Tangled Up In Knots: How Continued Federal Jurisdiction Over Sexual Predators On Indian Reservations Hobbles Effective Law Enforcement To The Detriment Of Indian Women, Suzianne D. Painter-Thorne Jan 2011

Tangled Up In Knots: How Continued Federal Jurisdiction Over Sexual Predators On Indian Reservations Hobbles Effective Law Enforcement To The Detriment Of Indian Women, Suzianne D. Painter-Thorne

Articles

Consequently, tribal lands have become safe havens for sexual predators, who can commit their offenses with little fear of prosecution. As Fort Peck Tribal Chairman A.T. “Rusty” Stafne explained, “Our people are afraid because there are persons committing crimes against us at night and in broad daylight....We have criminals that are simply unafraid of prosecution.” Indeed, “[t]o a sexual predator, the failure to prosecute sex crimes against American Indian women is an invitation to prey with impunity.”

Congress has responded to the epidemic of reservation crime with the Tribal Law and Order Act27 (TLOA). But, as this article explains, the …

Excessive Public Defense Workloads: Are Aba Standards For Criminal Justice Adequate, Norman Lefstein Jan 2011

Excessive Public Defense Workloads: Are Aba Standards For Criminal Justice Adequate, Norman Lefstein

UC Law Constitutional Quarterly

Excessive caseloads among public defenders in the United States is a pervasive national problem, which not only often prevents lawyers from furnishing their clients competent and diligent representation as required by rules of professional conduct but also jeopardizes the quality of justice in criminal and juvenile courts. Although the American Bar Association has addressed the problem in various policy statements, including its Criminal Justice Standards, Professor Lefstein argues that there are still issues that are not adequately covered. Specifically, he argues that the ABA should consider the development of standards that (1) authorize defenders to refuse to provide representation when …

On The Connection Between Law And Justice, Anthony D'Amato Jan 2011

On The Connection Between Law And Justice, Anthony D'Amato

Faculty Working Papers

What does it mean to assert that judges should decide cases according to justice and not according to the law? Is there something incoherent in the question itself? That question will serve as our springboard in examining what is—or should be—the connection between justice and law. Legal and political theorists since the time of Plato have wrestled with the problem of whether justice is part of law or is simply a moral judgment about law. Nearly every writer on the subject has either concluded that justice is only a judgment about law or has offered no reason to support a …

Ducks And Decoys: Revisiting The Exit-Voice-Loyalty Framework In Assessing The Impact Of A Workplace Dispute Resolution System, Zev J. Eigen, Adam Seth Litwin Jan 2011

Ducks And Decoys: Revisiting The Exit-Voice-Loyalty Framework In Assessing The Impact Of A Workplace Dispute Resolution System, Zev J. Eigen, Adam Seth Litwin

Faculty Working Papers

Until now, empirical research has been unable to reliably identify the impact of organizational dispute resolution systems (DRSs) on the workforce at large, in part because of the dearth of data tracking employee perceptions pre- and post- implementation. This study begins to fill this major gap by exploiting survey data from a single, geographically-expansive, US firm with well over 100,000 employees in over a thousand locations. The research design allows us to examine employment relations and human resource (HR) measures, namely, perceptions of justice, organizational commitment, and perceived legal compliance, in the same locations before and after the implementation of …

Moral Character, Motive, And The Psychology Of Blame, Janice Nadler, Mary-Hunter Morris Mcdonnell Jan 2011

Moral Character, Motive, And The Psychology Of Blame, Janice Nadler, Mary-Hunter Morris Mcdonnell

Faculty Working Papers

Blameworthiness, in the criminal law context, is conceived as the carefully calculated end product of discrete judgments about a transgressor's intentionality, causal proximity to harm, and the harm's foreseeability. Research in social psychology, on the other hand, suggests that blaming is often intuitive and automatic, driven by a natural impulsive desire to express and defend social values and expectations. The motivational processes that underlie psychological blame suggest that judgments of legal blame are influenced by factors the law does not always explicitly recognize or encourage. In this Article we focus on two highly related motivational processes – the desire to …

Rethinking Parental Incarceration, Sarah Abramowicz Jan 2011

Rethinking Parental Incarceration, Sarah Abramowicz

Law Faculty Research Publications

Recent changes in sentencing law, in the wake of cases interpreting Blakely v. Washington and United States v. Booker, have raised the possibility that courts sentencing parents may take children's interests into account more extensively than had previously been permissible. Now is thus an opportune time to reevaluate the merits of considering children's interests when sentencing parents. This Article uses the perspective of family law to offer a new rationale for, and a new approach to, taking children's interests into account when sentencing their parents. It does so by bringing out the connection between the debate over parental incarceration and …

Truancy Prosecutions Of Students And The Right [To] Education, Dean Rivkin Jan 2011

Truancy Prosecutions Of Students And The Right [To] Education, Dean Rivkin

Scholarly Works

Nationally, the high volume of prosecutions of students for truancy has constituted a perennial low visibility corner of the juvenile system. Rarely represented by counsel, students who are convicted often suffer serious sanctions, including incarceration, fines, unachievable conditions of probation, loss of driving privileges, and other burdensome restrictions. Although the process of truancy prosecutions differs state-by-state, and often court-by-court, the transparency and legality of these systems is subject to several on-going legal challenges asserting that, as a constitutional matter, the rule of law - embodying fairness, consistency, and the right to be heard - is systematically abused in truancy courts. …

Quieting Cognitive Bias With Standards For Witness Communications, Melanie Wilson Jan 2011

Quieting Cognitive Bias With Standards For Witness Communications, Melanie Wilson

Scholarly Works

Last year, as part of a project to revise the ABA Criminal Justice Standards for Prosecution and Defense Functions, the ABA Criminal Justice Section initiated round-table discussions with prosecutors, criminal defense lawyers, and academics throughout the United States. The Standards under review provide aspirational guidance for all criminal law practitioners. This Article stems from the Criminal Justice Section's undertaking. It considers the wording, scope, and propriety of several of the proposed changes that address lawyer-witness communications. It begins with a discussion of the effects of cognitive bias on these communications and explains why carefully tailored standards may lessen the detrimental …

Encyclopedia Of Contemporary American Social Issues [Book Review], Anne Jumonville Graf Jan 2011

Encyclopedia Of Contemporary American Social Issues [Book Review], Anne Jumonville Graf

Library Faculty Research

Acknowledging that current information about social issues is often ingested in sound bites and snippets, the Encyclopedia of Contemporary American Social Issues seeks to bridge the gap between newsstand, newcomer, and expert knowledge. As stated in the preface, editor Michael Shally-Jensen and entry contributors encourage readers to “appreciate current issues for the complex matters that they are” and generally succeed in that regard. Most useful are the many entries that follow the encyclopedia’s guiding principle by tying in recent examples and news stories before getting into more theoretical discussions. All entries provide historical context for the topic at hand and …

The Mexican Cartel Debate: As Viewed Through Five Divergent Fields Of Security Studies, Robert J. Bunker Jan 2011

The Mexican Cartel Debate: As Viewed Through Five Divergent Fields Of Security Studies, Robert J. Bunker

CGU Faculty Publications and Research

The Mexican cartel debate is becoming increasingly more important to U.S. national security, however, it is also becoming ever more confused, heated, and at times downright nasty, with little agreement about what is taking place in Mexico or in other regions of the Americas, such as Guatemala, Honduras, and even this side of the U.S. border. To shed some light on this critical debate—a debate we need to have now and not later— it is the contention of this author that, since the Mexican cartel phenomena is being looked at by scholars from divergent fields of security studies and since …

Rebuilding Character: The Practices Of Positive Youth Development Teachers In A Youth Correctional Setting, Edward Anthony Cope Jan 2011

Rebuilding Character: The Practices Of Positive Youth Development Teachers In A Youth Correctional Setting, Edward Anthony Cope

Electronic Theses and Dissertations

There is a worldwide call for alternatives to current systems focused on restorative justice. The United States currently has a process but no plan in implementing effective programs for rehabilitating youth offenders. For many years, the prevailing idea in youth corrections has been that nothing works as studies continued to have difficulty pinpointing effective programs. Yet, over the last several decades, prison populations have risen dramatically, as have penal housing costs.

Positive Youth Development (PYD) offers a different framework focused on developing youth assets and promoting positive adolescent development. Derived from research in behavioral sciences, PYD programs promote the development …

Immigrant Hispanic Women And The Victimization They Encounter In The United States, Alejandra Aranda Redondo

Theses Digitization Project

This study explored some of the primary reasons why immigrant Hispanic women are victims of abuse, along with various barriers they faced, and the ways in which they coped. The influence of the Hispanic culture is a driving force in the women's inability to move away from their abusers, to seek help, and to obtain the necessary help. Hispanic cultural attitudes and the perceptions of these victimized immigrant women affected their help-seeking behaviors.
