Making Language Access To Health Care Meaningful: The Need For A Federal Health Care Interpreters' Statute, Alvaro Decola
Making Language Access To Health Care Meaningful: The Need For A Federal Health Care Interpreters' Statute, Alvaro Decola
Journal of Law and Health
This Note will argue that there are strong public policy, and legal and equity considerations for Congress to enact a federal statute to address the inadequacies of the current policies and regulations pertaining to language access to health care. The issue has become a significant one throughout the United States, given the influx of LEP (Limited English Proficiency) Americans navigating the health care system. Part II of this writing discusses the existing federal laws dealing with language access and the hurdles faced by LEP individuals in bringing legal action, because of existing case law on the subject. Part II also …
Cultural Production And Ephemeral Art: Feminicide And The Geography Of Memory In Ciudad Juárez, 1998-2008, Alice Laurel Driver
Cultural Production And Ephemeral Art: Feminicide And The Geography Of Memory In Ciudad Juárez, 1998-2008, Alice Laurel Driver
Theses and Dissertations--Hispanic Studies
This dissertation examines representations of feminicide victims in documentary film, novels, non-fiction, art, and graffiti and argues that these images express anxiety about they way women traverse and inhabit the geography of Ciudad Juárez, often giving precedence to the idea of the public female body as hypersexualized. In order to reclaim memory of the victims some cultural producers focus on the testimonial form in which victims’ families and other activists share their stories or construct informal memorials in the city; these remembrances later appear in works of non-fiction, film, and art, as markers of the process of creating and preserving …

School-Based Juvenile Probation And Police Partnerships For Truancy Reduction, Leanne F. Alarid, Barbara A. Sims, James Ruiz
School-Based Juvenile Probation And Police Partnerships For Truancy Reduction, Leanne F. Alarid, Barbara A. Sims, James Ruiz
Contemporary Issues in Juvenile Justice
Truancy places students at risk in primary and secondary education and is linked to conduct disorder, drug use, and delinquency. To prevent truancy and reduce risk, school-based proba-tion supervision has emerged within school districts in partnership with local law enforcement officers in an effort to enforce probation conditions for truant youths and prevent future delin-quency. This research uses key information interviews of knowledgeable stakeholders to examine the delivery of school-based probation supervision. Home visits and court hearings were perceived to be effective at reducing truancy and tardiness. This study affirms that strong lead-ership, information sharing, and involvement of parents were …

Rhetoric Of Reconciliation: Implications From Bonhoeffer's [Work] For A Communicative Praxis Of Reconciliation Grounded In Christian Narrative, Charles E. Thomas
Electronic Theses and Dissertations
Reconciliation may broadly be considered as the repairing, restoring, and mending of that which has been broken, namely relationships be they interpersonal, communal, or national due to some type of conflict between two parties. This project seeks to establish a Rhetoric of Reconciliation as a narratively constructed ethical communicative praxis. The first chapter will consist of an overview of reconciliation. In the second chapter the major theoretical frameworks and scholarship in the field of reconciliation will be considered to establish a working understanding of the particular communicative processes of reconciliation and how these processes are narratively grounded. The major theoretical …

Implementing The Integrated Dual Disorder Treatment Model In Occupational Therapy, Amber Jessen, Nicole Nelson
Occupational Therapy Capstones
The purpose of this project was to develop a resource manual for occupational therapists to guide treatment planning for persons with a co-occurring mental illness and substance use disorder, according to the stages and components of the Integrated Dual Disorder Treatment (IDDT) Model.
A comprehensive literature review of the issues facing persons with co-occurring disorders, the IDDT model, and the role of occupational therapy for persons with co-occurring disorders was conducted. The literature supported the effectiveness of the IDDT model, and indicated justification for occupational therapy’s implementation of the IDDT model.
A resource manual was developed to support occupational therapists’ …

Enrolling And Engaging High-Risk Youths And Families In Community-Based, Brief Intervention Services, Richard Dembo, Laura M. Gulledge, Rhissa Briones-Robinson, Ken C. Winters
Faculty Publications
Increasing interest has been shown in brief interventions for troubled persons, including those with substance abuse problems. Most of the published literature on this topic has focused on adults, and on the efficacy of these interventions. Few of these studies have examined the critical issues of enrollment and engagement in brief intervention services. The present article seeks to address the shortcomings in the current literature by reporting on our experiences implementing National Institute on Drug Abuse (NIDA)-funded brief intervention projects involving truant and diversion program youths.
An Analysis Of Bachelor's Degree Production By Kentucky Public 4-Year Universities: Before And After The Kentucky Postsecondary Education Improvement Act Of 1997, Jonathan Pruitt
MPA/MPP/MPFM Capstone Projects
With the passage of the Postsecondary Education Improvement Act of 1997, Governor Paul Patton and the Kentucky General Assembly sought to improve the standard of living and quality of life in the state through increasing the educational attainment of its citizens. The production of bachelor’s degrees by the state’s public four-year universities is a key driver in increasing educational attainment and, therefore, meeting the goals of the legislation. This paper uses interrupted time series regression analysis to evaluate whether Kentucky public four-year universities have increased the rate at which bachelor’s degrees are produced in the period of time since the …

The Electronic “Scarlet Letter”: Criminal Backgrounding And A Perpetual Spoiled Identity, Daniel S. Murphy, Brian Fuleihan, Stephan C. Richards, Richard S. Jones
Social and Cultural Sciences Faculty Research and Publications
Crimes are multifaceted events that are not adequately explained with basic descriptors, yet a considerable amount of significance is afforded to relatively few simplistic labels that make up the contemporary “scarlet letter.” Today's criminal records create a lifetime of stigmatization for a person. These public records employ a limited range of information. By acknowledging the deleterious effects of even one documented criminal event on an individual's self-concept and status in society, we cannot avoid being faced with a serious moral dilemma in light of society's prevalent reliance upon electronic criminal records. The electronic brand carried for life poses great challenges …
A Synopsis Of Texas And Federal Sovereign Immunity Principles: Are Recent Sovereign Immunity Decisions Protecting Wrongful Governmental Conduct., Marilyn Phelan
A Synopsis Of Texas And Federal Sovereign Immunity Principles: Are Recent Sovereign Immunity Decisions Protecting Wrongful Governmental Conduct., Marilyn Phelan
St. Mary's Law Journal
The Texas Supreme Court recently rendered several decisions involving governmental entities reflecting the court’s inflexible application of the doctrine of sovereign immunity. These decisions raise concerns that the Court may be insulating government employees from adherence to ethical codes of conduct. Just as Congress enacted legislation requiring accuracy and reliability from financial officers of corporations, there exists a similar need for Texas courts to protect the public from governmental harm through misconduct. The current awareness of governmental officials lessens the likelihood of governmental transparency and accountability. This Article analyzes the Court’s current application of the sovereign immunity doctrine to provide …

Methamphetamine Dependence In Malaysia: Psychiatric Co-Morbidity And Suicidality, Methamphetamine Induced Psychosis, Genetic Polymorphisms And Efficacy Of Aripiprazole In The Treatment Of Methamphetamine Dependence / Ahmad Hatim Sulaiman, Sulaiman Ahmad Hatim
Student Works (2010-2019)
Methamphetamine dependence remains a worldwide problem and Malaysia is no exception. The widespread of methamphetamine dependent has given an impact that can be felt at various levels, from the individual, to the individual’s family, community and society. Unfortunately, there are not many studies done on the issues of methamphetamine dependence in Malaysia. We are still lacking in published data especially in terms of prevalence, psychiatry morbidity, genetic risk factors and treatment aspect. Based on the result of the study, we found that the prevalence of psychiatric co-morbidity was 54.4% and the prevalence of suicidality was 12.1 %. The subjects had …
¡Silencio! Undocumented Immigrant Witnesses And The Right To Silence, Violeta R. Chapin
¡Silencio! Undocumented Immigrant Witnesses And The Right To Silence, Violeta R. Chapin
Publications
At a time referred to as "an unprecedented era of immigration enforcement," undocumented immigrants who have the misfortune to witness a crime in this country face a terrible decision. Calling the police to report that crime will likely lead to questions that reveal a witness's immigration status, resulting in detention and deportation for the undocumented immigrant witness. Programs like Secure Communities and 287(g) partnerships evidence an increase in local immigration enforcement, and this Article argues that undocumented witnesses' only logical response to these programs is silence. Silence, in the form of a complete refusal to call the police to report …
The Need To Overrule Mapp V. Ohio, William T. Pizzi
The Need To Overrule Mapp V. Ohio, William T. Pizzi
Publications
This Article argues that it is time to overrule Mapp v. Ohio. It contends that the exclusionary rule is outdated because a tough deterrent sanction is difficult to reconcile with a criminal justice system where victims are increasingly seen to have a stake in criminal cases. The rule is also increasingly outdated in its epistemological assumption which insists officers act on "reasons" that they can articulate and which disparages actions based on "hunches" or "feelings." This assumption runs counter to a large body of neuroscience research suggesting that humans often "feel" or "sense" danger, sometimes even at a subconscious …

Creating Hope: Mental Health In Western Australian Maximum Security Prisons, Jennifer Fleming, Natalie Gately, Sharan Kraemer
Research outputs pre 2011
The status of prisoners’ mental health has wide-reaching implications for prison inmates, prison authorities and institutions, and the general community. This paper presents the mental health findings from the 2008 Health of Prisoner Evaluation (HoPE) pilot project in which 146 maximum security prisoners were interviewed across two prisons in Western Australia. Results revealed significant discrepancies across gender and Indigenous status regarding the history and treatment of mental health complaints, use of prescribed psychiatric medication, and experience of psychosocial distress. Illicit drug use and dependency, as well as patterns of self-harm and suicide are also reported. These findings highlight that imprisonment …
A Cautionary Note On Therapeutic Jurisprudence For Aboriginal Offenders, Ann-Claire Larsen, Peter Milnes
A Cautionary Note On Therapeutic Jurisprudence For Aboriginal Offenders, Ann-Claire Larsen, Peter Milnes
Research outputs 2011
Therapeutic jurisprudence (TJ) is a recent legal practice reform, requiring judges and lawyers to attend to offenders’ wellbeing. Despite being lauded as the ‘most prolific vector’ of the Comprehensive Law Movement, TJ has also been condemned as ineffectual, even dangerous. In this paper we review TJ in three sections: the problems TJ seeks to address, how TJ is applied and its requirements, and the new problems TJ produces. This paper exposes tensions between established legal principles and efficacy or recidivism concerns that drive the TJ agenda. It concludes that a judiciary that concerns itself with offenders’ social and psychological problems …

Review Of Indigenous Offender Health [Journal Article], Jocelyn Grace, Ineke Krom, Caitlin Maling, Tony Butler, Richard Midford
Research outputs 2011
This review provides an overview of health issues facing the Indigenous offender population, including some of the social and historical factors relevant to Indigenous health and incarceration. In doing so, it is important to first understand how Indigenous people conceptualise health. Health as it is understood in western society is a fairly discrete category, which differs from the traditional Indigenous perspective of health as holistic [1]. This is made explicit in the 1989 National Aboriginal health strategy that states 'health to Aboriginal peoples is a matter of determining all aspects of their life, including control over their physical environment, of …

Review Of Volatile Substance Use Among Indigenous People, Richard Midford, Sarah Mclean, Michelle Catto, Neil Thomson, Olivier Debuyst
Research outputs 2011
The purpose of this review is to summarise key information from a number of substantial reports and other documents to make it more accessible to people involved in Indigenous health in Australia. The review draws heavily on the work undertaken in the preparation of Volatile substance misuse: a review of interventions. That very important report was authored by Peter d’Abbs and Sarah MacLean, the latter a co-author of this review. This review focuses on Australian Indigenous people, so no substantial attention is directed at the use of volatile substances among other indigenous peoples, or among other disadvantaged people in Australia …
Reasonable' Perceptions Of Stalking: The Influence Of Conduct Severity And The Perpetrator-Target Relationship, Adrian J. Scott, Lorraine Sheridan
Reasonable' Perceptions Of Stalking: The Influence Of Conduct Severity And The Perpetrator-Target Relationship, Adrian J. Scott, Lorraine Sheridan
Research outputs 2011
Ex-partner stalkers are more persistent and dangerous than stranger stalkers, but are less likely to be convicted of an offence. This research considers whether the just world hypothesis (JWH) can account for this apparent contradiction. An experimental 3×3 independent factorial design was used to investigate the influence of conduct severity and the perpetrator–target relationship on perceptions of stalking. Three hundred and thirty-four students were presented with one of nine vignettes and asked to complete five scale items relating to the situation described. Conduct severity and the perpetrator–target relationship produced significant main effects for the combined scale items. The perpetrator's behaviour …
Security Risk Management: A Psychometric Map Of Expert Knowledge Structure, David Brooks
Security Risk Management: A Psychometric Map Of Expert Knowledge Structure, David Brooks
Research outputs 2011
The security industry operates within a diverse and multi-disciplined knowledge base, with risk management as a fundamental knowledge domain within security to mitigate its risks. Nevertheless, there has been limited research in understanding and mapping security expert knowledge structures within security risk management to consider if parts of security risk management are unique from more general risk management. This interpretive study applied a technique of multidimensional scaling (MDS) to develop and present a psychometric map within the knowledge domain of security risk management, validated with expert interviews. The psychometric MDS security risk management concept map presented the expert knowledge structure …
Prescription Drug Use Among Detainees: Prevalence, Sources And Links To Crime, Catherine Mcgregor, Natalie Gately, Jennifer Fleming
Prescription Drug Use Among Detainees: Prevalence, Sources And Links To Crime, Catherine Mcgregor, Natalie Gately, Jennifer Fleming
Research outputs 2011
Concern regarding the diversion and non-medical use of prescription pharmaceuticals continues to grow as anecdotal evidence and other research points to a sizeable increase in the illegal market for such drugs. Estimating the prevalence of illegal use and understanding how pharmaceutical drugs come to be traded in the illegal drug market remain key research priorities for policymakers and practitioners in both the public health and law enforcement sectors. This report is the first of its kind in Australia to examine the self-reported use of illicit pharmaceuticals among a sample of police detainees surveyed as part of the Australian Institute of …

Identifying The Negative Stigma Associated With Having A Learning Disability, Kelsey Lisle
Identifying The Negative Stigma Associated With Having A Learning Disability, Kelsey Lisle
Honors Theses
Those with learning disabilities (LDs) can be characterized as a minority group, and like most groups of minorities they face a distinct stigma by the larger population. While there iscurrently a lack of research in understanding LD stigma, it has become increasingly important given the push for inclusive classrooms settings. In this study it was hypothesized that regardlessof a participants’ gender, when participants were given a hypothetical description of a person that included information indicating that the individual has a LD, the participants would rate that individual less favorably. Results were consistent with the hypothesis. Participants perceived the hypothetical LD …
