, Mayada Serageldin

Theses and Dissertations

The origin of this thesis lay in the emergence of a minority group of ‘religious’ activists in London, England. The purpose of this group was to establish “Shari’a Zones” in pockets of Waltham Forest and Tower Hamlets, wherein certain acts would be prohibited and Shari’a law would be enforced. This led to an examination of the theological and religious beliefs of this small and much marginalized section of the British Muslim community. What became apparent is that this group prescribed to a view of Islam, and shariah law in particular, which is incongruent with the provisions of human rights law. …

Individual Discourse, Language Ideology And Spanish Transmission In El Paso, Texas, Isabel Velázquez

Spanish Language and Literature Papers

This paper reports the results of an analysis of the use of metaphors, metonyms, referential strategies, and expressions of deixis used by a group of middle-class bilinguals in the border city of El Paso, Texas, when speaking about use of Spanish and English in their city and in their home. A total of 234 metaphors referencing processes, institutions, and ethnic groups related to Spanish/English use were included. The goal of this study was to analyze how speakers conceptualized language use and language users in their community, and to examine if and how individual discourses map onto larger linguistic ideologies. The …

Insectography: Insects In The World Of Fiction, Erin Bauer Jun 2013

Insectography: Insects In The World Of Fiction, Erin Bauer

Department of Entomology: Dissertations, Theses, and Student Research

This is a comprehensive list of fictional works (films/TV episodes, video games, children’s books, and novels) originally published or produced in the United States between 1950 and 2012 about or including insects, spiders, related arthropods (many times anthropomorphized or mutated) and/or entomologists as main characters and playing a major role in the plot. Although the list encompasses both entertaining and educational works, it does not include textbooks or other non-fictional works or “fictionalized” accounts of real processes. For example, books such as Hope for the Flowers, where the story is told from the perspective of the main character, a …

Sméagol Versus Gollum: The Bridge Between Fantasy And Reality: Applying Jungian Psychology To Tolkien’S The Lord Of The Rings, Courtney C. Randall Jun 2013

Sméagol Versus Gollum: The Bridge Between Fantasy And Reality: Applying Jungian Psychology To Tolkien’S The Lord Of The Rings, Courtney C. Randall

Pell Scholars and Senior Theses

Many literary critics have observed Tolkien's work through biographical, allegorical, and source analyzing perspectives. Few scholars have considered the significance of Gollum. The complexity of Gollum is revealed through a Jungian lens and, although he is a fictional character, he may not be so far removed from reality. This character's split personality, as determined by the Ring, presents what could eventually become of man if he is not strong enough to resist that which has the potential to consume him. In other words, the worst version of the human condition is presented through Gollum and his internal conflict. He provides …

The Process Of How Teachers Become Teacher Leaders And How Teacher Leadership Becomes Distributed Within A School: A Grounded Theory Research Study, Steven J. Sanocki Jun 2013

The Process Of How Teachers Become Teacher Leaders And How Teacher Leadership Becomes Distributed Within A School: A Grounded Theory Research Study, Steven J. Sanocki

Dissertations

It is undeniable that leadership is necessary for any organization to succeed. However, educational leadership is often compartmentalized and relegated to the hierarchical leadership found in schools such as principals, superintendents, and those with a formal title. The concept of teacher leadership has begun to surface in progressive schools and districts throughout the country, as is evidenced throughout both the professional and scholarly (research) literature. Teacher leadership is occurring in practice, yet it lacks a clear definition and/or a consistent employment in K-12 education. Teachers have historically stepped out of their traditional role as a teacher and into formalized roles …

Are We All Originalists Now? I Hope Not!, James E. Fleming Jun 2013

Are We All Originalists Now? I Hope Not!, James E. Fleming

Faculty Scholarship

In recent years, some have asked: “Are we all originalists now?” My response is: “I hope not!” In the Article, I explain why. But first, I show that there is a trick in the question: Even to pose the question “Are we all originalists now?” suggests that one is presupposing what I shall call “the originalist premise.” To answer the question affirmatively certainly shows that one is presupposing it. The originalist premise is the assumption that originalism, rightly conceived, is the best, or indeed the only, conception of fidelity in constitutional interpretation. Put more strongly, it is the assumption that …

Experiences Of Latina First Generation College Students: Exploring Resources Supporting The Balancing Of Academic Pursuits And Family Life, Hercilia B. Corona-Ordoñez

Graduate Doctoral Dissertations

This study used a qualitative interview approach and thematic analysis (Braune and Clark, 2006) to interview first generation college student Latinas, exploring their experiences with higher education, their navigation/negotiation of resources for academic success and for wellness of self and family, and barriers they face as they attempt to both safeguard self and family wellness and reach their academic goals. It also directly explored the potential resources participants would find useful and ways in which colleges/universities might support them in these pursuits.

With this method, this study identified 6 major themes in the lives of first generation college student Latinas: …

"After All, Africa Is Largely A Nonliterate Continent": The Reception Of Vatican Ii In Africa, Agbonkhianmeghe E. Orobator

Theology Faculty Research and Publications

The article examines critical factors that determined the impact, reception, and implementation of Vatican II in Africa. Drawing on historical accounts, the author identifies and analyzes personalities, contexts, and issues that conditioned and shaped Africa's participation in the council. Looking back 50 years, he argues that while the continent's participation was negligible, shaped by a combination of events and attitudes that either facilitated or hampered reception, concrete examples abound of how the council generated impetus for growth, renewal, and reform in inculturation, interreligious dialogue, theological reflection, and ecclesial collaboration in Africa.

Dynamics Of International Nonprofit Capacity Building Partnerships, Julia Sparkman Jun 2013

Dynamics Of International Nonprofit Capacity Building Partnerships, Julia Sparkman

College of Communication Theses and Dissertations

This study worked to expand the discourse of international nonprofit capacity building research. In the field of Communication, research investigating international nonprofit partnerships is limited, and some international communities lack a voice within the scholarship. Through the lens of postcolonial reflexivity, the author traveled to Kenya to conduct participant observations and one-on-one interviews with a US Capacity Building Nonprofit (USCBN) and two local Kenyan nonprofit organizations (the KCN and the KSN). The findings revealed that the USCBN established previous organizational alliances with the KCN and the KSN. The previous alliances led to strong relationships. The relationships engendered collaboration within the …

Career Development In Language Education Programs, Saad Fathy Shawer, Saad Ali Alkahtani Jun 2013

Career Development In Language Education Programs, Saad Fathy Shawer, Saad Ali Alkahtani

Australian Journal of Teacher Education

This study assesses the influence of a two-year language program evaluation on program directors and faculty career development. The study makes use of mixed-paradigms (positivism and qualitative interpretive), mixed-strategies (survey research and qualitative evaluation), one-way analysis of variance (ANOVA) and a post-hoc test of multiple comparisons (Scheffe). The findings indicate that imposed program evaluation experiences help faculty members advance their career skills in terms of course planning, classroom teaching, learning assessment, classroom research, and coping with career pressure. The findings also indicate significant improvement in program director academic and administrative career skills. Moreover, the findings did not show inter-program differences …

The Effects Of Training On Pre-Service English Teachers’ Regulation Of Their Study Time, Aysegul Daloglu, Seniye Vural Jun 2013

The Effects Of Training On Pre-Service English Teachers’ Regulation Of Their Study Time, Aysegul Daloglu, Seniye Vural

Australian Journal of Teacher Education

Based on Zimmerman et al.’s (1996) learning model, an intervention consisting of seven weekly training sessions to increase students’ awareness of and ability to plan and manage their study time was developed. Weekly journals, in which students reflected on their implementation of each phase of the learning model, were applied for students and the researchers to monitor and evaluate the training process. The results indicate that the training proved to be beneficial in that students reported a frequent use of a variety of strategies throughout the training process.
