Beyond Saints and Sinners examines the forces affecting the exercise of discretion in American immigration courts, and argues that in this present age of immigration anxiety, the same facts that place an individual in deportation proceedings may constitute the reasons a judge will, relying on discretion, deny them relief for which they are otherwise eligible. The article explores the polarized narratives told about "good" and "bad" immigrants, the exceptionally difficult task of adjudicating in overburdened immigration courts, and the ways in which these polarized narratives interact with psychological short-cuts, or heuristics, that affect judicial exercises of discretion. Safeguarding adults is a priority in adult social care, and training is one of the main ways in which policy and guidance around it is implemented. Training transfer refers to the use of new learning on the job, and while the transfer literature is well developed, it does not extend to safeguarding adults training. Predators In Paradise: Puerto Rico's Recent Sex Offender Problems And The Federal Government's Ill Suited Solutions, Adan Soltren

Cardozo Journal of Equal Rights & Social Justice

The note examines the challenges and implications of implementing the Adam Walsh Act (2006) in Puerto Rico, particularly its Sex Offender Registration and Notification Act (SORNA) provisions. It highlights Puerto Rico's noncompliance with SORNA due to its less stringent sex offender laws and the economic and policy concerns surrounding full adoption. The analysis critiques SORNA's one-size-fits-all approach, especially its treatment of juvenile offenders, and proposes tailored solutions for Puerto Rico to address these issues while maintaining public safety.

Since 2011, a number of states have amended their collective bargaining laws covering state and local government employees. Debate rages about whether the goal of the proponents of change was to address budget shortfalls or weaken labor unions. Regardless of motive, legislatures in several states accomplished the goal of severely limiting or eliminating collective bargaining for some or all employees. The question facing unions, employers and employees in those states is “what now?” An answer may lie in looking to southern states like Virginia and North Carolina that have historically prohibited or severely restricted bargaining. Governmental neutrality is the heart of the modern Free Exercise Clause. Mindful of this core principle, which prevents the government from treating individuals differently because of their religious convictions, the Supreme Court held in Employment Division v. Smith that a neutral law can be constitutionally applied despite any incidental burdens it might impose on an individual’s exercise of religion. Conscientious objectors such as Quakers, for instance, do not have a constitutional right to be exempt from a military draft. Thus, neutrality now forms both the core and the outer limit of constitutionally guaranteed religious freedom. Judged according to founding-era views, …

· Research over the past two decades repeatedly demonstrates the relationship between poor health outcomes and socioeconomic factors such as poor housing, poverty, racism, and structural inequity.

· In 2005, the Northwest Health Foundation, supported by the Kaiser Permanente Community Fund, began an initiative to address these social determinants of health (SDOH).

· A variety of projects – short- and long-term, large and small – were supported over the five-year period for a total of $12.4 million. The mean project-implementation grant was $175,350 and 2½ years in length; capacity-building grants averaged $50,000 for 1½ years.

Despite the over 50-year existence of laws permitting the revocation of a police officer’s right to serve in law enforcement for serious misconduct, most scholars have ignored this development. Currently, 44 states have such laws, but they differ greatly in scope. This article suggests the three most important characteristics of an effective decertification law: first, the types of law enforcement officers covered by the law should be wide-ranging, including correctional officers and probation officers, not just police officers and deputy sheriffs and police officers. The goal of this master's thesis is to evaluate the current state of the partnership between the American National Red Cross chapters and Amateur Radio Emergency Service (ARES) groups. The alliance between these organizations has historically been outlined by national representatives, the most recent being the 2010 Memorandum of Understanding between the American National Red Cross and ARRL, the national association for Amateur Radio. This partnership was assessed through a nationwide survey of American National Red Cross chapter representatives. Findings suggest that most Red Cross chapters have current partnerships with their local ARES group, and collaboration occurs primarily for disaster …

Wild pigs are a damaging invasive species with a long history in the United States. However, during the last 30 years wild pigs have drastically expanded their invasive range and are now present in 44 U.S. states. Though historic records provide insights regarding original introduction histories in areas where pigs are long-established, little is known regarding sources for new populations. To develop a better understanding of recent invasions, I utilized an array of molecular markers (mitochondrial DNA sequence, nuclear microsatellites, and nuclear single nucleotide polymorphisms) to evaluate both the evolutionary history of introduced pigs and gene flow between populations indicative …

Factors That Influence Program Completion: Predicting Kentucky Drug Court Completion Outcomes, Elizabeth R. Hagensen

This dissertation examines data collected from Kentucky Drug Court to determine factors associated with program completion outcomes. Extant research on drug court completion outcomes is generally limited to individual drug courts and includes small numbers of observations. This research uses more than three thousand participant records spanning over three years from all Kentucky Drug Courts. Multiple logistic regression is used to determine which factors predict program completion. Participant characteristics, problem behaviors, and drug court variables are examined. It is a challenge for the United States to adequately protect the interests of its intellectual property industries, especially when U.S. interests are not in line with the social, cultural, and economic goals of other nations. Yet, as a major exporter of intellectual property protected goods, the U.S. has an interest in negotiating effective international intellectual property agreements that are perceived to be legitimate by the state signatories and their constituents. When the Supreme Court in District of Columbia v. Heller declared that the Second Amendment protects an individual right to keep and bear arms, it set atop the federal judicial agenda the critical task of elaborating the new right’s scope, limits, and content. Following Heller, commentators routinely draw upon the First Amendment’s protections for expressive freedom to support their proposals for Second Amendment doctrine. RIDA®COUNT test plates were used as an easy-to-handle and rapid indicator of microbial counts in karst ecosystems of several caves in Slovakia and Slovenia. All of the caves had a high organic input from water streams, tourists, roosting bat colonies or terrestrial surroundings. We sampled swabs, water and air samples to test robustness and universality of the RIDA®COUNT test kit (R-Biopharm AG, Germany, http://www.r-biopharm.com/) for quantification of total bacteria, coliforms, yeast and mold. Risk assessments contribute to sentencing and parole decisions, and thus are among the highest stakes assessments in the mental health field. The Static-99 has become a standard element of risk assessments for sex offenders, yet its norms and predictive accuracy have been established primarily with Caucasian samples, while the incarcerated population is disproportionately minority. Scoring of the Static-99 depends heavily on history of criminal offenses; if patterns of offenses differ along ethnic lines, the possibility that offense history should be understood to have ethnically-specific predictive validity (that is, the predictive significance of a given factor differs by ethnicity) becomes more …

The writ of habeas corpus and the right to due process have long been linked together, but their relationship has never been more unsettled or important. Following the September 11, 2001 attacks, the United States detained hundreds of suspected terrorists who later brought legal challenges using the writ. In the first of the landmark Supreme Court cases addressing those detentions, Hamdi v. Rumsfeld, the plurality chiefly relied on the Due Process Clause to explain what procedures a court must follow.
