War Crimes Prosecution – Lessons Learned From Bosnia And Herzegovina, Iva Vukusic Jan 2012

War Crimes Prosecution – Lessons Learned From Bosnia And Herzegovina, Iva Vukusic

Conflict, Memory, and Reconciliation: Bridging past, present, and future

Since the war ended fifteen years ago, war crimes prosecution has been the dominant tool of addressing war crimes committed during the four-year-long conflict in Bosnia and Herzegovina (1992-1995). The prosecution has been conducted at the International Criminal Tribunal for the former Yugoslavia (ICTY), the national institutions (Court of BiH, Sarajevo) and the local courts (cantonal and district in Republika Srpska, the Federation of BiH and the Brcko District – all entities established as a result of the Dayton Peace Accords). All these institutions have been criticized by various individuals in different capacities, for different reasons – some of these …

Gacaca: A Flawed Project And The Hope For Transitional Justice, Sonali Chakravarti Jan 2012

Gacaca: A Flawed Project And The Hope For Transitional Justice, Sonali Chakravarti

Conflict, Memory, and Reconciliation: Bridging past, present, and future

In 2000 an ambitious new process of transitional justice was launched in Rwanda as a way to adjudicate crimes related to the genocide of 1994 at a local level. It took the name gacaca from the traditional village courts on which it was based and between 2006-2010, almost one million cases were heard at gacaca courts throughout the country. Each court was led by a council of elected “people of integrity ” and it considered a range of crimes, from thefts to murder, connected to the genocide; it also required the participation of all residents who, using informal language, voiced …

Spiritual Economies: Redemptive Violence, The Body And Social Care, Perry W. Benson Jan 2012

Spiritual Economies: Redemptive Violence, The Body And Social Care, Perry W. Benson

Theses and Dissertations

“Spiritual Economies” asserts that the emancipatory drive in international social care to integrate spirituality and religion in culturally sensitive practice, is much needed given the demographic and social changes engendered by globalization. Ethical codes guiding the practice of international social care, furthermore, have mandated that spiritual and religious beliefs are an important part of cultural diversity. An extensive examination and analysis of the discourse on the integration of religion and spirituality in the predominantly secular social services, however, yielded a number of concerns among international social care scholars and practitioners regarding the inclusion of religion due to the potential for …

The Rise And Fall Of Administrative Justice - A Cautionary Tale, Michael Adler

Socio-Legal Review

This paper comprises a case study of the history of the Administrative justice and Tribunals Council (AJTC) in the United Kingdom from its the establishment in 2007 to its likely demise five years later, in 20 12. It outlines a number of competing approaches to administrative justice and identifies some of the key milestones on the road to reforming the ways in which disputes between citizens and the state are handled in the UK. It traces the rise and fall of the AJTC and considers how arguments for the establishment of an 'oversight body' that seemed, until recently, to enjoy …
