Pemilihan Perkataan Dan Struktur Morfologi Dalam Surah Al-Fatihah / Mat Taib Bin Pa, Pa Mat Taib

Student Works (2010-2019)

Sabah Malay Dialect : Phonological Differentiation In Social Context / Jane Wong Kon Ling, Jane Kon Ling Wong

Student Works (2010-2019)

Sabah Malay Dialect (SMD) or ‘the speech of Sabah’ is used widely as a lingua franca in interaction between different ethnic groups, and within single groups in Sabah. The broad sociolinguistic setting of the people of Sabah has influenced the formation of SMD. This is enhanced by migrations from Indonesia, the Philippines and other states in Malaysia. Consequently, the vast socio-cultural and socio-economic settings have resulted in language variations in SMD. SMD displays distinctiveness especially in its phonology compared to Standard Malay and other dialects. SMD is indeed a dialect in its own right as shown by this study. Adopting …

Constructing The Threat And The Role Of The Expert Witness: A Response To Aziz Rana's Who Decides On Security?, Wadie E. Said Jan 2012

Constructing The Threat And The Role Of The Expert Witness: A Response To Aziz Rana's Who Decides On Security?, Wadie E. Said

Publications

Aziz Rana's article presents clearly the overlooked but crucial question of "Who Decides on Security?" Namely, is determining who or what groups constitute a threat something that we are capable of making ourselves, or must we necessarily cede that authority to those in power-who supposedly have both the access to knowledge and the ability to understand it-to protect us from threats we cannot perceive? Using Rana's historical analysis as a framework, this Article builds on his thesis to show how the wide latitude granted to the conclusions of the Executive Branch's national security specialists in political matters has migrated into …

Economic Development And The Problem With The Problem-Solving Approach, Justin Deystone Jan 2012

Economic Development And The Problem With The Problem-Solving Approach, Justin Deystone

Publications

Scholars and practitioners alike have recently pointed to the idea of a "new moment" in the field of law and economic development, as well as a hope for a fruitful rethinking of political economy. The idea is that we have passed out of the period of high "neoliberalism," associated at one time with Reagan, Thatcher, and the so-called Washington Consensus and now eclipsed by the ascendance of the Obama Administration. The hope attending the new consensus is that, in the wake of neoliberal law and policy, the field of law and development might be on the verge of a new …

A Shift To Narrativity, Derek H. Kiernan-Johnson Jan 2012

A Shift To Narrativity, Derek H. Kiernan-Johnson

Publications

Slipshod, inconsistent use of core Applied Legal Storytelling terminology muddles its discourse and hampers its growth. Refining the field’s vocabulary is essential, but insufficient, as exclusive focus on the field’s objects of inquiry, such as story and narrative, and the means of creating or conveying them, such as storytelling and narrating, risks losing the “A” in ALS. We need a new focus, one unburdened by the ambiguities and negative associations of existing options that more accurately reflects Applied Legal Storytelling scholars’ unique contributions. A shift to narrativity. Narrativity, as imagined here, is a top-level quality of a legal text or …

Computable Contracts, Harry Surden Jan 2012

Computable Contracts, Harry Surden

Publications

This Article explains how and why firms are representing certain contractual obligations as computer data. The reason is so that computers can read and process the substantive aspects of contractual obligations. The representation of contractual obligations in data instead of (or in addition to) the traditional written language form - what this Article calls "data-oriented contracting" - allows for the application of advanced computer processing abilities to substantive contractual obligations. Certain financial contracts exemplify this model. Equity option contracts are routinely represented not as contract documents written in ordinary language - but as data records intended to be processed by …

Toward An Agenda For Teacher Education In Christian Colleges And Universities, Daniel C. Elliott Jan 2012

Toward An Agenda For Teacher Education In Christian Colleges And Universities, Daniel C. Elliott

International Christian Community of Teacher Educators Journal

The first (United States of America) national symposium by major teacher educator organizations took place in December 1995. The Association of Teacher Educators, the American Association of Colleges for Teacher Education, and the US Department of Education Office of Educational Research and Improvement sponsored and conducted a National Congress on Teacher Education. Leading national figures in teacher education presented their views to the almost 500 delegates. Focus groups examined the views and reported to a conference coordinator. The coordinator, in turn, synthesized the concerns, ideas and recommendations into a daily log of issues. I list some of the salient points …

Narrative Environmental Ethics, Nature Writing, And Ecological Science As Tradition: Towards A Sponsoring Ground Of Concern, John Ryan Jan 2012

Narrative Environmental Ethics, Nature Writing, And Ecological Science As Tradition: Towards A Sponsoring Ground Of Concern, John Ryan

Research outputs 2012

Over the last 30 years, environmental philosophers and ecological researchers have turned their attention to the possibilities of narratives: the stories people tell about their lives in conjunction with the human and non-human agents they live with. An interest in narrative environmental ethics reflects a re-evaluation of canonical ecophilosophical texts. Works such as Paul W. Taylor’s Respect for Nature suggest an essentialist view of environmental ethics in which predetermined principles are imposed on places and situations. On the other hand, Aldo Leopold’s A Sand County Almanac combines first-person prose with science-based explanations of the “biotic pyramid” towards the development of …

Which To Become? Encountering Fungi In Australian Poetry, John Ryan Jan 2012

Which To Become? Encountering Fungi In Australian Poetry, John Ryan

Research outputs 2012

As a largely unexplored group of organisms, fungi are ecologically complex members of the Australian biota. Fungi represent non-human alterity and interstitiality-neither animal not plant, beautiful yet evanescent, slimy and lethal, and eliding scientific categorisations. Donna Haraway's notion of "companion species" and Anna Tsing's "arts of inclusion" remind us that sensory entanglements are intrinsic to human-fungi relations. Drawing conceptually from Haraway and Tsing, this paper will examine examples of poetry from John Shaw Neilson, Jan Owen, Douglas Stewart, Geoffrey Dutton, Caroline Caddy, Michael Dransfield, Philip Hodgins, Jaime Grant and John Kinsella that represent sensory involvements with fungi based in smell, …

An action learning project was undertaken over a two-year period with the involvement of researchers, managers and practitioners across the five disciplines …

Skilled Labour Supply And Demand In Resource Rich Regions In Australia, Susanne Bahn, Rosalyn Cameron Jan 2012

Skilled Labour Supply And Demand In Resource Rich Regions In Australia, Susanne Bahn, Rosalyn Cameron

Research outputs 2012

The demand for specific skills for the current resources boom in Australia is placing extreme pressure upon the Australian workforce and economy to supply this labour for billion dollar resource sector projects primarily in Western Australia and Central Queensland. This paper is a conceptual think piece which overviews the current demand and supply of specialised labour for the Australian resources sector before presenting two resource rich region case studies. The first is the mining sector in Western Australia and the second is the coal seam gas/liquefied natural gas (CSG/LNG) industry in Central Queensland. This is followed by a mapping of …

Passive Flora? Reconsidering Nature's Agency Through Human-Plant Studies (Hps), John Ryan Jan 2012

Passive Flora? Reconsidering Nature's Agency Through Human-Plant Studies (Hps), John Ryan

Research outputs 2012

Plants have been—and, for reasons of human sustenance and creative inspiration, will continue to be—centrally important to societies globally. Yet, plants—including herbs, shrubs, and trees—are commonly characterized in Western thought as passive, sessile, and silent automatons lacking a brain, as accessories or backdrops to human affairs. Paradoxically, the qualities considered absent in plants are those employed by biologists to argue for intelligence in animals. Yet an emerging body of research in the sciences and humanities challenges animal-centred biases in determining consciousness, intelligence, volition, and complex communication capacities amongst living beings. In light of recent theoretical developments in our understandings of …

"Some Of My Children Are Worth More Than Others": Perceptions Of Nonresidential Fathers With Second Families As To The Fairness Of The Australian Child Support Agency's Handling Of First Family Child Support Financial Arrangements, Donna Stambulich, Julie Ann Pooley, Natalie Gately, Myra Taylor Jan 2012

"Some Of My Children Are Worth More Than Others": Perceptions Of Nonresidential Fathers With Second Families As To The Fairness Of The Australian Child Support Agency's Handling Of First Family Child Support Financial Arrangements, Donna Stambulich, Julie Ann Pooley, Natalie Gately, Myra Taylor

Research outputs 2012

One in three Australian marriages end in divorce, and over half of such divorces involve children. Research indicates that men tend to repartner within 1 to 2 years of a divorce and women within 3 to 5 years. A significant issue for repartnered men is the provision of financial support for children from both their first and second families. Although only 6% of all Australian first family children spend near/equal time (shared care) after divorce with both parents, fathers in Australia are mandated under child support legislation to provide financial support for their first family children, whether they reside with …

Voices In Concert: Communication Ethnography Of Pentecostal Worship, Bruce C. Coats Jan 2012

Voices In Concert: Communication Ethnography Of Pentecostal Worship, Bruce C. Coats

Dissertations (1934 -)

We know little about communication in Pentecostal worship service outside of the practice of tongues-speech. Pentecostals uniquely interpret communicative activity as distinctive factors in their identity; yet no research identifies the unique national speech codes operating with the Pentecostal churches. This study applied decreased that knowledge gap using Philipsen's Speech Codes Theory to analyzing the structure and interpretation of Pentecostal worship services, analyzing individual congregations in relationship with local culture and situated within the national Pentecostal movement. Fisher's narrative paradigm was applied to worship services to describe the narrative of a worship service as it extended in the everyday lives …

Multilingual Extraction Ontologies, Deryle W. Lonsdale, David W. Embley, Stephen W. Liddle, Yuri A. Tijerino Jan 2012

Multilingual Extraction Ontologies, Deryle W. Lonsdale, David W. Embley, Stephen W. Liddle, Yuri A. Tijerino

Faculty Publications

In our global society, multilingual barriers sometimes prohibit and often discourage international travelers from receiving desired goods and services. In a multilingual setting, easing linguistic-based tasks such as finding a restaurant, learning how to use local mass transit, and making simple business transactions would help remove barriers and encourage international travelers to seek and enjoy a wider variety goods and services. We propose multilingual extraction ontologies accessible via mobile devices as an aid to resolving these issues. Multilingual ontologies can communicate in multiple languages with the wireless local web as well as the international traveler and can thus break through …

Relationship Between Reported Out-Of-Class English Use And Proficiency Gains In English, Wendy Baker-Smemoe, Denisa K. Cundick, Norman Evans, Lynn Henrichsen, Dan P. Dewey

Faculty Publications

This study investigated the relationship between out-of-class L2 use and proficiency gains in learners of English as a second language (ESL) in an intensive English language program. In contrast to previous studies on this topic, which have found weak, non-existent or even inverse relationships between out-of- class language experience and L2 proficiency gains, this study took place over a longer period of time (31 weeks), involved a larger number of participants (61 ESL learners from 12 different language backgrounds at four proficiency levels), and found a statistically significant connection between out-ofclass language use and proficiency gains. Participants took a proficiency …

Is Color Blind Justice Also Culturally Blind? The Cultural Blindness In Justice, Shiv Narayan Persaud Jan 2012

Is Color Blind Justice Also Culturally Blind? The Cultural Blindness In Justice, Shiv Narayan Persaud

Journal Publications

As diverse ethnic groups continue to experience numeric growth and societal grounding in America, their advocacies for culturally competent representation within the legal system cannot be ignored or underplayed. Undoubtedly, some professions such as mental and physical health, and their related sectors, have developed and continue to integrate cultural competencies into their respective practices. Others such as the legal profession seem to lag in their advocacies and promotion of culturally competent practices.

In the criminal justice system, where discretionary legal decision-making authority is commonplace and may grossly affect the civil liberties of the citizenry, a paucity of standards requiring cultural …

Ogawa Mimei's Children's Stories: A Case Study Of The Rise Of Childhood In The Context Of Westernization And Japanese Modernization, Alexandra E. Kint Jan 2012

Ogawa Mimei's Children's Stories: A Case Study Of The Rise Of Childhood In The Context Of Westernization And Japanese Modernization, Alexandra E. Kint

Honors Theses

In this thesis, I examine the influences of westernization, the tension between Japanese modernity and tradition, and the stories of Hans Christian Andersen on Ogawa Mimei’s children’s stories. I begin the body of my thesis with a brief historical background of Japan, beginning with the start of the Meiji period in 1868. Within the historical section, I focus on societal and cultural elements and changes that pertain to my thesis. I also include the introduction of Hans Christian Andersen in Japan. I wrap up the historical section by a description of Ogawa’s involvement in the Japanese proletarian literature movement and …

Transnationalism And Identity: The Concept Of Community In Ghanaian Literature And Contemporary Ghanaian Culture, Devin M. Geary Jan 2012

Transnationalism And Identity: The Concept Of Community In Ghanaian Literature And Contemporary Ghanaian Culture, Devin M. Geary

Honors Theses

In my thesis, I use anthropology, literature, and adinkra, an indigenous art, to study Ghanaian concepts of community from an interactive standpoint. While each of these disciplines has individually been used to study the concept of community, the three have not previously been discussed in relation to one another. I explore the major findings of each field—mainly that in anthropology, transnational informants find communities upheld; in literature, transnational characters find the opposite; and in adinkra, there are elements of both continuity and dissolution—to discuss Ghanaian constructs of community in the transnational world. Throughout time, there have always been transnational individuals …

Legal Convergence Of East And West In Contemporary American Water Law, Robert Haskell Abrams Jan 2012

Legal Convergence Of East And West In Contemporary American Water Law, Robert Haskell Abrams

Journal Publications

Legal instrumentalism and legal convergence, two legal constructs, describe how American water law has developed over time. A study of early Eastern and Western water law shows that both systems are instrumentalist at their core and evolved to suit pressing developmental needs. Early on in the East, law was created to protect water use for millers, who used mills to generate power. In the West, riparian systems of the East were rejected in favor of a system that met the needs of settlers in more arid environments. Legal convergence is a concept suggesting that law governing various fields converges over …

Historical Realism And Imperialist Nostalgia In Terrence Malick’S The New World, Monika Siebert Jan 2012

Historical Realism And Imperialist Nostalgia In Terrence Malick’S The New World, Monika Siebert

English Faculty Publications

The promotional materials for Terrence Malick’s The New World (2005) devote considerable time to detailing the extraordinary effort of the production crew to recreate Werowocomoco, the capital of the Powhatan’s paramount chiefdom, and Fort James, the first surviving English settlement in Virginia, in the period from 1607 to 1617. The hour-long documentary on “The Making of The New World” accompanying the DVD release of the film, for example, chronicles the shared work of a research team of historians, archeologists, linguists, anthropologists, and members of Virginia tribes to represent as faithfully as possible Powhatan and English agriculture, architecture, language, and …
