The Act amends eleven Code sections relating to insurance. The Act classifies as "felonies" all acts that meet the current definition of insurance fraud and increases the maximum penalty for insurance fraud to ten years imprisonment and/or a $10,000 fine. The Act prohibits the Insurance Commissioner and the Office of the Insurance Commissioner from adopting or proposing rules relating to the sale of gasoline to the public, unless the rules require that a gas station be supervised by an on-site employee. The Act changes provisions relating to service of process on uninsured motorist carriers; the injured party need only serve …

State Building Codes: Firm Ceilings, Hard Floors, Or Shaky Foundations For Local Construction And Rehabilitation Standards, James Bross
Georgia State University Law Review
In law reform, as in life, the foam rubber pillow is often the best metaphor for the unforeseen effects of earnest efforts: just when all energy is directed at the annoying lump on one side, the far side springs out vengefully. During the 1960's, legal scholars and presidential commissions pressed earnestly for statewide building codes to serve as ceilings on local standards which are expensive impediments to mass-produced low-income housing; the legal scholars of the 1980's are eager to preserve historic structures whose rehabilitation is impeded by the inflexible floor of state codes under local standards. This article will evaluate …

Preemption And Regulatory Failure, David C. Vladeck
Pepperdine Law Review
Daily front-page stories recounting the failure of defibrillators, pacemakers, heart stents and infusion pumps have raised questions about the adequacy of FDA regulation of medical devices. At the same time, lower courts are struggling to apply the Supreme Court's ruling in Medtronic, Inc. v. Lohr to determine the preemptive reach of the Medical Device Amendments ("MDA"). This article explores the repercussions of Medtronic and argues that Congress' use of words like "requirements" in regulatory statutes should be seen as references to positive state law only, and should not be read, absent an explicit command by Congress, to subsume state law …

Dual Lenses: Using Theology And International Human Rights To Assess China's 2005 Regulations On Religion, Joel A. Nichols
Pepperdine Law Review
In order for China to move forward in the international community, it needs to continue to improve its standing on human rights issues. Of particular concern to many observers is the relationship between the government and religion. While foreign religious organizations and missionaries are still heavily regulated by a 1994 law, a new law respecting religious citizens and organizations within China went into effect in 2005. This new law is salutary in some respects in that it provides a much fuller delineation of the relationship between government and religion within China, and it appears more solicitous toward religious rights than …
