Many cases go unsolved every day in the United States; some due to a lack of technological advancement in forensic science. When a person is killed, raped, or in danger of physical harm, it is the responsibility of law enforcement and their collaborative agencies to find and apprehend the responsible parties. The use of familial DNA searches in the United States is a relatively new investigative technique. Traditionally, DNA samples found at a crime scene are run through a national Combined DNA Index System (CODIS) to look for possible matches. This Comment analyzes jurisprudence from the areas of abortion law and family autonomy rights, blending principles from both to suggest that a parent's right to decline vaccinations for his/her child should be deemed fundamental and, thus, should be statutorily protected by philosophical exemptions.

Criminal Justice Students' Perceptions Of Restorative Justice: A Study Of Demographic Variables And Restorative Justice Values, Lana Adelaide Mcdowell

As time progresses, criminologists continue to search for philosophies and policies which possess the ability to reduce criminal behavior. One such philosophy and policy may be restorative justice. This study explores the meaning of restorative justice as well as types of restorative justice processes including peacemaking circles, group conferencing, reparative boards, victim offender mediation/reconciliation programs, victim offender panels, social justice initiatives, and community justice. This study also provides a tentative definition/theory of restorative justice which suggests crime creates broken relationships; therefore, reparation, inclusion, acceptance of responsibility, remorse, apology, forgiveness, resolution, reintegration, reconciliation, and restoration are necessary components of justice.

Tracking Plagiarism Electronically: First-Year Students’ Perceptions Of Academic Dishonesty And Reports Of Cheating Behaviour In The Basic Communication Course, Joseph P. Mazer, Stephen K. Hunt

This study explored how electronic submission of course material, intended to deter instances of plagiarism, influenced first-year students’ perceptions of academic dishonesty and reports of cheating behaviour in a large, multi-section basic communication course. Results reveal that electronic submission of course material results in first-year students being less likely to self-report engaging in cheating behaviours and heightens their appreciation and awareness of what constitutes academic dishonesty. Implications for classroom pedagogy, course management, and teacher training are discussed.

"I Smooth'd Him Up With Fair Words": Intersocietal Law, From Fur Trade To Treaty, Janna Beth Promislow

History is an essential part of aboriginal law. The two disciplines, however, may produce incompatible narratives of indigenous-settler relations. In addition, indigenous legal traditions and the fur trade in the old North West have been under-represented in Canadian legal history, a gap that demotes over two centuries of working relationships to a brief preface to the numbered treaties and confederation. This dissertation seeks to bring under-observed normative relations between indigenous and European traders into Canadian legal history. To what degree can traditional Asian political and legal institutions be seen as embodying constitutionalist values? This question has risen to the fore in recent decades as part of a new attention to constitutionalism around the world, as well as the decline in orientalist perceptions of Asia as a region of oppressive legal traditions. This article juxtaposes East Asian analogues or antecedents of constitutionalism with a particular set of recent theoretical understandings of the concept of constitutionalism. Beyond Law Enforcement: Camreta V. Greene, Child Protection Investigations, And The Need To Reform The Fourth Amendment Special Needs Doctrine, Josh Gupta-Kagan

The Fourth Amendment “special needs” doctrine distinguishes between searches and seizures that serve the “normal need for law enforcement” and those that serve some other “special need,” excusing non-law enforcement searches and seizures from the warrant and probable cause requirements. The Supreme Court has never justified drawing this bright line exclusively around law enforcement searches and seizures but not those that threaten important non-criminal constitutional rights.

Child protection investigations illustrate the problem: Millions of times each year, state child protection authorities search families’ homes, and seize children for interviews about alleged maltreatment. Only a minority of these investigations involve an …

Grandparents, particularly, grandmothers in the African American community have historically provided needed care for their grandchildren (Crewe, 2003). Before there was a child welfare system that addressed the needs of African American children, there were grandmothers who served as the safety net for their biological, informally adopted grandchildren, and other minor relatives. They cared for grandchildren and others whose birth parents were unable or unwilling to care for them. For families of color, HIV/AIDS is an emerging issue that is contributing to the growing numbers of grandparent-headed households. A father’s participation in a child’s life has been regarded as a significant factor in the enhancement of a couple’s relationship. Although the investigations between paternal behavior and marital satisfaction come with mixed results, they clearly link the concepts of maternal and paternal role expectations to paternal behavior, which can be also moderated by earner status, child’s gender, and traditional versus contemporary role expectations. Subsidized Housing, Public Housing, And Adolescent Violence And Substance Use, Tamara Leech

Department of Public Health Scholarship and Creative Works

This study examines the separate relationships of public housing residents and subsidized housing residence to adolescent health risk behavior. Data included 2,530 adolescents aged 14 to 19 who were children of the National the Longitudinal Study of Youth. The author uses stratified propensity methods to compare the behaviors of each group—subsidized housing residents and public housing residents—to a matched control group of teens receiving no housing assistance. The results reveal no significant relationship between public housing residence and violence, heavy alcohol/marijuana use, or other drug use. However, subsidized housing residents have significantly lower rates of violence and hard drug use, …

Perceptions Of Mental Illness In The Legal System, Krista Wallace

Previous research suggests that there are stereotypes and misperceptions about the mentally ill population which affect juror’s decision making in cases where the insanity defense is raised. Many individuals believe it to be a “loophole” in the criminal justice system for offenders to escape punishment (Skeem and Golding, 2002). This study explores community perceptions of schizophrenia and personality disorders in a legal context. Results support that individuals are significantly less confident of their verdict decisions when the offender has a mental illness than when the offender has no mental illness. Within the criminal justice system, DNA (deoxyribonucleic acid) evidence has often been heralded as the gold standard of forensic science. In a 2009 U.S. Supreme Court decision, Chief Justice Roberts wrote that "DNA testing has an unparalleled ability both to exonerate the wrongly convicted and to identify the guilty. It has the potential to significantly improve both the criminal justice system and police investigative practices." The phrases “unparalleled ability” and “significantly improve” reflect the high standard that DNA has attained in both forensic science and the entire criminal justice system.

Harmonizing Equitable Exceptions: Why Courts Should Recognize An “Actual Innocence” Exception To The Aedpa’S Statute Of Limitations, Morgan Suder

San Diego Law Review

This Comment argues that to neutralize this potential inequality, the Supreme Court should affirm the Ninth Circuit’s recent decision in Lee v. Lampert, finding that a credible claim of actual innocence constitutes an equitable exception to the AEDPA’s one-year statute of limitations period. District courts must be able to call on their equitable powers, including both equitable principles already applied to the AEDPA’s statute of limitations as well as the actual innocence exception, in determining whether a district court may consider the merits of a criminal defendant’s otherwise untimely habeas petition.
