Societal Integration And Radical Islam Among Muslim Immigrants In Europe And The United States, Ghada Wahdan
Societal Integration And Radical Islam Among Muslim Immigrants In Europe And The United States, Ghada Wahdan
Regis University Student Publications (comprehensive collection)
Little research has been done using Social Disorganization Theory to explain the radicalization of Muslim immigrants in Europe and the United States. The author's intention is to offer a concise and clear comparison between the relationship of societal integration and radical Islam among Muslims living in Europe and the United States. The research modeled the application of Social Disorganization Theory which is seated in the idea that social disorder in communities creates disagreements in fundamental values, norms with behavioral irregularity and deviance. Radicalization of Muslim immigrants living in non-Muslim countries exists when there is a low degree of internal bonding …
Perpetuating The Marginalization Of Latinos: A Collateral Consequence Of The Incorporation Of Immigration Law Into The Criminal Justice System, Yolanda Vazquez
Perpetuating The Marginalization Of Latinos: A Collateral Consequence Of The Incorporation Of Immigration Law Into The Criminal Justice System, Yolanda Vazquez
Faculty Articles and Other Publications
Latinos currently represent the largest minority in the United States. In 2009, we witnessed the first Latina appointment to the United States Supreme Court. Despite these events, Latinos continue to endure racial discrimination and social marginalization in the United States. The inability of Latinos to gain political acceptance and legitimacy in the United States can be attributed to the social construct of Latinos as threats to national security and the cause of criminal activity.
Exploiting this pretense, American government, society and nationalists are able to legitimize the subordination and social marginalization of Latinos, specifically Mexicans and Central Americans, much to …

Welcome To Admitted Students, David Getches
Speeches
Summary by Jane Thompson: This is David's longest and strongest sales pitch on why to pursue a legal education, and why to choose CU Law over other law schools. It contains some vintage David lines: "You don’t have to know as you come in the door next August where you will end up, only the kind of person you want to be." OR "Look at the surroundings. Imagine having a life as well as an education here."

Realizing Padilla's Promise: Ensuring Noncitizen Defendants Are Advised Of The Immigration Consequences Of A Criminal Convictions, Yolanda Vazquez
Faculty Articles and Other Publications
On March 31, 2010 the United States Supreme court decided Padilla v. Kentucky and created a Sixth Amendment duty for defense attorneys to advise defendants of the immigration consequences of a criminal conviction. While Padilla answered the broad question of whether there is a duty to advise a defendant under the Sixth Amendment, it left many questions unanswered. One critical inquiry is how defense attorneys and the courts will determine what advice concerning the immigration consequences of the criminal conviction will satisfy defense counsels’ Sixth Amendment duty under Padilla.
This Article discusses the potential detrimental impact of Padilla’s ambiguous holding …

Improving The Handling Of Mentally Retarded Defendants In The Criminal Justice System, Jacqueline Gonzales
Texas Wesleyan Law Review
This Comment has four substantive sections beginning with a brief introduction about mental retardation. It will address how previous courts have handled mentally retarded defendants and identify emerging trends regarding the execution and punishment of mentally retarded individuals. This Author will then propose changes to the current system for handling mentally retarded defendants including: specialized training for judicial officers and special processing from booking and beyond. Followed by a brief discussion on the costs of implementation, how this system will help, and how the proposed system is different from the current system in place. Establishing a separate court system and …

Foreign Law As Legislative Fact In Constitutional Cases, A. Christopher Bryant
Foreign Law As Legislative Fact In Constitutional Cases, A. Christopher Bryant
Faculty Articles and Other Publications
Do we really need another law review article about foreign law in constitutional interpretation? In fact, we do. In the vast literature on the subject, a fundamental point has received scant attention. In the recent rulings that have stoked the present controversy, the Supreme Court has employed foreign law not as law, but rather merely as evidence of a legislative fact made relevant by domestic constitutional law. Commentators, however, have largely directed their attention to the merits of a genuine constitutional comparativism in which foreign law serves as a model for the creation of domestic constitutional doctrine. Many commentators have …

She Blinded Me With Science: Wrongful Convictions And The "Reverse Csi-Effect", Mark A. Godsey, Marie Alou
Faculty Articles and Other Publications
Prosecutors in the United States are often heard to complain these days of the "CSI-effect."' When they make this complaint, they mean that the popularity of television shows like CSI has made it unduly difficult for them to obtain convictions of guilty defendants. Jurors today have become spoiled as a result of the proliferation of these "high-tech" forensic shows, and now unrealistically expect conclusive scientific proof of guilt before they will convict. The unfortunate result is that guilty defendants are acquitted because of a lack of forensic evidence in cases where, in reality, no such forensic evidence was possible or …
The Regulatory Turn In International Law, Jacob Katz Cogan
The Regulatory Turn In International Law, Jacob Katz Cogan
Faculty Articles and Other Publications
In the post-War era, international law became a talisman for the protection of individuals from governmental abuse. Such was the success of this "humanization of international law" that by the 1990s human rights had become "part of... international political and legal culture." This Article argues that there has been an unnoticed contemporary counter trend -- the "regulatory turn in international law." Within the past two decades, states and international organizations have at an unprecedented rate entered into agreements, passed resolutions, enacted laws, and created institutions and networks, formal and informal, that impose and enforce direct and indirect international duties upon …

However, approach towards instruction and teaching was observed as related in …
State Legislatures Diversity, Innovation, And Policy Adoption, Janna Souvorova
State Legislatures Diversity, Innovation, And Policy Adoption, Janna Souvorova
Electronic Theses and Dissertations
The question of policy origination is the very essence of state public policy analysis. This study provides an overview of the previous research on innovation, as defined by Rogers (1962, 2003) and Walker (1969), and determinants models of state policy formulation, as they relate to innovation and policy adoption on the state level. The literature review indicates that previous research mostly focused on the internal state characteristics such as political and socioeconomic variables to explain state differences in policy adoption. The literature also indicates a general lack of empirical research relating diversity to innovation and policy adoption. State governments have …
