California's 2011 Realignment Legislation Addressing Public Safety And How It Will Impact Local Governments, John Mineau May 2012

California's 2011 Realignment Legislation Addressing Public Safety And How It Will Impact Local Governments, John Mineau

Master's Theses or Doctor of Nursing Practice

California’s 2011 Realignment Legislation Addressing Public Safety is the most sweeping public safety reform package since shortly after California’s statehood in 1850. Traditionally, any person convicted and confined for a felony has been incarcerated and supervised by the state. Moving forward, realignment will put many convicted felons in local jails instead of state prisons. It will also place paroling offenders under local probation supervision rather than state parole. The change in parole supervision represents a monumental shift of responsibility from the state to local governments. Realignment will have major effects on local government operations and budgets. Realignment has been conceptualized …

The Lawyer Meets The Therapist, The Minister, And The Psychiatrist: Law School Cross-Professional Collaborations, Timothy W. Floyd May 2012

The Lawyer Meets The Therapist, The Minister, And The Psychiatrist: Law School Cross-Professional Collaborations, Timothy W. Floyd

Mercer Law Review

Lawyers in practice rarely encounter purely legal problems. Understanding the social, economic, political, and historical context is often crucial to resolving legal issues, and legal decisions are often dependent upon business, scientific, medical, psychological, and technological information. Most legal representation occurs within some field of enterprise or industry, and nearly all representation of clients involves complex emotional and interpersonal dynamics.

Early in my legal career, I realized the importance of knowing other fields and specialties in order to be an effective lawyer. My first practice experience was in commercial litigation, and our firm represented clients from a wide range of …

Trends And Challenges In Lawyer Regulation: The Impact Of Globalization And Technology, Laurel Terry, Steve Mark, Tahlia Gordon

Faculty Scholarly Works

Globalization and technology have changed the practice of law in dramatic ways. This is true not only in the United States, but around the world. In this article, author Laurel Terry, along with Australian regulators Steve Mark and Tahlia Gordon, documented some of these global trends in lawyer regulation. Their article concluded that regulators face issues in common regarding “who” is regulated, “what” or whom is regulated, “when” regulation occurs, “where” regulation occurs, “how” it occurs, and “why” regulation occurs.

This article uses this who-what-when-where-why-and-how framework to discuss events around the world. These developments include the 2007 UK Legal Services …

Community Resources And Black Social Action, F Street, A Case Study, Robert Joseph Mckee May 2012

Community Resources And Black Social Action, F Street, A Case Study, Robert Joseph Mckee

UNLV Theses, Dissertations, Professional Papers, and Capstones

This study examines the resources employed by the predominantly African American residents of Historic West Las Vegas, Nevada, to protest a street closure in their community. Previous studies of collective social action in the black community have stressed the involvement and resources of the black church. Instead, the residents of this community relied on cultural, social, and economic resources that did not depend heavily on the church. In this ethnographic case study, I combined participant observation, ethnographic interviews, prolonged engagement, photographs, and document analysis. I argue that the resources a community employs in social action can be analyzed using my …

Do At-Risk Students Benefit When Novanet Is Used For Credit Recovery?, Rebecca Lynn Volkerding May 2012

Do At-Risk Students Benefit When Novanet Is Used For Credit Recovery?, Rebecca Lynn Volkerding

Dissertations

The purpose of this study was to determine if it is effective and appropriate to place all students needing credit recovery in computer-based classes regardless of age, risk ratio, and their previous failing grade. Driven by the NCLB mandate for schools to produce greater gains and graduate all students in 4.5 years, districts are now using online credit recovery programs to help at-risk students gain promotion and put students back on-track for graduation without placing these students back in the traditional classroom setting where they failed the class the first time. Although there is an adequate knowledge base about the …

Intellectual Property, Traditional Knowledge, And Biodiversity In The Global Economy: The Potential Of Geographical Indications For Protecting Traditional Knowledge-Based Agricultural Products, Teshager W. Dagne May 2012

Intellectual Property, Traditional Knowledge, And Biodiversity In The Global Economy: The Potential Of Geographical Indications For Protecting Traditional Knowledge-Based Agricultural Products, Teshager W. Dagne

PhD Dissertations

The relationship between international regimes regulating intellectual property, traditional knowledge and biodiversity has received much attention in recent times. Of the many complex and controversial issues in contemporary international legal discourse on this matter, the protection of traditional knowledge (TK) stands out as a significant challenge. Choices abound in the search for modalities to regulate rights to use and control TK systems and their underlying biodiversity. In recent times, the protection of geographical indications (GIs) has emerged as an option for protecting TK. Despite the considerable enthusiasm over it, there is appreciable research dearth on how far and in what …

Organizational Alliances By U.S. Schools, Elizabeth Chambliss May 2012

Organizational Alliances By U.S. Schools, Elizabeth Chambliss

Faculty Publications

U.S. law schools increasingly are forming organizational alliances with other training providers in the interests of market expansion and/or consolidation. At the top of the market, U.S. law schools are seeking to brand their positions within the global economy by forming alliances with elite foreign law schools, business schools, and corporate law firms and clients. Schools outside of this market are moving to establish alternative niches through alliances with solo and small firm practitioners, CLE providers, and other organizations serving low-and middle-income clients, as well as through the development of accelerated and/or specialty degrees. Schools at all levels are increasingly …

Engaging With Motherhood: Gender And Sexuality In Environmental Justice, Hannah M G Snyder May 2012

Engaging With Motherhood: Gender And Sexuality In Environmental Justice, Hannah M G Snyder

Pomona Senior Theses

Despite the fact that women make up a large proportion of participants in the environmental justice movement, the movement is still framed in terms of race and class. This thesis investigates the intersections of gender, sexuality, race, class, and environmental justice. I explore the prominent rolls that women play in grassroots environmental justice movements and the look at the discourses that surround gender and environmental justice through a queer studies and ecofeminist lens. I argue that motherhood narratives—while powerful motivators for activists and effective tools for creating resistance—can create a rhetoric that is exclusionary to people with non-normative sexualities and …

The Three W'S Of Hazardous Waste: Who, Why, And Where?, Christa Dean Jensen May 2012

The Three W'S Of Hazardous Waste: Who, Why, And Where?, Christa Dean Jensen

Graduate Theses, Dissertations, and Problem Reports (ETD)

In the late 1960s and 1970s, amid changing attitudes about the environment and emerging sustainability concerns, countries around the world began regulating multiple aspects of hazardous waste. Initial regulations, and those occurring since, all share the broader goals of curbing hazardous waste generation and regulating hazardous waste trade, but with few signs of progress. Using input-output analysis and spatial interaction modeling, this dissertation analyzes various dimensions of the hazardous waste problem in the United States and the United Kingdom. The overall objective is to develop methods to answer the following questions: 1) who is generating hazardous waste; 2) why is …

Mass Torts And Due Process, Sergio J. Campos May 2012

Mass Torts And Due Process, Sergio J. Campos

Vanderbilt Law Review

As the old saying goes, hard cases make bad law. But hard cases also reveal the limits of legal doctrine. In this Article, I turn to a class of hard cases--mass torts--to rethink the law of procedural due process under the Due Process Clause. Mass torts have long perplexed courts and scholars. They include torts caused by asbestos and other toxic chemicals, pharmaceuticals, oil spills, and other mass-produced products and services. The plaintiffs not only suffer significant injuries, but the sheer number of plaintiffs, each with claims that raise unique fact and legal issues, stretch judicial resources to the limit. …

Regulating Conflicts Of Interest In Global Law Firms: Peace In Our Time?, Janine Griffiths-Baker, Nancy J. Moore May 2012

Regulating Conflicts Of Interest In Global Law Firms: Peace In Our Time?, Janine Griffiths-Baker, Nancy J. Moore

Faculty Scholarship

The phenomenon of the global law firm has transformed the face of international law practice. The practice of law has itself become global, as lawyers play their part in the growing international market for corporate and commercial services. The global expansion of legal practice has prompted several jurisdictions to consider how their own global legal service markets should be regulated. To date, only limited scholarly consideration has been given to the practicalities of regulating the day-to-day practice of law on an international scale.

This Article attempts to shed light on methods of regulating the conduct of lawyers in the context …

The Traditional Roles Of Caring For Elders: Views From First Nations Elders Regarding Health, Violence, And Elder Abuse, Eileen A. Owen-Williams May 2012

The Traditional Roles Of Caring For Elders: Views From First Nations Elders Regarding Health, Violence, And Elder Abuse, Eileen A. Owen-Williams

Theses and Dissertations (ETD)

This study sought to respectfully understand Northern British Columbia First Nations Elders' views regarding health of communities, intergenerational relationships, Elder roles, and violence towards Elders. Injuries, both intentional and unintentional, are a leading cause of death for First Nations Peoples. Information regarding Elder abuse in First Nations communities is lacking, though family violence has been identified as a problem within First Nations communities. The goal of this research was to understand the point of view and Elders' reality through the creation of a dialogue with Elders, and to discern the interface between Traditional First Nations' belief systems, healing methods, and …

“Strong Words, Gentle Deeds”: Evaluating The Effectiveness Of The Maryland Immigration Consultant Act Five Years On, Cori Alonso-Marsden Apr 2012

“Strong Words, Gentle Deeds”: Evaluating The Effectiveness Of The Maryland Immigration Consultant Act Five Years On, Cori Alonso-Marsden

Legislation and Policy Brief

On February 7, 2005, legislators introduced in the Maryland General Assembly a bill entitled “Consumer Protection – Immigration Consulting Services.” Designated as House Bill 691, the legislation sought to protect Maryland consumers through a series of civil and criminal provisions targeting consultants for unauthorized immigration legal practice. Primarily, House Bill 691 limited the types of services an immigration consultant could offer and the claims she could make regarding those services. In addition, the law required that the consultant provide the client with a posted disclaimer regarding the scope of the service, and a written contract prior to the provision of …
