At The Intersection Of Sovereignty And Contract: Traffic Cameras And The Privatization Of Law Enforcement Power, William Davenport Mercer
At The Intersection Of Sovereignty And Contract: Traffic Cameras And The Privatization Of Law Enforcement Power, William Davenport Mercer
Scholarly Works
Many municipalities are making critical errors in their attempts to alleviate current financial burdens by contracting with private entities to perform many of their essential functions, most notably those agreements with companies to install traffic cameras and, in many cases, to monitor and cite offenders. By subcontracting part of their exclusive power to enforce law, these municipalities essentially bargain away sovereignty by parting with portions of their inherent police power. As these cameras fill a role played by the state’s law enforcement personnel, municipalities impermissibly infringe on the actual sovereignty of the state as well as the conceptual sovereignty of …

Media Bias Toward The Colorado Springs Police Department: An Analysis Of The Existence Of Bias Through Three Eras Of Police Chiefs /, Jennifer Walden
Regis University Student Publications (comprehensive collection)
Research has been conducted for decades examining bias in the media, specifically toward targeted groups and organizations such as politicians and public agencies. The intention of this study is to examine written media news stories surrounding the time period of three local police chiefs from 2001 through 2011 to determine the existence of bias toward the Colorado Springs Police Department. The research conducted during this study adds to existing research and literature which assesses the unpredictable relationship between the police department and the media. It expands on the need for a police department to utilize its public information officer and …

"At Risk Means A Minority Kid:" Deconstructing Deficit Discourses In The Study Of Risk In Education And Human Services, Cinzia Pica-Smith, Carmen Veloria
Pedagogy and the Human Sciences
Unexamined use of ubiquitous terms such as “at risk” in education and human service courses can lead to reifying raced, classed, and gendered deficit perspectives of youth and youth work. This paper examines the social construction of the term “at risk,” following students in four education and human services undergraduate and graduate courses and the work of two counselor and teacher educators as they engaged their students in the process of deconstructing and interrogating this term. Findings reveal that students enter the classroom with raced and classed assumptions of who is at risk. Students demonstrate a deficit orientation that contextualizes …

Juror Privacy In The Sixth Amendment Balance, Melanie Wilson
Juror Privacy In The Sixth Amendment Balance, Melanie Wilson
Scholarly Works
Some eight million citizens report for jury duty every year. Arguably, jury duty is one of the most significant opportunities to participate in the democratic process. For the accused, the jury acts as an indispensable safeguard against government overreaching. One might expect, therefore, that our justice system would treat putative jurors with care and tact. The opposite is true. During voir dire, potential jurors are required to share insights into their own lives, quirks, proclivities, and beliefs. Litigants have probed jurors’ sexual orientation, criminal histories, criminal victimization, health, family relations, and beyond. A few scholars have chided the system for …
Triaging Appointed-Counsel Funding And Pro Se Access To Justice, Benjamin H. Barton
Triaging Appointed-Counsel Funding And Pro Se Access To Justice, Benjamin H. Barton
Scholarly Works
For decades, scholars and advocates have lauded Gideon’s guarantee of appointed counsel in criminal cases and sought to extend it into a civil-Gideon right in a range of civil cases. This past Term, the Supreme Court disappointed the civil-Gideon movement in Turner v. Rogers, unanimously rejecting an across-the-board right to counsel while encouraging reforms to make courts more accessible to pro se litigants. Turner is mostly right, we argue, because funding limitations require reserving counsel mostly for criminal cases, where they are needed most. For the first time, the Court recognized that lawyers can make cases not only slower and …

Extended ‘Stop And Search’ Powers In Australia: A Challenge For Relations Between Police Officers And Citizens, Daniel Baldino, Martin Drum
Extended ‘Stop And Search’ Powers In Australia: A Challenge For Relations Between Police Officers And Citizens, Daniel Baldino, Martin Drum
Arts Conference Papers
This paper will provide an investigation, both theoretical and empirical, into the use of ‘stop and search’ powers in Australia. It will provide a detailed analysis of the legislation, its impact and the implications surrounding ‘stop and search’ powers in Western Australia and, in part, Victoria and the United Kingdom. The Commonwealth Heads of Government Meeting (Perth, October 2011) has also provided a unique opportunity to study a range of special policing laws and potential problems.

Women's Use Of Violence: An Ecological Systems Model, Sara Byczek
All-Inclusive List of Electronic Theses and Dissertations
Women's use of violence within intimate relationships is an important area of which both researchers and clinicians can benefit from gaining a better understanding. In the current literature on women's use of violence, two main perspectives dominate, including the family violence perspective and the feminist perspective. The main goal of the present study was to gain a better understanding of women's use of violence. Specifically, qualitative methodology was utilized to explore the possibility that typologies may exist within women's use of violence that may help to explain the discrepant findings within the literature. Twelve women completed an online questionnaire that …
Reexamining The Place Of Public Confession Of Sins In A Reformed Context., Matthew John Webber
Reexamining The Place Of Public Confession Of Sins In A Reformed Context., Matthew John Webber
CTS Master of Theology (ThM) Theses
A dangerous tendency plagues the scripturally mandated practice of confession within many mainline Christian churches. The danger is that the theological thrust of the practice has been ignored or compromised in such a way that the manner in which confession is practiced ignores fundamental elements which underlie the need for confession, specifically public confession performed before one's fellow believers. It is especially evident that the confession of one's sins, which once took place in pubic before the ecclesial body, has seen a significant amount of change within the Reformed context. The focus of this essay is to identify the theological …

Saving Their Own Souls: How Rluipa Failed To Deliver On Its Promises, Sarah Gerwig-Moore

In the summer of 2001, as a graduate student in law and theology, I began work on a master’s thesis that examined the predicament of men of faith on San Quentin’s Condemned Row. I was working in the California Appellate Project—mostly assisting with direct appeals and state habeas petitions on behalf of men under a death sentence—when a colleague guided me into theological conversations with some of our clients. On Condemned Row, they waited—up to five years to be assigned a court-appointed appellate attorney, on judges’ rulings, and to find whether the legal system would ultimately exact the penalty it …

The Influence Of Adhd And Bipolar Disorder Symptoms And Labels On Private High School Teachers’ Accommodations And Attitudes, Sara Kerney
Psychology Honors Papers
The present study examined the effects of symptoms and diagnostic labeling on teachers’ accommodations for and opinions of a student presented in a vignette containing a behavioral description of ADHD or Bipolar Disorder in an adolescent girl. Participants were 85 teachers from five New England private high schools who read a vignette and then answered subsequent questions in an online survey to measure opinions of that student and hypothetical accommodations. Additionally, questions measured participants’ familiarity with mental illness, opinions on mental illness, and beliefs in the causes of the disorders so that the relationship of these variables to accommodations and …

An Analysis Of Indiana Schools Implementing Alternative Teacher Evaluation Systems, Corey Wade Austin
All-Inclusive List of Electronic Theses and Dissertations
The purpose of this content analysis research project was to determine if there were predictive qualities of the demographic groupings; student population, free and reduced percentage, and geographic setting on the teacher evaluation tools that are an alternative to the Indiana RISE model. This study surveyed Indiana superintendents regarding their anticipated 2012-13 evaluation tool. The schools that designated they would be using an alternative teacher evaluation tool were then asked to make available their research of their document for comparison to a research-based template. The research-based template is a derivative of the work of Danielson (2007), Marshall (2005), and Marzano …

Recidivism Measurement And Sanction Effectiveness In Youth Diversion Programs, Thomas T. Maroney
Recidivism Measurement And Sanction Effectiveness In Youth Diversion Programs, Thomas T. Maroney
Electronic Theses and Dissertations
With the rapid growth of juvenile offender diversion programs, which use many nontraditional sanctions, the effectiveness of sanction combinations in juvenile diversion programs and in each individual program needs to be evaluated. Those making sanctioning decisions currently do so based on intuition rather than using an evidence- or theory-based approach. Considerable research has examined the relationship between offender risk factors and recidivism (who is more likely to reoffend?) and between offender risk factors and sanctions (who is more likely to receive what sanctions?), but little is known about the relationship between sanctions and recidivism (which sanctions best reduce recidivism and …

Beyond Family Law, Sarah Abramowicz
Beyond Family Law, Sarah Abramowicz
Law Faculty Research Publications
Family law has traditionally been treated as an exceptional field, a marginalized and special case in which the usual rules of the legal canon do not apply. This Article argues that the current challenge to family-law exceptionalism has been largely one way, to the detriment of a central concern of family law: the protection of children and of the parent-child relationship. Family-law scholars have focused primarily on whether and how to import the tools and insights of other areas of law into the zone of family relations, while largely overlooking the possibility that the tools and insights of family law …

We have had to re-examine the threats that we face and how we can better deal with them in the best way possible.
The following project will explore the many facets connected to making a resilient society. My area of expertise within the emergency services management gives me the unique perspective as a …
