Esperienza Elementare E Dritto = Elementary Experience And Law, Paolo G. Carozza, Andrea Simoncini, Lorenza Violini, Marta Cartabia

Translated by Mariangela Sullivan
Preface by Julián Carrón
...The essays making up this book reveal that law finds itself at a crossroads that is more anthropological than juridical. Indeed one’s concept of law flows directly from one’s concept of humanity. For this reason it seems to me entirely appropriate that the authors have refused to reduce elementary experience to doctrine or other abstract formulas to be imposed mechanically upon reality. Only an individual capable of feeling one’s own elementary experience alive within herself can make a valuable contribution to the debate that will lead us through this crossroads in the …
Building A Latin American Coalition On Forests: Negotiation Barriers And Opportunities, Maria Banda, John Oppermann
Building A Latin American Coalition On Forests: Negotiation Barriers And Opportunities, Maria Banda, John Oppermann
Vanderbilt Journal of Transnational Law
This Article looks at how these difficulties might be remedied to allow Latin America to lead the world to a robust anti-deforestation agreement. Part I provides a concise background on the REDD talks at the 2009 Copenhagen Climate Conference, which serves as a useful illustration of the substantive and procedural challenges in the ongoing deforestation negotiations. It identifies the main stakeholders at the climate talks and the camps in which national delegations organized themselves at Copenhagen. It then reviews the major substantive roadblocks in the REDD negotiations and identifies a series of analytical, ideological, and structural barriers that impeded significant …
The Double-Helix Double-Edged Sword: Comparing Dna Retention Policies Of The United States And The United Kingdom, Erica S. Deray
The Double-Helix Double-Edged Sword: Comparing Dna Retention Policies Of The United States And The United Kingdom, Erica S. Deray
Vanderbilt Journal of Transnational Law
Forensic scientists have used DNA profiling technologies to link suspects to crimes since Alec Jeffreys first proposed the idea in the 1970s. Recognizing the potential for using DNA databases to solve crimes and to prevent future crimes, England and Wales attempted to greatly expand its DNA database by allowing for the collection and indefinite retention of DNA profiles from arrestees. The European Court of Human Rights, however, issued a ruling in 2008 in the case of S. & Marper v. United Kingdom, advising the United Kingdom to restrict use of DNA profiles from arrestees and to establish time frames for …

Deaf Or Hearing: A Hearing Impaired Individual’S Navigation Between Two Worlds, Brittany Nicole Lash
University of Kentucky Master's Theses
identity play an important role in how they communicate and interact with other individuals. One group in which identity construction and navigation is a difficult process is the hearing impaired population. In an effort to understand how these individuals construct their identity and navigate their hearing impairment, this study utilizes Communication Theory of Identity. Through the use of interactive interviews, the researcher was able to examine how 11 participants manage their identity as hearing impaired individuals. The interviews provided insight into the four layers of identity proposed by CTI – personal, relational, enacted, and communal – in the hearing impaired …
Control Characteristics Of An All-Digital Proportional-Integral-Derivative (Pid) Compensator, David Michael Feinauer
Control Characteristics Of An All-Digital Proportional-Integral-Derivative (Pid) Compensator, David Michael Feinauer
Theses and Dissertations--Electrical and Computer Engineering
The digitization of classical control systems presents a number of challenges and opportunities with respect to the miniaturization, distribution, reliability verification and obsolescence of both the controller and the underlying system under control. A method for the design of proportional-integral-derivative (PID) compensators realized in the form of all-digital components is presented. All-digital refers to a system implementation that is realizable with a wide range of digital logic components including discrete digital logic elements and programmable logic devices (PLDs) such as field-programmable gate arrays. The proportional, integral and derivative components of the classical PID control law were re-envisioned in terms of …

The human genome comprises approximately 8-9% of human endogenous retroviruses (HERVs) that are transcribed with tissue specificity. However, relatively few organs have been examined in detail for individual differences in HERV transcription pattern, nor have tissue-to-cell culture comparisons been frequently performed. Using an HERV-specific DNA microarray, a core HERV transcription profile was established for the human kidney comparing 10 tissue samples. This core represents HERV groups expressed uniformly or nearly so in non-tumour kidney tissue. The profiles obtained from non-tumour tissues were compared to 10 renal tumour tissues (renal cell carcinoma, RCC) derived from the same individuals and additionally, to …

Extreme concentration of marine biodiversity and exploitation of marine resources in the Coral Triangle pose challenges to biogeographers and resource managers. Comparative phylogeography provides a powerful tool to test biogeographic hypotheses evoked to explain species richness in the Coral Triangle. It can also be used to delineate management units for marine resources. After about a decade of phylogeographical studies, patterns for theCoral Triangle are emerging. Broad connectivity in some species support the notion that larvae have maintained gene flow among distant populations for long periods. Other phylogeographic patterns suggest vicariant events resulting from Pleistocene sea level fluctuations, which have, at …

Solidarity, Subsidiarity, And Preference For The Poor: Extending Catholic Social Teaching In Response To The Climate Crisis, Jame Schaefer
Solidarity, Subsidiarity, And Preference For The Poor: Extending Catholic Social Teaching In Response To The Climate Crisis, Jame Schaefer
Theology Faculty Research and Publications
Grounding Catholic social thought is the belief that each human person has an intrinsic dignity and a desire for relationships with others that should lead to cooperating for their mutual good, making decisions individually and collectively to achieve it, and showing preference for the poor, vulnerable, and suffering in decision-making and actions. Rooted in the sacred scriptures, reflected upon at least implicitly for centuries by theologians, and taught by bishops of the Roman Catholic Church (the magisterium), principles to guide our decisionmaking and actions began to be considered collectively toward the end of the 19th century as “Catholic social teaching” …

Predictors Of Food Bank Usage Among Those With Low Food Security: Analysis Of The Current Population Survey Food Supplement Data, Sarah Mcqueen
MPA/MPP/MPFM Capstone Projects
Food insecurity is defined as the “access…at all times to the food needed for a healthy life” (Powledge 2010). According to the U.S. Census Bureau, approximately 15 percent of all Americans have experienced some measure of food insecurity. The issue is not new, but one that is ongoing and very complex and has impacts on individuals, households and society. In order to better understand the breadth and depth of the nation’s struggle with food sufficiency, an annual Food Supplement was attached to the Current Population Survey (CPS), a national labor force survey instrument. The CPS Food Supplement gathers information on …

Global surface temperature has increased markedly over the last 100 years. This increase has a variety of implications for human societies, and for ecological systems. One of the most obvious ways ecosystems are affected by global climate change is through alteration of organisms’ developmental timing (phenology). We used annual botanical surveys that documented the first flowering for an array of species from 1976 to 2003 to examine the potential implications of climate change for plant development. The overall trend for these species was a progressively earlier flowering time. The two earliest flowering taxa (Galanthus and Crocus) also exhibited the strongest …

The Last Shall Be First: Human Potential In Genetic And Theological Perspectives, M. Therese Lysaught
The Last Shall Be First: Human Potential In Genetic And Theological Perspectives, M. Therese Lysaught
Theology Faculty Research and Publications
The notion of “human potential” provides a fruitful window through which to explore the competing conceptual frameworks of contemporary genetics and Christianity. The contemporary cultural frame of genetics conceives of human potential in a broadly positive manner: the source of personal and societal flourishing is located within individual bodies, waiting to be identified and unleashed by genetic science and medicine for the good of persons and society. In the Judeo-Christian narrative, human individual, biological potential is far less relevant—and, in fact, may be construed as an impediment to the achievement of personal and social flourishing. Implications for the dialogue between …

Antarctica hosts a wide range of psychrophilic and psychrotolerant microbes, and thus is a prime choice for studies of the production of cold-functioning enzymes and other metabolites. However, the occurrence and importance of investment in such activities has received relatively limited attention in studies of Antarctic soil microbiota. In order to ex-amine extracellular enzyme production in this chronically low temperature environment, fungi were isolated from ornithogenic, pristine and human-impacted soils collected from the Fildes Peninsula, King George Island, Antarctica during the austral summer in February 2007. Forty-one fungal taxa were isolated from soil samples, from which 28 isolates of psychrophilic …
