Nurturing Forensic Science: How Appropriate Funding And Government Oversight Can Further Strengthen The Forensic Science Community, Craig M. Cooley Jul 2011

Nurturing Forensic Science: How Appropriate Funding And Government Oversight Can Further Strengthen The Forensic Science Community, Craig M. Cooley

Texas Wesleyan Law Review

This Article's objective will be to discuss why adequate funding and strict government oversight are necessary to strengthening the forensic science community's scientific foundation and improve its accuracy and efficiency. If lawmakers refuse to properly fund and oversee the forensic science community, the criminal justice system's truth-seeking mission will continue to be compromised. This not only harms innocent people, who are falsely implicated by unvalidated forensic evidence or improper forensic testimony, it inflicts another wound to the victims and their families.

Misuse Of Dna Evidence Is Not Always A “Harmless Error”: Dna Evidence, Prosecutorial Misconduct, And Wrongful Conviction, Kimberly Cogdell Boies Jul 2011

Misuse Of Dna Evidence Is Not Always A “Harmless Error”: Dna Evidence, Prosecutorial Misconduct, And Wrongful Conviction, Kimberly Cogdell Boies

Texas Wesleyan Law Review

The purpose of this article is to highlight the areas of DNA analysis that make it less reliable than most people believe and to show that because of this, misconduct related to DNA evidence should not receive harmless error review. The most reliable evidence sees no color, gender or socioeconomic status. Evidence can be an imperfect measure and manipulated by the pride and prejudice of those who control it. The recent explosion in the number of exonerations for wrongful conviction highlights a major flaw in the system - prosecutorial misconduct. This misconduct can take the form of presenting unreliable evidence, …

Exoneration And The Road To Compensation: The Tim Cole Act And Comprehensive Compensation For Persons Wrongfully Imprisoned, John Shaw Jul 2011

Exoneration And The Road To Compensation: The Tim Cole Act And Comprehensive Compensation For Persons Wrongfully Imprisoned, John Shaw

Texas Wesleyan Law Review

In recent years, the number of exonerations of persons wrongfully imprisoned has increased nationwide. With the number of exonerations continually on the rise, 27 states and the District of Columbia, have addressed the needs of exonerees with legislation that provides for the compensation of these individuals. A majority of these states offer basic monetary compensation. Basic monetary compensation, however, is not enough. The criminal justice system has failed these individuals in one way or another, and after years in prison, many are in need of more than money upon release. Texas has been leading the country in exonerating wrongfully convicted …

Vol. 2 No. 2, Summer 2011; Particularly Serious Crimes And Withholding Of Removal: An Aggravating Question, Jessica Fiocchi

Northern Illinois Law Review Supplement

The highly controversial topic of the removal of non-citizens from the United States is even more complex than most people realize. Besides the widely-known issues of the stretch on our nation's resources and immigrants' search for better lives, there are also issues of international relationships and threats to basic human rights. The United States has an international commitment not to remove aliens back to their home country if that country would be likely to subject the person to threats to their life or freedom, including kidnapping, torture, or murder. The U.S. denies this withholding of removal to those who have …

Preserving Attorney-Client Confidentiality At The Cost Of Another’S Innocence: A Systemic Approach, Ken Strutin Jul 2011

Preserving Attorney-Client Confidentiality At The Cost Of Another’S Innocence: A Systemic Approach, Ken Strutin

Texas Wesleyan Law Review

When a client admits to her lawyer that she is responsible for a crime that someone else has been charged with, it alters the geometry of the attorney-client relationship. A third party has now entered the room triangulating the lawyer's responsibilities to her client, to the innocent party and to the justice system. The idea of revealing a client's private confession is anathema to lawyers trained to carefully guard their clients' secrets. Fidelity to the client, preservation of confidences, and the right to counsel strongly militate in favor of nondisclosure. On the other hand, an innocent person is facing a …

A Breath Of Fresh Air: Methods And Obstacles For Achieving Air Pollution Reduction In Washington Factory Farm Communities, Linda M. Thompson Jul 2011

A Breath Of Fresh Air: Methods And Obstacles For Achieving Air Pollution Reduction In Washington Factory Farm Communities, Linda M. Thompson

Washington Journal of Environmental Law & Policy

“Animal feeding operations (AFOs),” or, if large enough, “concentrated animal feeding operations (CAFOs),” have become increasingly concentrated in ownership, location, and quantity of animals since the 1950s. The Yakima Valley of central Washington is one area that has been subject to an influx of these industrial farms, raising health and environmental concerns for residents. Despite scientific evidence of potential harm, citizens have had difficulty enforcing air emissions regulation. The problem is twofold: the EPA is still working with the industry to develop a methodology for emission monitoring––the effectiveness of which remains unclear––and, assuming monitoring methods existed, the statutory framework provides …
