Iron Bars Or Libraries: Which Will Reduce Crime More?, Kenneth Shepherd
Iron Bars Or Libraries: Which Will Reduce Crime More?, Kenneth Shepherd
Masters Theses
This study examines how government spending affects crime. Specifically, it is a longitudinal study of property crime in Illinois. The main model is: Property Crime = B1+B2(Deterrence spending)+B3(Other Social spending)+B4(Lagged Unemployment rate). Other Social Spending is Library spending, Hospital spending, and Higher Education spending by state and local governments in real per-capita form combined. Deterrence spending is the combined spending on police and corrections in real percapita form. The results from an OLS model on this equation showed Other Social spending was 50% more effective at reducing property crime than Deterrence spending. However, there was some multicollinearity and a time …

Player Safety In Youth Sports: Sportsmanship And Respect As An Injury Prevention Strategy, Douglas E. Abrams
Player Safety In Youth Sports: Sportsmanship And Respect As An Injury Prevention Strategy, Douglas E. Abrams
Faculty Publications
Preventing avoidable injury is the first obligation of adults who conduct and supervise youth sports events. The law plays only a limited role because lawsuits occur only after the injury. As the behavior of many parents and coaches has deteriorated, national youth sports governing bodies have produced materials that cast adults as role models and urge them to teach and practice sportsmanship and respect. These bodies should now recast these useful citizenship-based adult-education materials to stress also that adherence to sportsmanship and respect helps prevent injuries that can occur when adults acting irresponsibly neutralize national safety standards. Protective equipment is …

Confronting Coventurers: Coconspirator Hearsay, Sir Walter Raleigh, And The Sixth Amendment Confrontation Clause, Ben L. Trachtenberg
Faculty Publications
Using the example of a recent major terrorism prosecution, this article addresses “coventurer hearsay” in the context of the ongoing Confrontation Clause debate concerning the United States Supreme Court’s decision in Crawford v. Washington. Courts have recently begun admitting hearsay evidence pursuant to a revisionist interpretation of the coconspirator statement exception to the hearsay rule. Under the new “lawful joint venture” theory, a hearsay statement may be admitted as a coconspirator statement if made in furtherance of a “joint undertaking” - defined as pretty much any cooperative activity - even if the “conspiracy” is not illegal. Because this new interpretation …

Shaken Baby Syndrome As Felony Murder In North Carolina, Derick R. Vollrath
Shaken Baby Syndrome As Felony Murder In North Carolina, Derick R. Vollrath
Campbell Law Review
This Article argues that the North Carolina criminal law’s treatment of Shaken Baby Syndrome should be reformed. Rather than leaving in place a legal regime that allows the state to prosecute all Shaken Baby Syndrome cases as first-degree murder, the law should distinguish between accidental and purposeful killings. If the state wishes to punish Shaken Baby Syndrome cases with special severity, the General Assembly should make this policy choice explicit. In making this argument, this Article proceeds in three parts. First, this Article examines how and why North Carolina subjects all Shaken Baby Syndrome deaths to prosecution as first-degree murder. …

No Way To Treat Man's Best Friends: The Uncounted Injuries Of Animal Cruielty Victims, Samantha D. E. Tucker
No Way To Treat Man's Best Friends: The Uncounted Injuries Of Animal Cruielty Victims, Samantha D. E. Tucker
Animal Law Review
As society has come to recognize the sentience and intelligence of nonhuman animals, jurisdictions across the United States (U.S.) have promulgated animal protection laws. Despite the development of anti-cruelty statutes, though, states with sentence enhancement mechanisms continue to elevate criminal offenders’ sentences only if they injure human victims. This Note considers the development of anti-cruelty laws and explores how sentencing guidelines, victim injury points, and other sentence enhancement mechanisms function in U.S. criminal justice systems. It examines how multiple states treat victim injury, focusing particularly on Florida where, in October 2011, a Florida Assistant State Attorney—in what was likely the …

Underrepresentation Of Females In Academia: A Relative Rate Index And System Dynamics Model, Nupur Garg
Underrepresentation Of Females In Academia: A Relative Rate Index And System Dynamics Model, Nupur Garg
Yale Medicine Thesis Digital Library
Females continue to be significantly outnumbered by their male counterparts in the academic pipeline at the senior ranks. Confounding the problem is the inadequacy of tools used for measurement and analysis of it. A Relative Rate Index (RRI) is a better tool for measuring gender disparities of academic systems than calculating percentages of females in academia. An RRI determines the junctures and scales at which females fall out of the academic track. The RRIs for academic medicine departments at Yale were created using institutional records. Calculations indicate that the fallout for females in academia occurs from assistant to associate professor …

Restorative Practices: Graduate Students' Perspectives Seen Through A Transformative Learning Lens: A Dissertation, Craig W. Adamson
Educational Studies Dissertations
This dissertation explores students’ learning experiences in a newly accredited graduate school focused on Restorative Practices Theory, which enables people to restore and build community collectively. This exploration was conducted using a Transformative Adult Learning Theory lens in order to understand graduate students’ perspectives regarding their learning experiences. Data were gathered using a qualitative and quantitative mixed method concurrent nested strategy design (Creswell, 2003). Fifteen total participants at multiple phases of graduate study made up the sample, including both current students and alumni. Participants were involved in a semi-structured interview, submitted a previously completed course reflection paper and gave permission …

Power And Authority In The Student-Instructor Relationship In A Restorative Practices-Based Graduate Program, John W. Bailie
Educational Studies Dissertations
This study examined power and authority in the student–instructor relationship in a restorative practices–based graduate program. This qualitative investigation utilized a narrative approach. Ten alumni of the International Institute for Restorative Practices master’s degree programs were engaged in a one-time face-to-face interview and document review of their final master’s degree capstone papers. A listening guide voice-centered method was used as the primary data analysis method. This study found that participants used highly consistent language when describing the teachers and professors who were most meaningful to them, regardless of life stage. The second finding was that participants had meaningful personal experiences …

The author’s the sis is: (1) the criminal justice system is overflowing with social justice issues; (2) the most significant insight about the criminal justice system in the past 30 years is that criminal law raises equality values; (3) the Charter has had something …

From Smith To Smickle: The Charter’S Minimal Impact On Mandatory Minimum Sentences, Debra Parkes
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper attempts to assess the impact that the Canadian Charter of Rights and Freedoms has had, and may have in the near future, on mandatory minimum sentences and their proliferation in Canadian law. To answer those questions, the paper will first briefly review the Supreme Court case law on the constitutionality of mandatory minimum sentences. The next two sections will outline the approach taken in the recent Smickle decision, in which a mandatory minimum sentence was declared invalid under the Charter, and will argue that courts should subject the purported goals, justifications and impacts of mandatory minimum sentences to …
