Licensed To Share: How Libraries Are Handling Electronic Journal Article Requests, Karen Okamoto

Publications and Research

This questionnaire-based study examines how libraries are now handling electronic journal (e-journal) article requests in both lending and borrowing. With an increasing number of publishers and e-journal content providers permitting interlibrary loan (ILL) sharing, and with the availability of new license management tools and services, many respondents stated that they share e-journal articles. However, problems persist. Respondents cited is- sues such as restrictive licenses, automatic deflection of e-journal article requests, and the lack of information from libraries about what e-journal titles they are licensed to ILL.

A Kitchen Of One's Own: The Paradox Of Dione Lucas, Kathleen Collins Jan 2012

A Kitchen Of One's Own: The Paradox Of Dione Lucas, Kathleen Collins

Publications and Research

First appearing on the air in 1947, Dione Lucas was one of the earliest television cooking-show hosts. As a business owner, single mother, influential salesperson, and highly respected professional in her field (Julia Child referred to Lucas as “the mother of French cooking in America”), Lucas was a pioneer and potentially powerful role model. Given this profile, however, she was an anachronism and out of sync with the majority of contemporary women and home cooks. She was likewise out of sync with her television peers, as most homemaking programs were hosted by home economists and were contexts wherein thrift and …

Program Evaluation Of A Dropout-Prevention Academy, Kendra W. Harvin Green

Abraham S. Fischler College of Education ETD Archive

This applied dissertation study evaluated a dropout-prevention program in a South Carolina school district. The dropout problem was identified by school and district administrators and discussed at county board meetings among community members, faculty, and parents of children attending school in the district. A dropout-prevention program was implemented 3 years prior but, had never been evaluated.

The purpose of this study was to evaluate the Dropout-Prevention Academy program. The study determined how the program design matched effective dropout-prevention programs described in the literature; stakeholders’ (e.g., teachers, administrators, and parents) perceptions of the program; and any changes that occurred in student …

Batson "Blame" And Its Implications For Equal Protection Analysis, Robin Charlow Jan 2012

Batson "Blame" And Its Implications For Equal Protection Analysis, Robin Charlow

Hofstra Law Faculty Scholarship

Twenty-five years ago Batson v. Kentucky held that equal protection is violated when attorneys exercise racially discriminatory peremptory jury challenges and supply pretextual explanations for their strikes. Findings of Batson violations are tantamount to rulings that attorneys have discriminated and lied. Not only do Batson findings potentially subject violators to sanction under standards of professional ethics, but they also amount to imputations of personal fault or “blame” for socially undesirable conduct. This article explores, from both practical and theoretical perspectives, the problem of the attribution of personal fault to attorneys that is inherent in a finding of a Batson violation. …

Novice Principals’ Perceptions Of Effective Leadership Practices And Their Principal Preparation Programs, Melissa Y. Wilson Jan 2012

Novice Principals’ Perceptions Of Effective Leadership Practices And Their Principal Preparation Programs, Melissa Y. Wilson

Theses and Dissertations

The purpose of this study was to examine novice principals’ perceptions of effective leadership practices and the elements of their principal preparation program that prepared them for the role of school leader. A mixed-methods study was utilized by the researcher to gather quantitative data through the use of an online survey and to gather qualitative data through subsequent focus-group interviews to address the proposal’s three research questions: (a) What are the differences (if any) between the perceptions of novice elementary, middle, and high school principals regarding the five instructional leadership practices identified by Kouzes and Posner (2003; i.e., challenging the …

Teacher Retention: What Motivates Highly Qualified Urban Teachers To Stay?, Orlando B. Milligan Jan 2012

Teacher Retention: What Motivates Highly Qualified Urban Teachers To Stay?, Orlando B. Milligan

Theses and Dissertations

This applied dissertation was designed to provide insight into what motivates highly qualified teachers to remain in urban schools. Research has shown that the single most important factor in a child’s education is the teacher. Consequently, the issues related to teacher recruitment and retention rank as serious problems facing urban schools and the achievement of their children.

The purpose of this study was to examine what motivates highly qualified teachers to remain in urban schools and to identify factors that may contribute to the retention and recruitment of an urban teaching corps. This study also sought to determine if there …

The Sexual Socialization Of Sexual Offenders: How They Learn About Sexuality And How It Influences Their Future Behaviors, Erin Nicole Ditscheit Jan 2012

The Sexual Socialization Of Sexual Offenders: How They Learn About Sexuality And How It Influences Their Future Behaviors, Erin Nicole Ditscheit

Dissertations and Theses @ UNI

Every day, stories of individuals who have been sexually victimized dominate headline news. Despite the large amount of research conducted on sexual offenders, there is no known single etiology for their offense. This study investigates how sexual socialization plays a role in an offender's sexual attitudes and beliefs. Using data from a sample of 71 convicted sexual offenders from a single district in the Midwest, it was found that there is a relationship between certain media sources and negative attitudes towards women and sexuality. Additionally, by comparing the convicting offense of each of the participants and their attitudes, it was …

Abused Women Who Kill: Juror Perspectives On Self-Defense Theories, Shahrzad Nikoo Jan 2012

Abused Women Who Kill: Juror Perspectives On Self-Defense Theories, Shahrzad Nikoo

CMC Senior Theses

In self-defense cases of battered women who kill their abusive husbands, defendants have used Battered Woman Syndrome (BWS) expert testimony to help justify their acts of self-defense. However, past research demonstrates that BWS is ineffective in persuading jurors because it pathologizes the defendant rather than rationalizing her behavior. Additionally, BWS highlights passive (i.e., stereotypical) features of a battered woman, and such testimony may not apply to a defendant with active (i.e., atypical) features of a battered women. The current study hypothesized that another type of expert testimony, Social-Agency Framework (SAF), will persuade jurors to render more lenient verdicts, and that …

The Problem Of Convicting Innocent Persons: How Often Does It Occur And How Can It Be Prevented?, Leon Friedman Jan 2012

The Problem Of Convicting Innocent Persons: How Often Does It Occur And How Can It Be Prevented?, Leon Friedman

Hofstra Law Faculty Scholarship

In order to determine the number of innocent persons convicted and the severity of the problem that exists, it is necessary to examine the statistics. As indicated below, an often-quoted figure representing the number of wrongly persons convicted is about 0.5% of all criminal cases, or 30,000, which is not an insignificant number. Some modest changes in the system, particularly furnishing defendants with more exculpatory evidence at the outset, might make a significant change in that number.

The article focuses on the rate of false conviction of innocent people in the U.S. and highlights the steps to be taken to …

Prosecutors And Peremptories, Alafair S. Burke Jan 2012

Prosecutors And Peremptories, Alafair S. Burke

Hofstra Law Faculty Scholarship

A quarter of a century after the Court’s decision in Batson v. Kentucky, overwhelming evidence demonstrates that lawyers continue to exercise peremptory challenges in racialized ways. In light of Batson’s failure to alter a stubborn pattern of using peremptory challenges in racialized ways, scholars have repeatedly called for the abolishment of peremptory challenges, changes to the Batson framework, modifications to the rules of professional responsibility, and increased disciplinary enforcement and sanctions against those who discriminate during jury selection. The focus of much of the current Batson scholarship assumes that lawyers will inevitably consider race during jury selection and that the …

The Community Prosecutor: Questions Of Professional Discretion, Bruce A. Green, Alafair Burke Jan 2012

The Community Prosecutor: Questions Of Professional Discretion, Bruce A. Green, Alafair Burke

Hofstra Law Faculty Scholarship

This Article examines community prosecuting from an ethics perspective. Our focus is not on prosecutors’ compliance with the disciplinary rules, however. The strategies that have been said to exemplify community prosecuting are almost invariably compliant with disciplinary rules and other aspects of the law governing prosecutors. Rather, we take a broader perspective. Our focus is on how prosecutors exercise discretion in the context of adopting community prosecution strategies. We examine this question from both normative and procedural perspectives. We propose that the addition of community-based defense lawyers could help mitigate concerns about prosecutorial discretion in community justice programs by broadening …

Several legal cases are addressed, including the U.S. Supreme Court case Cullen v. Pinholster which deals with Section 2254(d)(I) of the nation's Antiterrorism and Effective Death Penalty Act of 1996.

Learning Lessons From The Past: Legal Issues Arising From Ireland's Child Abuse Reports, Ursula Kilkelly Jan 2012

Learning Lessons From The Past: Legal Issues Arising From Ireland's Child Abuse Reports, Ursula Kilkelly

Irish Journal of Applied Social Studies

Inquiries have played an important role in telling the stories of children abused and neglected in Ireland in situations of family abuse, clerical abuse and institutional abuse. The inquiries – associated with the name of the chairperson (Ryan) or by their geographical remit (Dublin, Ferns, Cloyne, Kilkenny and Roscommon) – serve to vindicate the rights of the children affected and to identify the failure of the authorities to protect children from harm. They also make numerous recommendations as to how children’s treatment can be improved. Although each inquiry had varying terms of reference, scope and status, together they address a …

Gendered Processes In Child Protection: 'Mother-Blaming' And The Erosion Of Men's Accountability, Majella Mulkeen Jan 2012

Gendered Processes In Child Protection: 'Mother-Blaming' And The Erosion Of Men's Accountability, Majella Mulkeen

Irish Journal of Applied Social Studies

The Inquiry Report of the Roscommon Child Care Case (HSE, 2010) was the first Inquiry Report into intra-familial child abuse and neglect in the Irish context to explicitly identify a gender dimension to its findings. This paper seeks to build on these observations and argues that an analysis of the gendering processes that underlie understandings of and responses to neglect, violence and abuse can make child protection policy and practice more effective. The absence of an analysis which places gender at the core of policy and practice in child protection and family support raises serious questions about the differentiated responses …

Psychopathy And Victim-Type Related To Treatment Outcome For Civilly Committed Sexual Offenders, Ashley Helle Jan 2012

Psychopathy And Victim-Type Related To Treatment Outcome For Civilly Committed Sexual Offenders, Ashley Helle

Dissertations and Theses @ UNI

Previous research on sexual offender treatment has produced mixed results regarding effectiveness and recidivism rates of sexual offenders. The literature shows differences among categories of sexual offenders which suggest extrafamilial adult offenders (rapists) and offenders with both adult and child victims ten to be a bigger threat to society in comparison to familial offenders (incest) and extrafamilial child offenders ( child molesters). Extrafamilial adult offenders and mixed offenders have demonstrated higher levels of psychopathy. Seventy-four civilly committed sexual offenders participated in the current study by completing a psychopathy measure and retrieval of archival data. Fifty-five participants produced valid PPI-R profiles …

Role Strain In Probation And Parole Work And Strategies Used To Reduce Strain, Samantha A. Shoger Jan 2012

Role Strain In Probation And Parole Work And Strategies Used To Reduce Strain, Samantha A. Shoger

Dissertations and Theses @ UNI

Probation and parole officers play a vital role in the operation of the correctional system. As a part of their role work in community-based corrections, probation and parole officers must act as both a client monitor and treatment counselor to not only assist in client reentry, but also to protect the public. Due to the nature of probation and parole work and the historical changes that have affected their work (i.e. the punitive turn, the New Penology, and the current correctional budgetary constraints), probation and parole officers must cope with a variety of factors in their work that can cause …

Automated Human Screening For Detecting Concealed Knowledge, Nathan W. Twyman Jan 2012

Automated Human Screening For Detecting Concealed Knowledge, Nathan W. Twyman

Business and Information Technology Faculty Research & Creative Works

Screening individuals for concealed knowledge has traditionally been the purview of professional interrogators investigating a crime. But the ability to detect when a person is hiding important information would be of high value to many other fields and functions. This dissertation proposes design principles for and reports on an implementation and empirical evaluation of a non-invasive, automated system for human screening. The screening system design (termed an automated screening kiosk or ASK) is patterned after a standard interviewing method called the Concealed Information Test (CIT), which is built on theories explaining psychophysiological and behavioral effects of human orienting and defensive …

Exploring High Risk Youth's Hiv-Related Knowledge, Cognitions, Sexual Behavior, And Condom Use, Mollie Blair Anderson

Electronic Theses and Dissertations Archive

This cross-sectional study characterizes a group of high-risk youth's HIV knowledge (Brief HIV-KQ) and cognitions (maladaptive, coping appraisal, and adaptive cognitions), as well as aspects of their sexual behavior and condom use. Descriptive statistics and regressions were used to analyze archival data collected from 794 youth (46.3% male and 53.7% female) ages 16–24 (M = 18.66; SD = 1.95) who attended an educational and vocational training program in a large urban area of the Mid-South. Results indicate that these youth were twice as sexually active as the national average yet used condoms more frequently. There were gender and age differences …

Child Welfare And Delinquency: Examining Differences In First-Time Referrals Of Crossover Youth Within The Juvenile Justice System, Courtney Nicole Shrifter Jan 2012

Child Welfare And Delinquency: Examining Differences In First-Time Referrals Of Crossover Youth Within The Juvenile Justice System, Courtney Nicole Shrifter

Dissertations and Theses

The link between child welfare and juvenile justice is well established, with over forty years of research that focuses on the increased risk of delinquency associated with child maltreatment. However, with over 700,000 children in the United States being victims of abuse and/or neglect in 2010 (DHHS, 2011), it is important to continue investigating this connection. Few studies are able to identify the same youth in both systems, therefore this study provides the unique opportunity using child welfare and juvenile justice administrative data from Oregon, to compare juvenile offenders that have been in the child welfare system, otherwise known as …

Assessing Risk Of Violence In Caucasian And African-American Male Forensic Patients, Brandy Lynn Herriott Jan 2012

Assessing Risk Of Violence In Caucasian And African-American Male Forensic Patients, Brandy Lynn Herriott

All-Inclusive List of Electronic Theses and Dissertations

Violence risk assessment, or the ability to predict the likelihood of a criminal offender's to commit a violent act in the future, is an essential role of psychologists in the criminal justice system. One of the most widely used violence risk assessment instruments is the Violence Risk Appraisal Guide (VRAG). The Psychopathy Checklist-Revised (PCL-R) is the most widely used measure of psychopathy and is often used as part of violence risk assessment, including in the the VRAG. The PCL-R is lengthy and time-consuming process, which has led to the development of the Childhood and Adolescent Taxon Scale (CATS), which is …

Immigration, Politics, Social Discord And Criminality In Italy, Pietro Lorenzini Jan 2012

Immigration, Politics, Social Discord And Criminality In Italy, Pietro Lorenzini

All-Inclusive List of Electronic Theses and Dissertations

The initial studies concerned with immigration in modern Italy emerged in the 1970s. They provided basic statistical information regarding the national origins, gender, religious identity, and racial and ethnic make-up of the migrants. As such immigration studies were commonly written within the framework of human rights, they were politicized in ways which often unveiled the political slant of researchers. Italian studies which touched upon immigration's relationship to criminality similarly demonstrated that questions regarding crime and migration are intertwined with contemporary Italian politics. Thus published studies which analyze immigration, crime and imprisonment often reflect the political bias of the researchers. By …

The Relationship Between Cross-Media Usage And Brand Recall In Advertisements: A Test Of Customer Engagement With Print And Digital Magazine Advertisements, Gabriela Sosa Lamarche Jan 2012

The Relationship Between Cross-Media Usage And Brand Recall In Advertisements: A Test Of Customer Engagement With Print And Digital Magazine Advertisements, Gabriela Sosa Lamarche

Theses

This study investigated the effectiveness of advertising using a cross-media approach. A laboratory experiment with a randomized controlled trial and a sample of college students (N = 34) was used to test whether the level of involvement was higher for tablet or print advertisements. Subjects were divided into two groups: those who saw the advertisements in print and those who saw them on tablets. Contrary to expectations, brand recall and purchase intent were higher for those viewing print than for tablet advertisements, although respondents considered interactive advertisements more engaging. One explanation is that most of the participants were so immersed …

Mid West–Gascoyne District Police Officers’ Experience With The Cannabis Infringement Notice Scheme, Kara Wright Jan 2012

Mid West–Gascoyne District Police Officers’ Experience With The Cannabis Infringement Notice Scheme, Kara Wright

Theses: Doctorates and Masters

Cannabis is currently the most frequently used illicit drug in Australia. Research has revealed a range of health, economic, criminal and social consequences associated with the drug. The widespread use of cannabis and the consequences associated with its use has ignited strong political and social debate as to what response should be taken to minimise the harmful effects of the drug. In order to reduce the harms associated with cannabis, and in line with the national harm minimisation framework, the Western Australia (WA) Cannabis Infringement Notice (CIN) scheme commenced in 2004. The introduction of the CIN scheme as part of …
