Immigration, Sovereignty, And The Constitution Of Foreignness, Matthew J. Lindsay
Immigration, Sovereignty, And The Constitution Of Foreignness, Matthew J. Lindsay
Connecticut Law Review
It is a central premise of modern American immigration law that immigrants, by virtue of their non-citizenship, are properly subject to an extra-constitutional regulatory authority that is inherent in national sovereignty and buffered against judicial review. The Supreme Court first posited this constitutionally exceptional authority, which is commonly known as the “plenary power doctrine,” in the 1889 Chinese Exclusion Case. There, the Court reconstructed the federal immigration power from a form of commercial regulation rooted in Congress’s commerce power, to an instrument of national self-defense against invading hordes of economically and racially degraded foreigners. Today, generations after the United States …
Self-Presentation Symbols And Their Effect On Heroic And Villainous Drive, Amelia Knight
Self-Presentation Symbols And Their Effect On Heroic And Villainous Drive, Amelia Knight
Honors Theses
There is a significant body of research reflecting that human beings are drawn to hero stories. This fascination stems from a basic human need for hope and the inspiration to achieve greatness. Most hero stories, especially fictional ones, contain symbolically embedded information, which helps us to mentally represent particular heroes. For example, when asked to visualize Batman and Superman two distinct images come to mind: Batman’s mask and Superman’s cape. In the real world, these symbols are a little more obscure, like a Policeman’s badge or a Fireman’s hat. Symbols are important for the understanding of viewers, but they can …
From Collaboration To Consolidation: Developing A More Expansive Model For Responding To Family Violence, Deseriee A. Kennedy
From Collaboration To Consolidation: Developing A More Expansive Model For Responding To Family Violence, Deseriee A. Kennedy
Cardozo Journal of Equal Rights & Social Justice
Academics and activists have frequently called for increased collaboration and communication between domestic violence and child welfare agencies as a means of more effectively responding to the impact of domestic violence on children and in recognition of the co-occurrence of domestic violence and child maltreatment. This Article reviews whether efforts based on the Greenbook and other initiatives calling for collaboration have led to any appreciable decrease in family violence. The Article finds evidence to suggest that there has not been significant improvement in the incidence or severity of family violence and more radical responses to family violence are needed. It …
The Transaction Cost Problem In International Intellectual Property Exchange And Innovation Markets, Sonia Baldia
The Transaction Cost Problem In International Intellectual Property Exchange And Innovation Markets, Sonia Baldia
Northwestern Journal of International Law & Business
In recent years, there has been a dramatic surge in cross-border IP exchange transactions driven by globalization, open innovation, and the escalating strategic value of IP to competitive firms, the positive result of which are significantly developed global IP markets. While critical to these global IP markets, international IP exchange remains highly inefficient because parties face excessive transaction costs relative to transaction value, both in transaction design and negotiation and in transaction enforcement. These transaction costs arise from the territoriality of IP laws and low visibility into individual state IP law regimes that IP exchange transactions may implicate, thus imposing …
Understanding Social Care, Kevin Lalor, Perry Share
Understanding Social Care, Kevin Lalor, Perry Share
Books/Book chapters
There is a good chance you are reading this because you are planning to be, or already are, a social care practitioner. Yet for many in Irish society, even those entering the field themselves, the meaning of the term ‘social care’ is not self- evident. A common question directed at social care students and professionals alike is, ‘What do you do?’ Misconceptions abound and in many cases practitioners are not accorded the recognition or status they deserve, partly as a consequence of a limited understanding of what the term means This chapter explores the notion of social care itself. Some …

Analysis Of Fatal And Nonfatal Accidents Involving Earthmoving Equipment Operators And On-Foot Workers, Esref Emrah Kazan
Analysis Of Fatal And Nonfatal Accidents Involving Earthmoving Equipment Operators And On-Foot Workers, Esref Emrah Kazan
Wayne State University Dissertations
In view of the limitations of univariate statistics for studying construction accidents, a multivariate approach was undertaken using crosstabulation analysis and logistic regression.
Heavy construction equipment accidents related data for four type of equipment; backhoe, bulldozer, excavator and scraper were incorporated in the study using categorical variables. Degree of injury indicating the severity of accident outcome (fatal vs. nonfatal) was selected as the dependent variable, and a variety of factors potentially affecting the outcome comprised the independent variables. Cross tabulation results enabled the understanding and evaluation of associations between the research variables, while logistic regression yielded predictive models that helped …

Polemic, Redaction, And History In The Mandaean Book Of John: The Case Of The Lightworld Visitors To Jerusalem, James F. Mcgrath
Scholarship and Professional Work - LAS
It is unclear whether there is anything of historical usefulness that can be gleaned from the details of the depictions of figures such as John the Baptist, Miriai, and Jesus in the Mandaean Book of John. This does not mean, however, that the text cannot provide useful information about the history of the Mandaeans, and of their interactions with other religious communities. By analyzing the evidence for redaction in certain key sections, and by distinguishing between core elements and peripheral additions to the stories recorded in it, it is possible to draw conclusions about the tradition history of the material, …

Five Year Carbon Storage Analysis In The Gordon Natural Area, Joy Fritschle, Chad Hudson, Catherine Spahr, Andy Tamez
Forest Carbon Storage Study Documents
The Gordon Natural Area (GNA) serves as a natural laboratory for a range of class research projects. In a Geography Field Methods course led by Dr. Fritschle, students established five permanent carbon-study plots in 2008. Since then, students have returned to these plots to measure the carbon stock of standing trees in five plots located along a topographic gradient: floodplain, ridge-top, lower mid-slope, mid-slope and upper mid-slope. Using U.S. Forest Service established guidelines, all trees greater than 5 cm and up to 73 cm in diameter at breast height (DBH) were measured and identified within each 40 m circular plot. …
Internet Freedom And Computer Abuse, Lothar Determann
Internet Freedom And Computer Abuse, Lothar Determann
UC Law SF Communications and Entertainment Journal
The Computer Fraud and Abuse Act ("CFAA") has a bad reputation. It is associated with constitutional law challenges and community outrage. It played a role in the tragic suicide of Aaron Swartz, computer programmer, Internet activist and CFAA defendant. It has been decried as a basis for abuse of justice, which is ironic, given its title and focus on punishing abuse. It has been called "the worst law in technology" and "the most outrageous criminal law you've never heard of." It is loathed and feared as a threat to Internet freedom.
A particular concern is that the law could criminalize …

Can The Past Inform Us About Sebago Lake’S Future?, Firooza Pavri, Jean Macrae, Anna Springsteen, Abraham Dailey
Faculty Publications
Scientists often consider past population trends to make predictions about future growth. Can we do the same with landscapes? Is there a way to examine how land has changed in the past twenty years? And can that help us predict how the land will look in twenty more? The answer to these questions is yes. Landscape trends are important because the quality of water in any lake is influenced by the condition of the land around it. Most important is green space - forested or vegetated land not broken by human development. The simple rule: more green space means more …

Department of Earth and Atmospheric Sciences: Faculty Publications
This is the first part of a three-part paper on North American climate in phase 5 of the Coupled Model Intercomparison Project (CMIP5) that evaluates the historical simulations of continental and regional climatology with a focus on a core set of 17models. The authors evaluate the models for a set of basic surface climate and hydrological variables and their extremes for the continent. This is supplemented by evaluations for selected regional climate processes relevant to North American climate, including cool season western Atlantic cyclones, the North American monsoon, the U.S. Great Plains low-level jet, and Arctic sea ice. In general, …
Problems In Historiography: The Americanization Of German Ethnics, Bradley Jake Hustad
Problems In Historiography: The Americanization Of German Ethnics, Bradley Jake Hustad
All Graduate Theses, Dissertations, and Other Capstone Projects
Gaps still exist in the history written about German Americans and how they assimilated or acculturated into American society from the late seventeenth century until the present day. History written about how German Americans became Americanized contains fifteen distinct types of scholarship that can roughly be divided into urban and rural disciplines. Because historians have not applied ideas introduced in urban studies into research about rural areas and vice versa, the overall arguments advanced by historians suffer. Additionally, historians have not researched colonial Germans, Germans who immigrated to America before the Revolution, in extensive depth. Furthermore, scholars can do more …
The Chattanooga Campaign: Death Of The Confederacy, Joshua Robert Smith
The Chattanooga Campaign: Death Of The Confederacy, Joshua Robert Smith
All Graduate Theses, Dissertations, and Other Capstone Projects
The purpose of this work is to demonstrate the importance of the Chattanooga Campaign. The campaign was important to the war because the Confederate loss opened the deeper Southern states to the advancing Union Armies. Due to the ineptitudes and failures of their leader, Braxton Bragg, the Army of Tennessee was forced to relinquish their hold on east Tennessee. Bragg's failures were equally matched by the insubordination he received from his subordinate officers, Leonidas Polk, William Hardee, and James Longstreet. These men failed to work together and consequently Tennessee was lost to the Union. Chattanooga was a major rail hub …
