Unintended Consequences Of Cigarette Taxation And Regulation, Angela Hawken, Jonathan D. Kulick, James Prieger

Tobacco smoking harms health. Taxes and regulations can reduce that harm. But evasion reduces the efficacy of taxes and regulations and creates harms of its own in the form of illicit markets. Enforcement can reduce evasion but creates additional harms, including incarceration and violence. Peter Reu-ter has pointed out that a flat ban on cigarettes would be likely to generate illicit-market harms similar to the harms of existing illicit drug markets. Taxes and regulations can be thought of as “lesser prohibitions,” subject to the same sorts of risks. Minimizing total harm means minimizing the sum of abuse harms and control …

Alien grass invasions in arid and semi-arid ecosystems are resulting in grass–fire cycles and ecosystem-level transformations that severely diminish ecosystem services. Our capacity to address the rapid and complex changes occurring in these ecosystems can be enhanced by developing an understanding of the environmental factors and ecosystem attributes that determine resilience of native ecosystems to stress and disturbance, and resistance to invasion. Cold desert shrublands occur over strong environmental gradients and exhibit significant differences in resilience and resistance. They provide an excellent opportunity to increase our understanding of these concepts. Herein, we examine a series of linked questions about (a) …

Successful memory involves not only remembering information over time, but also keeping memories distinct and less confusable. The computational process for making representations for similar input patterns more distinct from each other has been referred to as "pattern separation." In this work, we developed a set of behavioral conditions that allowed us to manipulate the load for pattern separation at different stages of memory. Thus, we provide experimental evidence that a brain-derived neurotrophic factor (BDNF)-dependent pattern separation process occurs during the encoding/storage/consolidation, but not the retrieval stage of memory processing. Conditional Expression Of Tgf-Β1 In Skeletal Muscles Causes Endomysial Fibrosis And Myofibers Atrophy, Jigna Narola, Sachchida Nand Pandey, Adam Glick, Yi-Wen Chen

To study the effects of transforming growth factor beta 1 (TGF-β1) on fibrosis and failure of regeneration of skeletal muscles, we generated a tet-repressible muscle-specific TGF-β1transgenic mouse in which expression of TGF-β1 is controlled by oral doxycycline. The mice developed muscle weakness and atrophy after TGF-β1 over-expression. We defined the group of mice that showed phenotype within 2 weeks as early onset (EO) and the rest as late onset (LO), which allowed us to further examine phenotypic differences between the groups. While only mice in the EO group showed significant muscle weakness, pathological changes including endomysial fibrosis and smaller …

Staphylococcus aureus clonal complex 398 (CC398) isolates cluster into two distinct phylogenetic clades based on single-nucleotide polymorphisms (SNPs) revealing a basal human clade and a more derived livestock clade. The scn and tet(M) genes are strongly associated with the human and the livestock clade, respectively, due to loss and acquisition of mobile genetic elements. We present canonical single-nucleotide polymorphism (canSNP) assays that differentiate the two major host-associated S. aureus CC398 clades and a duplex PCR assay for detection of scn and tet(M). The purpose of this study was to explore the specific reasons why households in Kitere village, Kenya experience persistent food insecurity every year while the region enjoys the advantage of two planting/harvest seasons in a year. Kitere village lies within the lakeside region of Nyanza Province in Kenya, generally considered to be one of the more agriculturally productive parts of the country. The Participatory Rural Appraisal method was employed to gather qualitative data on the causes of food insecurity in Kitere village. A method for treating brain-related chronic pain disorders in human subjects includes assessing the brain function of a subject suffering from chronic pain, diagnosing a chronic pain-related abnormal brain condition, and mitigating the abnormal brain activity by applying an electrical stimulation signal to tissues corresponding to at least one area of abnormal brain activity.

The Facilities Manager occupies a unique position within the lifecycle of a building asset, as he/she is one of the only Architectural, Engineering, and Construction/Facilities Management (AEC / FM) professionals who is in a position to view the product of the entire design and build process. For some time now, a narrow but persistent majority of the Supreme Court has undertaken the project of circumscribing federal power. Marching under the banner of state sovereignty, this majority has attacked the flanks of congressional power in at least three areas: its enumerated powers, its power to direct the state administration of federal programs, and its power to abrogate state immunity from suit. During the October Term 2011, the battle over the appropriate balance of federal power and state sovereignty continued in earnest on all three fronts. Supreme Court jurisprudence often privileges certain constitutional provisions to the detriment of others. Following World War II, the Court’s elevation of the equal protection doctrine drove decisions that limited the rights of states and individuals. Over the last twenty years, however, the First Amendment—particularly the Free Speech Clause—has knocked equal protection from its perch.
This Article analyzes United States v. Alvarez and Knox v. Service Employees International Union by critiquing the Court’s opinions, comparing these opinions to other contemporaneously decided cases, and situating the cases within the larger doctrinal field of the First Amendment.
