Fundamental Forces Driving United States And International Financial Regulations Reform, Lawrence G. Baxter Jan 2012

Fundamental Forces Driving United States And International Financial Regulations Reform, Lawrence G. Baxter

Faculty Scholarship

Multiple forces create a systemic crisis of the proportions of the Global Financial Crisis of 2008. Global and domestic financial reform is a difficult and perplexing task, one that is likely to take many years, and one that will surely continue to be shaped by a diverse range of forces. Recent measures remain incomplete and in some cases are even proving to be misdirected. This article considers seven fundamental forces shaping actions on future reform, specifically the (1) long term impact of the Crisis (and all financial crises); (2) increase in the “financialization” of the global economy, seemingly disproportionate to …

A Current Assessment Of Some Extraterritorial Impacts Of The Dodd-Frank Act With Special Focus On The Volcker Rule And Derivatives Regulation, Lawrence G. Baxter Jan 2012

A Current Assessment Of Some Extraterritorial Impacts Of The Dodd-Frank Act With Special Focus On The Volcker Rule And Derivatives Regulation, Lawrence G. Baxter

Faculty Scholarship

As the world struggles to emerge from the Global Financial Crisis the vision of a harmonious framework of global financial regulation seems as distant as ever. Important progress made by international committees such as the Basel Committee on Banking Supervision and the Financial Stability Board notwithstanding, there seem to be increasing signs of unilateral, extraterritorial action by major jurisdictions, including the United States. This paper reviews the framework created by the US financial reforms, in particular anti money laundering provisions, the Volcker Rule and the proposed OTC derivatives margin requirements, and considers some of the dilemmas presented by modern global …

Analysis And Synthesis Of Metadata Goals For Scientific Data, Craig Willis, Jane Greenberg, Hollie C. White Jan 2012

Analysis And Synthesis Of Metadata Goals For Scientific Data, Craig Willis, Jane Greenberg, Hollie C. White

Faculty Scholarship

The proliferation of discipline-specific metadata schemes contributes to artificial barriers that can impede interdisciplinary and transdisciplinary research. The authors considered this problem by examining the domains, objectives, and architectures of nine metadata schemes used to document scientific data in the physical, life, and social sciences. They used a mixed-methods content analysis and Greenberg’s (2005) metadata objectives, principles, domains, and architectural layout (MODAL) framework, and derived 22 metadata-related goals from textual content describing each metadata scheme. Relationships are identified between the domains (e.g., scientific discipline and type of data) and the categories of scheme objectives. For each strong correlation …

Freedom Of Expression And Its Competitors, George C. Christie Jan 2012

Freedom Of Expression And Its Competitors, George C. Christie

Faculty Scholarship

The recognition of an increasing number of basic human rights, such as in the European Convention on Human Rights, has had the paradoxical effect of requiring courts in the common-law world to consider whether the extensive protection given by the common law to expression that was not false or misleading must be modified to accommodate these newly recognized basic rights. The most important of these newly recognized rights is the right of privacy, although expression has other competitors as well, such as what might be called a right to be spared the emotional trauma caused by abusive language. This article …

Services Liberalization In The Philippines: A Capacity Needs Assessment For Aec 2015, Fernando T. Aldaba, Rafaelita M. Aldaba Jan 2012

Services Liberalization In The Philippines: A Capacity Needs Assessment For Aec 2015, Fernando T. Aldaba, Rafaelita M. Aldaba

Economics Department Faculty Publications

The paper aims to assess and determine the capacity-building needs required to liberalize trade in services in the Philippines. Through the ASEAN Framework Agreement on Services, the Philippines has committed to liberalize various sectors including air transport, maritime transport, construction, financial services, and telecommunications. The overall progress of services liberalization has been modest compared to trade in goods due mainly to constitutional restrictions, limitations on market access, and application of the national treatment principle. Apart from these constitutional and legal constraints, the other obstacles to services liberalization include high cost of doing business, inadequate infrastructure, and governance issues affecting the …

Finding International Law, Part Ii: Our Fragmenting Legal Community, Harlan G. Cohen Jan 2012

Finding International Law, Part Ii: Our Fragmenting Legal Community, Harlan G. Cohen

Faculty Scholarship

Is there an “International Community?” This Article suggests that there is not, that the oft-discussed fragmentation of international law reveals that there are in fact multiple overlapping and competing international law communities, each with differing views on law and legitimacy.

This Article reaches this conclusion by taking a fresh look not only at the sources of fragmentation, but at the sources of international law itself. Building on earlier work rethinking international law’s sources and drawing insights from legal philosophy, compliance theory, and international relations, this Article takes a closer look at three areas that have challenged traditional interpretations of international …

Flows, Vortices, And Counterflows: Artification And Aesthetization In Chiasmatic Motion On A Mobius Ring, Yrjö Sepänmaa Jan 2012

Flows, Vortices, And Counterflows: Artification And Aesthetization In Chiasmatic Motion On A Mobius Ring, Yrjö Sepänmaa

Contemporary Aesthetics (Journal Archive)

My first question is the general orientation towards the aesthetic and artistic in our culture. Secondly, I deal with intentional and sought-for aestheticization and artification, which are driven particularly by art and aesthetic education. Thirdly, I concentrate on the effects of the change on people and culture, in general, and on art, in particular. The processes of art and the aesthetic have their counter-movements that create tension and dynamics. I characterize the flow pattern as chiasmatic motion taking place on a Möbius ring. Art and the aesthetic are a pair, the parts of which are related to each other through …

Aesthetization, Artification, And Aquariums, Thomas Leddy Jan 2012

Aesthetization, Artification, And Aquariums, Thomas Leddy

Contemporary Aesthetics (Journal Archive)

‘Artification’ is a term recently coined and developed in Finnish aesthetic theory and proposed by Ossi Naukkarinen in this volume as the process of treating non-art objects as art. In this paper, I distinguish between a superficial sort of artification and a deep sort. The superficial sort is the one we need to worry about. In Part I, I consider various issues surrounding the definition of artification. In the process, I situate artification within the larger question of aestheticization. I understand aestheticization in terms of recent psychological work on supernormal stimuli and Virginia Postrel’s defense of style and surface in …

When Is Artification?, Roberta Shapiro, Nathalie Heinich Jan 2012

When Is Artification?, Roberta Shapiro, Nathalie Heinich

Contemporary Aesthetics (Journal Archive)

How do people do or make things that come to be seen as works of art? In other words, when is there artification? The answer to this question is simultaneously symbolic, material, and contextual. It has to do with meanings, objects, interaction, and institutions. We seek to define not what art is nor how it should be considered, but how and under what circumstances it comes about by way of methodical observation and inquiry in a variety of fields. Circus acrobats, break-dancers, fashion designers, chefs, graffiti artists, printers, photographers, and jazz musicians are some of the examples we explore. This …

Artification And The Drawing Of Distinctions: An Analysis Of Categories And Their Uses, Kari Korolainen Jan 2012

Artification And The Drawing Of Distinctions: An Analysis Of Categories And Their Uses, Kari Korolainen

Contemporary Aesthetics (Journal Archive)

The aim of the article is to examine how we distinguish between art, decoration, and furnishing within a research interview. The interview specimens here are examined by adapting the ethnomethodologically oriented method of Membership Categorization Analysis. The results indicate that the speakers rely, for example, on the context of the interview situation and also use flexible logical means, such as conditioning and comparison, to make the discussed issues more comprehensive. The results of the analysis are interpreted in the context of artification, emphasizing in particular the notion of the situated process of categorical resiliency.

Church Turnaround: Perspectives, Principles, And Practices, Kenneth E. Priddy Jan 2012

Church Turnaround: Perspectives, Principles, And Practices, Kenneth E. Priddy

Great Commission Research Journal

Prominent church analysts agree that over 80% of American Protestant churches are in plateau and decline and that the growth of the church is not keeping pace with the growth of the population. Sacrifice on the part of church leaders and congregants is sorely needed but strongly resisted, as congregations tend to prefer stability and familiarity above risk and change. This paper presents insights into the origin of plateau and decline and offers perspectives, principles, and practices that when properly and faithfully applied, generate health, growth, and multiplication in churches that commit to sustainable church turnaround.

Characteristics Of Turnaround Pastors, Gordon Penfold Jan 2012

Characteristics Of Turnaround Pastors, Gordon Penfold

Great Commission Research Journal

While the population of the United States grows, the percentage of people attending church continues to plummet. Much of the drop can be attributed to the 70% to 85% of the churches that have plateaued or declined in attendance. However, bright spots are on the church landscape. Many churches, after decades of plateau or decline, begin to turn around and grow as they are led by “turnaround” pastors. This paper explores the leadership characteristics of turnaround pastors in contradistinction to non-turnaround pastors and argues that church renewal and church planting are critical components needed for a healthy twenty-first century church.

A Critique Of The Multi-Ethnic Church Planting Strategy, Gustavo Suarez Jan 2012

A Critique Of The Multi-Ethnic Church Planting Strategy, Gustavo Suarez

Great Commission Research Journal

This paper seeks to discover if the multiethnic church planting strategy is effective in reaching a multicultural nation. This paper will first take a brief look at the challenges of an ethnic population in North America with primary emphasis given to the Hispanic population. Second, I will present supportive evidence for the multiethnic church planting view. Third, I will present arguments against the multiethnic strategy. Fourth, I will give observations and implications for the church. The main source of argument centers more in the methodology used. The reader will readily see the contrasting theological and cultural opinions of these two …

Modernism En Vogue: Popular Periodicals And Their Engagement With Modernist Culture, Natalie Kalich Jan 2012

Modernism En Vogue: Popular Periodicals And Their Engagement With Modernist Culture, Natalie Kalich

Dissertations

My project investigates commercial magazines from the 1920s, including, The Saturday Evening Post, Ladies' Home Journal, Vogue, and Vanity Fair to reveal the frequency with which modernist writers contributed to these periodicals and the extent to which editors of these magazines found modernist discourse marketable to larger audiences, thereby undermining the assumption that modernists only spoke to a coterie audience. Furthermore, by investigating the similarities present in discourse on modernism and developments in popular culture such as jazz and film in a commercial context, I expand and complicate constructions of modernist and popular culture from both sides of the cultural …

An Investigation Of The Phospholamban-Serca Regulatory Interaction With Fluorescence Resonance Energy Transfer, Philip Adam Bidwell Jan 2012

An Investigation Of The Phospholamban-Serca Regulatory Interaction With Fluorescence Resonance Energy Transfer, Philip Adam Bidwell

Dissertations

With Fluorescence Resonance Energy Transfer (FRET), we are able to detect changes in the structure and affinity of the PLB-SERCA regulatory complex in live cells. Using this approach, we have detected a high level of PLB-SERCA interaction even at Ca2+ concentrations known to fully relieve PLB inhibition of SERCA, suggesting that dissociation is not required for relief of inhibition. We also detect no real-time change in PLB-SERCA binding over the course of a single Ca2+ transient in paced myocytes. The effect of Ca2+ on the PLB-SERCA interaction is best described as a reduced affinity with no change in the structure …

According To What Nomos: Understanding Romans 2 In Conversation With Diaspora Jewish Conceptions Of Nomos, Kyle Fever Jan 2012

According To What Nomos: Understanding Romans 2 In Conversation With Diaspora Jewish Conceptions Of Nomos, Kyle Fever

Dissertations

The law (nomos) functions as a central piece of Paul's argument in the second chapter of his letter to the community in Rome. Throughout his argument Paul's references to nomos carry such complexity that there is significant disagreement about how to understand this nomos. On the one hand, scholars debate over the degree to which Greco-Roman conceptions of nomos shape the understanding of nomos present in Romans 2. On the other hand, Paul appears to have the Jewish law in mind, and there is no consensus about how Paul conceives of the Jewish law in his argument, given the similarities …

Examining Female Principals That Lead Within The Same Schools That They Once Taught, Erica Michele Jordan Jan 2012

Examining Female Principals That Lead Within The Same Schools That They Once Taught, Erica Michele Jordan

Dissertations

The purpose of this study was to examine female principals that once taught within the school that they now lead. This study explored the transition from colleague to superior and discussed Sergiovanni's Sources of Authority (1992) that are employed by female administrators to balance social relationships while maintaining high levels of teacher expectations, conducting formal/informal evaluations, and exerting disciplinary actions when appropriate. This study served to explain what happened to social relationships when there was a positional power shift over a person where a friendship had previously been established.

Eleven female principals throughout suburban areas of Chicago, Illinois, that once …

Wet Chicago: Prohibition And The Development Of The Informal Alcohol Economy, Brian Doumeth Jolet Jan 2012

Wet Chicago: Prohibition And The Development Of The Informal Alcohol Economy, Brian Doumeth Jolet

Dissertations

The Prohibition-era presents a story of both continuity and change. While the illegal alcohol manufacturing and selling that occurred during the period was not an aberration from the past, the resultant increased wealth and sway of the criminal underworld and the increasing disrespect for the law were new transformations. This dissertation seeks to understand the informal economy in alcohol by examining the multitude of men and women who participated in this black market in the city of Chicago, Illinois. The analysis describes the movement from small-time bootleggers operating within a narrow market to the development of a complex and hierarchical …

Bullying (1950 - 2010): The Bully And The Bullied, Steven Arthur Provis Jan 2012

Bullying (1950 - 2010): The Bully And The Bullied, Steven Arthur Provis

Dissertations

This study investigates the bully and the bullied from 1950 to 2010. It begins by presenting a historical background of each decade with the major historical events that defined our culture. Each decade can be characterized by a particular zeitgeist, or spirit of the times. During each decade, popular movies and television programs that provided bullying as entertainment will be examined. This study will explore how popular culture was concurrent with bullying. This study through Barbara Coloroso's (2008) explicit characteristics of the bully and the bullied will describe the characteristics of the bully and the bullied from each decade from …

Reification And The Closed Mind, Mark D. Rockwell Jan 2012

Reification And The Closed Mind, Mark D. Rockwell

Dissertations

What does it mean to have an open mind? Is it desirable? Are we therefore to avoid its opposite, a closed mind? How shall we proceed in producing an open mind or avoiding its opposite a closed mind? The terms open and closed are commonly used as if the meanings of the terms were clear and the expectant goods associated with being open preferred. This project examines the current literature regarding the above problem and then suggests an alternative exploration of the concept of reification as closed-mindedness. Reification will be defined in its traditional sense with the addition that it …

A Case Study: The Impact Of An Immersion Experience On The Vocation Of Lay Teacher-Leaders In American Jesuit High Schools, Martin Joseph Schreiber Jan 2012

A Case Study: The Impact Of An Immersion Experience On The Vocation Of Lay Teacher-Leaders In American Jesuit High Schools, Martin Joseph Schreiber

Dissertations

The purpose of this case study explores the impact of an immersion experience to a least developed country on the vocation of lay teacher leaders in American Jesuit High Schools. Nine lay teacher leaders engaged in a four stage process of immersion from November 2009 to August 2010. The study employed the conceptual framework of Edward Hahnenberg's, "Awakening Vocation" to develop a self-understanding of a lay teacher leader's call. The writings of Paulo Freire, Fredrick Buechner and Parker Palmer informed the study's exploration of vocation. Poetry from Mary Oliver and William Stafford functioned as a method for articulating a lay …
