Biological soil crust ecology in the hot Mojave Desert is poorly understood with regard to crust distribution and abundance, as well as the impacts of trampling disturbance on crust development. Our objective was to study biological soil crusts in 2 areas of differing disturbance pressures in the high desert region of Joshua Tree National Park, California, with respect to visible crust cover and frequency, chlorophyll a, and soil stability. Impacts on biological soil crusts from 2 disturbance regimes, historic grazing and recent high knot traffic, were compared using a disturbance indicator. Family Affairs newsletter (2004-2016)

FAMILY AFFAIRS was a free, twice-a-month, social activities newsletter for the GLBTQI (gay/lesbian/bisexual/trans/queer/intersex) community, sent out around the 1st and 15th of each month. It covered the State of Maine only. The list was begun and maintained for many years by Jean Vermette in Bangor, and later operated by Zack Paakkonen of Portland. Over the years it evolved from a social activities newsletter into a business directory, classified ad service, and community bulletin board.

The article presents an analysis on the advancement of public employee speech and interpretations of the U.S. Supreme Court on Garcetti v. Ceballos. It discusses the similarities and error that exists among the federal circuit courts. It overviews the factors shared by circuits different to certain courts. The article presents information on the appropriate level of scrutiny that is required in reviewing the validity of constitutionality of restraints. It overviews the First Amendment jurisprudence with strict scrutiny and balancing test. It also explains the U.S. Supreme Court case Republican Party of Minnesota v. White. It suggests state to provide same protections to judicial candidates as that of other elected officials.

Building A Better Mousetrap: Enhanced Dollar Cost Averaging, Lee Dunham, Geoffrey C. Friesen

This paper presents a simple, intuitive investment strategy that improves upon the popular dollarcost- averaging (DCA) approach. The investment strategy, which we call enhanced dollar-costaveraging (EDCA), is a simple, rule-based strategy that retains most of the attributes of traditional DCA that are appealing to most investors but yet adjusts to new information, which traditional DCA does not. Simulation results show that the EDCA strategy reliably outperforms the DCA strategy in terms of higher dollar-weighted returns about 90% of the time and nearly always delivers greater terminal wealth for reasonable values of the risk premium. The Goss Farm was permanently protected in November of 2010 with assistance from the USDA, Natural Resources Conservation Service Farm and Ranch Lands Protection Program (FRPP) and is located directly adjacent to the Awcomin Salt Marsh, in Rye, New Hampshire. The Town of Rye Conservation Commission owns the land, and the RCCD holds the conservation easement on the property. Coastlines, like riverbanks, are dynamic. They continually move, usually imperceptibly, but in storm events they can move a great distance. This movement affects both private and public property rights. The State owns "submerged lands," wherever they happen to be at the time.' In legal documents in Texas, terms such as "along the river" and "with the meanders of the river" describe property boundaries. Although heralded as an emancipation proclamation for people with disabilities, the Americans with Disabilities Act ("ADA") has done little over the course of its twenty-year history to increase the number or quality of employment opportunities available to individuals with a disability. Title I of the ADA requires employers to make reasonable accommodations for qualified employees with a disability so long as the accommodations do not impose an undue hardship on the employer. Regardless of whether you believe that human activities cause or contribute to global warming, regulatory action seeking to mitigate the future consequences of climate change will impact the lives of every American. On January 2, 2011, U.S. Environmental Protection Agency ("EPA") regulation of greenhouse gas emissions from stationary sources took effect. The EPA rule implementing this regulation is the conclusion, for the time being, of a sequence of recent judicial and administrative activities comparable to a regulatory domino effect. A True Threat To First Amendment Rights: United States V. Turner And The True Threats Doctrine, Casey Brown

The Supreme Court has carved out several exceptions to what qualifies as protected speech under the First Amendment, including true threats and incitement. The majority rule in the circuit courts is that speech qualifies as a true threat if the speech would be interpreted by an objectively reasonable person as an intent to commit serious harm or injury. Most courts apply a true threats analysis to cases involving a charge under 18 U.S.C. § 115(a)(1)(B). Furthermore, most courts do not require that the speaker actually intend to carry out the threat in order to be convicted. Although courts have generally …

The Freedom of Information Act ("FOIA" or "the Act") serves an important purpose in informing the citizenry of its government's actions. Congress created it as a disclosure statute, the Supreme Court has decided FOJA in favor of disclosure, and the D. C. Circuit has kept that goal of disclosure by refusing to broaden its exemptions. Despite this history of consistent treatment, the Third Circuit attempted to change the game with its holding in AT&T v. FCC. The Third Circuit held that corporations may have personal privacy under FOIA Exemption 7(C). This paper will argue that this holding contradicted three FOIA …

Highly Porous Silica Network Prepared From Sodium Metasilicate, R E. Essien, O A. Olaniyi, L A. Adams, R O. Shaibu

Journal of Metals, Materials and Minerals

Porous silica network was prepared from sodium metasilicate (Na2SiO3) at room temperature (27C) using hydrochloric acid (HCl) as catalyst through the sol-gel method. The gel was dried at 120C for 1 day and calcined at 800C for 3 hours and the material obtained characterized using scanning electron microscopy (SEM), X-ray diffraction (XRD) and Fourier transform infrared spectroscopy (FTIR). The results showed the formation of amorphous silica particles of average sizes 598 nm with ordered porous network of pore sizes ranging from 0.18-0.91 ?m. This synthetic route uses sodium metasilicate as commercial precursor without pore forming templates which could be useful …

Structural Determinants Of Homicide: The Big Three, Maria Tcherni

Building upon and expanding the previous research into structural determinants of homicide, particularly the work of Land, McCall and Cohen (1990), the current paper uses county-level data to disentangle three major influences on homicide rates: poverty, racial composition, and the disruption of family structure. Theoretical foundations of these influences are laid out, and the effects of the three factors on homicide rates are tested at two time periods as far removed from one another as possible: 1950-1960 and 1995-2005. All major variables typically used in homicide research are included as controls. The results of analyses show that the effects of …

In Defense Of Community: Athenian Legal Rhetoric And Its Modern Legacy In American Foreign Policy, Bradley Aron Cooper

This Article will examine how the rhetoric of the legal speechwriters reflected idealized views on participatory democracy and the rule of law. Next, this Article will attempt to show that these same views also supported a strong Athenian tradition of opposing tyranny, and that this, in turn, led to the inclusion of anti-tyrannical rhetoric in some of the legal speeches. Finally, this Article will address the lasting legacy of this anti-tyrannical rhetoric by giving evidence of its modern usage in the rhetoric of American foreign policy and by proposing reasons for its enduring presence.

Does the Texas Labor Code permit Congress to amend Texas law by proxy? Specifically, does the Texas Commission on Human Rights Act automatically incorporate Title VII amendments? This is the question posed to Texas courts and federal courts interpreting the limitations period for filing employment discrimination claims with the Texas Workforce Commission. Despite almost two decades of court precedent interpreting Texas's equal employment opportunity law, the answer is anything but clear. Leadership Faculty Publications

Even among people who know and have seen the value of logic models, the term can “strike fear into the hearts” of experienced community psychologists and veteran non-profit staff and board members alike. Add the phrase “outcome-based planning” and you are likely to energize those you are working with to run as fast as possible for the door. Such technical terms may confuse and intimidate community members and grassroots partners who are the foundation of the practice of community psychology. At the same time, organizations can benefit from time spent on outcome-based planning, especially in developing a well-conceived logic model.
