Note – Someone Is Watching: The Need For Enhanced Data Protection, Nic Roethlisberger

UC Law Journal

The computer revolution has created a world where communication is cheap and instantaneous, and where vast amounts of information and consumer goods are just a click away. It also has created a world where the electronic gadgets we use every day create a trail of information that is being collected, examined, sold, and—far too often—stolen. Individuals have little to no control over the use and sale of this personal, private information, and the law has failed to keep pace. Some privacy advocates have suggested that traditional privacy torts should be used by the courts to stop the worst of these …

Publications from the Center for Applied Rural Innovation (CARI)

The manner in which food animals are produced, shipped and processed has been in the news lately. Specifically at question is whether or not current livestock practices adequately ensure the welfare of food animals. With a sizable animal agriculture production sector in the state of Nebraska, this is an important issue. How do rural Nebraskans feel about animal welfare issues? Do their opinions differ by age, education or their experience with livestock production?

This paper provides a detailed analysis of these questions. This report details 2,490 responses to the 2011 Nebraska Rural Poll, the sixteenth annual effort to understand rural …

Alberta Legal Services Mapping Project: An Overview Of Findings From The Eleven Judicial Districts, Mary Stratton Jul 2011

Alberta Legal Services Mapping Project: An Overview Of Findings From The Eleven Judicial Districts, Mary Stratton

Canadian Forum on Civil Justice

The Alberta Legal Services Mapping Project (ALSMP) was a large-scale, collaborative research initiative designed to increase understanding of the legal needs of Albertans, the extent to which these needs are currently being met, and how access to legal services can be improved. It was the most comprehensive „mapping‟ research1 so far undertaken in Canada and collected an unprecedented breadth and depth of information about legal programs and services in Alberta, the demands on those services and identified legal needs that are not yet being met. The data also captured local social contexts and identified current strengths as well as gaps …

Network Accountability For The Domestic Intelligence Apparatus, Danielle Keats Citron, Frank Pasquale Jul 2011

Network Accountability For The Domestic Intelligence Apparatus, Danielle Keats Citron, Frank Pasquale

UC Law Journal

A new domestic intelligence network has made vast amounts of data available to federal and state agencies and law enforcement officials. The network is anchored by “fusion centers,” novel sites of intergovernmental collaboration that generate and share intelligence and information. Several fusion centers have generated controversy for engaging in extraordinary measures that place citizens on watch lists, invade citizens’ privacy, and chill free expression. In addition to eroding civil liberties, fusion center overreach has resulted in wasted resources without concomitant gains in security. While many scholars have assumed that this network represents a trade-off between security and civil liberties, our study …

A Simplified Method For Analyzing Factors Contributing To Motorcyclists’ Fatal Injuries In Ohio, Deogratias Eustace, Vamsi Krishna Indupuru Jul 2011

A Simplified Method For Analyzing Factors Contributing To Motorcyclists’ Fatal Injuries In Ohio, Deogratias Eustace, Vamsi Krishna Indupuru

Civil and Environmental Engineering and Engineering Mechanics Faculty Publications

The aim of this paper was to analyze traffic crash data by using a simplified method in determining significant factors that increase the risk of a motorcyclist being fatally injured once involved in a motorcycle crash in Ohio. The concept of overrepresentation, which is similar to relative risk, was used in identifying significant variables associated with the elevated risk of a motorcycle crash resulting into a fatality. The overrepresentation factor (ORF) was calculated for each variable of interest. The ORF offers a simple but powerful procedure of determining whether a certain factor significantly occurs more or less frequently in one …

Identification Of Risk Factors Associated With Motorcycle-Related Fatalities In Ohio, Deogratias Eustace, Vamsi Krishna Indupuru, Peter W. Hovey

Civil and Environmental Engineering and Engineering Mechanics Faculty Publications

Out of the 7,138,476 motorcycles operating on U.S. roads, 346,925 were registered in the state of Ohio in the year 2007. Although motorcycles represent only 2.8% of all registered vehicles in the state of Ohio, motorcycling accounts for more than 13% of Ohio highway traffic fatalities. Since 2005, Ohio has had a distressing distinction of being among the fifteen states that have sustained more than half of all motorcycle fatalities recorded in the USA (NHTSA 2007; NHTSA 2008a). For the past ten years, the overall motorcycle crash fatalities have been increasing while the motor vehicle occupant crash fatalities have been …

The Kiyemba Paradox: Creating A Judicial Framework To Eradicate Indefinite, Unlawful Executive Detentions, Samuel Chow Jul 2011

The Kiyemba Paradox: Creating A Judicial Framework To Eradicate Indefinite, Unlawful Executive Detentions, Samuel Chow

Cardozo Journal of International and Comparative Law

The article examines the Supreme Court's evolving role in reviewing detentions related to national security, particularly focusing on the writ of habeas corpus. It argues that while the Court has expanded habeas protections, significant limitations remain, especially in ordering release into the United States. The author contends that for habeas to be meaningful, courts must have the authority to grant "functional release," balancing individual liberty against executive powers. The analysis highlights key cases like Boumediene v. Bush, Munaf v. Geren, and Kiyemba v. Obama, which reveal the challenges in preventing indefinite detentions and the need for clearer …

When Responsive Legislation Ignores The Forest For The Trees, Matthew G. Curtis Jul 2011

When Responsive Legislation Ignores The Forest For The Trees, Matthew G. Curtis

Law Student Publications

Large-scale financial disasters have resulted in equally large-scale overhauls of the system responsible for financial industry regulation. Choice over responding parties to these disasters is minimal, and the public inevitably looks to the government for assistance and explanation. The increasingly globalized economy causes any nationwide financial regulation in the U.S. to be felt throughout international markets. U.S. environmental regulation, while not felt immediately abroad, can have drastic impacts on business planning, environmental risk-management, and human rights in the developing world.

Is Institutional Sexual Misconduct Predictive Of Sexual Recidivism Amongst Male Sex Offenders?, Angela Marie Fleck Jul 2011

Is Institutional Sexual Misconduct Predictive Of Sexual Recidivism Amongst Male Sex Offenders?, Angela Marie Fleck

Dissertations (1934 -)

There has been a large body of research conducted on establishing a valid set of predictors of sexual offender recidivism in the past 20 years. However, despite findings that indicate that prior history of sexual offenses serves as a primary predictor of sexual offense recidivism, there has been little focus on the impact of institutional sexual misconduct on sexual offense recidivism rates. This study aimed to investigate the relationship between institutional sexual behavior and sexual offense recidivism rates amongst a sample of male offenders who received a sexual misconduct report while incarcerated and/or was convicted of a sexual offense. Additionally, …

The Shadow Bargainers, Ronald F. Wright, Jenny Roberts, Betina Cutaia Wilkinson Jul 2011

The Shadow Bargainers, Ronald F. Wright, Jenny Roberts, Betina Cutaia Wilkinson

Cardozo Law Review

Plea bargaining happens in almost every criminal case, yet there is little empirical study about what actually happens when prosecutors and defense lawyers negotiate. This Article looks into the bargaining part of plea bargaining. It reports on the responses of over 500 public defenders who participated in our nationwide survey about their objectives and practices during plea negotiations.

The survey responses create a rare empirical test of a major tenet of negotiation theory, the claim that attorneys bargain in the “shadow of the trial.” This is a theory that some defenders embrace and others reject. Describing the factors they believe …

Immigration Discourses In The U.S. And In Japan, Chie Torigoe Jul 2011

Immigration Discourses In The U.S. And In Japan, Chie Torigoe

Communication ETDs

The primary purpose of this study was to investigate how systems of racial inequality and dominance produced at macro-institutional level discourses are reproduced and/or challenged in micro-interpersonal everyday discourses regarding immigration/foreign workers in the U.S. and in Japan. To establish a link between the discourses at these two levels, I employed a combination of critical and interpretive theoretical perspectives, and analyzed how racial ideologies were reproduced and/or challenged through participants' use of various interpretative repertoires (i.e., discursive themes and specific rhetorical moves therein) and positioning of self and Others. Interpretative repertoires and discursive positioning of self and Others are major …

An Information Technology (It) Based Approach For Enhancing Prompt And Effective Post-Disaster Reconstruction, Faisal Manzoor Arain Jul 2011

An Information Technology (It) Based Approach For Enhancing Prompt And Effective Post-Disaster Reconstruction, Faisal Manzoor Arain

Business Review

Information technology (IT) has become strongly established as a supporting tool for many professional tasks in recent years. One application of IT, namely the knowledge management system, has attracted significant attention requiring further exploration as it has the potential to enhance processes, based on the expertise of the decision-makers. A knowledge management system can undertake intelligent tasks in a specific domain that is normally performed by highly skilled people. Typically, the success of such a system relies on the ability to represent the knowledge for a particular subject. Post-disaster reconstruction and rehabilitation is a complex issue with several dimensions. Government, …

State Legislative Update , Benjamin Angulo, Daniel J. Romine, Matthew Schacht Jul 2011

State Legislative Update , Benjamin Angulo, Daniel J. Romine, Matthew Schacht

Journal of Dispute Resolution

This analysis will examine the sample of bills in four parts. Because some of the proposed state bills are silent on whether their respective bills are reserved for non-commercial matters, Part II examines whether the bills apply to businesses that are parties to business-to-business international commercial contracts. Part III assesses the bills' definition of foreign law to better understand the scope of the anti-foreign law bans. Because each anti-foreign law bill initially defines foreign law as one that is created outside the U.S., Part III analyzes whether the bills' foreign law definitions include international organizations and tribunals. It is important …
