The Boys' Republic, Jonas Mueller Jan 2012

The Boys' Republic, Jonas Mueller

Electronic Theses and Dissertations

The young men in The Boys’ Republic live in a world that is continually falling apart. Their houses collapse into sinkholes, forest fires carve out chunks of their towns, plague spreads through their communes, the money runs out on the construction project where they work. This decay mirrors their own collapsing identities, as they are forced to question their mastery of nature, their nostalgia for their youth, their relationships with others, and the value of masculinity itself. Drawing on the work of writers like Dennis Cooper, Flannery O’Connor, and Benjamin Percy, The Boys’ Republic depicts men in the midst of …

Life History Response To Infection And The Potential For Dishonest Signals In The Ground Cricket, Allonemobius Socius, Emily Copeland Jan 2012

Life History Response To Infection And The Potential For Dishonest Signals In The Ground Cricket, Allonemobius Socius, Emily Copeland

Electronic Theses and Dissertations

In order to maximize fitness, individuals must partition their limited resources among competing physiological processes, creating negative statistical associations between processes known as “life-history trade-offs”. Evidence indicates that individuals tend to decrease their reproductive investment when confronted with a significant immunological challenge in order to increase investment in immune defense. This trade-off is often accompanied by a significant decrease in the sexual signal, which provides an honest signal of the male’s infection status to potential mates. However, if individual residual reproductive value is low, they may instead increase their reproductive investment to maximize reproductive success before the end of their …

A Feminist Content Analysis Of Seventeen Magazine, Brittany Marie Trimble Jan 2012

A Feminist Content Analysis Of Seventeen Magazine, Brittany Marie Trimble

All Graduate Theses, Dissertations, and Other Capstone Projects

Over the past two decades, there has been growing concern among researchers, clinicians, and policy makers regarding the sexualization of female adolescents in the media. Developmental psychologists and researchers argue that adolescents are particularly vulnerable to messages presented in the media, as these messages are internalized as real. These messages afflict long-term emotional and physical effects on adolescent girls. Through content analysis and extensive research, The American Psychological Association (APA) Task Force (2010) argued that the sexualization of adolescent girls and women directly effects the psychosocial development of young women, creating self-objectification, negative self-images, anxiety, shame, depression, eating disorders, and …

Teaching Children How To Like Balanced Meals, Harumi Norasakkunkit Jan 2012

Teaching Children How To Like Balanced Meals, Harumi Norasakkunkit

All Graduate Theses, Dissertations, and Other Capstone Projects

Growing up in Japan, balanced meals were always provided at home, at schools and even at restaurants. Unfortunately, children are not going to choose balanced meals from the start, so this habit has to be instilled by parents and by the educational system until it eventually becomes a personal preference for children. If children are simply given the choice to eat whatever they want from the beginning, it is unlikely that this preference will ever be developed. The emphasis of nurturing the habit of eating balanced meals, rather than just eating preferred foods, is what is particular about Japanese parenting. …

Effect Of Low Maternal Aldosterone On Offspring Cardiovascular Development, Travis Dean Mckee Jan 2012

Effect Of Low Maternal Aldosterone On Offspring Cardiovascular Development, Travis Dean Mckee

All Graduate Theses, Dissertations, and Other Capstone Projects

Maternal conditions are well known to affect fetal cardiovascular development. This study was designed to investigate in spontaneously hypertensive rats (SHR), the effects of maternal aldosterone suppression on the development of hypertension in the offspring. A sham procedure or a right adrenalectomy combined with cryodestruction of the zona glomerulosa of the left adrenal gland was performed on SHR females. The rats were mated and male offspring were implanted at 11-13 weeks of age with a PA-C40 remote monitoring device placed into the femoral artery to record cardiovascular parameters for 4 weeks. Systolic (mmHg), diastolic (mmHg), and mean blood pressure (mmHg), …

Influences Of Adjacent Land-Use On Avian Community Structure In Sub-Boreal Peatlands Of The Midwest, Lucas J. Wandrie Jan 2012

Influences Of Adjacent Land-Use On Avian Community Structure In Sub-Boreal Peatlands Of The Midwest, Lucas J. Wandrie

All Graduate Theses, Dissertations, and Other Capstone Projects

Surrounding land use influences avian community structure; moreover, anthropogenic manipulation of habitat can alter bird species richness and composition. In the first chapter of my thesis work, I conducted avian surveys at 20 sub-boreal peatlands in eastern Minnesota and western Wisconsin to detect correlations between land development and bird community structure. Peatlands are wetlands that accumulate decaying organic plant material (peat) and provide valuable and diverse habitats to a variety of flora and fauna. I measured urban and cropland development at three spatial scales (500 m, 1000 m, and 2500 m radii). Effects of development on avian communities also were …

The Effect Of Exercise On Endothelin And Endothelin Receptor Levels In Shr And Wky Male And Female Rats, Lacey Stiller Jan 2012

The Effect Of Exercise On Endothelin And Endothelin Receptor Levels In Shr And Wky Male And Female Rats, Lacey Stiller

All Graduate Theses, Dissertations, and Other Capstone Projects

The role of exercise as a means to modulate renal function in hypertension is unclear. However, prior studies in the laboratory of Dr. Penny Knoblich indicate that exercised female spontaneously hypertensive rats (SHR) and Wistar Kyoto (WKY) rats excrete significantly more sodium in response to a rise in blood pressure relative to exercised male and sedentary female SHR and WKY rats. The purpose of this study was to evaluate the effects of exercise on endothelin and endothelin receptor levels in the urine and kidneys of male and female SHR and WKY rats, to elucidate potential mechanisms to explain an increase …

The Lessons Of Living Gardens And Jewish Process Theology For Authorship And Moral Rights, Roberta R. Kwall Jan 2012

The Lessons Of Living Gardens And Jewish Process Theology For Authorship And Moral Rights, Roberta R. Kwall

Vanderbilt Journal of Entertainment & Technology Law

This Article examines the issues of authorship, fixation, and moral rights through the lens of Jewish Process Theology. Jewish Process Theology is an application of Process Thought, which espouses a developmental and fluid perspective with respect to creation and creativity. This discipline offers important insights for how to shape and enforce copyright law. The issue of "change" and authorship is more important now than ever before given how the digital age is revolutionizing the way the world thinks about authorship. By incorrectly maintaining that a living garden is not capable of copyright protection since it is unfixed, changeable, and partially …

Digital Originality, Edward Lee Jan 2012

Digital Originality, Edward Lee

Vanderbilt Journal of Entertainment & Technology Law

This Article examines the doctrine of originality in U.S. copyright law and proposes a reconfigured, three-part test that can better analyze issues of first impression involving works created with new digital technologies. The proposed test, encapsulated by the concept of digital originality, provides much needed guidance to courts to address the increasing complexities of digital creations in the twenty-first century.

Curbing Copyblight, John Tehranian Jan 2012

Curbing Copyblight, John Tehranian

Vanderbilt Journal of Entertainment & Technology Law

This Article identifies and analyzes the growing problem of "copyblight" the use of overreaching claims by putative copyright holders to ownership of public domain works, and, more broadly, to exclusive rights which they do not hold in copyrighted works. Despite the fact that copyblight circumscribes political and social discourse, stifles creativity, and constricts the dissemination of information, present law provides few, if any, disincentives against the practice. Building on the groundbreaking work of Paul Heald and Jason Mazzone, this Article advances three proposals to temper the problems of overreach in order to restore a needed balance in our copyright system: …

The Center Of A Homesteading Community In Northwest Montana: Archaeological Investigations On The Polebridge Schoolhouse, Alexander J. Kroll Jan 2012

The Center Of A Homesteading Community In Northwest Montana: Archaeological Investigations On The Polebridge Schoolhouse, Alexander J. Kroll

Graduate Student Theses, Dissertations, & Professional Papers

In the summer of 2010, I excavated the remnants of a historic one-roomed schoolhouse near Polebridge, Montana, just outside of Glacier National Park. The schoolhouse’s recovered artifacts represent a lively community of homesteaders residing in the North Fork Valley of the Flathead River during the early 20th century. 3,704 individual artifacts in the form of metal, glass, ceramic and faunal remains, tell of life during this time period. The research goals of this thesis have three objectives: 1) the historical record often depicts schoolhouses as serving as public space for the community, the archaeological record can be used to corroborate …

The Effect Of Photocycle On Self-Control In Betta Splendens, Kathryn Gwen Lamp Jan 2012

The Effect Of Photocycle On Self-Control In Betta Splendens, Kathryn Gwen Lamp

Graduate Student Theses, Dissertations, & Professional Papers

The present study examined the effect of varying light cycles on self-control in Siamese fighting fish (Betta splendens). The subjects included 16 male Betta splendens, and instrumental choice trials were run. A subject began each trial in the start box and, when a guillotine divider door was lifted, entered one side of a divided terminus. The checkerboard side of the choice door represented either the smaller, more immediate choice (SS) or the larger, more delayed choice (LL). When the subject had entered one side of the goal box, the guillotine divider door was lowered and the subject was given food …

A Pragmatic Republic, If You Can Keep It, Bill Sherman

The administrative state has been bedeviled by doubts about its democratic legitimacy and its questionable Constitutional provenance. Courts and scholars attack or shore up this weakness, but almost all proceed on the assumption that the administrative state is a modern leviathan unimaginable to the Founders. Consequently, questions about the role of politics in agency decisions assign a disfavored role to “pure politics” in rulemaking. This Book Review Essay challenges that assumption and its implications for the role of politics in administrative decisionmaking. Centering on a review of Jerry L. Mashaw’s new book, Creating the Administrative Constitution: The Lost One Hundred …

Don’T Blame Crawford Or Bryant: The Confrontation Clause Mess Is All Davis’S Fault, Deborah Ahrens, John Mitchell Jan 2012

Don’T Blame Crawford Or Bryant: The Confrontation Clause Mess Is All Davis’S Fault, Deborah Ahrens, John Mitchell

Faculty Articles

In Michigan v. Bryant, a dying victim lying in a parking lot provided responding officers with the identity of the man who shot him. In determining whether the subsequent use of the deceased declarant’s statement at trial violated the Confrontation Clause, the Bryant Court applied the testimonial versus nontestimonial analysis established in the Court’s previous decision, Crawford v. Washington. Holding that testimonial hearsay covered statements involving past events, while nontestimonial statements were directed at an “ongoing emergency,” the Bryant Court applied a multi-factor, totality of the circumstances analysis and found that the deceased declarant’s identification had been directed …

The Vanishing Plaintiff, Brooke D. Coleman Jan 2012

The Vanishing Plaintiff, Brooke D. Coleman

What if restrictive procedural rules kept cases like Bakke v. Regents of the Univ. of Cal., Monell v. Dept. of Soc. Servs., and Hopkins v. Price Waterhouse from making it past a motion to dismiss and on to the Supreme Court? A case like Bakke is well-known for its holding about the use of race in admissions policies. But imagine that Alan Bakke was never able to get his original trial court complaint past a motion to dismiss, through discovery, and on to a final, appealable judgment. While reasonable people can disagree about the merits of Bakke, it …

Recent Writing On Law And Happiness, Richard Delgado Jan 2012

Recent Writing On Law And Happiness, Richard Delgado

Faculty Articles

In the course of a review of recent books on the hedonic level of lawyers' lives, Professor Richard Delgado puts forward an explanation for the high rate of stress, anxiety, depression, and burnout among lawyers. Professor Delgado examines suggestions of leading authorities on how attorneys may achieve happiness, usually through extrinsic measures such as more vacations, exercise, or meditation. He also considers proposals on how supervisors can make legal workers more content, including more art work for the walls, windows with leafy outlooks, a basketball court, or more praise. Professor Delgado specifically criticizes the teachings of positive psychology, explaining that …

The Guardians Of Knowledge In The Modern State: Post’S Republic And The First Amendment, David M. Skover, Ronald K. L. Collins Jan 2012

The Guardians Of Knowledge In The Modern State: Post’S Republic And The First Amendment, David M. Skover, Ronald K. L. Collins

Faculty Articles

Collins and Skover’s essay examines Yale Law School Dean Robert Post’s recent book, Democracy, Expertise, and Academic Freedom: A First Amendment Jurisprudence for the Modern State (Yale, 2012). Collins and Skover describe and examine Dean Post’s dichotomy between the realm of “democratic legitimation,” where the First Amendment should offer its strongest protections, and the realm of “democratic competence,” where the First Amendment should yield to the findings of knowledgeable experts. Questioning the theoretical premises of Dean Post’s book, they argue that a “harm principle” may better explain much of the First Amendment doctrine that Post attempts to reconcile with his …

Un-Apologizing For Context And Experience In Legal Education, John Mckay Jan 2012

Un-Apologizing For Context And Experience In Legal Education, John Mckay

Faculty Articles

This Essay accompanies the Fifth Annual Symposium at Creighton University School of Law addressing the rapidly changing legal profession and our not-so-rapidly changing legal education and law school pedagogy. The Symposium's focus on the changing practice of law provides an opportunity to reconsider the woefully incomplete effort by law schools to respond to the challenge of the Carnegie Report and its many preceding critics. Rather than merely pile on, however, this Essay suggests that Jesuit law schools in particular might have something to offer their colleagues-an experiential teaching style grounded in centuries old pedagogy inspired by the founder of the …

Increasing Parity Is Associated With Cumulative Effects On Memory, Laura M. Glynn Jan 2012

Increasing Parity Is Associated With Cumulative Effects On Memory, Laura M. Glynn

Psychology Faculty Articles and Research

BACKGROUND: The purpose of this investigation was to determine if reproductive experience is associated with cumulative effects on human memory performance during pregnancy and if these effects persist into the postpartum period.

METHODS: Verbal recall memory performance was assessed in 254 women four times during pregnancy and at 3 months postpartum. The relation between parity and memory function was evaluated with hierarchical linear modeling and analysis of covariance (ANCOVA).

RESULTS: The data indicate that the previously documented adverse effects of pregnancy on memory performance are compounded with successive pregnancies. During gestation and postpartum, multiparity was associated with poorer memory function, …

In Vitro Measurements Of Tracheal Constriction Using Mice, Iurii Semenov, Jeremiah T. Herlihy, Robert Brenner

Bioelectrics Publications

Transgenic and knockout mice have been powerful tools for the investigation of the physiology and pathophysiology of airways(1,2). In vitro tensometry of isolated tracheal preparations has proven to be a useful assay of airway smooth muscle (ASM) contractile response in genetically modified mice. These in vitro tracheal preparations are relatively simple, provide a robust response, and retain both functional cholinergic nerve endings and muscle responses, even after long incubations. Tracheal tensometry also provides a functional assay to study a variety of second messenger signaling pathways that affect contraction of smooth muscle. Contraction in trachea is primarily mediated by parasympathetic, cholinergic …

Stein, Neth Sansothy, Keo Sichan, John Kaldor, Jennifer L. Evans, Lisa Maher, Joel Palefsky

Nursing and Health Professions Faculty Research and Publications

Background

Although cervical cancer is the leading cancer in Cambodia, most women receive no routine screening for cervical cancer and few treatment options exist. Moreover, nothing is known regarding the prevalence of cervical HPV or the genotypes present among women in the country. Young sexually active women, especially those with multiple sex partners are at highest risk of HPV infection. We examine the prevalence and genotypes of cervical HPV, as well as the associated risk factors among young women engaged in sex work in Phnom Penh, Cambodia.

Methods

We conducted a cross-sectional study among 220 young women (15–29 years) engaged …
