The pervasive culture of underage and excessive drinking on college campuses has led to numerous federal and state regulatory efforts to reduce drinking rates among college students. One such policy has been to restrict alcohol advertisements in college student publications, which implicates the First Amendment by limiting access to lawful commercial speech. Although the Supreme Court has developed a four-part balancing test to determine the validity of commercial speech restrictions, the Court has not articulated the level of proof required for assessing the validity of restrictions on alcohol advertisements in college student publications. Dead Again: The Latest Demise Of The Confrontation Clause, Michael D. Cicchini

In Crawford v. Washington, the Supreme Court abandoned its Roberts “reliability” approach to the right of confrontation. The Court conceded that the Roberts decision had killed the Confrontation Clause by: (1) impermissibly tying the right of confrontation to the rule against hearsay; (2) inappropriately allowing pretrial determinations of reliability to replace actual cross-examination at trial; (3) relying too heavily on malleable, multi-factor balancing tests; and (4) completely failing to constrain judicial discretion. Since Crawford, however, the Court has decided Davis v. Washington and Michigan v. Bryant. Unfortunately, in the course of deciding those cases the Court has once again killed …

Using Tort Law To Understand The Causation Prong Of Standing, Luke Meier

Under current Supreme Court case law, a plaintiff does not have Article III standing to sue in federal court unless that plaintiff can demonstrate “causation.” The term “causation” is ubiquitous within the law. Because of the frequency with which the term appears in various legal contexts, however, the conceptual analysis associated with that term can vary. Unfortunately, the Supreme Court has never clearly established the conceptual analysis necessary for making the causation determination within standing law. Consequently, there is confusion on this question. This Article addresses that confusion by relying on causation terms and concepts fully developed within tort law. …

Pulmonary Diffusional Screening And The Scaling Laws Of Mammalian Metabolic Rates, Chen Hou, Michael Mayo

Biological Sciences Faculty Research & Creative Works

Theoretical considerations suggest that the mammalian metabolic rate is linearly proportional to the surface areas of mitochondria, capillary, and alveolar membranes. However, the scaling exponents of these surface areas to the mammals' body mass (approximately 0.9-1) are higher than exponents of the resting metabolic rate (RMR) to body mass (approximately 0.75), although similar to the one of exercise metabolic rate (EMR); the underlying physiological cause of this mismatch remains unclear. The analysis presented here shows that discrepancies between the scaling exponents of RMR and the relevant surface areas may originate from, at least for the system of alveolar membranes in …

This report details the design and construction of a testing apparatus for characterization of small electric aircraft power systems designed for use in the California Polytechnic State University San Luis Obispo Aerospace Engineering department’s subsonic wind tunnel. Academic debate continues to face the long term issue of how to reconcile competing philosophies of argument pedagogy and competitive practice, especially between adherents technical and civic debate theories. Using the theories of Pierre Bourdieu, this essay offers an analysis of this division, focusing on the role of dominant language formation and the role fluency plays in constituting power dynamic in the activity. The conception of a translation approach to judging is offered as a remedy for the exclusionary effects of technical language use in debate.

Spatial, Ontogenetic, And Sexual Effects On The Diet Of A Teiid Lizard In Arid South America, J Van Leeuwen, Alessandro Catenazzi, M Holmgren

Most lizard species feed on small arthropods, and although some are omnivorous, only a few species are strict herbivores. We studied the diet of Dicrodon guttulatum, a teiid lizard endemic to the arid coastal deserts and dry forests of northern Peru. Herbivory by this lizard has been identified as a potential limiting factor in the regeneration of plant communities in these dry ecosystems. We collected gastric and fecal samples of adult males, adult females, and juveniles of D. guttulatum in different plant communities. Based on the ontogenetic shift from insectivory to herbivory observed in other herbivorous lizards, we hypothesized …

Asset Gathering By Hedge Fund Firms, Melvyn Teo

Research Collection BNP Paribas Hedge Fund Centre

We explore agency issues within hedge fund firms. We find that firms that launch many funds tend to underperform other firms by between 3 to 5 percent per year after adjusting for risk. These findings are strongest for firms offering funds that pursue many distinct strategies, invest in a variety of geographical regions, locate in a gamut of countries, and offer different base currencies. Our results allow fund investors to distinguish, ex-ante, firms that focus on delivering alpha from those that focus on gathering assets.
