Questioning The Peremptory Status Of The Prohibition Of The Use Of Force, James A. Green

It is incontrovertible that the prohibition of the unilateral use of force is a fundamental aspect of the United Nations (U.N.) era system for governing the relations between states. Given this fact, the prohibition, as set out most crucially in Article 2(4) of the U.N. Charter, is often seen as the archetypal example of a jus cogens norm (a "peremptory norm" of general international law). Certainly, an overwhelming majority of scholars view the prohibition as having a peremptory character. This volume is a product of the efforts of the Institute for National Strategic Studies Spacepower Theory Project Team, which was tasked by the Department of Defense to create a theoretical framework for examining spacepower and its relationship to the achievement of national objectives. The team was charged with considering the space domain in a broad and holistic way, incorporating a wide range of perspectives from U.S. and international space actors engaged in scientific, commercial, intelligence, and military enterprises.

The Conventional Prompt Global Strike (CPGS) concept calls for a U.S. capability to deliver conventional strikes anywhere in the world in approximately an hour. The logic of the CPGS concept is straightforward. The United States has global security commitments to deter and respond to a diverse spectrum of threats, ranging from terrorist organizations to near-peer competitors. The United States might need to strike a time-sensitive target protected by formidable air defenses or located deep inside enemy territory. The Strategic Studies Institute's XXI Annual Strategy Conference, held at Carlisle Barracks from April 6-8, 2010, addressed the topic of the meaning of war. While it did not seek to produce a definitive answer to questions about the nature and definition of war, it did highlight the crucial questions and their implications, including issues such as whether the cause of war is shifting, whether all forms of organized, politically focused violence constitute war, and the distinction between passive and active war.

Part I of this Article analyzes the shortcomings of both international and domestic law regulating PCMF conduct through examining the Nisour Square massacre aftermath. Part II analyzes current international and domestic law to determine whether PCMFs fit within an existing legal framework. In particular, Part II engages a brief historical analysis of the law of mercenarism, both drawing parallels and distinguishing between the legal definition of mercenaries and PCMFs. Part III examines the convergence of three novel legal developments. Part IV provides a framework to categorize PCMFs, which exhibit both military and corporate characteristics. Hugo Grotius frequently occupies the title, '`father' of international law.' While the origins of professional lineage were a source of professional and personal conflict for jurists in the nineteenth century, scholars today tend to treat Grotius as either a symbolic marker of changing historical thought, or the symbolic figure of a style or school of global governance. In the first instance, Grotius is important because he made a methodological leap in one form or another from a theological to a secular frame of jurisprudential thinking, and in so doing, characterized the dilemmas of governance in familiar terms to modernity. In recent years, federal courts have tried an increasing number of suspected terrorists. In fact, since 2001, federal courts have convicted over 403 people for terrorism-related crimes. Although much has been written about the normative question of where terrorists should be tried, scant research exists about the impact these recent trials have had upon the Article III court system. The debate, rather, has focused almost exclusively upon the proper venue for these trials and the hypothetical problems and advantages that might inhere in each venue.

We use a three country – one good Cournot oligopoly model to investigate feasibility of free trade areas (FTAs) between two of the three countries. Using a linear demand, constant marginal cost and a welfare function which is a sum of consumers’ surplus (CS), profits and tariff revenues (TR), we derive optimum tariff before and after an FTA is formed. We show that although tariffs imposed by FTA members are lower than pre FTA tariffs, the optimum tariff imposed by the non-member remains unchanged. A comparative anthropologist could not have asked for a better script: two high profile cases, one before the European Court of Human Rights, the other before the U.S. Supreme Court, each involving challenges to traditional displays of crosses on government property. The European high court struck down the cross. The American high court upheld the cross. Both cases are procedurally complicated and are factually distinguishable. Alluding to the enormous investments in wellness, health, and anti-aging by affluent US society today the article focuses on the anthropological and religious implications of this phenomenon by stating that the pursuit of such caring for the body has superseded the quest for salvation. The first section provides a historical background analysis of how the contemporary semi-religious bodymindedness came about, while the second part analyses wellness, health, and salvation from a phenomenological point of view.
