The "Act amends the 'Georgia Fair Lending Act' by revising certain definitions including 'annual percentage rate,' 'creditor,' 'home loan,' and 'points and fees.' The Act provides for certain limits on liability for persons who purchase, are assigned, or become a holder of a high-cost home loan. The Act further provides for exemptions for state …

Georgia State University Law Review

The Act allows law enforcement agencies to apply for certificates to use speed detection devices so long as the applicant provides continuous law enforcement services or allows only full-time officers to operate such devices. The Act defines what is commonly know as a "speed trap." It provides a rebuttable presumption that a law enforcement agency is utilizing its speed detection devices for revenue purposes when the fines levied based upon the use of such devices are equal to or more than forty percent of the agency's budget. However, in calculating the total speeding revenue for the agency, fines levied for …

Social Networking And Faculty Discipline: A Pennsylvania Case Points Toward Confrontational Times, Requiring Collective Bargaining Attention, James Ottavio Castagnera, John Lanza Iv

Journal of Collective Bargaining in the Academy

While social-networking sites like Facebook are still relatively new to the working world, employers monitoring their employee’s activities and conduct outside the workplace is not. The most alluring aspects of social-networking sites is the ease in which an account can be created and maintained, the personalization options they present to the user, and a uniquely 21st century way of keeping in contact with friends and family. Social-networking sites are truly a wonder of the modern age, where by typing out a few sentences, uploading some photographs, videos and making some friend requests, one can present his or her entire life …

State Building Codes: Firm Ceilings, Hard Floors, Or Shaky Foundations For Local Construction And Rehabilitation Standards, James Bross Mar 2012

State Building Codes: Firm Ceilings, Hard Floors, Or Shaky Foundations For Local Construction And Rehabilitation Standards, James Bross

Georgia State University Law Review

In law reform, as in life, the foam rubber pillow is often the best metaphor for the unforeseen effects of earnest efforts: just when all energy is directed at the annoying lump on one side, the far side springs out vengefully. During the 1960's, legal scholars and presidential commissions pressed earnestly for statewide building codes to serve as ceilings on local standards which are expensive impediments to mass-produced low-income housing; the legal scholars of the 1980's are eager to preserve historic structures whose rehabilitation is impeded by the inflexible floor of state codes under local standards. This article will evaluate …

Improving Filtering Of Email Phishing Attacks By Using Three-Way Text Classifiers, Alberto Trevino Mar 2012

Improving Filtering Of Email Phishing Attacks By Using Three-Way Text Classifiers, Alberto Trevino

Theses and Dissertations

The Internet has been plagued with endless spam for over 15 years. However, in the last five years spam has morphed from an annoying advertising tool to a social engineering attack vector. Much of today's unwanted email tries to deceive users into replying with passwords, bank account information, or to visit malicious sites which steal login credentials and spread malware. These email-based attacks are known as phishing attacks. Much has been published about these attacks which try to appear real not only to users and subsequently, spam filters. Several sources indicate traditional content filters have a hard time detecting phishing …

Collaborative Family Law, Pauline H. Tesler Mar 2012

Collaborative Family Law, Pauline H. Tesler

Pepperdine Dispute Resolution Law Journal

Collaborative Law appears to meet significant needs both among family law clients and among the lawyers who assist them through divorce. As will be discussed more fully below, clients appear to want the advantages of a contained, settlement-oriented, creative, private, respectful process without sacrificing the benefits of having a committed legal advocate at their sides. For that reason Collaborative Law appeals to clients who may hesitate to commit to a dispute resolution process facilitated solely by a neutral mediator. And, while many family lawyers suffer considerable professional angst as a consequence of their awareness that family law courts are neither …

Facillitative Mediation: The Classic Approach Retains Its Appeal, Carole J. Brown Mar 2012

Facillitative Mediation: The Classic Approach Retains Its Appeal, Carole J. Brown

Pepperdine Dispute Resolution Law Journal

In this additional step in the civil litigation process in Ontario, the mediator is assigned a primarily "facilitative" role. This paper advances the position that mandatory mediation in Ontario was not designed as a process where a third party would offer an evaluation of the legal merits of a dispute. Instead, the goals of mandatory mediation are best achieved, and the parties know what to expect, when a mediator takes on the role of a neutral third party who facilitates communication, and takes an interest-based approach to problem-solving. This paper further posits that the mandatory mediation process, which requires the …
