Avoiding Jeopardy, Without The Questions: Recovery Implementation Programs For Endangered Species In Western River Basins, Reed D. Benson
Avoiding Jeopardy, Without The Questions: Recovery Implementation Programs For Endangered Species In Western River Basins, Reed D. Benson
Law of the Rio Chama
The application of the Endangered Species Act to water resources has generated much controversy in the American West. In several western river basins, however, Recovery Implementation Programs (RIPs) provide an alternative, collaborative approach to ESA compliance. These programs offer an enhanced role for states and stakeholders in ESA decisionmaking, and increased certainty that ESA requirements will not disrupt ongoing water project operations and established uses. This Article examines the origins, purposes, and elements of various RIPs, with particular emphasis on these programs' approach to compliance with the requirements of ESA section 7 for federal agency actions. The Article also considers …

Avoiding Jeopardy, Without The Questions: Recovery Implementation Plans For Endangered Species In Western River Basins, Reed D. Benson
Faculty Scholarship
This article addresses Recovery Implementation Programs (RIPs) for endangered species in the context of four western river basins where the U.S. Bureau of Reclamation (USBR) is a key water supplier and manager. Rather than focus in detail on any particular program, this article addresses these RIPs as a group, representing an alternative approach to Endangered Species Act (ESA) compliance that has taken root in the western water context. Part I of this article provides context, outlining federal and state roles regarding water resources in the West. Part II explains the requirements of the ESA, focusing on federal agency obligations under …
Visual Jurisprudence, Richard Sherwin
Visual Jurisprudence, Richard Sherwin
Articles & Chapters
Lawyers, judges, and jurors face a vast array of visual evidence and visual argument inside the contemporary courtroom. From videos documenting crimes and accidents to computer displays of their digital simulation, increasingly, the search for fact-based justice is becoming an offshoot of visual meaning making. But when law migrates to the screen it lives there as other images do, motivating belief and judgment on the basis of visual delight and unconscious fantasies and desires as well as actualities. Law as image also shares broader cultural anxieties concerning not only the truth of the image, but also the mimetic capacity itself, …

Opening PandoraʼS Stream: Piping Music Into The Information Literacy Classroom, Kathleen Langan, Dianna E. Sachs
University Libraries Faculty & Staff Publications
Although it is well known that music can affect cognitive processes, little research has been conducted examining the influence of background music on students in information literacy classrooms. In 2010, librarians at Western Michigan University investigated the effect of background music on student engagement and retention of information literacy concepts. This article examines the theory and practical applications of background music to improve a classroom atmosphere and its impact on students’ learning. Results from this qualitative and quantitative study indicate positive correlations between background music and student comfort, confidence, and retention. DOI: 10.1080/15228959.2013.785876

The importance of information literacy (IL) at the college level is well documented. Like many other institutions, Western Michigan University (WMU) has come to recognize the value of IL, after years of deliberate and steady promotion of its benefits to the WMU community by the University Libraries. A crucial question that has emerged as part of the Libraries’ strategic plan to meet the University’s IL needs is this: What are the best ways to deliver library instruction to address the needs of today’s students and faculty, keeping in mind emerging and changing technologies to which faculty and students relate?

Scripting Therapeutic Screen Stories : Animating The Healing Potential Of Film Narratives, Andrew Levett
Scripting Therapeutic Screen Stories : Animating The Healing Potential Of Film Narratives, Andrew Levett
Theses : Honours
Beyond entertainment, animated narratives can potentially induce psychological healing, termed “individuation.” Stories exist in many forms, like literature, film and conversation, as well as in the human mind, or “psyche.” These “self-narratives” use life experience to shape consciousness. Therefore, effective storytelling based on archetypal myths can restructure the psyche. Film narratives communicate meaning through symbols, termed “textual cues”, while screenwriters employ specific templates, which organise story information into familiar structures. These guide audiences towards predetermined meaning. Through bibliotherapy, which is the use of literature for therapeutic purposes, audiences project their unconscious content onto narrative components that resonate with it. Ego-consciousness …
Exploring Wellbeing In Older Male Farmers In Western Australia, Jessica L. Mckee
Exploring Wellbeing In Older Male Farmers In Western Australia, Jessica L. Mckee
Theses : Honours
In the context of an ageing population it has become increasingly important to identify the determinants of wellbeing in older adulthood. A review of the literature relevant to wellbeing and strengths relevant to older male farmers in Australia was conducted. This body of knowledge was identified to be sparse. Existing literature on farming primarily had a deficits focus, and only a small number of qualitative studies were specific to older male farmers. Four broad, overlapping areas representing the meaning of wellbeing were identified as potentially important: farming work; connectedness; the land; health and wellbeing. The inter-connected nature of farming life …

Water Matters!
While many of the water issues in New Mexico center around having an adequate supply of water, the quality of the water is just as important as the quantity in supplying water for drinking and other uses that rely on clean water. Protecting water quality is financially more feasible than conducting expensive cleanup programs. New Mexico has a strong interest in water quality regulation to protect public health and the environment and to minimize expenditures for mitigation of contaminated supplies. Water quality is a difficult subject to navigate; there is a complex web of statutes and agency involvement. This paper …

Multiple sclerosis (MS) is an inflammatory demyelinating disease of the human central nervous system (CNS). Neurotropic demyelinating strain of MHV (MHV-A59 or its isogenic recombinant strain RSA59) induces MS-like disease in mice mediated by microglia, along with a small population of T cells. The mechanism of demyelination is at least in part due to microglia-mediated myelin stripping, with some direct axonal injury. Immunization with myelin oligodendrocyte glycoprotein (MOG) induces experimental autoimmune encephalomyelitis (EAE), a mainly CD4(+) T-cell-mediated disease, although CD8(+) T cells may play a significant role in demyelination. It is possible that both autoimmune and nonimmune mechanisms such as …

New findings: • What is the central question of this study? How does parental exercise training directly and/or transgenerationally affect offspring phenotypes over two generations of mice? • What is the main finding and what is its importance? We observed preliminary evidence that parental exercise training can influence health-related phenotypes (e.g. body and fat mass, muscle gene expression) in mouse offspring. These findings indicate that parental exercise may be another environmental factor (like altered nutrition) capable of influencing offspring phenotypes in adulthood. Early life and preconception environmental stimuli can affect adult health-related phenotypes. Exercise training is an environmental stimulus affecting …
Evaluation Of The Live Release Rate Formula & Implementation: Example Analysis Of The Effects Of Mandatory Spay/Neuter Laws On Intake At Shelters Within Dallas, Tx, Amanda Laskoe
MPA/MPP/MPFM Capstone Projects
It is estimated that shelters spend $1 billion annually dealing with unwanted animals (Frank & Carlisle-Frank, 2007). Approximately six to eight million cats and dogs enter U.S. shelters each year, and three to four million of these animals are then euthanized (HSUS, 2009). These are staggering statistics, yet in the early nineties, euthanasia estimates ranged from seven to seventeen million dogs/cats annually (Frank & Carlisle-Frank, 2011). Such improvements have resulted from a greater understanding of, and resources being dedicated to, the issue. Unfortunately, the rate of decline for euthanasia has slowed because programs have not been accurately targeted toward animal …

Unrelated Business Income's Impact On Direct Public Support In The Nonprofit Sector, Kelsey Lewis
MPA/MPP/MPFM Capstone Projects
Nonprofits today are losing their traditional funding sources for a variety of reasons and are turning to nontraditional ways of finding resources to make sure their organization is able to sustain itself while still meeting its mission. One common non-traditional approach is engaging in unrelated business income activities. Since these activities are not related to a nonprofit’s mission they are subject to taxation. Some question whether these activities help a nonprofit organization meet its mission.
A nonprofit seen not fulfilling its mission can be detrimental to that organization especially where its donors are concerned. If a donor does not support …
Optimal Asylum, Shalini B. Ray
Optimal Asylum, Shalini B. Ray
Vanderbilt Journal of Transnational Law
The U.S. asylum system is noble but flawed. Scholars have long recognized that asylum is a "scarce" political resource, but U.S. law persists in distributing access to asylum based on an asylum seeker's ability to circumvent migration controls rather than the strength of the asylum seeker's claim for protection. To apply for asylum, an asylum seeker must either arrange to be smuggled into the United States or lie to the consulate while abroad to obtain a nonimmigrant visa. Nonimmigrant visa requirements effectively filter the pool of asylum applicants according to wealth, educational attainment, and intent not to remain in the …

Biology
Theodosius Dobzhansky famously proclaimed that “nothing makes sense in biology except in the light of evolution." Though Dobzhansky's statement is sometimes dismissed by biologists in other fields as self-promotion, recent advances in many areas of biology have shown it to be prophetic. For example, genomics, which emerged mostly from molecular biology, is now steeped in evolutionary biology. Evolutionary theory helps to explain our origins, our history, and how we function as organisms and interact with other life forms, all of which are crucial to understanding our future (e.g., [1]–[5]). Evolutionary approaches have helped reconstruct the history of …
Thermal Selection In Sceloporus Occidentalis During Exercise Recovery, Morgan A. Halley
Thermal Selection In Sceloporus Occidentalis During Exercise Recovery, Morgan A. Halley
Scripps Senior Theses
Ectotherms regulate body temperature (Tb) primarily through behavioral interactions with their environment. These animals also have limited aerobic scopes and must rely on anaerobic metabolism to support intense activity; lactate byproduct and glycogen depletion are two consequences of anaerobic metabolism that must be dealt with during exercise recovery. It has been suggested that, in many ectothermic species, Tb may affect the rate of lactate clearance and glycogen repletion during recovery from intense exercise. This study investigated thermoregulatory behavior in Western Fence Lizards (Sceloporus occidentalis) to determine preferred Tb during exercise recovery. I hypothesized that …

Butylated Hydroxyanisole, BHA, and Butylated Hydroxytoluene, BHT, are commonly used as preservatives for our food as well as additives in many products such as cosmetics, petroleum, and medicine. Although their use has been approved by the Food and Drug Administration (FDA), there have been controversies and debates on whether these phenol derivatives or antioxidants are safe to use. Their accumulative toxicology and side effects need to be thoroughly investigated as we continue to consume them on a daily basis. Data obtained by genomic analysis in Tang lab suggested the involvement of DNA damage checkpoint/repair pathways in the response network to …
Through The Bottom Of A Drinking Glass: How Beer And Brewing Changed Human History, Matthew Bougher
Through The Bottom Of A Drinking Glass: How Beer And Brewing Changed Human History, Matthew Bougher
Master of Liberal Studies Theses
Abstract Every corner of the earth is either currently influenced by or has been influenced by the beer and brewing industry. The significance of this product throughout human history is extensive and one would think the study of it would reflect this. However, until recently the study of beer and brewing was mostly historical and archeological in nature. The social, personal lives and economic impact of those who either consume or produce beer were largely overlooked. This look into how beer and brewing changed cultures and the life of everyone from the king to the peasant is of great importance …
Insects In The World Of Fiction, Erin Bauer
Insects In The World Of Fiction, Erin Bauer
Department of Entomology: Faculty Publications
Since early childhood, I have had a passion for two things: books and insects. While working on master’s degrees in library science and entomology, I’ve had the unique opportunity to combine these fields. My library background led to an interest in bibliographical information, and thus, as part of my master’s program in entomology at the University of Nebraska–Lincoln, I chose to research and compile a list of fictional works (published/produced in the United States, 1950–2012) about or including insects, spiders, related arthropods, and/or entomologists as main characters.
Although there are numerous small bibliographies about insects, a full list seems to …

Aquatic Macroinvertebrate Communities And Water Quality At Buffered And Non-Buffered Wetland Sites On Federal Waterfowl Production Areas In The Rainwater Basin, Nebraska, John R. Riens, Matt S. Schwarz, Fatima Mustafa, William Wyatt Hoback
Department of Entomology: Faculty Publications
Nebraska’s Rainwater Basin has an abundance of natural wetlands and is a focal point in the annual migration corridor used by millions of waterfowl and shorebirds. However, these wetlands are in a landscape dominated by agriculture and as a result, siltation and poor water quality are continual problems. We evaluated twelve wetland sites on federally managed Waterfowl Protection Areas from 2007 – 2009 for water quality, sediment quality, andmacroinvertebrate diversity. Six of the sites received agricultural runoff directly via culverts and drainage ditches (non-buffered sites) and six siteswere protected from agricultural runoff by a vegetated buffer (buffered sites). Mean total …

RNA interference (RNAi), the sequence-specific suppression of gene expression, offers great opportunities for insect science, especially to analyze gene function, manage pest populations, and reduce disease pathogens. The accumulating body of literature on insect RNAi has revealed that the efficiency of RNAi varies between different species, the mode of RNAi delivery, and the genes being targeted. There is also variation in the duration of transcript suppression. At present, we have a limited capacity to predict the ideal experimental strategy for RNAi of a particular gene/insect because of our incomplete understanding of whether and how the RNAi signal is amplified and …

Motivation In Athletes With And Without Autism Spectrum Disorder: Sq, Eq And Aq Relationships To Preferred Feedback, Julia C. Harreschou
Scripps Senior Theses
All athletes are driven by motivation, sources or reasons to push their bodies to their limits and continue to do so regularly. There have been several studies concerning motivation in typical athletes, and many regarding social motivation in people with High Functioning Autism (HFA), however most have been limited to children, and there have been no investigations into HFA athletes’ motivation. The current study looks into the role of social dimensions in athletics, and tests how one’s gender and placement on the Empathy Questionnaire (EQ), Systemizing Questionnaire (SQ), and on the Autism Questionnaire (AQ) affect intrinsic motivation in athletics. It …

Spanish-English code-switching is a prevalent and significant form of communication in bilingual and bicultural communities. Authors who wish to reflect and validate cultural and linguistic diversity in their written works may incorporate code-switching in their texts. The purpose of this study is to explore the growing trend of the inclusion of the Spanish language in English-based books written for children in the United States. In order to better understand how code-switching is utilized by authors of varying Spanish language proficiency, fourteen non-native Spanish speakers were surveyed and seventeen examples of their children's books that include Spanish-English code-switching were analyzed in …

Aboriginal Title In Canada: Site-Specific Or Territorial?, Kent Mcneil
All Papers
This paper addresses the issue of Aboriginal title to land, and the relationship I see between Indigenous law and the common law in this context. In my understanding, there have been three judicial approaches to Aboriginal title: 1. A purely proprietary approach, based on occupation of land and the effect given to occupation by the common law (common law Aboriginal title). 2. An Indigenous law approach, whereby Aboriginal title arises from and is defined by pre-existing Indigenous law (Indigenous law title). 3. A territorial approach, whereby Aboriginal title is derived from both common law and Indigenous law and has governmental …

What Determines The Market Success Of A Nanofood Innovation?, Emie Yiannaka
Cornhusker Economics
If you are not quite sure what a nanofood is, you are not alone. The majority of the public in the United States is still uninformed about nanotechnology and its applications to the food sector. According to a commonly used definition, a nanofood is food that has been cultivated, produced, processed or packaged using nanotechnology techniques/tools or to which engineered nanomaterials have been added (Sekhon 2010).1 Food nanotechnology has the potential to increase the supply, quality and safety of food. Applications include the use of nanosensors for monitoring crop growth, pest control and plant and animal diseases; additives and ingredients …

Nebraska farmers and ranchers are concerned regarding meeting the May 10, 2013 deadline for preparing (but not submitting) Oil Spill Prevention, Control and Countermeasure (SPCC) plans. This newsletter discusses the SPCC program requirements for ag producers, explains the SPCC self-certification option and discusses SPCC implementation realities. Importantly, the Environmental Protection Agency (EPA) cannot legally enforce SPCC requirements against farms until September 30, 2013. EPA enforcement is likely to occur only if a “significant” (my word) oil products spill has occurred (a single spill of more than 1,000 gallons or two spills, each totaling more than 42 gallons within 12 months). …

Biofuel Policy And Drought Impacts On The U.S. Grain And Livestock Markets, Sunil P. Dhoubhadel, Azzeddine Azzam, Matthew C. Stockton
Cornhusker Economics
With the rapid increase in the production of biofuels in the United States, especially corn based ethanol, the ethanol industry has emerged as the livestock and poultry industry’s largest single competitor for corn, the predominant source of feed for cattle, hogs and poultry. As a consequence of this competition, corn prices have dramatically increased. Higher corn prices affect profitability of the livestock and poultry enterprises, as 60 to 70 percent of their variable costs are feed costs. Ethanol production, however, also has a positive effect on livestock production in the form of distiller grains (DG). DG is a by-product of …
