Transtemporal Separation Of Powers In The Law Of Precedent, Randy Beck
Transtemporal Separation Of Powers In The Law Of Precedent, Randy Beck
Notre Dame Law Review
The article focuses on several aspects associated with the law of precedent including the distinction between holding and dictum, the doctrine of stare decisis, and judicial resolution of a legal issue. It discusses a transtemporal application of separation of powers principles based on the law of precedent that allocates power to judges to minimize precedential effect of previous judges. It mentions that the general rule of stare decisis allocates power to evaluate previous decision-making.
Evading Legislative Jurisdiction, Austen L. Parrish
Evading Legislative Jurisdiction, Austen L. Parrish
Notre Dame Law Review
An essay is presented on the adoption of a different approach by the U.S. courts to deal with the issues related to legislative jurisdictions. The author discusses lapses in the decisions of the courts related to the practice of redefining extraterritoriality that have been foundational in both domestic and international law. It also offers brief information on the decision of the U.S. Supreme Court for the court case Morrison v. National Australia Bank Ltd.

Forum Choice For Terrorism Suspects, Aziz Huq
Forum Choice For Terrorism Suspects, Aziz Huq
Articles
What forum should be used to adjudicate the status of persons suspected of involvement in terrorism? Recent clashes between Congress and the president as to whether the status of terrorism suspects should be determined via Article III courts or military commissions have revived the debate about this venue question. The problem is typically framed as a matter of legal doctrine, with statutory and doctrinal rules invoked as dispositive guides for sorting suspects into either civilian or military venues. This Article takes issue with the utility of that framing of the problem. It argues that the forum question can more profitably …

Women's Rights, Public Defense, And The Chicago World's Fair, Barbara Babcock
Women's Rights, Public Defense, And The Chicago World's Fair, Barbara Babcock
Chicago-Kent Law Review
Women were an important part of the great public meetings held in connection with the Chicago World's Fair. One of these "Congresses," as they were called, was devoted to the achievements of nineteenth century women, and brought together suffragists, club women, society ladies, and activists of all stripes from around the world. The Congress of Jurisprudence and Law Reform featured two American women lawyers holding their own on a platform with leading professors, judges and advocates. With an extraordinary speech based largely on her own experience in the courts, Clara Foltz launched the public defender movement.

Women Lawyers And Women's Legal Equality: Reflections On Women Lawyers At The 1893 World's Columbian Exposition In Chicago, Mary Jane Mossman
Chicago-Kent Law Review
In Chicago in 1893, for the first time in history, women lawyers were invited to participate with male lawyers and judges at the Congress on Jurisprudence and Law Reform, one of a number of Congresses organized in conjunction with the World's Columbian Exposition. By the 1890s, women lawyers had achieved considerable success for at least two decades in gaining admission to state bars in the United States, and their success provided important precedents for women who wished to become lawyers in other parts of the world. Yet, as Nancy Cott explained, although women's admission to the professions had been seen …

Big Censorship In The Big House—A Quarter-Century After Turner V. Safley: Muting Movies, Music & Books Behind Bars, Clay Calvert, Kara Carnley Murrhee
Northwestern Journal of Law & Social Policy
On the twenty-fifth anniversary of the United States Supreme Court’s decision in Turner v. Safley, this Article examines how federal courts across the country are applying the Turner standard today in cases involving the First Amendment free speech rights of inmates. Are courts too quick today to support the censorial proclivities of prison officials? Do judges too readily capitulate in deference to the concerns of those tasked with overseeing the incarcerated? Those are the key questions this Article addresses by analyzing inmate access to magazines, movies, books, and other common forms of media artifacts. This Article’s determinations stem from …

Beating Down The Lowly: The Criminalization Of The Homeless And Alternative Solutions, Amber Will
Symposium on Research and Creative Expression (SORCE)
In the current economy, the issue of homelessness is increasingly pervading the normal constructs of society. Thousands of men, women, and children struggle to find a place to sleep and enough food to satisfy their hungry stomachs. While many people suffer under these conditions, local governments continue to create new anti-homeless legislation to further eject them out of society. Bans prevent the homeless from urinating, sleeping, camping, and panhandling in public through fines and prison sentences. The laws specifically target the homeless, discriminating against them for actions which are necessary for daily survival. The legal system only further hurts this …

The Regulation Of Online Gaming Across Jurisdictions: Success, Standards And Stability, Peter Nelson
The Regulation Of Online Gaming Across Jurisdictions: Success, Standards And Stability, Peter Nelson
Political Science Theses and Capstones
In 2005 the gaming market was worth an estimated six billion dollars, half of that represented by online gambling revenues. However not all jurisdictions (countries) regulate the industry the same. Some jurisdictions allow the industry to flourish while some go as far as banning the industry all together. I gather data on all 75 global jurisdictions that have some form of online gaming. I analyze which regulations allow the industry to prosper while maintaining quality standards, and which regulations do not work. Preliminary analysis shows that the amount of years a country has allowed online gambling, as well as the …
