((Re)Considering Race In The Desegregation Of Higher Education, Maurice C. Daniels, Cameron V. Patterson

Georgia Law Review

This Essay examines the struggle to desegregate the
University of Georgia (UGA) in the context of the broader
strategies to defeat segregation in higher education. In
doing so, this Essay explores Horace T. Ward's struggle to
enroll in UGA School of Law in Ward v. Regents, the first
lawsuit in Georgia history to attempt to dismantle the
centuries-old practice of segregation at UGA. The Essay
then examines the Holmes v. Danner case, which led to the
admission of the first African-American students at UGA
and the dismantling of segregation statewide in Georgia's
public colleges and universities.
Building upon this backdrop, …

Section 7 Of The Charter And The Principled Assignment Of Legislative Jurisdiction, Alana Klein Jan 2012

Section 7 Of The Charter And The Principled Assignment Of Legislative Jurisdiction, Alana Klein

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper argues that in deciding whether state action is arbitrary, overbroad or disproportionate, contrary to section 7 of the Canadian Charter of Rights and Freedoms, courts should look beyond the relationship between the means and ends of state action and toward broader considerations about the democratic context in which such action occurs. The case of Canada (Attorney General) v. PHS Community Services Society is taken as the paper’s starting point. The re, the Supreme Court of Canada overturned the federal Minister of Health’s decision to deny Insite — a provincially supported safe injection site — an exemption from drug …

Assessing The Impact Of The Ancillary Powers Doctrine On Three Decades Of Charter Jurisprudence, Vanessa Macdonnell

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper seeks to better understand the factors that may have led the Supreme Court of Canada to assume a role in articulating new police powers since the advent of the Charter in 1982. It also attempts to situate the Court’s ancillary powers cases within the context of a larger jurisprudential trend of balancing individual rights against “societal interests” outside of section 1 that has emerged in the Charter case law. The paper suggests that courts may be disposed to create new common law police powers because in some cases, the police have infringed the Charter rights of suspects in …

Sexual Assault Cases In The Supreme Court Of Canada: Losing Sight Of Substantive Equality?, Emma Cunliffe Jan 2012

Sexual Assault Cases In The Supreme Court Of Canada: Losing Sight Of Substantive Equality?, Emma Cunliffe

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The equality guarantee contained in section 15 of the Canadian Charter of Rights and Freedoms has prompted reforms that protect women as complainants in sexual assault cases. This paper considers the effectiveness of these reforms. Part II supplies a history of the relationships between consent, trial procedure and substantive equality in sexual assault law. I argue that substantive equality has had a significant effect on both substance and procedure. Part III examines the impact of these reforms by considering the extent to which substantive equality has infused judicial reasoning and fact determination in contested sexual assault cases. Specifically, I focus …

Playing Well With Others-But Still Winning: Chief Justice Roberts, Precedent, And The Possibilities Of A Multi-Member Court, William D. Araiza Jan 2012

Playing Well With Others-But Still Winning: Chief Justice Roberts, Precedent, And The Possibilities Of A Multi-Member Court, William D. Araiza

Georgia Law Review

This Essay considers methods by which a Supreme
Court Justice inclined to weaken precedent may do so
without explicitly overruling cases. Adding to the
literature examining "stealth overruling" and the

dynamics of multi-judge courts, it examines instances
from the first five years of the Roberts Court where Chief
Justice Roberts acted in a way consistent with that of a
judge who strategically situates himself among his
colleagues so as to erode precedent while appearing to
uphold it. The Essay does not speculate that the Roberts
Court, or Chief Justice Roberts himself, is any more
inclined than past Courts or Justices …

An Exploratory Study On Social Learning Theory, Social Bond Theory, Experiences With Police And Demographic Effects On College Student Attitudes Toward Police, Tyson Allen Mclean Jan 2012

An Exploratory Study On Social Learning Theory, Social Bond Theory, Experiences With Police And Demographic Effects On College Student Attitudes Toward Police, Tyson Allen Mclean

Graduate Student Theses, Dissertations, & Professional Papers

Research on public attitudes toward police is principally conducted through survey methods focused on analyzing the effects of experiences with police, satisfaction with police services and respondent demographics. Most research collects data from the general public, which overall reports high levels of satisfaction with the police. However, few studies focus on the college student population and fewer integrate theoretical frameworks to explore this complex issue. This research incorporates tenets from social learning and social control theories as a conceptual framework from which the analysis is built. It also explores the role that personal and vicarious contact and demographic influences play …

Marking The Woman A Sinner: Testimony And Legal Fiction In Renaissance England, Lesley Skousen Jan 2012

Marking The Woman A Sinner: Testimony And Legal Fiction In Renaissance England, Lesley Skousen

Quidditas

Throughout Medieval England, ordained clergy could avoid secular punishment for felony by claiming a privilege known as benefit of clergy. During the Reformation, this privilege was repurposed by the ministers of Henry VIII and offered as a lay benefit. The plea of clergy left women ineligible, as they could not be priests and were rarely convicted in the same numbers as men. Even when accused of crimes, women could rely on legal fictions and evasive testimonies to escape conviction. Then in 1624 and 1691, Parliament redesigned benefit of clergy to include women, first for slight theft and then on equal …

Equipping Our Lawyers: Mitchell's Outcomes-Based Approach To Legal Education, Gregory M. Duhl Jan 2012

Equipping Our Lawyers: Mitchell's Outcomes-Based Approach To Legal Education, Gregory M. Duhl

Faculty Scholarship

It is timely that the William Mitchell Law Review has decided to dedicate an issue to outcomes in legal education. As a long-time innovator in pedagogy, professional skills education, and experiential learning, William Mitchell has once again emerged as a leader in its outcomes-based approach to course and curricular design. Amid the current climate of uncertainty in legal education and the legal profession, and as a relative newcomer to Mitchell’s history, I believe in Mitchell’s future – tied to the past, but innovative and distinct. In this essay, I share our vision for increasing emphasis on outcomes, expanding experiential learning …

Play Fair With Recidivists, Richard Dagger Jan 2012

Play Fair With Recidivists, Richard Dagger

Political Science Faculty Publications

Retributivists thus face a difficult challenge. Either we must go against the social grain, and perhaps our own intuitions, by insisting that a criminal offense carry the same penalty or punishment no matter how many previous convictions an offender has accrued; or we must find a way to justify the recidivist premium. I shall take the second route here by arguing that recidivism itself is a kind of criminal offense. In developing this argument, I shall rely on Youngjae Lee's insightful analysis of "recidivism as omission." I shall complement his analysis, however, by grounding it in a conception of criminal …

Systemic Racial Bias And Rico's Application To Criminal Street And Prison Gangs, Jordan Blair Woods Jan 2012

Systemic Racial Bias And Rico's Application To Criminal Street And Prison Gangs, Jordan Blair Woods

Michigan Journal of Race and Law

This Article presents an empirical study of race and the application of the federal Racketeer Influenced and Corrupt Organizations Act (RICO) to criminal street and prison gangs. A strong majority (approximately 86%) of the prosecutions in the study involved gangs that were affiliated with one or more racial minority groups. All but one of the prosecuted White-affiliated gangs fell into three categories: international organized crime groups, outlaw motorcycle gangs, and White supremacist prison gangs. Some scholars and practitioners would explain these findings by contending that most criminal street gangs are comprised of racial minorities. This Article challenges and problematizes this …
