Pragmatism dominates contemporary legal thought, but knowing this isn’t knowing so much. Legal pragmatism means different things to different people, and as this essay argues, minimalist and experimentalist forms of regulation both share a broadly pragmatic sensibility about law and democracy. As a consequence, we need to tease out the various threads of legal pragmatism in the hope of distinguishing the pragmatisms that work from the ones that don’t, or less pragmatically, the ones that are just from the ones that are not. This knowledge will come from an ongoing assessment of the political stakes immanent in the pragmatisms, and …

Deflected Agreement In The Book Of Mormon, Andrew C. Smith

Deflected agreement is a grammatical phenomenon found in Semitic languages—it is ubiquitous in Arabic and found occasionally in Classical Hebrew. Deflected agreement is a plausible explanation for certain grammatical incongruities present, in translation, within the original and printer's manuscripts and printed editions in the Book of Mormon in the grammatical areas of verbal, pronominal, and demonstrative agreement. This finding gives greater credence to the plausibility of the authenticity and historicity of the Book of Mormon. Additionally, the implications of this finding on Book of Mormon scholarship are discussed.

Where does one find the German Enlightenment? General surveys and otherwise highly serviceable scholarly readers on the Enlightenment tend to neglect it. A recent book on the German Enlightenment by T. J. Reed observes that for many outside Germany, including scholars, the connection Aufklarung und deutsch (Enlightenment and German) is almost paradoxical. Why should this be so? One explanation is that the German Enlightenment is overshadowed by the French Enlightenment. A second explanation is that late-nineteenth-century Germany is associated with a turn away from Enlightenment ideas, in part a countervailing reaction to the terror of the Napoleonic Wars and French …

Based on a keynote presentation at the 2012 Canadian Historical Association conference, this paper surveys the state of digital technology and its impact on academic publication and teaching in the contemporary university. Accordion Crimes, a novel by E. Annie Proulx, traces the life of and routes travelled by a green diatonic button accordion: its birth in Sicily in the workshop of “The Accordion Maker,” its numerous changes of ownership in the Americas during encounters between various immigrant communities, and its death when it finally falls into disrepair in the town of Old Glory, Minnesota. There are other accordions in the book, and many temporary human owners, but it is one particular green accordion that is the book’s protagonist. We meet and experience other characters largely through their interactions with the green accordion, …

The broad ecological distribution of L. casei makes it an insightful subject for research on genome evolution and lifestyle adaptation. To explore evolutionary mechanisms that determine genomic diversity of L. casei, we performed comparative analysis of 17 L. casei genomes representing strains collected from dairy, plant, and human sources. Results Differences in L. casei genome inventory revealed an open pan-genome comprised of 1,715 core and 4,220 accessory genes. Extrapolation of pan-genome data indicates L. casei has a supragenome approximately 3.2 times larger than the average genome of individual strains. Evidence suggests horizontal gene transfer from other bacterial species, particularly lactobacilli, …

Quantitative and qualitative evaluation of compost is necessary in order to provide consumers with basic knowledge about the product’s composition, and to protect public health and the environment by preventing the spread of contaminated material. Current methods for analysis of basic compost properties give accurate results but are time consuming and require numerous laboratory procedures. This study evaluated the use of visible near-infrared diffuse reflectance spectroscopy (VisNIR DRS) for organic matter (OM) determination and field portable X-ray fluorescence (PXRF) spectroscopy for determination of elemental composition of composted materials. Obesity and diabetes are the most prevalent metabolic disorders. It is estimated that more than 86% of US adults would be overweight or obese and more than 50% obese by the year 2030. Non Alcoholic Fatty Liver Disease (NAFLD) has also been referred to as hepatic manifestation of insulin resistance. NAFLD or steatosis is defined as lipid accumulation exceeding 5% by weight in hepatocytes in the absence of substantial alcohol intake. Background: The increasing consumption of dietary supplements (DS) has drawn the attention of regulatory agencies, researchers and healthcare professionals. The US Food and Drug Administration (FDA) does not require premarketing assessment of DS considering them safe unless proven otherwise. However, the reporting rate of DS adverse events (DS-AE) is low. Objective: To describe pharmacists’ attitudes and knowledge of DS and DS information resources, and to determine the importance of selected attributes in pharmacists’ decisions to report a DS-AE. This Article provides an historically-rooted analysis of a recent spate of civil RICO complaints arising from labor union organizing campaigns. The Article historicizes contemporary civil RICO suits against labor unions by analogizing to nineteenth century conspiracy prosecutions of unions. In tracing this history of organized labor’s social standing, the Article addresses the cultural framing of the union and its place in political and cultural discourse over the past century. The civil RICO complaints have received limited scholarly attention mainly focusing on issues of federal preemption; this Article argues for a broad reading of the cases as a way to understand …

Although the Supreme Court declared almost forty years ago that “there is no constitutional value in false statements of fact,” the Court in United States v Alvarez ruled that the First Amendment protects at least some -- and perhaps many -- intentional lies from government prohibition. In Alvarez, a divided Court struck down the Stolen Valor Act, a federal statute that made it a crime for any person to state falsely that he or she had received a military decoration or medal. Efforts to identify and implement an appropriate tax neutrality benchmark have been persistent themes in scholarly and policy debates on international taxation for fifty years. This paper questions whether the concept of tax neutrality has been adequately specified for analyzing the efficiency properties of international tax systems. As distinct from the closed-economy setting, in the open-economy setting, neither tax revenues received nor the burdens that tax revenues pay for may be taken as fixed. Employment Division v. Smith was a watershed moment in First Amendment law, with the Supreme Court holding that neutral statutes of general applicability could not burden the free exercise of religion. Congress's subsequent attempts, including the passage of Religious Freedom Restoration Act and Religious Land Use and Institutionalized Persons Act, to revive legal protections for religious practice through the legislative and administrative process have received tremendous attention from legal scholars. Health, safety, and environmental regulation in the United States are saturated with risk thinking. It was not always so, and it may not be so in the future. But today, the formal, quantitative approach to risk provides much of the basis for regulation in these fields, a development that seems quite natural, even necessary. This particular approach, while it drew on conceptual and technical developments that had been underway for decades, achieved prominence during a relatively short timeframe; roughly, between the mid-1970s and the early 1980s--a time of hard looks and regulatory reform. In this thesis study we examined glycogen synthase kinase-3β (GSK-3β) and its effects over Nrf2 and Pin 1 as it relates to Alzheimer’s disease (AD). AD is a neurodegenerative disease characterized by a prolonged high oxidative environment. Transcription factor Nrf2 is vital in the brain’s defense against oxidative insults through its up-regulation of over 100 antioxidants. Depletion of the brain’s antioxidant defense system results in intolerance to an oxidative environment, contributing to the progression of AD. The regulatory Pin 1 protein promotes cellular homeostasis, and when down-regulated results in increased deposits of neurofibrillary tangles (NFTs) and amyloid-β (Aβ) plaques, the …
