Mass Disaster Mediation: Innovative, Adr, Or A Lion's Den?, Elizabeth Baker Murrill Mar 2012

Mass Disaster Mediation: Innovative, Adr, Or A Lion's Den?, Elizabeth Baker Murrill

Pepperdine Dispute Resolution Law Journal

Mass torts and other mass claims are becoming an ever more popular forum for the use of alternative dispute resolution to resolve parties' claims in the wake of events that produce thousands of conflicts overnight. Mediation, in particular, has been used in several high-profile mass disaster events in an effort to resolve individual claims efficiently and quickly. This paper evaluates special risks posed in this kind of mediation that can go to the heart and the integrity of the mediation process. The thesis of this paper is that the potential imbalance in the parties' experience, education, and individual situation can …

The Negotiator-As-Professional: Understanding The Competing Interests Of A Representative Negotiator, Trevor C. W. Farrow Mar 2012

The Negotiator-As-Professional: Understanding The Competing Interests Of A Representative Negotiator, Trevor C. W. Farrow

Pepperdine Dispute Resolution Law Journal

This article is about lawyers as negotiators, and in particular, it is about identifying and understanding the influential and potentially competing interests that are - or at least should be - in the minds of lawyers (and potentially other third party representatives) during the overall negotiation process. While there continues to be an increasing amount of literature on the mechanics and strategies of negotiation, the underlying interests that are typically at stake in representative negotiations from the perspective of representatives - particularly negotiations involving lawyers - have not been adequately studied. And until all interests are identified and placed squarely …

Funding The Fight Against Domestic Violence, Carol W. Hunstein, Joan Prittie, Sherry Boston, Michelle Carney Mar 2012

Funding The Fight Against Domestic Violence, Carol W. Hunstein, Joan Prittie, Sherry Boston, Michelle Carney

Working in the Public Interest Conferences

Last October, the City Council in Topeka, Kansas, adopted a radical approach to managing the cots of prosecuting domestic violence— the city repealed its domestic violence law. The move was political brinksmanship, intended to force the county to pick up the tab for prosecutions, but it nonetheless sent a significant message about state and local funding priorities.

Across the nation, declining returns on escrow accounts funding legal services, government funding cutbacks, and reduced giving has left more people at risk of serious harm and death from domestic violence. Panelists will discuss the effects of austerity on prosecutions, preventative services, and …

Mobilization And Poverty Law: Searching For Participatory Democracy Amongst The Ashes Of The War On Poverty, Wendy A. Bach Mar 2012

Mobilization And Poverty Law: Searching For Participatory Democracy Amongst The Ashes Of The War On Poverty, Wendy A. Bach

Scholarly Works

In 1964, at the height of the Civil Rights Movement, the federal government launched Community Action, a program that was to be designed and implemented with the maximum feasible participation of the poor. Today in governance theory, we are told once again that participation by affected communities in the mechanisms of governance have the ability to deepen democracy – to yield better policy and to engage new voices in the mechanisms of democracy. Mobilization and Poverty Law: Searching for Participatory Democracy Amongst the Ashes of The War on Poverty turns to history to explore a question central to both governance …

Addressing The Needs Of Self-Represented Litigants In The Canadian Justice System, Trevor C. W. Farrow, Diana Lowe, Bradley Albrecht, Heather Manweiller, Martha E. Simmons Mar 2012

Addressing The Needs Of Self-Represented Litigants In The Canadian Justice System, Trevor C. W. Farrow, Diana Lowe, Bradley Albrecht, Heather Manweiller, Martha E. Simmons

Canadian Forum on Civil Justice

How can the Canadian justice system better assist self-represented litigants (SRLs) with their legal needs? There is a service gap that exists in the Canadian justice system between what SRLs need and what is currently being provided. The system needs to better address how SRLs understand, avoid, manage and resolve their legal issues. While the entire justice system has a role to play in understanding and addressing this question, courts and court administrators in particular have a central role to play. Some important efforts have begun to address the needs of SRLs. However, major challenges persist in providing adequate court …

Changing The Modal Law School: Rethinking U.S. Legal Education In (Most) Schools, Nancy B. Rapoport Mar 2012

Changing The Modal Law School: Rethinking U.S. Legal Education In (Most) Schools, Nancy B. Rapoport

Dickinson Law Review (1908-2003)

This essay argues that discussions of educational reform in U.S. law schools have suffered from a fundamental misconception: that the education provided in all of the American Bar Association-accredited schools is roughly the same. A better description of the educational opportunities provided by ABA-accredited law schools would group the schools into three rough clusters: the "elite" law schools, the modal (most frequently occurring) law schools, and the precarious law schools. Because the elite law schools do not need much "reforming," 2 the better focus of reform would concentrate on the modal and precarious schools; however, both elite and modal law …

A Battle Between Law And Society In Micronesia: An Example Of Originalism Gone Awry, Brian Z. Tamanaha Mar 2012

A Battle Between Law And Society In Micronesia: An Example Of Originalism Gone Awry, Brian Z. Tamanaha

Washington International Law Journal

Two conceptions of the relationship between law and society appear to compete: the idea that law mirrors society and the notion that a gap exists between law and society. Both ideas have some truth—law is an imperfect mirror of society. For various reasons, law and society can fall out of sync or even come into conflict. The 1975 Constitutional Convention, which led to the formation of the Federated States of Micronesia (“FSM”), marked the beginning of a battle between that society and its legal institutions. The Constitution’s framers strove to preserve traditional Micronesian culture by ensuring it a respected place …

Denial: Domestic Violence In The South Florida Tri-County Jewish Community, Michael Sue Jenefsky Mar 2012

Denial: Domestic Violence In The South Florida Tri-County Jewish Community, Michael Sue Jenefsky

School of Criminal Justice Theses and Dissertations

The research hypothesis of the study was that there was denial with regard to domestic violence in the Jewish population of the South Florida tri-county area. The Jewish female victims of domestic violence that reside in the South Florida tri-county area were shown to be underserved stemming from denial within the Jewish community. Determining factors of underserved were the lack of faith-based shelters, shalom bayit (peace in the home), get (Jewish divorce), and the need for financial support from various sources. Challenge to the hypothesis was eliminated by the comparison of statistics from two distinct frames of reference: distribution of …

How Do Start-Ups Obtain Their Legal Services?, Darian M. Ibrahim Mar 2012

How Do Start-Ups Obtain Their Legal Services?, Darian M. Ibrahim

Faculty Publications

This essay presents the first empirical study of how rapid-growth start-up companies obtain their legal services, with particular attention to the choice between in-house and outside counsel. Drawing on responses to online surveys of venture-capital-backed start-ups formed between 2006 and 2008, the study tests several hypotheses rooted in economic and entrepreneurship literature. The results show that most start-ups do not employ in-house counsel, with cost considerations and broader coverage offered by outside firms emerging as the primary reasons. In contrast, start-ups that do hire in-house counsel cite their attorneys’ superior understanding of the business, responsiveness, and ability to monitor internal …

Saving Smokers From Themselves: The Paternalistic Use Of Cigarette Taxes, Gary M. Lucas Jr. Mar 2012

Saving Smokers From Themselves: The Paternalistic Use Of Cigarette Taxes, Gary M. Lucas Jr.

Faculty Scholarship

Governments at all levels have significantly increased cigarette taxes in recent years. Under the framework traditionally used by tax policy analysts, these tax increases are justified (1) if they are necessary to force smokers to internalize the harm that smoking causes others or (2) if they are a fair and efficient way to fund the government. But economists have generally concluded that on net, smokers do not impose large costs on third parties. In addition, heavily taxing cigarettes places a significant financial burden on low-income smokers and their families, which raises fairness concerns. As a result, scholars who support cigarette …

Securing Civil Protection Orders For Teens When Laws Ignore Teens, Lisa V. Martin Mar 2012

Securing Civil Protection Orders For Teens When Laws Ignore Teens, Lisa V. Martin

Faculty Publications

Despite the pervasiveness of violence in teen relationships, civil protection order statutes largely ignore teens. The accessibility of protection orders for teens depends primarily on the scope of their rights to standing and legal capacity to pursue claims for protection. Because states largely fail to detail expressly the circumstances under which teens are accorded standing to seek protection orders and legal capacity to represent their own interests in related court proceedings, the accessibility of protection orders for teens in most states remains in flux.

This article explores legal principles and policy arguments that support the extension of standing and legal …

The Brave New World Of Lawyers In Japan Revisited: Proceedings Of A Panel Discussion On The Japanese Legal Profession After The 2008 Financial Crisis And The 2011 Tōhuku Earthquake, Bruce E. Aronson Mar 2012

The Brave New World Of Lawyers In Japan Revisited: Proceedings Of A Panel Discussion On The Japanese Legal Profession After The 2008 Financial Crisis And The 2011 Tōhuku Earthquake, Bruce E. Aronson

Washington International Law Journal

In the United States, the 2008 financial crisis had a serious impact on a legal profession that had been growing strongly for three decades, highlighting fundamental issues concerning the business and educational models of both law firms and law schools. This raises the interesting question of how Japan, with its much shorter history of large law firms and professional law schools, has been affected by the 2008 financial crisis and the 2011 Tōhoku earthquake, tsunami, and nuclear reactor crisis. At a recent conference sponsored by the University of Washington School of Law and the law firm of Perkins Coie, a …
