Constitutional Law - Press Has No Constitutional Right To Attend A Pretrial Suppression Hearing, Jay C. Welch
Campbell Law Review
American courts have struggled continuously with balancing the defendant's right to a fair trial with the reporter's right of freedom of the press. The courts face a most difficult challenge when confronted with a highly publicized case because they may have to exclude the public and the press from any pretrial hearings to ensure defendant's right to a fair trial under the sixth amendment. The Supreme Court of the United States considered the constitutional ramification of judicial pretrial closure orders in Gannett Co. v. DePasquale. In a five-four decision the Supreme Court held the sixth amendment's public trial guarantee did …
Criminal Procedure - Waiver Of Right To Counsel, Patti Owen Harper
Criminal Procedure - Waiver Of Right To Counsel, Patti Owen Harper
Campbell Law Review
The United States Supreme Court's landmark decision Miranda v. Arizona spawned countless cases interpreting the Court's construction of standards for the admissibility of criminal defendants' statements made during custodial interrogations. While earlier cases addressed the issue of waiver of right to counsel in a trial context, Miranda represented the Court's first consideration of waiver of right to counsel in a pretrial context. Chief Justice Warren, writing for a majority of five, explained that the Court intended "to further explore some facets of the problem, thus exposed, of applying the privilege against self-incrimination to 'incustody interrogations, and to give concrete constitutional …

Interpreter Preparedness For Specialized Settings, Jamie Walker, Sherry Shaw
Interpreter Preparedness For Specialized Settings, Jamie Walker, Sherry Shaw
Journal of Interpretation
Sign language interpreters who begin work soon after graduating from post-secondary programs, either associate-level training programs or bachelor-level interpreter education programs are vulnerable to unique challenges for which they may be inadequately prepared, especially if they work as community interpreters in specialized settings. This descriptive study represents the initial attempt to understand how graduates determine personal readiness and identifies contributors to preparedness for working in specialized settings. The sample of recent program graduates provided a snapshot of how prepared interpreters felt in their first years following graduation regarding competency in Legal, Healthcare, Mental Health, Educational, and Deaf-Blind situations. This study …
American Sign Language/English Interpreting In Legal Settings: Current Practices In North America, Len Roberson, Deb Russell, Risa Shaw
American Sign Language/English Interpreting In Legal Settings: Current Practices In North America, Len Roberson, Deb Russell, Risa Shaw
Journal of Interpretation
Standard demographic information was collected on certified and non-certified sign language interpreters relative to the provision of interpreting services in legal settings. The study examined which practices interpreters incorporate into their work in legal settings, with particular attention to working in teams consisting of deaf and hearing interpreters, use of consecutive interpreting, preparation for interpreting in legal settings, and maintaining appropriate roles in the courtroom. Findings suggest that the main reason interpreters do not specialize in legal interpreting is a lack of understanding of the nature of the work and appropriate training. A systemic training sequence that addresses many of …

“It Was Difficult To Manage The Communication”: Testing The Feasibility Of Video Remote Signed Language Interpreting In Court, Jemina Napier, Marcel Leneham
Journal of Interpretation
The aim of the project reported here was to investigate whether the use of current technology within the New South Wales (Australia) Department of Justice is appropriate for providing video remote signed language interpreting services in court given that video conference facilities make use of fixed- angle cameras that cannot be moved, zoomed in or out, or focus on different parts of the courtroom. The study sought answers to questions concerning consumer comfort levels, integrity of interpreting process, and optimum settings for interpreters to provide quality services remotely. Conclusions from the study include the need to carefully consider the technological, …
