There is an immense variety of privately owned businesses. They will be stakeholders because their businesses are located there, but they will also be assets in themselves in drawing people to the area. There is basically everything anyone could possible want or need in this area. There are two gas stations, a Family Dollar, a liquor store, a few sit down restaurants, numerous places where one can get a quick bite to eat, a frame shop, a clothing store, a pawn shop, a store with fresh produce (which is hard to find in urban areas), a store that sells sports …

Miranda’S Hidden Right, Laurent Sacharoff
Miranda’S Hidden Right, Laurent Sacharoff
Sturm College of Law: Faculty Scholarship
When the Court in Miranda v. Arizona applied the Fifth Amendment “right to remain silent” to the stationhouse, it also created an inherent contradiction that has bedeviled Miranda cases since. That is, the Court in Miranda said that a suspect can waive her right to remain silent but also that she must invoke it. Numerous courts have repeated this incantation, including most recently last summer in Berghuis v. Thompkins. But how can both be true about the same right? Either the suspect has the right and can waive it or does not yet enjoy it and must therefore invoke it. …

Transnational Business Governance Interactions Working Papers
In this paper we analyse discursive struggles over what is referred to as legal and illegal user practices in the internet as an outcome of regulatory uncertainty. The latter, in turn, is examined in the context of a multi-layered transnational copyright regime characterised by three features: the absence of an universally recognized single authority in charge of law-making, fragmented and partially contradicting forms of regulation of global, national and sectoral scope, and considerable indeterminacy of rule interpretation and application arising from the variety and distinctiveness of local usage contexts. We argue that notions of legality and illegality are used strategically …

Introduction: Targeting In An Asymmetrical World, D. A. Jeremy Telman
Law Faculty Publications
This is the introduction to a collection of articles to be published in the Valparaiso University Law Review. The articles address the challenges presented by non-traditional warfare and non-traditional combatants in the contexts of the War on Terror and the trend toward multilateral and humanitarian interventions. Two of the contributions, those of Jonathan Hafetz and David Frakt, detail the hybrid model, part criminal law, part law of war, that the United States developed for addressing the status of detainees in the War on Terror. Two of the contributions, those of Rachel VanLandingham and Iain Pedden, propose international models for addressing …

Advancing Transgender Civil Rights And Equality In New York: The Need For Genda, New York Civil Liberties Union, Lincoln Square Legal Services, Inc.
Policy and Legislative Advocacy Clinic
Currently, no statewide law in New York explicitly prohibits discrimination against people whose appearance or identity does not conform to gender stereotypes. This means that people who are fired from their jobs, denied housing and services, and mistreated in the workplace, in stores and in restaurants merely because of their appearance or gender identity do not have clear legal protection. The Gender Expression Non-Discrimination Act (GENDA) would fix this problem by adding gender identity and gender expression to the categories currently included in New York State’s antidiscrimination laws, such as sex, sexual orientation, race, religion and disability. This report explains …

Law Librarian Scholarship
This is a PDF of the slide presentation given by the authors at the 2012 CALI Conference for Law School Computing, held June 21-23, 2012 at the Thomas Jefferson School of Law in San Diego, CA.
The CALI session discussed the trend among law schools towards an open access publishing model for both faculty scholarship and student law reviews. Included was a brief overview of the Durham Statement on open access legal publishing and the advantages for law schools that move to this publishing model (including improved accessibility and access and even increased citation rates). Additionally, the session focused on …
It's Complicated: Privacy And Domestic Violence, Kimberly D. Bailey
It's Complicated: Privacy And Domestic Violence, Kimberly D. Bailey
All Faculty Scholarship
This Article challenges the notion that there is no role for privacy in the domestic violence context. Privacy is a complicated concept that has both positive and negative aspects, and this Article examines the value that more privacy could provide for domestic violence victims. While privacy was historically used as a shield for batterers, more privacy for domestic violence victims could protect their personhood, ensuring that they are treated with dignity and respect. In addition, current mandatory criminal justice policies have become so intrusive in many victims’ lives that limitations are needed to prevent the threat of state abuse. These …

Well-Being Analysis Vs. Cost-Benefit Analysis (With J. Bronsteen & J. Masur) (Symposium), Christopher J. Buccafusco
All Faculty Scholarship
Cost-benefit analysis is the primary tool used by policymakers to inform administrative decisionmaking. Yet its methodology of converting preferences (often hypothetical ones) into dollar figures, then using those dollar figures as proxies for quality of life, creates systemic errors so large as to deprive the tool of value. These problems have been lamented by many scholars, and recent calls have gone out from world leaders and prominent economists to find an alternative analytical device that would measure quality of life more directly. This Article proposes well-being analysis (WBA) as that alternative. Relying on data from the field of hedonic psychology …

Ted Kaczynski and Bernie Madoff share much in common. Both are well-educated, extremely intelligent, charismatic figures. Both rose to the height of their chosen professions—mathematics and finance. And both will die in federal prison, Kaczynski for committing a twenty-year mail-bombing spree that killed three people and seriously injured dozens more, and Madoff for committing the largest Ponzi scheme in history, bilking thousands of people out of almost $65 billion. But that last similarity—Kaczynski’s and Madoff’s plight at sentencing—may not have had to be. While Kaczynski’s attorneys tirelessly investigated and argued every aspect of their client’s personal history, mental state, motivations, …

Batson Revisited (Symposium), Nancy S. Marder
All Faculty Scholarship
The twenty-fifth anniversary of Batson v. Kentucky provides an important moment to reflect on Batson and to consider how this seminal case and its progeny have affected the use and abuse of peremptory challenges. I had initially welcomed the U.S. Supreme Court’s approach to peremptory challenges in Batson back in 1986. Although Batson was a compromise—preserving peremptories while seeking to address discriminatory peremptories—it had the noble goal of trying to eliminate discrimination during jury selection. I also embraced its expansion over the years. The logic of Batson was inexorable: just as prosecutors should not be permitted to use peremptories to …
The Conundrum Of Cameras In The Courtroom, Nancy S. Marder
The Conundrum Of Cameras In The Courtroom, Nancy S. Marder
All Faculty Scholarship
In spite of a communications revolution that has given the public access to new media in new places, the revolution has been stopped cold at the steps to the U.S. federal courthouse. The question whether to allow television cameras in federal courtrooms has aroused strong passions on both sides, and Congress keeps threatening to settle the debate and permit cameras in federal courts. Proponents of cameras in federal courtrooms focus mainly on the need to educate the public and to make judges accountable, whereas opponents focus predominantly on the ways in which cameras can affect participants’ behavior and compromise the …
