Today, the criticism of law schools has become an industry. Detractors argue that legal education fails to effectively prepare students for the practice of law, that it is too theoretical and detached from the profession, that it dehumanizes and alienates students, too expensive and inapt in helping students develop a sense of professional identity, professional values, and professionalism. In this sea of criticisms it is hard to see the forest from the trees. “There is so much wrong with legal education today,” writes one commentator, “that it is hard to know where to begin.” This article argues that any reform …
Ptsd And Substance Use Disorders Among Offenders: Examining The Effects Of Tbi, Gender And Interpersonal Violence Victimization, Monica E. Cornelius
Ptsd And Substance Use Disorders Among Offenders: Examining The Effects Of Tbi, Gender And Interpersonal Violence Victimization, Monica E. Cornelius
MUSC Theses and Dissertations
Offender populations have high rates of substance use disorders (SUDs) as well as violence, traumatic brain injury (TBI), and post traumatic stress disorder (PTSD). The lack of screening and treatment of co-occurring disorders has been cited as a major barrier to treating SUDs in offenders. A significant proportion of the offender population has at least one co-occurring disorder with their substance use. Often co-occurring disorders are related to SUDs. Evidence suggests that interpersonal violence victimization (IPVV), TBI, and PTSD are related to SUD and that PTSD alone may also contribute to criminality. The specific aims of this research are to: …

The Emerging Enforcement Practice Of The International Criminal Court, Hirad Abtahi, Steven Arrigg Koh
Cornell International Law Journal
The dual enforcement regime of the International Criminal Court constitutes a fundamental pillar of the Rome Statute of the International Criminal Court and represents a novel system within the history of international criminal law. This article is the first to focus on the emerging practice of the Court as it begins developing and implementing this unique enforcement regime. Drawing directly from the recent history within the Presidency and focusing on the current activities of the Trust Fund for Victims, this Article explains how, why, and in what direction the Court's enforcement practice is evolving.

Examining Cross-Cultural Counseling Competencies Of Substance Abuse Counselors In The Commonwealth Of Pennsylvania, Abdelhadi Elamin
Examining Cross-Cultural Counseling Competencies Of Substance Abuse Counselors In The Commonwealth Of Pennsylvania, Abdelhadi Elamin
Electronic Theses and Dissertations
With minority Americans expected to comprise more than 40% of the U.S population by 2035 and 47% by 2050 and substance abuse epidemic with 23.5 million nationwide in need for treatment, there is a growing need for cross-cultural counseling competence among substance abuse counselors. This study examined substance abuse counselors' level of cross-cultural counseling competence in the Commonwealth of Pennsylvania. The research method used was quantitative in nature. Substance abuse counselors were asked to self-assess their level of competence by completing a questionnaire and modified Cross-Cultural Counseling Inventory Revised (CCCI-R) subscales to determine whether counselor's gender, level of education, field …

The Patchwork Principle Against Self-Incrimination Under The Charter, Lisa Dufraimont
The Patchwork Principle Against Self-Incrimination Under The Charter, Lisa Dufraimont
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The principle against self-incrimination refers to the idea that an individual cannot be compelled to assist in her own prosecution. In the pre-Charter era, the view prevailed that no overarching principle against self-incrimination existed in Canadian law. While certain discrete legal rules were recognized as protecting suspects against compulsory self-incrimination, these rules were not thought to reflect or constitute any independent, functional legal principle. Since the advent of the Charter, however, an overarching principle against self-incrimination has been recognized as one of the principles of fundamental justice. This constitutional principle has come to be understood as undergirding a number of …
Police Questioning In The Charter Era: Adjudicative Versus Regulatory Rule-Making And The Problem Of False Confessions, Steven Penney
Police Questioning In The Charter Era: Adjudicative Versus Regulatory Rule-Making And The Problem Of False Confessions, Steven Penney
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
Unlike in the areas of detention and search, Parliament has played no role in regulating the questioning of adult criminal suspects by police. This paper examines the implications of this legislative silence. Critics of the courts’ use of the ancillary powers doctrine in the law of detention and search have argued that the optimal regulation of police investigative practices requires robust legislative input. I argue that the same is true of police questioning. But given the improbability that this will happen, I argue that appellate courts should adopt a more robustly “regulatory” (as opposed to “adjudicative”) approach to both the …
The Charter Balance Against Unscrupulous Law And Order Politics, Don Stuart
The Charter Balance Against Unscrupulous Law And Order Politics, Don Stuart
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
Part I of this paper documents the unscrupulous politics of the majority Harper Government in enacting Bill C-10, the Safe Streets and Communities Act, in the name of victims’ rights. The Government ignored the legion of advice from opposition members and from lawyers, correctional officials, criminologists and judges within and outside Canada that resort to greater use of imprisonment, and minimum penalties in particular, will be costly and will not make Canadians safer. Opponents also predicted that there would be a disproportionate impact on vulnerable communities. In Part II it is argued that entrenched Charter standards as asserted by our …
Looking Backward, Looking Forward: The Supreme Court Of Canada’S Decision In R. V. Ipeelee, Jonathan Rudin
Looking Backward, Looking Forward: The Supreme Court Of Canada’S Decision In R. V. Ipeelee, Jonathan Rudin
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The Supreme Court of Canada’s decision in March 2012 in R. v. Ipeelee confirmed that the Court remained committed to the principles it set out in the 1999 decision of R. v. Gladue with respect to addressing the causes of Aboriginal over-representation in prison through the sentencing process. The Court made it clear that the Gladue analysis must be carried out in every case regarding an Aboriginal offender regardless of severity and that it is not necessary for there to be a nexus between the circumstances of the particular offender and the offence itself. The Court also stated that: The …
The Brilliant Career Of Section 7 Of The Charter, Peter W. Hogg
The Brilliant Career Of Section 7 Of The Charter, Peter W. Hogg
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
Section 7 of the Charter of Rights was not intended by the framers to be a provision that authorized extensive judicial review of legislation. The protection of property was deliberately not included in its text in order to reduce its scope — and the potential for judicial review. and the phrase “the principles of fundamental justice” was intended to cover only procedural due process. Contrary to expectations in 1982, over the succeeding 30 years the Supreme Court of Canada has given an expansive interpretation to section 7 and used it to strike down a variety of laws, including the criminalization …
