Comparative Research in Law & Political Economy
The Law And Politics Of Unjust Enrichment, Dan Priel
The Law And Politics Of Unjust Enrichment, Dan Priel
Comparative Research in Law & Political Economy
One of the marked differences between American private law and the private law of the rest of the common law world is the relative lack of interest in restitution in the former compared with the enthusiasm for the subject in the latter. It has recently been suggested that this difference has to do with the impact of legal realism on American law. It was realism’s disdain for doctrinal analysis, it is said, which explains why American scholars did not find the largely doctrinally-driven work on restitution very interesting. In this essay I reject this argument as it fails to explain …
The Networked Infrastructure Of Fossil Capitalism: Implications Of The New Pipeline Debates For Environmental Justice In Canada, Dayna Nadine Scott
The Networked Infrastructure Of Fossil Capitalism: Implications Of The New Pipeline Debates For Environmental Justice In Canada, Dayna Nadine Scott
Comparative Research in Law & Political Economy
A read of the critical geography literature on the concept of “networked infrastructures” generates two arguments in relation to the environmental justice implications of the new pipeline debates. First, the proposed coast-to-coast pipeline is likely to exacerbate existing environmental inequities in Canada. Conceiving of the crude oil in a pipeline as a material flow of commodified nature demonstrates that, at the end of the pipe, inputs of labor, technology and capital are required to convert the crude into useable forms of energy. This leads to a serious engagement with the communities at the ends of the proposed pipes. Here, I …
Sociological Jurisprudence 2.0: Updating Law's Interdisciplinarity In A Global Context, Peer Zumbansen
Sociological Jurisprudence 2.0: Updating Law's Interdisciplinarity In A Global Context, Peer Zumbansen
Comparative Research in Law & Political Economy
The gap between law’s pronouncement of rules and their impact or failure in concrete social environments has long prompted efforts to make lawyers more responsive to the “realities on the ground”. While this turn to sociological jurisprudence seemed a logical consequence of the Legal Realists’ attack on formalism and positivism, it exposed legal theory to a never-ending series of questions concerning the limits of law in becoming an empirically informed social science. Even trailblazing Legal Realists themselves questioned the extent to which empirical knowledge might erode the core of law’s claim to authority. Where are we today, after numerous transgressions …
A System Of Transnational Business Interactions: The Case Of The Living Wage, David J. Doorey
A System Of Transnational Business Interactions: The Case Of The Living Wage, David J. Doorey
Comparative Research in Law & Political Economy
The subject of transnational business governance (TBG) interactions is an emerging field of study. These interactions are complex, involving multiple public and private actors crossing vast geopolitical spaces, with sometimes shared, but often conflicting interests. This complexity makes TBG interactions both an exciting new field of inquiry for scholars, but also an extremely challenging one. In these early days of theory development, it is useful to engage in a mapping exercise that will help scholars identify and test the relationships between the many inputs and outputs of TBG interactions. This paper contributes to this exercise by proposing and developing a …
Two Models Of General Jurisprudence, Dan Priel
Two Models Of General Jurisprudence, Dan Priel
Comparative Research in Law & Political Economy
The essay is a comment on William Twining’s recent book Globalisation and Legal Scholarship (2011), to be published as part of a symposium issue on the book. The aim of my comment is to present and contrast two models of general (or universal) jurisprudence: the one favoured by Twining and the other adopted by Jeremy Bentham. Twining’s model aims to be general by capturing the great variety of laws as they exist in the world, by contrast, Bentham argued that it is mostly prescriptive claims about law that can be universal. I argue that the descriptive model suffers from serious …

Approximating Law And Development, Human Rights And Transitional Justice, Peer Zumbansen, Ruth Buchanan
Comparative Research in Law & Political Economy
This chapter is the introduction to the forthcoming edited collection "Law in Transition: Human Rights, Developments and Transitional Justice", edited by the authors and forthcoming with Hart Publishing (Oxford, 2013). The book will appear in the "Osgoode Reader" series and brings together many of the leading experts of the increasingly pertinent intersection of development, rights and transitional justice studies. The Introduction traces the theoretical and practical challenges of this discursive interaction and argues that it is only through such dialogue that a better understanding of the institutional and normative issues arising in contemporary law & development and TJ contexts will …
10 Years ‘Equator Principles’: A Critical Economic-Ethical Analysis, Manuel Wörsdörfer
10 Years ‘Equator Principles’: A Critical Economic-Ethical Analysis, Manuel Wörsdörfer
Comparative Research in Law & Political Economy
June 4th, 2013 marks the formal launch of the third generation of the Equator Principles (EP III) and the tenth anniversary of the EPs – enough reasons for evaluating the EPs initiative from an economic ethics and business ethics perspectives. In particular, this essay deals with the following questions: What are the EPs and where are they going? What has been achieved so far by the EPs? What are the strengths and weaknesses of the EPs? Which necessary reform steps need to be adopted in order to further strengthen the EPs framework? Can the EPs be regarded as a role-model …
Private Governance, Public Implications And The Tightrope Of Regulatory Reform: The Isda Credit Derivatives Determinations Committees, John Biggins, Colin Scott
Private Governance, Public Implications And The Tightrope Of Regulatory Reform: The Isda Credit Derivatives Determinations Committees, John Biggins, Colin Scott
Comparative Research in Law & Political Economy
Regulatory relationships in financial markets exemplify the importance and changing nature of transnational business governance interactions (TBGI). These interactions involve reciprocal forces of influence between private and public regulators. This paper examines one key case of private governance in financial markets: the emergence, structures and decision-making of Credit Derivatives Determinations Committees (DCs) of the International Swaps and Derivatives Association (ISDA). The paper highlights the mechanisms or ‘pathways’ of interaction between ISDA, governments, courts and public regulators. Interactions between state and non-state actors are shown to occur in both operational and policy spheres. ISDA is found to be a particularly resilient …
Transnational Human Rights Litigation And Territorialized Knowledge: Kiobel And The ‘Politics Of Space’, Philip Liste
Transnational Human Rights Litigation And Territorialized Knowledge: Kiobel And The ‘Politics Of Space’, Philip Liste
Comparative Research in Law & Political Economy
In Kiobel v. Royal Dutch Petroleum Dutch and British private corporations were accused of having aided and abetted in the violation of the human rights of individuals in Nigeria. A lawsuit, however, was brought in the United States, relying on the Alien Tort Statute - part of a Judiciary Act from 1789. In its final decision on the case, the US Supreme Court has strongly focused on ‘territory.’ This usage of a spatial category calls for closer scrutiny of how the making of legal arguments presupposes ‘spatial knowledge,’ especially in the field of transnational human rights litigation. Space is hardly …
Central Asian Regimes Trample Women's Rights : The Effects Of Political Transition On The Status Of Women In Kazakhstan, Uzbekistan, Kyrgyzstan, Tajikistan, And Turkmenistan, Anastasia Kocher
Honors Capstones
The five Central Asian states have all experienced difficult economic and societal transitions following their political independence in 1992 and face uncertain futures. This is especially true with regard to the significant issue of women’s rights. Following the collapse of the Soviet Union, women began losing ground as traditional gender stereotypes returned to the newly independent countries of Central Asia. In the absence of Soviet rule, women have found themselves increasingly unable to advocate for education, equitable working conditions, and political representation. Uzbekistan, Kazakhstan, Kyrgyzstan, Tajikistan, and Turkmenistan have faced their individual challenges since their independence. Yet, my research recognizes …

Educational contexts that support the complexity of in-service teacher learning around the purposeful use of technology are scarce. This qualitative case study describes a Literacy Enrichment Camp offered for traditionally marginalized elementary-aged children. Within camp, 5 teachers and 1 instructor prioritized their own and students’ inquiry-based teaching and learning around iPads. This article shares what teachers learned about themselves and the 17 students who participated in the 3-week camp. Teachers collected data through field note observations of teacher/student interactions with iPads, teacher interviews, and teacher reflection journals. Data were analyzed through constant comparative method, revealing themes of previously unrecognized teacher-resistance …

Geography Of Disability. An Analysis Based On The Socioeconomic Levels Of Two Metropolitan Areas: Monterrey, Nuevo Leon And Dallas, Texas, Silviya Pavlova Nikolova
Social Work Dissertations - Archive
This doctoral project investigated the performance of disability within two different political, cultural, and socioeconomic environments. Data were analyzed from decennial census data from Mexico (2010) and the U.S. (2000) that included a measure of disability prevalence and the activities on which disability status is assessed. In Chapter 1, the relevance of the study to the understanding of disability as a context-related matter was explained. Comparative statistics and scholarly reports on disability have been used to discuss the existing discrepancies between disability trends in developing and developed countries. An emphasis for a construction of multifactorial comparative model for disability research …

Gis-Based Expert Systems Model For Predicting Habitat Suitability Of Blackside Dace, Benjamin L. Blandford, John Ripy, Ted H. Grossardt, Ryan Evans, Sara Hines
Kentucky Transportation Center Presentations
This study presents a GIS-based predictive habitat suitability model for the blackside dace, a federally-listed threatened species of the Upper Cumberland River basin in southeastern Kentucky. The model is a rules-based system which incorporates expert knowledge about habitat preferences for the species. The five habitat factors identified by experts and included in this model are stream gradient, canopy coverage, riparian vegetation type, riparian zone width, and stream order. Using GIS, the five habitat parameters were parameterized and combined across the entire stream network. Combinations were evaluated by blackside dace experts in terms of habitat suitability. The resulting model was tested …

The Global Land Rush: Markets, Rights, And The Politics Of Food, Smita Narula
The Global Land Rush: Markets, Rights, And The Politics Of Food, Smita Narula
Elisabeth Haub School of Law Faculty Publications
In the past five years, interest in purchasing and leasing agricultural land in developing countries has skyrocketed. This trend, which was facilitated by the 2008 food crisis, is led by state and private investors, both domestic and foreign. Investors are responding to a variety of global forces: Some are securing their own food supply, while others are capitalizing on land as an increasingly promising source of financial returns. Proponents argue that these investments can support economic development in host states while boosting global food production. But critics charge that these “land grabs” disregard land users' rights and further marginalize already …
Dynamic Governance Innovation, Elizabeth Burleson
Dynamic Governance Innovation, Elizabeth Burleson
Elisabeth Haub School of Law Faculty Publications
This article frames environmentally sound innovation in the context of transnational network theory with the goal of setting forth a preliminary framework for international legal policy coherence. I consider how network dynamics can facilitate broad diffusion of environmentally sound technologies, concluding that what appears to be fragmented trade, environment, and human rights regimes are indeed sustainable development building blocks with which to achieve dynamic governance. Collaborative environmentally sound innovation networking may be able to shepherd whole renewable energy sectors across the innovation valley of death and help turn a global responsibility to ramp up green technology into a global initiative …
Similarity Of Climate Control On Base Flow And Perennial Stream Density In The Budyko Framework, Liuliu Wu
Similarity Of Climate Control On Base Flow And Perennial Stream Density In The Budyko Framework, Liuliu Wu
Electronic Theses and Dissertations
Streams are classified into perennial, intermittent, and ephemeral streams based on flow durations. Perennial stream is the basic network, while intermittent or ephemeral stream is the expanded network. Connection between perennial stream and base flow at the mean annual scale exists since one of the hydrologic functions of perennial stream is to deliver runoff even in low flow seasons. The partitioning of precipitation into runoff and evaporation at the mean annual scale, on the first order, is captured by the ratio of potential evaporation to precipitation (Ep/P called climate aridity index) based on the Budyko hypothesis. The primary focus of …

Stability Of Academic Performance Across Science Subjects Among Chinese Students, Meng Fan
Theses and Dissertations--Educational, School, and Counseling Psychology
With data describing 110,520 eighth grade students from 592 junior high (middle) schools in China, a three-level hierarchical linear model was developed in this study to create a multivariate multilevel environment to examine (a) the effects of student-level and school-level variables on science achievement in four subject areas (science inquiry skills, biology, earth science, and physics) and (b) the consistency or stability of academic achievement across the four subject areas among students and among schools. Results indicated that (a) student characteristics, including gender, parental SES, time spent in learning, and the type of family separation, were related to high academic …
Evaluating The Utility Of A Virtual Environment For Childhood Social Anxiety Disorder, Nina Sarver
Evaluating The Utility Of A Virtual Environment For Childhood Social Anxiety Disorder, Nina Sarver
Electronic Theses and Dissertations
Objective: Two significant challenges for the dissemination of social skills training programs are (a) the need to provide sufficient practice opportunities to assure skill consolidation and (b) the need to assure skill generalization (i.e., use of the skills outside the clinic setting). In the case of social anxiety disorder, virtual environments may provide one strategy to address these issues. This investigation describes the development of an interactive skills-oriented virtual school environment and evaluated its utility for the treatment of social anxiety disorder in preadolescent children (Study 1). This environment included both in-clinic and at-home solutions. In addition, a pilot replication/extension …
Kantian Peace Extended: Liberal Influences And Military Spending, Isaac M. Castellano
Kantian Peace Extended: Liberal Influences And Military Spending, Isaac M. Castellano
Theses and Dissertations--Political Science
The Kantian Triangle of democratic institutions, IGOs, and economic interdependence has received a great deal of attention by international relations scholars. This project expands on liberal theory by arguing the pacific effects of the Kantian Triangle extend beyond dyadic context, and shapes state decision making on defense spending decisions. This project asserts that as states (1) build democratic institutions, (2) increase the number of memberships in international intergovernmental organizations (IGOs), and (3) exposes domestic markets to the global economy and subsequent interdependence on foreign markets for both imports and exports, they are less likely to allocate resources toward the military. …
