How House Bill 2063 And The Expansion Of Access To Protective Orders Could Have Saved Yeardley Love's Life, Amy Weiss
Richmond Public Interest Law Review
Battered women often face an uphill battle in the legal system. In the 2011 session, the Virginia General Assembly added a new tool to these women's arsenal.o An amended version of House Bill 2063 sponsored by Delegate Rob Bell (R- Albemarle) passed the House and Senate unanimously on February 26, 2011. This paper will examine Virginia protective order law before the enactment of House Bill 2063, how Yeardley Love's death was a catalyst for reform of the law, how the law will change under House Bill 2063, and possible future developments in legislative reform that could further help victims of …

Future Of Equality For Virginia's Tribes: Reform The Federal Recognition Process To Repair Injustice,, Katherine Womack
Richmond Public Interest Law Review
This article first examines the historical background of the Virginian-American Indian identity after European contact in Part I. This section looks at the early interactions between American Indians and colonial settlers, the treaties that defined American Indian identity, and the first government-to-government relationships between the tribes and colonial powers. It also follows the changing social attitudes toward American Indians. Part II discusses how social attitudes in the early twentieth century about American Indians led to longreaching legal effects for Virginian-American Indians. Part III details the federal recognition process, and discusses how and why it denies Virginia's tribes an equal place …

The Psychological And Emotional Experiences Of Pregnant And Postpartum Incarcerated Women, Kimberly Erin Gillette
The Psychological And Emotional Experiences Of Pregnant And Postpartum Incarcerated Women, Kimberly Erin Gillette
Theses, Dissertations, and Projects
This theoretical thesis explores the experiences of pregnant and postpartum incarcerated women, with particular emphasis on the impact of attachment insecurity, relational trauma, and forced separation from their infants. The majority of incarcerated women are dually diagnosed with substance abuse disorder and other clinical disorders on Axis I or II of the Diagnostic Statistic Manual IV. Often the symptoms displayed from Posttraumatic Stress Disorder are mistaken for personality disorders which prejudice staff and providers against these women. Thorough assessments need to be conducted using a compassionate lens to accurately interpret the psychological effects of interpersonal violence and other traumas and …

Fred Zacharias’S Skeptical Moralism, David Luban
Georgetown Law Faculty Publications and Other Works
Fred Zacharias's articles, Rethinking Confidentiality, published in two parts, were a sensational start to an illustrious career. Fred conducted the first and one of the best empirical studies of confidentiality in years, surveying lawyers and clients in Tompkins County, New York, about what lawyers actually told clients about confidentiality and its exceptions, and what difference the exceptions made in whether clients withheld information from their lawyers.

Williams V. Illinois And The Confrontation Clause: Does Testimony By A Surrogate Witness Violate The Confrontation Clause?, Paul F. Rothstein, Ronald J. Coleman
Georgetown Law Faculty Publications and Other Works
This article comprises a four-part debate between Paul Rothstein, Professor of Law at Georgetown Law Center, and Ronald J. Coleman, who works in the litigation practice group at Cleary Gottlieb Steen & Hamilton LLP, on Williams v. Illinois, a Supreme Court case that involves the Confrontation Clause, which entitles a criminal defendant to confront an accusing witness in court. The issue at hand is whether said clause is infringed when a report not introduced into evidence at trial is used by an expert to testify about the results of testing that has been conducted by a non-testifying third party. …
Are We Flipping Coins With The Liberty Of Potentially Dangerous Individuals?: A Comparative Analysis, Sébastien David Martineau
Are We Flipping Coins With The Liberty Of Potentially Dangerous Individuals?: A Comparative Analysis, Sébastien David Martineau
LLM Theses
The concept of dangerousness in Canadian and French criminal law is a central component in the development of prophylactic measures, such as section 810.1 and 810.2 of the 'Criminal Code' and similar French provisions. The imposition of preventive measures to control the risk of future behaviour of potentially dangerous individuals relies on inexact science to determine and assess dangerousness. In the last decades, several risk assessment tools have been developed, notably some in Canada, but their reliability in predicting dangerousness varies. The objectivity and reliability of a determination of dangerousness can be affected not only by the type of risk …

Reproductive Health
The Population Council has provided technical assistance and conducted research to strengthen the evidence base on sexual and gender-based violence (SGBV) programming in sub-Saharan Africa, where countries have begun to recognize the importance of both preventing violence and responding to the needs of SGBV survivors. These activities have created an active network of partners from across sub-Saharan Africa, who are developing, implementing, and evaluating core elements of a comprehensive, multisectoral response model. This brief reports how network partners have significantly increased the evidence base on program responses: a range of successful approaches have been demonstrated for improving comprehensive services within …

Systematic Sexual Violence By U.S. State Agencies: A Victimology Approach, Sarah Brightman
Systematic Sexual Violence By U.S. State Agencies: A Victimology Approach, Sarah Brightman
Dissertations
Women experience sexual violence at the hands of the United States military, police, corrections officers and border patrol agents. The study of state crime has been expanding rapidly in criminological research, however there has been little attention paid to its victims, particularly women, and especially to women's sexual victimization. The purpose of this research is to expand current research to develop a gendered analysis of state crimes in the context of sexual violence against women. This research applies Kauzlarich, Matthews and Miller's (2001) six propositions of a Victimology of State Crime to four cases of sexual victimization by U.S. agencies. …
The Effects Of Implementing Restorative Justice In An In-School Suspension Program, Nikki Brown-Kersey
The Effects Of Implementing Restorative Justice In An In-School Suspension Program, Nikki Brown-Kersey
Dissertations
The purpose of the proposed study was to assess the effects of implementing an in-school suspension program with a Restorative Justice component on office referrals, suspensions and grade point averages. The combination of Restorative Justice and inschool suspension as an alternative to out-of-school suspension warrants empirical evaluation. According to recent research, neither Restorative Justice nor in-school suspension alone have enough empirical evidence to support their success and continued use in schools in isolation. The positive aspects of each combined may produce a more successful alternative to suspension. A group design procedure was used to assess if significant changes in the …

The Declaration Of Independence And Immigration In The United States Of America, Kenneth M. White
The Declaration Of Independence And Immigration In The United States Of America, Kenneth M. White
Faculty Articles
The United States has always been a nation of immigrants, and immigration policy has always been controversial. The history of immigration in the United States is contrasted in this article with a normative standard of naturalization (immigration policy) based on the Declaration of Independence. The current immigration debate fits within a historical pattern that pits an unrestricted right of immigration (the left) against exclusive, provincial politics (the right). Both sides are simultaneously correct and incorrect. A moderate policy on immigration is possible if the debate in the United States gets an infusion of what Thomas Paine called "common sense."
