To Promote The Creative Process: Intellectual Property Law And The Psychology Of Creativity, Gregory N. Mandel

Notre Dame Law Review

The article discusses creativity under intellectual property (IP) law in the U.S. and the U.S. Constitution. The author examines Article I of the U.S. Constitution which was the basis for the U.S. Congress' enactment of copyright and patent laws. He argues that large-scale collaborative projects are very common in the 21st century and are found in government, private, and university research markets.

Government Ideology, Democracy And The Sacrifice Ratio: Evidence From Latin American And Caribbean Disinflations, Tony Caporale Sep 2011

Government Ideology, Democracy And The Sacrifice Ratio: Evidence From Latin American And Caribbean Disinflations, Tony Caporale

Economics and Finance Faculty Publications

This study uses a sample of 34 disinflations undertaken by thirteen Latin American and Caribbean (LAC) nations to test if political institutions impact the cost of policy induced disinflations. We find, after controlling for several of the most important covariates in the literature, that disinflations are less costly for right vs. left governments and that sacrifice ratios are lower for more democratic vs. authoritarian governmental regimes. This is robust to different measures of government ideology as well as to alternative ways of computing the sacrifice ratio and lends support for political economy literature which argues that political institutions have significant …

'The Earth Is Crying Out In Pains Of Childbirth': Bauxite Mining And Sustainable Rural Development In The Brazilian Atlantic Forest, Lena R. Connor

Environmental Analysis Program Mellon Student Summer Research Reports

In 2003, residents of the Serra do Brigadeiro Territory, a rural region of Southeastern Brazil in one of the few remaining patches of the Atlantic Forest, learned of a large number of bauxite concessions in their territory given by the federal government to the prominent Companhia Brasileira de Alumínio (CBA), Brazil’s largest aluminum producer. Because the region prides itself on its small-scale agriculture and its lush natural environment, the mining has been the source of much contention in the community. Introduced to the topic by the international conservation non-profit and research center, Iracambi, I spent two months in the territory …

A Ceo’S Most Important Strategic Asset: Assessing Corporate Reputation, Ernest Hall Jr., Jooh Lee Sep 2011

A Ceo’S Most Important Strategic Asset: Assessing Corporate Reputation, Ernest Hall Jr., Jooh Lee

Rohrer College of Business Departmental Research

Past research has used the Fortune Most Admired Companies index as a proxy for such difficult-to-measure variables as corporate reputation, corporate social responsibility, and stakeholder orientation. Utilizing the Fortune reputation index, the present study investigates the relationship between corporate reputation and the remuneration tendered to the leaders of these most admired companies. Given that the CEO wields the greatest power and potential to influence a firm’s reputation it is suggested that the most widely respected firms would compensate their CEOs with higher levels of remuneration. The present study provides an empirical test of the reputation-remuneration linkage. Using the Fortune index …

Death In Irish Prisons: An Examination Of The Causes Of Deaths And The Compliance Of Investigations With The European Convention On Human Rights, Colette Barry Sep 2011

Death In Irish Prisons: An Examination Of The Causes Of Deaths And The Compliance Of Investigations With The European Convention On Human Rights, Colette Barry

Dissertations

Death is a tragic and unfortunately unavoidable aspect of life in a prison. The death of a prisoner raises significant questions in relation to the conditions of confinement and the conduct of the prison authorities. Robust investigations into these deaths can enhance accountability by shedding light on deficits in both institutional and systemic practices, as well as providing families of the deceased with a sense of closure. In Ireland, the investigative responses to prison deaths are neither robust, nor do they allow for significant scrutiny of the circumstances surrounding the death. The causes of deaths in custody and the compatibility …

What About Boys? An Initial Exploration Of Sexually Exploited Boys In Cambodia, Glenn Miles, Heather Blanch Sep 2011

What About Boys? An Initial Exploration Of Sexually Exploited Boys In Cambodia, Glenn Miles, Heather Blanch

Annual Interdisciplinary Conference on Human Trafficking: 3rd (2011)

Sexual exploitation of children has tended to focus on girls. The majority of organizations and service providers for sexually exploited children cater to the needs of girls. However, boys are also vulnerable to sexual exploitation. Limited research has been done to determine the prevalence of sexual exploitation of boys, but what has been done suggests that the issue is worthy of more attention. This study hopes to provide a baseline of information about young men who are being sexually exploited in Phnom Penh, Cambodia. In gathering and analyzing data about these young men, the researchers hope to promote awareness about …

Quality Of Life In Nonmetropolitan Nebraska: 2011 Nebraska Rural Poll Results, Rebecca J. Vogt, Randolph L. Cantrell, Bradley Lubben, Connie I. Reimers-Hild

Publications from the Center for Applied Rural Innovation (CARI)

Nebraska appeared to survive the recent economic recession better than most other states. The state's unemployment rate has been one of the lowest in the nation in recent years. The agricultural economy has also been strong. Farm income levels reached record levels in 2010 and are expected to remain strong this year. Given the challenges and uncertainties of recent years, how do rural Nebraskans believe they are doing and how do they view their future? Have these views changed over the past sixteen years? How satisfied are they with various items that influence their well-being? How happy are rural Nebraskans? …

New Americans: Child Care Decision-Making Of Refugee And Immigrant Parents Of English Language Learners, Helen Ward Jd, Erin E. Oldham Lachance Phd, Julie Atkins Ma

Children, Youth, & Families

The immigrant and refugee communities in the United States continue to increase. Denver, Colorado and Portland, Maine are two U.S. cities that reflect the changing demographics across the country. As these cities evolve and adjust to serve new populations, it becomes necessary to rethink deep-rooted culturally constructed patterns and traditions that do not take into account the beliefs and practices of these new cultures. One such tradition is child care. Because of the important link between preschool experiences and later school success, understanding refugee and immigrant families’ beliefs and decisions about child care is extremely important. From a policy perspective, …

Urban Rail Infrastructure – The Path From Comprehensive Transport Plans To The Recent Experience, Kym Norley Sep 2011

Urban Rail Infrastructure – The Path From Comprehensive Transport Plans To The Recent Experience, Kym Norley

World Transit Research

Some 40 to 50 years ago the Australian State and Capital Territory governments produced comprehensive transport plans that began the transport planning processes for their capital cities. The subsequent path has been varied, particularly in regard to public transport. Sydney in particular has a long history of equivocation and deferral of major transport infrastructure construction, despite current and planned urban growth. Expansion of the railway network is now a major planning issue. Urban growth has outstripped that of the public transport system over an extended period and, whether or not policies of consolidation succeed, urban rail system capacity and extent …

A Policy Analysis Of The Criminal Justice (Community Service) (Amendment) Act 2011, Fionnuala Lawlor Sep 2011

A Policy Analysis Of The Criminal Justice (Community Service) (Amendment) Act 2011, Fionnuala Lawlor

Dissertations

The Criminal Justice (Community Service) (Amendment) Act of 2011 is legislation which is aimed at encouraging a greater use of community service orders for people convicted of minor offences. It places a requirement on Judges when considering the imposition of a sentence of 12 months or less to consider the alternative sanction of community service first. This is the first legislation for a number of years which is aimed at diverting offenders from prison and very little is known about the reasoning behind its introduction. This thesis will utilise the framework of policy analysis set out by Kingdon (1995) and …

Comparative Constitutional Law: Introduction, Tom Ginsburg, Rosalind Dixon Sep 2011

Comparative Constitutional Law: Introduction, Tom Ginsburg, Rosalind Dixon

Public Law and Legal Theory Working Papers

Comparative constitutional law is a newly energized field in the early 21st century. Never before has the field had such a broad range of interdisciplinary interest, with lawyers, political scientists, sociologists and even economists making contributions to our collective understanding of how constitutions are formed and how they operate. Never before has there been such demand from courts, lawyers and constitution-makers in a wide range of countries for comparative legal analysis. And never before has the field been so institutionalized, with new regional and international associations providing fora for the exchange of ideas and the organization of collaborative projects. This …
