Have We Come Full Circle? Judicial Sentencing Discretion Revived In Booker And Fanfan, Sandra D. Jordan
Have We Come Full Circle? Judicial Sentencing Discretion Revived In Booker And Fanfan, Sandra D. Jordan
Pepperdine Law Review
The much anticipated Supreme Court decision in United States v. Booker and Fanfan has both invalidated the mandatory nature of the federal Sentencing Guidelines as well as restored judicial discretion for federal judges. With the Booker decision there is a renewed opportunity to correct some of the imbalance that came about as a result of the mandatory guidelines and the sentencing policies of the past twenty years. Booker has implications for all future sentencing as the power between the judiciary and the jury has been realigned and the power of the government has been reduced. Sentencing cannot accomplish legitimate goals …

Mission Driven And Data Informed Leadership, Anthony C. Holter, James M. Frabutt
Mission Driven And Data Informed Leadership, Anthony C. Holter, James M. Frabutt
Journal of Catholic Education
The contemporary challenges facing Catholic schools and Catholic school leaders are widely known. Effective and systemic solutions to these mounting challenges are less widely known or discussed. This article highlights the skills, knowledge, and dispositions associated with mission driven and data informed leadership—an orientation to school level leadership that we believe holds great promise for the renewal and revitalization of Catholic schools. The conceptual framework developed in this article takes specific shape through an examination of the problem-based learning strategies embedded in the curriculum of the Mary Ann Remick Leadership Program in the Alliance for Catholic Education at the University …

Overview Of The Term: The Rule Of Law & Roberts's Revolution Of Restraint, Douglas W. Kmiec
Pepperdine Law Review
In this introduction to a symposium on Chief Justice Roberts’ first term, Professor Kmiec begins with a discussion of how the addition of Chief Justice Roberts and Justice Alito to the Supreme Court resulted in a continuation of the center-right tradition of the Rehnquist-O’Connor era, and he addresses the impact of Justice O’Connor’s retirement on Justice Kennedy’s jurisprudence. Professor Kmiec also evaluates Rehnquist’s final term, determining that, during this term, Rehnquist lost some of the hard earned constitutional advantages in the areas of religious accommodation, federalism, and the protection of property rights. Professor Kmiec ends his article with a discussion …

Law As A Healing Profession: The "Comprehensive Law Movement" , Susan Daicoff
Pepperdine Dispute Resolution Law Journal
This article outlines the history, context, importance, and development of ten or so "vectors" of an emerging change in the law comprising the "comprehensive law movement." The vectors include: creative problem solving, therapeutic jurisprudence, preventive law, restorative justice, collaborative law, transformative mediation, and holistic justice. The movement utilizes the insights of procedural justice and other social science-based understanding of the intrapersonal and interpersonal dynamics of legal affairs and legal disputes. Casting A Wider Net: Another Decade Of Legislative Expansion Of The Death Penalty In The United States, Jeffrey L. Kirchmeier
Casting A Wider Net: Another Decade Of Legislative Expansion Of The Death Penalty In The United States, Jeffrey L. Kirchmeier
Pepperdine Law Review
During the last decade, judges, politicians, scholars, and the general public have become troubled about problems with the death penalty in the United States. Also during this time, major studies of the death penalty have recommended a reduction in the number of statutory factors that make one eligible for the death penalty. Despite these concerns, legislatures continue to expand their capital punishment statutes to make more defendants eligible for the death penalty. This Article examines how, during a time of growing concern about innocence and arbitrariness in the death penalty system, a number of legislatures have continued to expand their …

The Illinois Supreme Court recently authorized the use of television cameras and "other recording devices" for "extended media coverage" of the courts in the state. For the first time, this extends access in that state to all trial courts following an appellate experiment that began in the 1980s. It took the efforts of Illinois Supreme Court Chief Justice Thomas Kilbride to "bring more transparency and accountability" to the sometimes troubled Illinois criminal justice system.
