American School Finance Litigation And The Right To Education In South Africa, Scott R. Bauries Jan 2012

American School Finance Litigation And The Right To Education In South Africa, Scott R. Bauries

Law Faculty Scholarly Articles

This paper addresses the South African Constitution's invitation to the Constitutional Court to 'consider foreign law' when interpreting its provisions. Focusing on the education provisions found in section 29 of the Constitution, I make two claims. Firstly, contrary to the developing consensus, American state supreme court jurisprudence in school funding cases makes a poor resource to aid the interpretation of the basic South African right to education, regardless of the quantum of education that the Constitutional Court decides is encompassed by the word 'basic'. Secondly, however, certain aspects of these same American decisions, particularly the space they provide for a …

Environmental and Occupational Health Faculty Publications

PAHs were measured in water, sediment, and shrimps of Estero de Urias, an estuary in Sinaloa, Mexico, during the rainy and dry seasons, and analyzed for eleven PAHs routinely detected in samples. Phenanthrene was the most dominant congener in the water, sediment, and shrimp samples comprising about 38, 24, and 25%, respectively, of the eleven PAHs detected, followed by pyrene and naphthalene in water and sediment samples, and pyrene and fluorine in the shrimp samples. Total PAH concentrations ranged from 9 to 347 ng/L in water, 27 to 418 ng/g in sediments, and 36 to 498 ng/g in shrimps. The …

Hot, Crowded, And Legal: A Look At Industrial Agriculture In The United States And Brazil, David N. Cassuto, Sarah Saville

Animal Law Review

Over the last sixty years, industrial agriculture has expanded in the United States and throughout the world, including in Brazil. Any benefit this expansion has brought comes at significant environmental and social costs. Industrial agriculture is a leading contributor to global climate change, air and water pollution, deforestation, and dangers in the workplace. This Article discusses the impact of industrial animal agriculture in the U.S. and Brazil. It also examines the laws pertaining to industrial agriculture in both countries and provides a comparative analysis of the two legal regimes. Finally, this Article concludes with the observation that although the price …

2011 Legislative And Administrative Review, Patrick Graves, Keith Mosman, Shayna Rogers Jan 2012

2011 Legislative And Administrative Review, Patrick Graves, Keith Mosman, Shayna Rogers

Animal Law Review

It is my pleasure to introduce Animal Law’s fourteenth annual Legislative and Administrative Review. The 2011 Legislative and Administrative Review analyzes some of the year’s most groundbreaking developments in animal-related state and federal legislation, such as federal regulations of genetically engineered fish and attempts by state legislatures to overturn animal-related citizen initiatives.

Additionally, for the first time in Animal Law’s history, this year’s Review also includes an analysis of some of the most important animal-related administrative law developments of the year. Because many decisions impacting animals occur in the administrative arena, it is our hope that the administrative section complements …

Coalitions In The Jungle: Advancing Animal Welfare Through Challenges To Concentration In The Meat Industry, Lis Kamila Jan 2012

Coalitions In The Jungle: Advancing Animal Welfare Through Challenges To Concentration In The Meat Industry, Lis Kamila

Animal Law Review

The meat processing conglomerates that currently control the majority of the market share in the meatpacking industry are responsible for its most systemic animal abuses. Increased concentration has enabled these larger processors to dictate animal treatment standards maintained by meat producers, most of whom have caved to economic pressure and moved their animals from small farms into Concentrated Animal Feeding Operations. Animal welfare proponents have failed to adequately challenge the concentration of the meat industry and in 2012 have yet to fully explore strategies made available by the Packers & Stockyards Act of 1921 (PSA). This Article proposes that a …

The role of caveolin and caveolae in the pathogenesis of infection has only recently been appreciated. In this chapter, we have highlighted some important new data on the role of caveolin in infections due to bacteria, viruses and fungi but with particular emphasis on the protozoan parasites Leishmania spp., Trypanosoma cruzi and Toxoplasma gondii. This is a continuing area of research and the final chapter has not been written on this topic.

Standards For Health Care Decision-Making: Legal And Practical Considerations, A. Kimberley Dayton

Faculty Scholarship

This Article explores the guardian’s role in making, or assisting the ward to make, health care decisions, and provides an overview of existing standards and tools that offer guidance in this area. Part II outlines briefly the legal decisions and statutory developments assuring patient autonomy in medical treatment, and shows how these legal texts apply to and structure the guardian’s role as health care decision-maker. Part III examines the range of legal and practical approaches to such matters as decision-making standards, determining the ward’s likely treatment preferences, and resolving conflicts between guardians and health care agents appointed by the ward. …

In Defense Of The Short Cut, Stephen M. Johnson Jan 2012

In Defense Of The Short Cut, Stephen M. Johnson

Articles

Congress frequently gives administrative agencies a choice of several different tools—including legislative rulemaking, nonlegislative rulemaking, and adjudication—to interpret and apply the statutes that they administer. When Congress gives agencies a choice, courts rarely second-guess the agencies’ choice of policymaking tool. Rarely, that is, unless the agency chooses to interpret a statute through nonlegislative rulemaking. ...

Part II of this Article explores the variety of policymaking tools that are available to agencies, the deference generally accorded an agency’s choice of tool, and the reluctance of courts to defer when agencies choose to make policy through nonlegislative rulemaking. Part III explores Franklin’s …

Learning Public Health Through Civic Issues, Kathleen Fitzpatrick Jan 2012

Learning Public Health Through Civic Issues, Kathleen Fitzpatrick

Health Sciences Faculty Publications

This course is organized around current challenging health issues, such as mandatory immunization, childhood obesity, health insurance, tobacco control, etc. Activities included issues-focused debates, lecture and video presentations, case study discussions, and guest speakers. Students completed fifteen hours of community-based service learning, many in the Lawrence Math-Science Partnership, an outreach program in which undergraduates work on after-school STEM enrichment activities with middle-school students. Several activities complemented the course issues, allowing college students to make connections between course theory and community needs, while engaging middle-school students in important public health concepts. The SENCER-SALG assessment (N=189/192 (98%) of enrolled students) indicated that …

Retrotransposons As A Major Source Of Epigenetic Variations In The Mammalian Genome, Muhammad B. Ekram, Keunsoo Kang, Hana Kim, Joomyeong Kim Jan 2012

Retrotransposons As A Major Source Of Epigenetic Variations In The Mammalian Genome, Muhammad B. Ekram, Keunsoo Kang, Hana Kim, Joomyeong Kim

Faculty Publications

Transcription of retrotransposons is usually repressed by DNA methylation, but a few elements, such as intracisternal A-particles (IAPs) associated with the Agouti and Axin-fused loci, partially escape this repression mechanism. The levels of this repression are also variable among individuals with an identical genome sequence, generating epigenetically different states of loci or epialleles. In the current study, we tested the existence of additional retrotransposon-derived epialleles in the mouse genome. Using a series of bioinformatics approaches, 143 candidate epialleles were first identified from the mouse genome based on their promoter activity and association with active histone modification marks. Detailed analyses suggest …

Contextual Chemosensory Urine Signaling In An African Cichlid Fish, Karen P. Maruska, Russell D. Fernald Jan 2012

Contextual Chemosensory Urine Signaling In An African Cichlid Fish, Karen P. Maruska, Russell D. Fernald

Faculty Publications

Chemosensory signaling is crucial for communication in many fish species, but little is known about how signalers modulate chemical output in response to sensory information and social context. Here, we tested the hypothesis that dominant male African cichlid fish (Astatotilapia burtoni) use urine signals during social interactions, and demonstrate that this signaling depends on social context (reproductive; territorial) and on available sensory information (visual cues; full interaction). We injected males with dye to visualize urine pulses and exposed them to full sensory information or visual cues alone of four types: (1) dominant male; (2) gravid (reproductively receptive) females; (3) mouth-brooding …

The Development And Morphology Of Zebrafish After Embryonic Ethanol Exposure, Frances Lee Jan 2012

The Development And Morphology Of Zebrafish After Embryonic Ethanol Exposure, Frances Lee

Honors Theses

Maternal consumption of alcohol may subject the fetus to fetal alcohol syndrome or fetal alcohol spectrum disorders (FAS or FASD). FAS/D is a public health problem, and affected children are defined by varying degrees of irreversible mental retardation, physical defects, behavioral issues, and vision problems from prenatal alcohol exposure (Riley et al. 2011). Recent studies on FAS have looked towards animal models, such as zebrafish, Danio rerio, that exhibit homologous physical and behavioral effects of alcohol (Bilotta et al. 2004). I exposed zebrafish embryos to low doses of ethanol (0.5% v/v or 1% v/v) in either chronic (at least 8 …

Edible Activism: Food And The Counterculture Of The 1960s And 1970s, Sandra Johnson Jan 2012

Edible Activism: Food And The Counterculture Of The 1960s And 1970s, Sandra Johnson

Honors Theses

Food is an essential part of every person’s life. Not only does it provide sustenance, but it also holds cultural value. Throughout American history, food has played a significant role in activism because of its ability to form and express identity, build community, demonstrate allegiance with certain beliefs, and reject the status quo. In 1773, American colonists boycotted the controlling British Monarchy and the monopolistic East India Company by throwing tea into the Boston harbor in what later became known as the Boston Tea Party. During the Jacksonian era of the 1830s, radical vegetarians led by the ideologies of …

“Called Her Women Together” Home Birth In Maine, Margaret Kruithoff Jan 2012

“Called Her Women Together” Home Birth In Maine, Margaret Kruithoff

Honors Theses

Nine months ago, I set out to write a thesis on childbirth: hippies having their babies in the woods, hospital politics, and women’s rights. The final product is very different than what I had intended. Instead of finding crazy hippies in the woods, I found a community of kind and skilled midwives and loving, openhearted mothers. I am deeply indebted to these inspiring women for their stories and wisdom, which fill the pages of this thesis. Interviewing these mothers, midwives, and home birth advocates was a tremendously empowering experience for me, a young woman.

Enhancement Of Emergence Potential And Stand Establishment Of Moringa Oleifera Lam. By Seed Priming, Wasif Nouman, Muhammad Tahir Siddiqui, Shahzad Maqsood Ahmed Basra, Irfan Afzal, Hafeez Ur Rehman

Turkish Journal of Agriculture and Forestry

Moringa oleifera is a miracle tree that can be used in multiple ways, including as foodstuff, livestock fodder, a plant growth enhancer, or a water purifier. While the stem cutting method is easy and successful for tree propagation, the recent introduction of moringa as a field crop for biomass production requires propagation through seeds. The germination of stored moringa seeds is a problem of great concern that may be overcome by employing seed priming techniques. A pot study was conducted to explore the potential of seed priming in moringa. Seeds were subjected to hydropriming, matripriming, and priming with moringa leaf …

Knowledge, Application, And The Impact Of Nutrition Education Of Portion Sizes In Female Adolescents, Denise Fearday Jan 2012

Knowledge, Application, And The Impact Of Nutrition Education Of Portion Sizes In Female Adolescents, Denise Fearday

Masters Theses

The rising rates of obesity in children and adolescents are a cause for concern and an opportunity to educate youth on prevention strategies regarding obesity. Studies have shown that adolescents carry their knowledge and habits of eating into adulthood, and therefore should be educated when young to prevent obesity at an older age. A nutrition education workshop was presented to a group of adolescent females to determine their knowledge and application of portion sizes. The workshop was designed as a pretest-intervention-posttest study with an objective of determining the impact of a portion size workshop on the knowledge and attitudes of …
