Impairment As Protected Status: A New Universality For Disability Rights, Michelle A. Travis

This Article analyzes the fundamental change to federal
civil rights law that Congress accomplished through the
ADA Amendments Act of 2008 (the ADAAA). Congress
enacted the ADAAA in response to a series of United States
Supreme Court opinions that had narrowly interpreted the
definition of disability in the Americans with Disabilities
Act of 1990. Although many commentators have
recognized the ADAAA's intent to restore the class of
individuals with disabilities to the breadth that Congress
originally intended, this Article argues that the ADAAA
accomplished something more significant: it extricated
disability from the broader concept of impairment. As a

differential treatment, our judgments often seem to depend
on how to conduct in question is described. For example,
legal prohibitions on same-sex marriage seem clearly
impermissible insofar as they can be described as a form of

Sandwiched between the account of Saul’s conversion in Acts 9 and Peter’s vision of the Gentiles in Acts 10 is the story of the raising of Tabitha. While staying in the town of Lydda, Peter, the presiding disciple of Christ, is approached by two individuals from the neighboring city of Joppa with the request that he come and attend to the then-deceased Tabitha. When he gets there, he is met by widows weeping and wailing over Tabitha’s departure. Computer-based modeling and simulation has been a training staple in the military domain since the first aircraft simulators were adopted. More recently, virtual environments based on modeling, simulation and serious games, have introduced relatively low-cost, yet high value additions to the learning environment. As these virtual environments have proliferated, many researchers have investigated the relationship between theoretical foundations of learning, learner development and content delivery, and applied their findings in an attempt to bolster learning, yet performance deficiencies continue to exist. This study asserts that performance deficiencies exist in part because of insufficient contextually appropriate opportunities to practice.

The first essay is entitled: "CEO Overconfidence, Corporate Governance Practices and Firm Innovation". In this study, I examine if overconfident CEOs overinvest or underinvest in innovative projects. I also investigate if overconfident CEOs pursue innovative projects to benefit personal interests or the interest of shareholders. By focusing on the effect of corporate governance in monitoring the behavior of overconfident CEOs, my results show that there is a negative relation between CEO overconfidence and firm innovation among firms with poor governance. Within literature there are two opposing views regarding the role of emotions in the creative process. The most commonly held view contends that positive emotions enhance creativity, while negative emotions stifle it; yet, some studies show an opposite trend. To help resolve this conundrum, this research examined the mediating effect of attention on the relationship between mood and creativity. The results showed that positive deactivating and negative activating emotions led to broader attention, while positive activating and negative deactivating emotions caused narrowing of attention. The dark ocean is vast, high in pressure, cold, and scarce in resources, but has been shown to support a diverse and active microbial community wherever it is studied. Such studies, however, are scarce due to the difficulty of sampling at such depths, and are difficult to interpret due to compounding effects of pressure and temperature on physiology. Protists, functionally defined as the microbial portion of the domain Eukarya, are particularly neglected in studies of deep-sea microbiology. Forgiveness And Relationship Satisfaction: Mediating Mechanisms, Scott R. Braithwaite, Edward A. Selby, Frank D. Fincham

Although the ability to forgive transgressions has been linked to overall relationship satisfaction, the mechanisms that mediate this association have not been established. We propose that the tendency to forgive a romantic partner increases relationship satisfaction via increased relational effort and decreased negative conflict. In two studies, we used structural equations modeling to examine these variables as potential mechanisms that drive this association. In Study 1 (N = 523) and Study 2 (N = 446) we found that these variables significantly mediated the association between forgiveness and relationship satisfaction. Alcohol misuse increases risk of suicidal behavior in older adults. TheDepressive Symptom Inventory-Suicidality Subscale (DSI-SS; Metalsky & Joiner,1997) and its relation to suicide attempt history was examined to see if it differedfor older adults as a function of their alcohol use. Structural equation modelingwas used in a sample (N= 1,061) of older adult outpatients to examine the scale’smeasurement invariance and population heterogeneity and its relation to suicideattempt history. Analyses supported the equivalence of the DSI-SS in risky andnonrisky drinkers. The DSI-SS significantly predicted past suicide attempts. Find-ings support the viability of the DSI-SS as suicide screening tool for older adults.

Close relationships have been linked to cardiovascular morbidity and mortality. More research is needed, however, on the social and biological processes responsible for such links. In this study, we examined the role of relationship-based attitudinal processes (i.e., attitude familiarity and partner importance) on ambulatory blood pressure during daily life. Forty-seven married couples completed a questionnaire regarding their own attitudes, perceptions of their partner’s attitudes, and perceptions of partner importance. They also underwent a 1-day ambulatory assessments of daily spousal interactions and blood pressure. Partner importance was related to better interpersonal functioning (e.g., partner responsiveness) and lower ambulatory systolic blood pressure. …

The purpose of this study was to investigate the effects of strategic conflict-related adjustments in cognitive control processes on indices of performance monitoring. Previous research has examined the ability of parametric task-related manipulations to bias attention to errors; however, the present study sought to elucidate the effects of internal adjustments in control mediated by the anterior cingulate cortex on error-related conflict processing. High-density event-related potentials (ERPs) were obtained from 124 healthy individuals (68 female, 66 male) during a modified Eriksen flanker task. Purpose: This paper examines how scholarly research on corporate branding has evolved using bibliometric author co-citation analysis of articles published between 1969 and 2008 on corporate branding.

Design/methodology/approach: The bibliography was compiled using the ISI Web of Science database. We searched articles published between 1969 and 2008 that used terms in their title related to our research scope. Then we used citation mapping to visualize the relationships between and among key works in the field.

Slang lexemes and swearwords are commonly discussed in conjunction with each other as though they were slightly different versions of the same phenomenon. However, they clearly are not, as a careful consideration of their different prototypical functions reveals. Each of these lexical categories has a central or core function, and in each case this function is linked to the obligatory expression of affect. The primary objective of most trade agreements is to restrain members' use of trade policies for protectionist purposes. But it would be pointless to restrict the application of border instruments without regulating the possible use of domestic policies for protectionist purpose. To this end, most agreements include an obligation for National Treatment (NT) of foreign products. The NT provision in the GATT appears in Art. III, which applies to most government actions that have impact trade. It requires that imported products be treated as favorably by domestic policy as similar, indigenous products. Manual annotation of large textual corpora can be cost-prohibitive, especially for rare and under-resourced languages. One potential solution is pre-annotation: asking human annotators to correct sentences that have already been annotated, usually by a machine. Another potential solution is correction propagation: using annotator corrections to dynamically improve to the remaining pre-annotations within the current sentence. The research presented in this paper employs a controlled user study to discover under what conditions these two machine-assisted annotation techniques are effective in increasing annotator speed and accuracy and thereby reducing the cost for the task of morphologically annotating texts written in classical Syriac. …

Elicited imitation (EI) is a testing method for learners’ oral language proficiency. One common criticism aimed at EI is that performance might not require linguistic knowledge, but mere rote memorization. This study explores the issue by administering two tests to the same group of students studying English as a second language: (1) a working memory test, and (2) an English EI test. Participants came from a range of English language proficiency levels. This paper investigates using Perlin Noise in a three-dimensional environment. Perlin Noise has been previously used to simulate clouds, marble, wood, and other natural phenomena as well as to model virtual landscapes. The simulation created for the I.S. procedurally generates both static and animated textures and models virtual landscapes to create a virtual world. In order to keep up with the rapidly advancing graphics industry, the OpenGL API is utilized to generate the textures in real-time and to display the final product.

This essay concerns religious reasons: how these compare with public reasons, and their appropriate place in the politics and law of the United States. Although I focus primarily on arguments about what this place should be, sound normative answers about these questions are closely connected to certain descriptive facts and estimates about what does happen and what is possible.

While user acceptance and adoption of mobile applications have received growing interest from IS researchers, only a paucity of studies have focused on user continuance behaviors in the mobile commerce context. Studying the IS continuance behavior of 147 registered users of an information-oriented mobile application, this research extends the general model of IS continuance to include a number of explanatory antecedents: information quality, system quality, process quality, and hedonic value.
