The Limits Of Corporate Rights Under International Law, Julian G. Ku Jan 2012

The Limits Of Corporate Rights Under International Law, Julian G. Ku

Chicago Journal of International Law

For most commentators, the acceptance of corporate rights under international human rights law is part of a broader push to recognize corporations as subjects of international law. As subjects, corporations would not only enjoy some international legal rights, but they would also be liable for many international legal duties. In prior work, I have critiiZed the effort to impose international legal duties on corporations in the context of the Alien Tort Statute, arguing that there is insufficient international consensus to treat corporations as subjects of international law. In this Article, I criticize the parallel effort to treat corporations as subjects …

China's Indigenous Innovation Policies Under The Trips And Gpa Agreements And Alternatives For Promoting Economic Growth, S. James Boumil Iii Jan 2012

China's Indigenous Innovation Policies Under The Trips And Gpa Agreements And Alternatives For Promoting Economic Growth, S. James Boumil Iii

Chicago Journal of International Law

China's intricate web of Indigenous Innovation policies affords preferences in government procurement to certain high-technology products whose intellectual property is owned or registered in China. While the the policies were intended to strengthen China's national economy, they have been heavily criticized, notably by the US and the EU, as a strategic attempt to commercialize non-Chinese proprietary ideas in China and as a trade barrier that harms all stakeholders in the world marketplace. Although China's State Council recently committed the county to repealing several key Indigenous Innovation measures, the extent to which Indigenous Innovation preferences will be implemented by the local …

Harnessing The Cloud: International Law Implications Of Cloud-Computing, Vineeth Narayanan Jan 2012

Harnessing The Cloud: International Law Implications Of Cloud-Computing, Vineeth Narayanan

Chicago Journal of International Law

For decades, with the advent of better and faster computer chips, processor speed has grown exponentially, and with it, the demand for computing power. Now, as that growth slows due to technological bottlenecks, the world will look to solutions like cloud-computing to ensure that the ever-increasing demand of computing power is met. Thus, the need for efficient, reliable, and powerful cloud-computing services will lead to and necessitate global cloud-computing service providers. But their vitalness will also bring cloud-computing under the scrutiny of government regulation, as countries struggle to ensure that the data of their citizenry is protected. This Comment explores …

Looking To Fill An International Regulatory Gap: Brazil Brings The Issue Of Exchange Rates And Trade Before The World Trade Organization, Antonia F. Pereira, Silas W. Allard Jan 2012

Looking To Fill An International Regulatory Gap: Brazil Brings The Issue Of Exchange Rates And Trade Before The World Trade Organization, Antonia F. Pereira, Silas W. Allard

Emory International Law Review

Concern over the relationship between exchange rates and trade has a long history in both international law and economics. This concern has manifested itself in two primary ways: first, as a worry about the impact of currency fluctuation on trade flows and, second, as a worry about the impact of currency manipulation on fairness in the international trading regime. While there is no consensus on how to address the problems created by the relationship of exchange rates and trade, this lack of consensus has done nothing to diminish states' concerns over the impact of currency fluctuation and manipulation on trade.

Citizenship And Marriage In A Globalizing World: Multicultural Families And Monocultural Nationality Laws In Korea And Japan, Erin Aeran Chung, Daisy Kim Jan 2012

Citizenship And Marriage In A Globalizing World: Multicultural Families And Monocultural Nationality Laws In Korea And Japan, Erin Aeran Chung, Daisy Kim

Indiana Journal of Global Legal Studies

This Article analyzes how individual and local attempts to address low fertility rates in Korea and Japan have prompted unprecedented reforms in monocultural nationality laws. Korea and Japan confront rapidly declining working-age population projections; yet, they have prohibited the immigration of unskilled workers, until recently in Korea's case, on the claim that their admission would threaten social cohesion. Over the past two decades, both countries have made only incremental reforms to their immigration policies that fall short of alleviating labor shortages and the fiscal burdens of maintaining a large elderly population. Instead, prompted by the growth of so-called multicultural families …

"Coming Out Of The Shadows": Dream Act Activism In The Context Of Global Anti-Deportation Activism, Laura Corrunker Jan 2012

"Coming Out Of The Shadows": Dream Act Activism In The Context Of Global Anti-Deportation Activism, Laura Corrunker

Indiana Journal of Global Legal Studies

This Article, based on ethnographic fieldwork with an undocumented, youth-led immigrant rights organization, explores undocumented youth activism in the United States in relation to global anti-deportation movements. The strategies that undocumented youth utilize in their fight for the DREAM Act, a bill that creates provisions for certain undocumented youth to legalize their status, are compared with examples of anti-deportation activism outside the United States. In comparing the DREAM Act movement with anti-deportation movements globally, three points of commonality emerge: (1) leadership of undocumented immigrants; (2) visibility; and (3) measures of "deservingness." This Article argues that comparing examples of immigrant activism …
